TERMS AND CONDITIONS

YOUR CONTRACT WITH MOTOEXPRESS We set out below an explanation of the conditions that apply when you book an event (means package, tour or holiday) with us. It is important that you read these conditions together with the event information contained on our web site as they define our obligations to you and your obligations to us.

EVENT BOOKING Selecting the Accept Terms and Condition check box on the reservation page of the MotoExpress website www.motoexpress-events.com confirms you have downloaded, read and accept these Terms and Conditions as a binding contract between MotoExpress and you, the event participant. If you book an event by telephone then your attention will be drawn to these Terms and Conditions and copy of the Terms and Conditions will be transmitted to you. All prices stated are on a per person basis and include VAT and taxes unless otherwise stated. All event bookings include breakfast unless otherwise stated. Lunch and dinners are not included unless specifically otherwise stated. Flights are not included in our packages. The person making the booking is responsible for the attendees having the appropriate travel documents and visas prior to departure.

TICKET ONLY BOOKINGS Once tickets are purchased no cancellations are refunds are possible. There are no exceptions to this rule. Tickets are normally shipped 2 weeks prior to the date of the Grand Prix.

METHOD OF PAYMENT MotoExpress shall only accept payment via the use of credit or debit cards. No surcharge is levied for the use of credit or debit cards. Amex cards are not accepted. Only in exceptional circumstances will MotoExpress accept bank transfers or Cheques.

RESERVATION AND DEPOSIT Provisional bookings only become firm and valid on the receipt of your deposit payment. The level of deposit required for any Motoexpress event is stipulated on the MotoExpress website www.motoexpress.co.uk.

PAYMENT OF BALANCE Final balances are due for payment no later than 56 days (8 weeks) prior to the commencement of the event.

PRICE GUARANTEES The price quoted at the time of your booking is the price you pay. No surcharges are applied for currency fluctuations. Furthermore we don’t charge supplements for payments made by credit cards. From time to time we may modify our published prices up or down. This change in published price will have no effect on any previously made bookings.

INSURANCE Attendees must be suitably insured with adequate cover for health, accident, luggage, travel and event cancellation.

PRICE OF TOUR DOES NOT INCLUDE Our website www.motoexpress.co.uk lists the items not included in our tour price. Specifically Flights and all items of a personal nature are not included.

CANCELLATIONS – BY YOU Cancellations received more than 56 days prior to event start date will be subject to a cancellation fee equal to the deposit paid. Cancellations received less than 56 days prior to the event start date will be subject to a cancellation fee equal to the total event price inclusive of any extras or options booked. No exception to this policy can be made for any reason.

CANCELLATIONS – BY US While is very rare for us to need to cancel, however sometimes we may need to cancel or change your reservation. If we cancel you are entitled to a 100% refund. We will not cancel your event with less than 56 days to go to the start of the event. If we make a major change your event, such as a change of hotel you will be entitled to refund of monies paid. Please note that we do not have any responsibility or liability for any consequential losses you may incur from arrangements you have made with other parties.

CANCELLATIONS – BY THIRD PARTY In the very unlikely event that the entire event is cancelled, or for any other cancellation which is outside our control, you will be entitled to a refund less 15% administration costs. Thus we will refund 85% of all monies paid to us.

PHOTO AND VIDEO MATERIAL Photos and videos produced by MotoExpress during the event are the property of MotoExpress. The copyrights rest with MotoExpress. MotoExpress can use all this material for advertising and marketing purposes, including images in which individual tour members can be recognized.

TRANSFER OF BOOKING Participants may transfer the booking to another person providing that a minimum of two weeks notice is given. Amendments to the original booking will be subject to a £25 administration charge.

WEATHER CONDITIONS MotoExpress cannot be made liable for unpleasant or unsuitable weather conditions, and no refunds are made for such conditions.

