TERMS AND CONDITIONS 1.

ELIGIBILITY CRITERIA: A. Experience of having successfully completed similar works during last three years. B. The tenderer must have the sufficient manpower, machinery and equipment necessary to execute the works. The tenderer shall provide the detail list of machinery and manpower to execute such similar projects. C. The bidder should be registered as Civil Contractor in the Sultanate of Oman.

2.

PRICES: Eligible Bidders are required to quote Percentage above (+)/below (-) offered at (A) for estimated Bill of quantities (BOQ) mentioned in the Bill Of Quantities and Schedule of Rates and finally fill up the Grand Total amount. All local taxes, income-tax, custom duties, port duties, landing charges, local transportation, storage and all other charges or dues, etc as per the law in force in the Sultanate of Oman during the contract course shall be borne by the bidder and his offer shall be deemed to have included all such charges.

3.

PLANT UNIT / WORK SPECIFICATION The works shall have to be carried out in accordance with the procedures, standards & specifications of Haya. Prior to excavation, sub-contractor shall have to survey and mark the route. Prescribed public awareness signs shall be provided. 4.

MATERIALS

Materials will be supplied by TCIL to the sub-contractor as mentioned in the BOQ and Schedule of rates. a. FTTH Street cabinet/FDH with all accessories. b. Optical Fibre Cables, OF Splice Protection sleeves 45mm c. Joint Closures/ODFs etc d. Sc/APC Pigtail e. SC/APC Connectors of different sizes. f. Customer Premises Fiber Termination unit 4m port SC/APC including Adapters. All the other materials to be used in executing the Telecom Works such as Cotton waste, Cable Cleaning Liquid, and all other material required for execution of the Telecom work other than specified in TCIL supply shall be supplied by the sub-contractor.

Material accounting statement duly certified shall be submitted by the sub-contractor periodically. 5. WORKMANSHIP Work is to be executed strictly as per Haya specifications. Any work rejected by the TCIL or Haya or its representative, due to poor workmanship or other faults, will have to be redone by the sub-contractor free of charge. In case TCIL decided to redo the job themselves, no charges will be paid to the contractors for rejected work. 6. PAYMENTS The payment to the sub-Contractors will be on back to back basis and shall be released against sub-contractor’s invoice after receipt of corresponding payment from client for certified executed quantities, after retaining 10% as retention. Sub-contractors invoice shall be supported with material account for invoiced works and details of balance materials, if any, available with sub-contractor for work in hand. 10% retention shall be released after 365days of defect liability period) upon the completion of snags & issue of final completion certificate by Haya and receipt of invoice by TCIL. Haya will make payment to TCIL within 60days from the date of receipt of invoice, subject to any unresolved disputes. Payment shall be done by cheque. 7. COMMENCEMENT DATE AND COMPLETION DATE. As stipulated in the work order. 8. PERIOD OF CONTRACT The period of contract shall be one year. Contract period shall be upto issuance of Final Acceptance Certificate by Haya for the works. 9. TIME SCHEDULE FOR COMPLETION OF WORKS Sub-contractor shall ensure that works of all the job orders are completed within agreed implementation period for each job order with TCIL. 10. INSURANCE All necessary insurance for the safety of sub-contractor’s personnel & his tools, plant & machinery will be the responsibility of the sub-Contractor as per local laws and copy of the policy should be submitted to TCIL. 11. SUB CONTRACTING Further sub-contracting of the works is not permitted. 12. COLLECTION OF STORES All the necessary stores / materials will have to be collected by the sub-contractor from TCIL stores and used for the project only. Balance quantities, if any, shall be returned to TCIL at the stores and proper store return slip is to be obtained. 13. STANDARD TERMS & CONDITIONS Standard terms and conditions shall be the same as finalized by Haya for these works.

