Instructions to Bidders [ Second Call] SECTION –A 1) Scope of works The Director, College of Engineering, [An Autonomous Institute Govt. of Maharashtra] Shivajinagar, Pune .411005, (Employer) invites the tenders for Solar Water Heating System for Boys‟ Hostel at COEP as detailed in the table given bellow. 2) Qualification of the bidder: shall include :-

Reputed Contractors who dose not have a formal registration with any government body but having excellent proven work experience in this field can also be eligible. c) Copy of Income tax return for previous 3 years. d) Details of any litigation, current or during the last 3 years in which the bidder is involved, the parties concerned and disputed amount in each case. e) A Demand Draft towards the EMD of specified amount, drawn on any nationalized or scheduled Bank, against EMD in the name of „The Director, College of Engineering, Pune, should be deposited with this bid. 3) To qualify for award of the contract the bidder :

a) Should have satisfactorily executed [proof to be attached], as a main supplier/agency at least three similar assignments of Solar Water Heating systems. The value each one should not be less than Rs. 20, 00,000, or two similar assignments, each of value not less than Rs. 25,00,000 or one similar assignment of value not less than Rs. 40, 00,000/- in the last three years. Certified Xerox copy of the certificate / completion report from the concerned should be attached b) Bids from Joint ventures are not acceptable. c) Even though the bidders are pre-qualified, they are subject to be disqualified if they have: made misleading or false representations in the forms, statements and attachments submitted in proof of the qualification requirements; and/or record of poor performance such as abandoning the works, not properly completing the contract, inordinate delays in completion, litigation history, or financial failures etc.; and/or Participated in the previous bidding for the same work and had quoted unreasonably high bid prices and could not furnish rational justification to the employer. d) The tenders will be evaluated on technical qualification and reputations. After meeting the technical criteria, the most competitive response of the agency will the basis of award of the contract.

4) Bid price : a) The contract shall be for the complete work as described in the bill of quantities, drawing and technical specifications. b) Corrections, if any, shall be made by crossing out, with signature. c) All duties, taxes and other levies involved under the contract shall be included in the total price except Octroi. As applicable, employer will give Octroi exemption certificate(s) to the successful bidder, if required. d) The rates quoted by the bidder shall be fixed for the duration of the contract / satisfactorily completion of the project and shall not be subject to adjustment on any account. e) The rates should be quoted in Indian Rupees. f) The bidder shall bear all costs associated with the preparation and submission of his Bid, and the Employer will in no case be responsible & liable for those costs. g) The Bidder, at the Bidder‟s own responsibility and risk & cost, is encouraged to visit and examine the site of Works and its surroundings and obtain all information that may be necessary for preparing the Bid and entering into a contract for the Works.

For having clear and better idea of quantum and nature of work, prospective bidders are urged to visit the site with prior appointment and discuss the modalities beforehand. No payment is applicable during the period. i) The bidder should also quote separately for annual maintenance contact in percent of cost of the project. 5) Submission of Tenders a] Each bidder shall submit only one tender. 8) Information relating the evaluation of tenders & recommendations for the award of contract shall not be disclosed to bidders or any other persons not officially concerned with the process until the award to the successful bidder is announced. 9) Evaluation of Tenders The owner will evaluate & compare the tender determined to be substantially responsive i.e. which a) Meet the technical qualification & evaluation criteria specified. b)

10) Award of contract The Employer will award contract to the bidder whose tender has been determined to be substantially responsive and who meets the specified qualification criteria. Notwithstanding the above, the Employer reserves the right to accept or reject any tenders & to cancel the bidding process and reject all tenders at any time prior to the award of contract, without giving any reason thereof. 11) Performance Security Within 15 days of receiving letter of acceptance, the successful bidder shall deliver to the Director, College of Engineering, [An Autonomous Institute of Govt. of Maharashtra], Shivajinagar, Pune 411005, the performance security (Either a bank guarantee or a bank draft in favour of the employer) for an amount equivalent of 5% of the contract price. The performance security shall be valid till the expiry of the period of maintenance of the work, specified in the clause 12. 12) Period of Maintenance: The “Period of Maintenance (defect liability)” for the work is Three Years from the date of taking over possession. During the period of maintenance [Warranty period]; the contractor will be responsible for rectifying any defects in working. This will be done by the contractor at his own expenses.

(13) Special Conditions: 1. For Technical data / detail & specifications if in doubt /unclear /mismatch, the same are to be clarified with COEP: [email protected]., [email protected] 2. The employer reserves the option to allot the work partly or totally to single or different Contractors. The employer also reserves the right to supply some of the material. The scope of work for such items will be limited to erection only. 3. The employer reserves the right to call explanations from any bidder regarding the calculations / clarifications on any details. They may also visit the office of the bidder / various works carried out by him. The necessary Cooperation in this regard is envisaged from the bidder. 4. The Contractor is responsible for the due & proper execution of all the works as per terms & conditions stipulated under this Contract. The contracting agency should study the design details and understand clearly prior to quoting. The responsibility of performance will be with the contractor. 5. The contractor may have to use additional supports, materials, accessories, hardware, equipments, labor, etc. for proper execution & performance, required stability of complete system, fulfilling the design requirements, following best engineering practice, executing the additional instructions given by the employer during the work. No additional cost/charges will be paid for this. 6. The bidder shall make no changes in the tender form or in the specifications & schedule. 7. The employer/ their representatives shall have access to the workshop /Manufacturing facilities of the bidder so as to assure themselves of the quality of the material & workmanship. 8. The successful bidder [contractor] shall submit a detailed bar chart within 5 days of award of work. 9. In order to complete the work, within the stipulated time limit of contract , the contractor may have to work in more than one shift. 10. The contractor shall make their own arrangements for security of their materials / tools/labours, etc. 11. Employer reserve the right to split the items and scope of work without assigning any reason thereof. 12. In case of any controversy, the decision of the Employer shall be final & binding on contractor. 13. Verbal instructions given by the employer, if any, will be confirmed in writing by the contractor within 2 days & before execution thereof. 14. One qualified engineer/professional on behalf of contractor, capable of handling/understanding all the technical points & act accordingly, should be available on site at all the time. 15. In case of conflict in specifications or terms in tender/ drawings, general engineering practice, national & international codes, more stringent among the all will be applicable. 16. i.

