Overview This contract is intended to cover the Department of Environmental Protection’s requirements for the operation of the Food Concession at Sherwood Island State Park, in Westport, CT. Scope of Services The scope of services being sought requires the successful Concessionaire to provide and maintain a food operation for the general public through a 3-year contract for the Building Concession at Sherwood Island State Park in Westport, Connecticut, as outlined in the criteria listed below. The contract period for the first year will be upon execution of the Concession Contract and the remainder periods will be from April 15th through September 30, 2010. The State reserves the right to renew the above noted building concession contract for two 1 -year periods. In exchange for use of the concession facilities at Sherwood Island State Park, the successful vendor will be expected to pay an annual use fee and undertake facility improvements (up to $8,000 annually under Item III.) The bid will be awarded to the vendor who demonstrates the ability to meet the requirements of this proposal and offers the highest annual use fee. I. Goals: Plans for updating the food service facility, such as: ¯ Upgrade and/or maintain Concessionaire locations, k/a: Main Pavilion Concession Building #1 and East Beach Concession Building #10, to meet State and City codes and approval of the Department of Environmental Protection. ¯ An itemized list of the type of equipment to be used within the facility. ¯ Detailed Inspection / Cleanliness program. !1. General: The proposed Concessionaire(s) is responsible for: 1. All aspects of the food service operation, including preparing and serving the food, consumables, supplies, clean up, trash disposal, and ensuring that any State or Municipally designated recyclables generated by the operation be recycled. As of 11/13/01 the state designated recyclables typically generated in this type of operation include but are not limited to: glass food containers, metal food containers, old corrugated cardboard, and old newspapers. For a complete list of state mandated recyclables visit the CT DEP website http://www.dep.state.ct.us/wst/recycle/recyfact.htm. For a list of locally required recyclables contact the municipality in which the operation is located. In general terms all equipment associated with the food concession operation must be provided by the concessionaire, i.e. refrigerators, freezers, stoves/grills, etc. Proposed Concessionaire(s) responsibilities include but are not limited to: electricity, propane, phone service, insurance (see Section IV), building maintenance and any other necessary expenses that may arise during the operation of the concession. There are two (2) Food Concession Buildings at Sherwood Island State Park. The proposed Concessionaire will be responsible for compliance with all applicable laws and regulations for a food service operation. 2. The proposed Concessionaire is to establish a system to ensure proper accounting and auditing practices. 6

The proposed Concessionaire will have quality assurance in terms of customer satisfaction, competitive pricing for products and services, and, in the case of food items, the availability of a variety of products and fully and properly balanced meals. III. Concession Building and Local Health Department Required Improvements: The proposed Concessionaire will be responsible for performing the specified work or hiring subcontractors in the various trades to perform such work and making direct payment for the services performed. Any improvements or permanent fixtures approved by the Department of Environmental Protection and provided by the proposed Concessionaire during the proposed contract term shall become the property of the State of Connecticut. The proposed Concessionaire will be responsible for completing the following work (up to $8,000 in value per year) in Concession Buildings #1 and #10, as indicated below: The proposed Concessionaire will agree to make the improvements during the contract term and if the total in each contract year does not equal $8,000.00, the difference shall be added to the annual use fee for that year. Prior to Memorial Day for the Calendar Year 2008: Clean the interior of the buildings as necessary to obtain acceptance and permit from the local health department. 2. Schedule an inspection of the fire suppression system and recharge it if necessary, so it will be deemed acceptable for use. 3. Any other items for repair that may be noted after the inspection has been completed by the local health department. It is responsibility of the Concessionaire to schedule the local health department inspection, in a timely fashion, in order for any required work to be completed prior to Memorial Day in the calendar year of 2008. 4. Replacement of all three sets of double industrial doors. 5. I set of double doors 76" wide by 88" high (for the rear of building) 6. 2 sets of double doors 63" wide 80" high (for front of building) Prior to Memorial Day for the Calendar Year 2009: East Concession Building: 1. Replacement of all 4 service counter tops (each top is 9 feet long) 2. Replacement of all wood trim around service windows (9’ x 4’ each window) 3. Replacement of all 6 roof support posts (each is 8’ tall x 6" square) 4. Replacement of both side doors (each 36" x 80") 5. Repair to concrete pad in front of concession bldg. Prior to Memorial Day for the Calendar Year 2010: 1. Addition of 12 cement based picnic tables for east concession area These tables are for sole use by the East Concession Building For specific details or questions on any of the improvements be prepared to discuss with the on-site Park Supervisor from Department of Environmental Protection PRIOR TO SUBMITTING A BID PROPOSAL. Time Frame: All work to be completed and accepted by the local health department and the Department of Environmental Protection as outlined in Section 111 above. The proposed Concessionaire will not be allowed to install vending machines in Sherwood Island State Park.

IV. Insurance: The successful Concessionaire must, without expense to the State, procure and maintain throughout the contract award term liability insurance, from insurance companies authorized to do such business in the State of Connecticut, coveting all services contained herein (Detailed in Attachment "A"). Before commencing the work, the successful bidder shall furnish a certificate or certificates, in form satisfactory to the Department of Environmental Protection (DEP), showing that it has complied with the requirements, which certificate or certificates shall state that the policies shall not be changed or canceled until thirty days written notice has been given to the Department of Environmental Protection. V. Correspondence, Business Information Changes: All correspondence regarding this contract should be directed to the address below. In the event that the awarded contractor company’s name and/or Federal Identification Number changes, and/or company moves and/or updates address and/or telephone number(s) and/or contact person, it is the contractor’s responsibility to advise the DEP, Bureau of Outdoor Recreation, State Parks Division of such changes in writing. The state will not be held responsible for payments or purchase orders, which are delayed due to additional routing caused by the lack of notification on the Concessionaire’s part. These updates shall be forwarded to: DEP Bureau of Outdoor Recreation, Division of State Parks and Public Outreach, 79 Elm Street, Hartford, CT 06106-5127. VI. Qualifications: Food Service Providers are expected to have sufficient experience, and be capable of providing a variety of food items.

VII. Mandatory Site Visit: The purpose of the site visit is to answer questions, familiarize each bidder with the site location and work areas involved and to familiarize you with the requirements of this request that could affect your performance or ability to make a valid proposal. The meetinlt will take olaee at a time and on a mutually reserved date with the Park Supervisor at the Sherwood Island State Park Concession Building, prior to the Bid Opening Date of April 18, 2008.

VllI. Selection Criteria: The following criteria will be considered when awarding this contract: ¯ Ability to meet requirements as outlined in the above referenced Sections noted in this Request for a Building Food Concession Proposal. ¯ The State will be awarding the concession contract to the proposed Concessionaire who provides the closest proposal that meets the Scope of Services and Goals as outlined above. The State will also base the award of the proposed concession contract by experience, the proposed rental amount and completeness of the bid submittal information. Therefore, the concession contract may not necessarily be awarded to the bidder offering the highest rental fee. All awarded bids shall be subject to the execution of a concession agreement, acceptable in form and content by the Commissioner, Deputy Commissioner or the Chief of the Bureau of Outdoor Recreation for the Department of Environmental Protection.