19. ARBITRATION If any dispute or difference arising in connection with the main contract between HAYA Water (OBC) & TCIL touches or concerns the sub-contract works, the decision of arbitration (as foreseen under the provisions of the main contract) shall also be binding upon the subcontractor in so far as it touches or concerns sub-contract works. If any dispute or difference arises between the Employer and the sub-contractor in connection with the contract and the parties cannot resolve it between themselves, either party may give notice in writing to the other of the existence of such dispute or difference specifying its nature and if the Employer determines that dispute does not concern the main contract; it shall, subject to the provisions of the Rules of Conciliation and Arbitration of the Sultanate of Oman, referred to arbitration and the decision of arbitration shall be binding on both the parties. Any clarification regarding NIT can be checked from our office from 12.01.2015 to 18.01.2015. Section 2 General Conditions of Contract The “Conditions of Contract” shall be the Standard Conditions of Contract contained within the “Sultanate of Oman Standard Documents for Building and Civil Engineering Works, 4th Edition, September 1999 (Arabic)” as prepared by The Ministry of Finance, Muscat, and its amendments. The Bidders are deemed to be in possession of their own copy of this document and must be fully aware of and to have understood the contents therein. Notes: Definations Clause 1.(1)(a)

“Employer” means names of the Government of Sultanate of Oman and the legal successors in title to the Employer who has employed the Contractor (TCIL). Section 3 PARTICULARS CONDITIONS OF CONTRACT Note If any clause in the Particular Conditions of Contract contradicts (PCC) to the General Conditions of Contracts (GCC) in a meaning, obligation responsibility, term and condition or procedural process, then the clause stated in the PCC shall prevail. 1.0

DEFENITIONS

The Contract

“Contract” means the Agreement and the other documents such as instruction to tender, terms & Conditions of Contract , the specifications, the drawings, the priced bill of quantities (if required in the tender), the schedule (if required in the tender), the letter of acceptance, the contract (LPO), and the form of agreement and appendix to the form of agreement.

Persons

“Client” means the Haya Water (OBC) whose registered address is P.O. Box 1047, Postal Code 133, Al Khuwair, Muscat, Sultanate of Oman and the legal successors and permitted assignees. “Service Provider” means the person or persons, firm or company whose tender has been accepted by the Company and includes the Service provider’s representatives, successors and permitted assignees.

Other Definitions

“Services” means the services to be executed in accordance with this agreement. Services shall include both temporary and permanent Services. “Effective Date: Means the date on which this Contract comes into force and effect pursuant to Clause 2. “Purchase Order” Shall mean an order issued in writing by the Client/Contractor at the start of contract execution and/or any time during the operational period instructing the Service Provider to Perform the Services specified in the order within the time frame specified in the order. If the term Call Off, CallOut, Job, Job Order, for Works Order, Work Order or similar terms appear in the Contract, they shall have the same meaning as Purchase Order, unless the context requires otherwise. “Works” Means the services specified in the Scope of Work and Specifications in a Work Order. “The Site" Means the lands and/or other places on, into or through which work is to be executed under the Work Order or any adjacent land, path or street which may be allocated or used for the purpose of carrying out the Contract.

2.0

CONTRACT

2.1

This Contract, when accepted by sub-contractor either by written acceptance, by commencement of Services, constitutes the entire Agreement between Contractor and subcontractor concerning its subject matter, and neither any contrary or additional conditions Page 11 of 41

nor any subsequent amendment or supplement shall have any effect without contractors’s prior written consent. It is also understood that Contracts/Purchase Orders may be issued or released against this Contract, and that the terms herein shall be applicable to such Contracts. 2.2

This Contract and the Commencement period shall come into effect on the date specified in the Form of Agreement. The date the Contract comes into effect is defined as the Effective Date.

3.0

CALL OUT

3.1

The Client/Contractor shall have the right to order Services on a Call-out Basis and the subcontractor shall perform such Services in accordance with the Contract and the same schedule specified in the Call-Out. The Call-out order shall be solely governed by the Haya Water Contact person as stated in the PO. The Call-Out shall be made by sending an official request.

3.2

The Client does not guarantee any minimum quantity of Call-out, nor does the Client undertake to exclusively use the Service provider for the performance of Call-out Services, with the exception of Call-out Services, if any, if respect of which the Contract does explicitly guarantee the quantity and/or exclusivity.

