TARIFFS OF THIRD PARTIES The tariffs of third parties do not form any part of the general terms and conditions of Havenbedrijf Rotterdam N.V.

The mentioned third parties act under their own specific general terms and conditions. Therefore no rights can be derived from the tariffs of third parties as mentioned in this brochure.

De derden, genoemd in deze brochure, handelen onder hun eigen specifieke algemene voorwaarden. Voor wat betreft de tarieven van derden kunnen geen rechten aan deze brochure worden ontleend. Havenbedrijf Rotterdam N.V. is niet aansprakelijk voor het gebruik van de tarieven van derden zoals genoemd in deze brochure.

This Tariff shall be applicable to all ‘Towage’ performed by or ordered from Svitzer, whether or not under a Svitzer Towage Agreement. In case this Tariff is applicable to ‘Towage’ performed under a Svitzer Towage Agreement it is not to be interpreted in its own right, but in conjunction with and as part of this Svitzer Towage Agreement. Should there be any conflict between this Tariff and the Svitzer Towage Agreement, the latter shall prevail. All services rendered by Svitzer, salvage services excluded, shall be subject to the Dutch Harbour Towage Conditions 1951 as filed at the office of the Clerk of the Amsterdam and Rotterdam District Courts. Copy of same will be forwarded upon request, free of charge. The official language of the Tariff is English. The Tariff is subject to Dutch Law. Any dispute arising out of or in connection with this Tariff shall be settled amicably, failing which same shall be referred to arbitration according to the rules of the ‘Nederlands Arbitrage Instituut’ (Dutch Arbitration Institute). The arbitral award shall be final and unconditionally binding. By ordering tugs or other services, the ordering agent is deemed to acknowledge that the vessel’s owners, operations, masters, and agents have been informed of and have accepted these Terms and Conditions. The rates in this Tariff will not apply in case when vessels break loose from their moorings and other unforeseen circumstances. For assistances outside the mentioned areas in this Tariff, special arrangements have to be made. Invoices outstanding after 14 days may be subject to a compound interest charge 10% per annum for each month the invoice remains outstanding. If payment terms are not adhered to SVITZER reserves the right to withdraw credit facilities. Rates: per tug. No extra charges on Saturdays, Sundays and official recognized holidays. Value added Tax (VAT) if applicable will be added to the aforementioned rates. Discounts available for long term contracts.

Tariffs for reporting services are based on the Deadweight (DWT) of the vessel. Tariffs include our fee for message handling, from ship to shore, and the services on the in- and outward voyage of a vessel, ISPS and excluded VAT.

A special tariff will be applicable to containervessels with a DWT over 22,500 tons.

Member of the International Ship Reporters Association (I.S.R.A.). Our General Terms in the most recent version, as filed with the Registrar of the Rotterdam District Court shall apply to all legal relations with parties. The applicability of the other party’s General Terms is expressly excluded. Our General Terms stipulate that the Court of Rotterdam shall be the competent court. These terms will be made available on request. We supply your water for drinking, deionised and cooling water. We give Consultancy and audits of water management systems. We take care of sampling and analysis of your(drinking, sewage, bilge) water on board and issue approved water-certificates, a service we provide in all major harbours worldwide. In case of contamination of drinking water on board, we can supply disinfection products services and consultancy to provide cleaning solutions.