RESPONSIBILITY MotoExpress is responsible for providing the services listed in the tour description according to the local standard and the accurate description of services offered on its website. MotoExpress carefully selects and constantly checks its contractors, such as hotels. MotoExpress is responsible for conscientious travel preparations. When you make a booking, either on your own behalf or on behalf of others, you and those of whom you are acting on behalf hereby exclude, release and forever discharge MotoExpress and all other persons involved in the organisation, conduct and promotion of the event from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with the participation in the event. If you or any member of your party suffers from a medical condition or disability which may affect their tour arrangements, full details of the disability or medical condition must be advised to MotoExpress before / at the time of booking so that arrangements can be amended to suit the individual needs of the participant’s disability or medical condition. If in the opinion of MotoExpress a particular package or booking is not suitable for the disability /medical condition, including but limited to the extent that it compromises the personal safety of either the participant or other members of the group, then MotoExpress reserves the right to refuse a booking at its discretion. In the event of the disability / medical condition not being made known to MotoExpress before or at the time of booking, then MotoExpress further reserves the right to cancel the booking at any stage and cancellation charges will apply (See Cancellations). Motorsports can be dangerous and attending a motorsport event often requires attendees to walk long distances, wait for long periods in queues, be exposed to external elements including, but not limited to prevailing weather conditions. In addition, some race circuits may have limited facilities (e.g. catering and basic amenities). Therefore, by making a booking with MotoExpress, we presume that you and / or all

persons for whom the booking is made has personally assessed the risks that may be involved in attending the relevant event and has attested that they, among other things; Have the relevant fitness to attend. Accept any inherent risk that may be associated with attending the event, and discharge MotoExpress from all liability, potential or otherwise, arising from any injury, accident, suffering, disease, death, damage or other consequential loss to any person or their possessions (except where resulting from gross negligence). In addition, MotoExpress shall not be held responsible for any type of claim, including damages to persons or property, loss of equipment, delays and illness as a result of but not limited to; Acts, errors or omissions, injury, loss, accidents, delays or irregularities that could be caused by the breakdown or defect of a land vehicle or airline carrier or any other company transporting passengers. Negligence, fault or omission on the part of a tour service supplier or its personnel, including all persons over which MotoExpress has no direct or immediate authority. Theft, strike, illness, quarantine, mechanical failure, terrorist attack, war, government or police constraint, or any other cause beyond our control, including any modifications to the itinerary resulting from these events. Bankruptcy or suspension of activities of a carrier, or any other tour service provider Whilst every precaution is taken by MotoExpress and its agents, MotoExpress does not hold itself out to be responsible for the personal safety, security and wellbeing of attendees. You and all persons for whom you make a booking hereby indemnify and hold MotoExpress and its representatives and agents harmless against any and all claims in respect of personal injury or damages either direct or consequential arising from any cause whatsoever as a result of the participation by the attendee and persons under his or her authority on the event. Attendees must be responsible for the good behaviour of themselves. We reserve reasonable discretion to refuse your booking or to remove you or a member of your party from any event, if your demeanour or behaviour, or that of a member of your party is disruptive, dangerous or annoying to other people. No refund or payment of any costs incurred by you will be made under these circumstances.

PASSPORT Participants must be in possession of a valid passport. Guests are responsible for ensuring that there passports are accepted for entry into countries where the events are held.

HEALTH FORMALITIES UK participants should apply for form E111 issued by the Post Office, which entitles the holder to urgent treatment for accident or unexpected illness in EU countries.

Participants are strongly advised to take out additional travel insurance to cover against any expenses not covered by form E111.

FORCE MAJEURE AND COMPENSATION Compensation payments or refunds will not be made in the following situations: War, threat of war, riots, civil strife, terrorist activity, industrial disputes, natural disasters, fire, technical problems to transport, closure or congestion of ports, cancellations or changes to schedules by carriers ceasing to operate due to adverse weather conditions or other reasons and similar events beyond our control or where we cancel because you fail to pay the balance of your holiday cost.

THE PACKAGE TRAVEL, PACKAGE HOLIDAYS and PACKAGE TOURS REGULATIONS ACT 1992 MotoExpress complies with the regulations of the act.

By way of security for the refund of clients money paid over in the event of insolvency MotoExpress warrants that all monies paid over by a client under or in contemplation of a contract for a relevant package are held in the United Kingdom in trust for the consumer until the contract (tour or event) has been fully performed or any sum of money paid by the consumer in respect of the contract has been repaid to him or has been forfeited on cancellation by the client.

COMPLAINTS PROCEDURE Complaints should be put in writing within one month of return.

VERBAL CHANGES Verbal changes of contract are invalid unless confirmed in writing by MotoExpress.

ERRORS AND OMISSIONS MotoExpress reserves the right to correct errors or calculation mistakes at any time.