3.3

The client shall be entitled, as it sole discretion; to cancel any Service provided on a Call-Out basis. The Service provider shall be entitled to reimbursement of properly substantiated direct costs, if any, incurred as a result of such order or cancellation being made at such short notice that such costs are unavoidable, provided the Service provider notifies the Client of any such costs within fourteen (14) days of the cancellation. Same will be applicable to the sub-contractor.

4.0

CHANGES IN PRICES No price increases shall be permitted unless otherwise provided for in the Contract.

5.0

COMPLETION OF THE SERVICES

5.1

The sub-contractor shall subject to the provisions of the Contract and with due care and diligence carry out the Service and provide all labour (including the supervision thereof), materials, equipment consumables and all other items, whether of a temporary or permanent nature required to complete the Service.

5.2

Where applicable, the Service provider shall commence and complete the Service by the dates or within the time specified in the Contract or the Purchase Order.

5.3

The Service shall be executed in accordance to the Client’s specifications or in the absence thereof, according to good practice and standards of workmanship. The service provider undertakes that all Service done will be fit for its intended purpose.

6.0

SERVICE MONITORING

6.1

The services shall be in accordance with the Contract requirements to the satisfaction of the Client or its authorized representative. The TCIL’s authorized representative shall have the right to inspect and examine the work being performed on the Client’s behalf at any reasonable time; where any part of the work is being performed on premises other than the Client’s Premises; reasonable notice shall be

given to the sub-contractor. The service provider shall give all such facilities as the Client’s or its authorized representative may reasonably require for such inspection and examination. 7.0

VARIATION

7.1

The client/TCIL reserves the right at any time to issue a written variation order to amendment to the Contract concerning specifications, quantity, methods of services, time of delivery of services; or any other matters affecting this Contract.

7.2

The Quantities stated in the Bills of Quantities are tentative and subjected to change. The variations in quantities are unlimited and have no upper or lower limit. The rates quoted in the Contract are final and binding and no increase in rate is applicable for any such variation in quantities.

7.3

Any additional scope of work as determined in accordance with the Contract will be settled through the variation procedure after obtaining the new rates after approval and acceptance by the Client/TCIL/Sub-contractor.

7.4

Employer at its sole discretion may increase or delete the entire quantities of the scope of work. Sub-Contractor shall not be entitled to any claim whatsoever.

7.5

The sub-Contractor shall submit to the Engineer within 7 days of the receipt of a Site Instruction/variation or any other form of instruction for variation work, a detailed statement and measurements, appropriate back-ups in a format approved by the quantity surveyor and valued in accordance with the Contract. Should the sub-Contractor fail to comply with this condition the Quantity Surveyor may assess the variation work instructed and his assessment will be final and binding upon the sub-Contractor.

8.0

INVOICES AND PAYMENT

8.1

Service provider shall issue invoices only upon completion of services required by Client hereunder. Unless different payment terms are specified on the Contract hereof, Client shall issue payment within sixty days (60) of its receipt of correct and conforming Service provider invoice. Payment by Client is contingent upon satisfactory completion of services by Service provider.

9.0

LIABILITY FOR NEGLIGIENCE

9.1

The Service provider shall compensate the Client for any loss, damage or expenses suffered by it as a result of a breach on his part of his contractual obligations. In the case of damage to property due to simple negligence, the Service provider’s liability shall be limited to the total value of the Contract unless otherwise stipulated. The same shall be passed on to the sub-contractor.

10.0

TERMINATION FOR CONVENIENCE

10.1

The Contractor may terminate this agreement for convenience at any time with 30 days notice in writing from the Contractor to the sub-contractor.

11.0

TERMINATION FOR BREACH OF CONTRACT

11.1

Where the sub-contractor is in breach of, or fails to fulfill essential contractual obligations, the Contractor shall be entitled to withdraw from the Contract without previous notice.

