Dear Ms. Hall-Elzy: Attached is the Special Investigation Report for the above referenced facility. Due to the violations identified in the report, a written corrective action plan is required. The corrective action plan is due 15 days from the date of this letter and must include the following: • • • • •

How compliance with each rule will be achieved. Who is directly responsible for implementing the corrective action for each violation. Specific time frames for each violation as to when the correction will be completed or implemented. How continuing compliance will be maintained once compliance is achieved. Exit Conference with licensee designee, Kyra Hall-Elzy

ALLEGATION: Child A (male, age 4) stated that lead caregiver, Christiane Daily, pulled his arm which resulted in nursemaids elbow. INVESTIGATION: On 12/23/2011, Ms. Magee left a voicemail message stating that on 12/22/2011, Child A was taken to the emergency room from the center. He was diagnosed by a doctor with having nursemaids elbow. Ms. Magee then faxed a written report to the department documenting the incident. On 01/05/2012, I Spoke with Child A’s Mother who stated that she received a phone call from Ms. Nicholas informing her that Child A’s was experiencing pain in his arm. When she arrived at the center Child A told her that his caregiver Ms. Daily pulled his arm when he went “limp noodle” and would not get up off the floor. She explained “limp noodle” as he was sitting on the floor and when Ms. Daily went to pick him up Child A resisted by making his body go limp to resist being picked up. Ms. Nicholas was also present when Child A made these statements. 2

Child A’s Mother left the center with Child A and brought him to the emergency room where he was diagnosed with nursemaids elbow. The doctor told Child A’s Mother that nursemaids elbow is the result of Child A’s arm being suddenly pulled in an upward motion. Child A returned to the center the following week and is in care currently. Child A’s Mother believes that Child A was injured by Ms. Daily but she does not think it was intentional. She was not happy that her child was injured but felt that she was notified in a timely manner. On 01/06/2012, I conducted an unannounced inspection and interviewed, Ms. Nicholas and Ms. Megee. Ms. Nicholas stated that Ms. Daily, the lead preschool caregiver did not show up for work today and she was unable to contact her by phone. Ms. Nicholas stated that the lead caregiver in Child A’s classroom was Ms. Daily and that she worked alone with the children. On 12/22/ 2011, Ms. Daily called her to the prek classroom to look at Child A’s arm. Child A would not allow Ms. Nicholas to look at his arm. She asked Child A what happened and he stated that he would not get up and Ms. Daily pulled him up by his arm. Ms. Nicholas asked Child A the same questions several different ways and he continued to say that Ms. Daily pulled him up by his arm. Ms. Nicholas does not believe that Ms. Daily pulled Child A’s arm on purpose. She did acknowledge that if Child A was resisting and would not get up, then there was a chance that Ms. Daily could have, on accident, caused Child A’s nursemaids elbow injury. Ms. Megee was not at the center when the incident occurred, but spoke with Child A’s Mother the morning after the incident, when Child A’s Mother explained that Child A had nursemaids elbow. Ms. Megee did not speak with Ms. Daily about Child A’s injury and does not believe Ms. Daily caused his injury. On 01/24/2012, I spoke with Ms. Daily. She stated that she noticed something wrong with Child A on the playground. But it was not until after nap when Child A stated that his arm was hurting. She contacted Ms. Nicholas who then attempted to look at Child A’s arm. Ms. Daily stated that on average Child A has three to four fits within the classroom daily where she has to physically pick him up to remove him. When Ms. Daily asks Child A to do something within the classroom he will routinely throw himself on the floor at which time she usually picks him up by his armpits. Because she has physically removed Child A multiple times she does not recall anything specific. Where she does not believe that she pulled Child A’s arm on purpose, she did acknowledge that it could have happened on accident. She does not recall if she did or did not have to pick up Child A on the day in question.

APPLICABLE RULE R 400.5105 Supervision and ratio requirements.

ANALYSIS:

CONCLUSION:

(1) The center shall provide appropriate care and supervision of children at all times. Ms. Daily did not provide appropriate care and supervision of Child A when she picked him up from the floor by his arm causing nursemaids elbow. VIOLATION ESTABLISHED

APPLICABLE RULE R 400.5111a Accident, injury, illness, death reporting.

ANALYSIS: CONCLUSION:

(1) The center shall make a verbal report to the department within 24 hours of a serious injury, or accident, or a serious illness or medical condition occurring while a child is in care that results in emergency medical treatment at a health facility or hospitalization, or death. Ms. Nicholas made a verbal report to the department within 24 hours of Child A’s injury. VIOLATION NOT ESTABLISHED

APPLICABLE RULE R 400.5111a Accident, injury, illness, death reporting.

ANALYSIS: CONCLUSION:

(2) The center shall submit a written report in a format provided by the department within 72 hours of a serious injury or accident, or a serious or medical condition which results in emergency medical treatment at a health facility or hospitalization, or death. A copy of the report shall be kept on file at the center. Ms. Nicholas provided the department with a written incident report within 72 hours of Child A’s injury. VIOLATION NOT ESTABLISHED

APPLICABLE RULE R 400. 5113c Child illness. (1) Parents shall be notified when the center observes changes in the child's health, a child experiences accidents or injuries, or when a child is too ill to remain in the group.

ANALYSIS: CONCLUSION:

Ms. Nicholas contacted Child A’s Mother when Child A told her that his arm was hurting. VIOLATION NOT ESTABLISHED

RECOMMENDATION Upon receipt of an acceptable corrective action plan, I recommend that the status of the license remain unchanged.
