SUPPLEMENTARY DOCUMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE HEALTH AND SAFETY EXECUTIVE AND THE PETROLEUM SAFETY AUTHORITY NORWAY CONCERNING HEALTH AND SAFETY SUPERVISION RELATED TO PIPELINES AND INSTALLATIONS GOVERNED BY TERMS OF THE EXISTING FRIGG - ST. FERGUS AGREEMENT

PART I: GENERAL INFORMATION 1. Introduction This Supplementary Document to the existing Memorandum of Understanding (MoU) between the Health and Safety Executive (HSE) and the Petroleum Safety Authority Norway (PSA) contains additional information on practical arrangements which HSE and PSA mutually understand will apply to health and safety supervisory activities and exchange of information with regard to pipelines and installations governed by the existing Frigg - St. Fergus Agreement between UK and Norway. 2. Objects of health and safety supervision The health and safety supervision arrangements of this Supplementary Document cover mutual understandings on practical arrangements for: •

The following installations in the Frigg Field: Quarter Platform (QP), Treatment Platform 1 (TP1), Treatment Compression Platform 2 (TCP2), Drilling Platform 2 (DP2) and Concrete Drilling Platform 1 (CDP1). In the Frigg Field there is also a steel jacket that was misplaced during installation (DP1). The field lay out is shown in appendix 1 to this Supplementary Document.



Following disconnection of the British owned pipeline from the Frigg Field, it therefore no longer requires to be covered in the Supplementary Document.



Vesterled: The Norwegian owned Frigg - St. Fergus pipeline, now disconnected from the export riser at TCP2 up to and including metering instruments at St Fergus, and also including associated installations serving this pipeline, the Heimdal Connection and the 12” link from this pipeline to the Heimdal Connection. The Heimdal Connection means the pipeline from the welded connection with the export riser at the Heimdal Riser platform up to its tie-in weld to the part of the Norwegian Pipeline situated on the UK Continental Shelf. The Heimdal Connection has the following specifications: Length: ~45 km, dimension 32”, wall thickness: 19.05 mm, material grade: C-Mn X65, SMYS 450 Mpa, medium: gas, design pressure: 164 Bar, commissioning date: 1.10.2001, design life: 50 years. The pipeline (disconnected from TCP2) to St Fergus has the following specifications: ~ 362 km, dimension: 32", wall thickness: 19.5 mm, material grade: X65, medium: gas, design pressure: 148.9 bar, commissioning date: September 1977, and design life: 20 years. There is a decommissioned and bypassed Manifold Compression Platform, MCP-01, installed 187 km from the Frigg Field.

The operating companies are as follows: Total E&P Norge AS operates the field. Gassco AS operates the Norwegian owned Vesterled pipeline. Total E&P UK plc serves as technical service provider and carries out the day-to-dayoperations on behalf of Gassco AS. 3. Exchanging information on health and safety related issues HSE and PSA will exchange relevant information on health and safety issues related to the Frigg - St Fergus pipeline system, the Vesterled and the installations in the Frigg Field. Information regarding major incidents/accidents related to the pipeline systems and to the installations on the Frigg Field will be exchanged without delay.

PART II:

HEALTH AND SAFETY SUPERVISION OF THE VESTERLED PIPELINE

4. Co-ordinating Authority PSA and HSE have appointed PSA to have a co-ordinating role in joint supervisory activities and supervisory activities, which relate to the operator's health and safety management system for the Norwegian owned Vesterled pipeline system. PSA will co-ordinate all communication with the operating company in such matters. Notwithstanding the two authorities’ co-ordinating roles, the UK and/or Norwegian legislation will apply as specified in the Frigg-St. Fergus Agreement. Each authority may conduct independent supervisory activity in accordance with their authorisation. In order to enhance efficient co-operation, HSE and PSA will make arrangements for proper assessment of differences between their relevant respective legal provisions pertaining to health and safety, and will involve the operating companies in that process as deemed appropriate. 5. Planning and conducting health and safety supervisory activities The authorities will prepare and agree a joint plan covering health and safety supervision with regard to the pipeline. PSA and HSE may suggest joint supervisory activities to be incorporated in the plan.

When health and safety supervisory activities are carried out jointly, the responsible authority will arrange the practical matters involved and direct the supervisory activities. When such joint activities have been conducted, the responsible authority will forward a draft report as well as relevant correspondence to the other for agreement before the final report is being sent to the relevant operating company. HSE and PSA will exchange information on the results of all independent supervisory activities relating to the pipeline. 6. Handling of applications for consents, exemptions and taking enforcement or equivalent action, etc. Applications and other formal communication concerning the pipeline, which are required by provisions of UK and/or Norwegian law, such as, health and safety related consents, exemptions from legal provisions, etc., shall be submitted by the operating companies to the relevant authority. Each authority will, where practicable, consult the other before consenting to applications or prior to taking enforcement or equivalent action. Copies of consents, exemptions, licenses or other legal documents issued by one authority will be made available to the other. 7. Status meetings HSE and PSA will arrange, as appropriate, status meetings with the other Authority and the operator to review the operator’s performance in ensuring the safe operation of the pipeline and the proper functioning of the operator’s health and safety management. Agenda items will normally include: •

The authorities' experience with supervision of the operator’s operations and health and safety management and their expectations with regard to the operator’s performance in the future;



Presentation and discussion of the operator’s condition report;



Operational aspects;



The operator’s inspections;



Discussion of the operator’s assessment of the overall technical condition;



Discussion of the operator’s assessment of whether there is a need to update the overall, long-term programme for condition control;

Presentation and discussion of the operator’s future inspection programme;



Presentation and discussion of the operator’s future maintenance programme;



Status of the operator’s projects.

PART III: HEALTH AND SAFETY SUPERVISION OF THE FRIGG INSTALLATIONS 8. Co-ordinating authority PSA and HSE have appointed PSA to have a co-ordinating role in joint supervisory activities and supervisory activities, which relate to the operator's health and safety management system. PSA will co-ordinate all communication with Total E&P Norge AS in such matters. Notwithstanding PSA's co-ordinating role, the UK and Norwegian legislation will apply in accordance with the Frigg-St. Fergus Agreement, and each authority may conduct independent supervisory activities. 9. Planning and conducting health and safety supervisory activities Each authority will exchange a copy of its proposed plans covering health and safety supervision with regard to the Frigg Field installations for comment. Independent or joint supervisory activities will be arranged as appropriate. When health and safety supervisory activities are carried out jointly, PSA will be responsible for arranging the practical matters involved and for directing the supervisory activities. When such joint activities have been conducted, PSA will forward a draft report as well as relevant correspondence to HSE for agreement before the final report is being sent to Total E&P Norge AS. PSA and HSE will exchange information on the results of all independent supervisory activities relating to the installations.

10. provisions, etc., shall be submitted by Total E&P Norge AS to the relevant Authority. Each Authority will, where practicable, consult the other before consenting to applications or prior to taking enforcement or equivalent action. Status meetings Meetings to discuss supervisory activities relating to the Frigg Field installations will be co-ordinated by the PSA, when the activities are of a joint supervisory nature. The main objective of the status meetings will be to review the operator's performance in ensuring the safe operation of the Frigg Field installations and the proper functioning of the operator's health and safety management. Meetings that relate to independent supervisory activities will be arranged by the authority, which is undertaking that activity. In all cases, the agenda for, and date of, the meeting will be made known to both authorities at least one week prior to the meeting and either authority will be free to attend the meeting as it deems necessary.