In the case of minor breach of his contractual obligations by the Sub-contractor, TCIL shall be entitled to terminate the Contract if the breach is not remedied by the Sub contractor within a reasonable period of time not exceeding 14 days from the date on which notice is given to the Sub-contractor.. Where the Client terminates the Contract because of the Sub-contractors nonperformance of an obligation under the Contract then the Sub-contractor shall only be paid for Service property completed under the Contract upto the date of termination less any additional costs incurred by the TCIL due to the non-performance. PENALTIES FOR DELAY (Where applicable)

12.1

Subject to Clause 13, if the Sub-Contractor fails to complete all or part of the services with the time period specified in the Call-out of haya(OBC) , TCIL may, without prejudice to any other rights and remedies, deduct from the total price stipulated in this contract an amount specified in Appendix to the Form of Tender for each day of delay (or part thereof), up to a maximum limit of (10%) of cumulative value of the services provided or a total value of the Contract whichever is higher. The same shall be passed on to the sub-contractor.

13.0

FORCE MAJEURE

13.1

The sub-contractor shall not be liable for default or penalties for delay, if to the extent that its failure to perform its obligation under this Contract is the result of an event of Force Majeure. For purposes of this Contract, Force Majeure is defined as an event beyond the control of Service provider; not involving the Client’s fault or negligence and not foreseeable and includes acts of God, natural disasters, war and other events of similar nature or force.

14.0

GOVERNING LAW

14.1

This Contract and all matters arising out of, or related in any manner to this Agreement, or the dealings between the parties to this Contract shall be construed with an in accordance with the laws of the Sultanate of Oman.

15.0

CONFIDENTIAL INFORMATION

15.1

All information, drawings, documents and knowledge or Client’s operations, business, employees, processes or equipment acquired or handled by sub-contractor in connection with this Contract shall be considered to be Confidential Information, and shall not be disclosed without the prior written consent of Client.

16.0

HSE REQUIREMENT

16.1

Haya /TCIL warrants that the services provided are in strict compliance with all applicable laws, regulations and requirements relating to health and safety, in particular the subcontractor will ensure all works comply with an adhere to Ministerial Decision 286. Subcontractor shall take all reasonable precautions and safety measures necessary to protect his own and Client’s staff and any other persons who are at any time directly or indirectly affected by sub-contractor’s operations. Sub-contractor shall comply at all times with all laws and enactments relating to Health and Safety. The sub-contractor shall conform in every way with the Health and Safety Regulations of the Client. These regulations are available to subcontractor before he submits his bid. It shall be sub-contractors responsibility to finalize him with Client’s health and safety regulations. The Client always uses a “permit to work” safety procedure and this must be followed by the latter. Sub-contractor shall make no claim for any extra remuneration because of lack of knowledge of any Health and Safety Regulations of the Client. End of Section 3

Section 4 Scope of Works / Services 1.0

Introduction

Executive Summary The scope of works describes the Construction Services required to: 

Maintain the fibre optic, duct and related PoP site system.



Construct minor works to alter or augment the Fibre system.

Construct customer connections to the network Haya Water will be assumed to have constructed a Governorate wide network covering and estimated 50,000 plots. These plots can be either. 

Single dwelling units



Multiple dwelling units



Large business customers



SME commercial Business



Municipality, Health, Education or Ministry Sites

The network topology will be termed - Fiber to The Home (FTTH) and is detailed in the attached network design guidelines specification. The scope of works will be detailed below but in summary it will cover the following items for which Haya water will request a turnkey design and build solution:

Supply all materials in connection with customer connection, maintenance and minor works as per the attached BOQ.



Provide planning and design support relating to customer installation and minor works as required.



Provide civil installation works for customer connections and other minor works



Provide cable installation for customer connections and other minor works.



Provide maintenance support for any damage sustained to any part of the PoP site, civil and cable system.



Provide four hour response time to emergency works

Scope of work The scope of works will as per the BOQ requirements. Customer Connections Haya Water (OBC) has approval to provide a Fiber to the Home (FTTH) Network throughout the Governorate of Muscat. This consists of a fiber optic network provided in ducts from a number of Point of Presence (POP) sites located strategically across the Governorate. The Cable network forms a passive optical fibre network terminated on an optical distribution frame within the POP site the cables pass through Fiber distribution hubs housing passive optical splitters with a split ratio of 1:32. From the FDH distribution cables are fed to Network Access Points (NAPs) at street level. Each NAP will have the capacity to feed up to eight individual tenancies with sufficient capacity to support services from three different suppliers. On receipt of an order for service from the provider, the contractor will install a drop cable consisting of one 4 core fibre to G 657 specifications from the NAP to the customer premises.

The process for taking the order is discussed in another document and is not discussed in this scope of works. The existing cable network extends to NAPs located at strategic positions at street level. The ducted network extends beyond the NAP position and consists of 1 x 25mm HDPE duct terminated on the inside compound wall (see figure 1)

Standard 25mm duct termination Two methods of ducted connection may be encountered where the duct has been laid after 2010, in some cases the 25mm duct will be laid from the NAP chamber to a small hinged box placed in the footway outside the customer’s property. These connection boxes are known as “Toby Boxes”.

On receipt of a customer’s order, the 25mm duct will be extended from the termination as shown in figure 1, or the Toby Box as shown in figure 2 to the customer’s property. Placement of Works TCIL/Haya Water will provide the sub-contractor with the following information: Page 17 of 41

 Name of the Customer  Location of property to be served along with a geographical map  Full routing of fibre including ODF position, E Side FDH position, Splitter output port, D side position, NAP number, and Fibre position within the NAP  Cable and duct plans of the area concerned.  Schematic cable distribution print of the FDH Survey The initial response by a sub-contractor is to arrange a site appointment with the Customer. The sub-contractor will visit the site and be responsible for: Agree with the customer the location of the Optical Network Termination point (ONT) within the customer’s premises and negotiate permission for all duct and cable routes.  Agreeing with the customer the most efficient and cost effective route from the duct termination / toby box to the ONT.  Obtaining any necessary permissions, non-objection certificates or approvals to execute the works.  Provide a work pack to enable the physical connection.  Ensure the work pack is surveyed, planned and executed within the time scales laid down in the Service Level Agreement. Installation After the initial survey, the sub-contractor will direct its staff to execute the work as described in the work pack and install a four core fibre cable (G657) from the specified NAP to the termination point agreed with the customer. The cable will be terminated at the customer’s premises on a four port termination box and present on SC/APC connectors. In the NAP, the Sub-Contractor will splice fibre 1 of the 4 fibre drop cable to the fibre specified by Haya TU/TCIL. The Fibre will be tested as per the Haya Testing specifications. Haya TU may wish to witness this test. After gaining acceptable test results the Sub-Contractor will provide a patch cord from the allocated D side to the splitter port specified by Haya TU/TCIL. The work will be subject to supervision by Haya Water(OBC)/TCIL. All works will comply with Health and Safety (HSE) requirements as laid out in Clause 16.0 of Particular Conditions of Contract. It should also be noted that the HSE requirements of the customer connections will also include working inside domestic homes with the additional aspects of family members and children being part of the work site. Completion After completion of the works the Sub-Contractor will provide the following:  Detailed as built drawings of work done  OTDR traces Page 18 of 41

 Bills of quantity & bills of materials used.  Original documents of any NOCs permissions or approvals received. Maintenance The Sub-Contractor will plan and implement all required activities to restore service and bring all plant items back into specification. The sub-contractor will do his portion of the work as per BOQ immediately so as to meet the deadline for completion of the work. There are two main work areas:  Handling of Customers Faults and Planned Maintenance from time reported until time cleared.  Compilation and generation of all customer specific contractually agreed records and statics. All works will be managed by the sub-contractor. Responsibilities The Sub-Contractor will be responsible for: Receiving and recording all necessary information from Haya Water/TCIL.  Having identified the fault type and category passing all necessary information to the sub-contractor (Civil/Telecom). The sub-contractor will be responsible for: Call out and mobilizing Civil / Telecom Team.  Controlling and directing the activities of their team  Initiating any plant repair activities.  Sub-contractor will be Monitoring performance to ensure that: Reports and performance measurement Statistics for each operation are accurate.  They provide all information to allow performance measurement throughout the Contract maintenance Organization.  All response and repair target times are achieved.  Maintain a fault report log. The report must be based on data that is gathered and recorded on site.  Producing fault specific reports and statistics on all functions to allow the performance monitoring and implementation of any necessary improvement measures.  Liaise with TCIL/Haya Water and provide them with all necessary information to allow them to meet customer response and repair times/targets for faults and customer timescales for pro-active maintenance works.

The report will also include any general issues arising in the report period Haya Water/TCIL may request additional information to be reported as issues arise. The cost of these activities will be measured and compensated for as per the schedule of rates. Minor Works The sub-contractor will undertake any other miscellaneous works as directed to by TCIL/Haya Water. This job type will likely be of a moves/changes nature and will be disconnected from any other works. The cost of these activities will be measured and compensated for as per the schedule of rates. Health and Safety. The sub-contractor will ensure all works comply with Ministerial Decision 286. The sub-Contractor will develop and maintain a Construction Phase Health and Safety Plan throughout the duration of the project and ensure that it is properly implemented at all times. Provide all Welfare and staff facilities and hazardous material storage at a location nearby the areas where work is taking place in accordance with Health and Safety legislation requirements. Program The Sub-Contractor shall prepare a program of works grouped by location, scheduling the elements of work during the contract period. The Sub-Contractor shall maintain and update the programme of works throughout the contract period and present to TCIL/Haya Water updated programme on a weekly basis or as soon as an incident occurs that significantly affects the programme. In the event of suspected compensation events being identified, the Sub-Contractor shall submit early warning notification to the TCIL/Haya Water Project Manager who will decide whether the event is allowable as a compensation event.

The sub-Contractor shall liaise with the TCIL/Haya Telecom Unit throughout to ensure that any compensation event claims are dealt with in accordance with the Terms and Conditions of this Agreement. Project Management The Sub-Contractor shall provide a Contract Project Manager for the duration of the Project, who will be single point of contract with TCIL/Haya Water and who will drive the Project through to completion. TCIL shall manage the interfaces and liaise between the various specialists, and Sub-contractors employed by the Haya Water. The Sub-Contractors’ daily whereabouts are to be recorded and submitted on an implementation tracker and sent to the TCIL by 5pm each day. Develop an end to end process encompassing all activities for which the Contractor is responsible. Develop a Quality Plan specific to the Project. Provide regular reports to TCIL/Haya Water on the progress of the project in relation to the programme and identify any threats to the Completion date. Attend a weekly progress to meeting and present project report (the contents of which will be agreed between TCIL/Haya Water Unit and the Contractor at pre contract stage) or where deemed necessary by Haya Water. Minor and report Quality throughout the life of the Project including regular auditing of the works. Make the audit reports available to TCIL/Haya Water including corrective actions taken or planned. Design, develop and maintain an asset register for the Works Package as the work proceeds taking care to record specific locations and serial numbers for individual pieces of equipment installed. Provide an escalation procedure for Haya water to raise unresolved issues with senior management within the Contractor. Design, develop and maintain a risk register for the Works Package as the work proceeds. This register is to be updated on a live basis and be made available to TCIL/M/s. Haya Water at all time. Actual start notice Procedure. Daily Completions Reporting. Materials Management The materials including, but not limited to FTTH Street cabinets, ODFs/racks, pigtails/patch cords, Joint Closures etc and all other materials required for Telecom Work will be transported to site from TCIL stores by the sub-Contractor. All logistics for the movement of materials and stores will be responsibility of the Sub-Contractor. Delays can be expected within border and custom controls at the point of entry to the country. It is assumed that the sub-contractor will allow for this potential delay in his program. All stores and materials will be managed in a secure area by the sub-Contractor. After the contract has been awarded the Sub-Contractor will supply descriptions and if necessary samples of stores and materials. TCIL/Haya Water will review the items prior to issuing materials Acceptance Certificate (MAS). On receipt of the MAS the contractor will order the stores and provide a detailed schedule of stores delivery dates. Page 21 of 41

Stock Management The Sub-Contractor is required to maintain a minimum level of stock as to assist in the execution of his scope of work well in time. Telecom Construction Works The Construction works may include, but is not limited to all or any of the following. Work within trunk routes, minor roads, housing estates, private streets and lands. Work with special engineering difficulty, including works of a specialist nature and the like. Trial holes and location of existing services. All temporary works including traffic management, protection of the public and all operatives associated with the project. Opening/closing of chambers into carriageways, footpaths. FOC fault localization by use of OTDR etc are in the scope of sub-contractor. All testing works to be executed as per Haya standard Document SPC-TEL-009 End to END Loss ILM testing,OTDR testing and production of all test results required for completion of Work order and acceptance by Haya(OBC) Additional Construction Notes Historically, where telecom duct has been laid as part of the waste water build, 110mm HDPE Corrugated duct has been employed, in the fibre only areas addressed by this contract and any additional duct required to augment the existing duct the contractor will employ 90mm rigid PVC duct with a grey colour. (The Industry standard for telcom duct, (also referred to as “Duct 54”) preformed bends will allow for deviation from straight runs. The duct will be buried with a minimum depth of cover of 600mm in footway, and 800mm in carriageway conditions, the buried duct being ‘blinded’ with sand or earth free from stones to a depth of cover of at least 100mm from the top of the duct. Also, a number of non-standard access chambers have been employed in the waste water build, the designs will utilize these chambers, however in fibre only areas, only the industrial norm chambers referred to as “Type 4” and “Type 6” will be employed. Type-4 will be used for turning chambers and type 6 where splices will be located. The dimensions and specifications for these chambers can be found in the associated Civil Specification documents. Chambers may be block built, precast concrete, cast in situ or prefabricated, Haya TU recommend using commercially available pre-fabricated chambers due to cost and ease of installation. However, if the contractor uses pre-cast or cast in situ, a M10 mix of cement, sand and aggregate of ratios 1:2:6 clean (potable) water is to be used, and sufficient curing time allowed for. The Haya Water may witness a slump test and compressive tests as may be required from the ministry of Transport and Communications Road Laboratory. The maximum span between access chambers is set at 250m. No duct or access chambers will be laid in private property without the explicit permission from the Haya Water. If the situation should arise, the sub-contractor shall be responsible for obtaining irrevocable way leave permission from the land owner (s).

In Oman, trees and ornamental gardens are seen as national assets, care must be taken to avoid damage to tree roots and disruption to ornamental gardens. Primarily the FTTH cable network will take advantage of telecom duct laid during the installation of the waste water network, however, in areas where no waste water infrastructure has been laid, new telecoms civil apparatus consisting of duct and access chambers will be constructed. These areas are known as Fibre Only areas. Contract Start and Completion TCIL/Haya Water reserves the right to alter any program of works by either adding or deleting works. They also reserve the right to alter the priority of the build to be built where reasonably practicable. The Sub-contractor shall organize a completion visit to enable the works to be inspected and accepted by Haya Water. TCIL/Haya Water will not accept completion of work package until all Handover Documentation has been received and accepted. Handover documentation (Sub-contractor responsibility) Provide the following documents to Haya Water/TCIL. Network in electronic format together with 2 hard copies. As built record drawings will be submitted in .dwg format as detailed in SD-TEL-017 Rev0 (CAD Standards) attached. Provision of test certificates for end to end ILM testing and OTDR. GPON records detailing splice and property records. Access node records detailing splice and GPON allocations. ODF records. Health and Safety File including and additional risk assessments, method statements and residual risk assessments. Interim Valuations The sub-contractor will provide a monthly interim valuation of the works completed to date and submit for approval by the Haya Water. Work will only be included in valuations for sections that are 100% complete. Arrange to meet the TCIL/Haya Telecom Unit on site so that any measured works claimed can be validated. Final Account The sub-contractor shall provide a fully documented Final Account for the Work Package to TCIL/Haya Water. The sub-contractor shall provide all information, final measurements, invoices, quotations, timesheets, delivery tickets etc as requested in order that Haya Telecom Unit can approve the Final Account Claimed. Should there be reason for Haya Telecom Unit (OBC) to carry out on-site measurements to enable agreement of the Final Account, the sub-contractor shall provide attendance on the surveyor to enable safe inspections.