All equipment shall be of professional grade suitable for long term, heavy-duty application and shall be as per recommended makes by the client.

ii.

Solar flat plate collector must have BIS approval as per IS: 12933(part 1) with amdt. No.1 & 2 and IS: 12933(Part 2)/2003. Collector box top cover plate should be of toughened glass with thickness of 4.0 mm (min.) Finned tube absorber made of copper

iii.

Sheet and copper tube. Desirable weight of a single collector box will be 45-48 kg. Bottom side of the collector box should be insulated with rock wool of 48-kg/m3 density. Gaskets and Grommets shall conform to sec.5 of IS: 12933 (pt-2)/2003. Insulated hot water storage tank size for each system will be as per the requirement of each hostel considering 10% buffer. The thickness of the water storage tank shall be uniform. The tank shall be non-pressure type and made of SS-304 with sacrificial anode. Tank insulation must be rock wool of density 48 kg/m3 with (more than 100 mm thick) appropriate thickness clad with aluminum sheet outside. Robust tank stand assembly shall be made of MS angle or tubular structure with Powder coating shall be provided.

iv.

The work shall be carried out as per specifications. Any deviations from the Specifications, either on account of manufacturing or installation practices or for any other reasons, shall be clearly mentioned in the separate letter explaining in detail each and every departure the contractor proposes to make from the tender specifications. Unless specifically mentioned it will be considered that the bidder agrees to supply all equipment as specified. No deviation is accepted unless it is approved by the employer.

v.

The layout and installation of the equipment shall be carried out confirming the best engineering practices.

vi.

The installation of the various equipment and wiring shall be such as easily accessible for maintenance and routine checkups.

vii.

The rates quoted for various items included in this tender, shall be inclusive of the cost of necessary framework, scaffolding, lifting of materials etc.

viii.

The contractor shall furnish the following in due course a. Drawings showing complete connection layout of the equipments.

b. As built wiring diagram. c. Original catalogues & manuals of equipments. d. Performance test reports by performing all requited tests. e. Operating instruction sheets/Manuals. ix.

The contractor shall guarantee that all the equipment shall be free of defects and that equipment shall operate satisfactory and that the performance and efficiencies of the equipment shall not be less than the guaranteed values.

x.

The guarantee of the total system shall be Onsite & the guarantee period shall not be less than 36 months or the period of guarantee offered by manufacturer, whichever is the maximum from the date of completion & handover of the system.

xi.

Important: All the Solar Water Heating Systems shall be warranted for a minimum period of 3 years from the date of installation and commissioning against any manufacturing and design defects,[ which includes material, spare and service ] .

* 3500 LPD to ‘C’ block through hot water transportation system refer fig No.7 and *2500 LPD to’ D’ block through hot water transportation system refer fig No.7 (16) Important Note Important note about hot water transportation from Hostel block ‘I’ to Hostel block ‘C’ and ‘D’: It is planned to supply hot water to „C‟ and „D‟ from „I‟ as shown in Fig.5,6 and 7.The approximate distances and location of „C‟ and „I‟,„C‟ and „D‟ are shown in the same fig. The bidder is required to lay insulated hot water piping (B class G.I.Pipe) as per the scheme mentioned in fig. 7.A single pipe of 1.5 inch diameter will carries hot water from I‟, to „C‟. A single pipe of 1 inch diameter will carry hot water From „C‟ to „D‟ Before casting the concrete for mounting „C‟ channel pillars, the steel bar for concrete must be welded to steel bar in the slab of present terrace. Similar method is to be used for anchoring wire rope (multi strand) to the terrace which supports the pillar. One turn buckle is necessary in one wire rope for adjusting the tension. Proper clamping arrangement is necessary to install the turn buckle and ends of the wire rope to pillar and hot water pipe. No welding is allowed at GI hot water pipe for clamping purpose. Steel Wire Rope Slings must adhere for dimensional accuracy and high strength. Mechanical Splicing / Hydraulic Pressing - Steel Wire Rope is formed into both ended looped sling and locked using an aluminum compound Ferrule which is further subjected to load under a hydraulic press of suitable capacity exerting exactly the desired load according to the rope Dia. This results in a permanent locked ferrule thereby forming the loop. This procedure is in adherence to IS5245 Party II. Manual Splicing / Hand Splicing - A sling is locked manually using its own strands interlocked to form a permanent loop. ARTICLES OF AGREEMENT 1)

This deed of agreement is made in the form of agreement on _______________day __________________ month _____________200___________, between (the referred to as the first party) and _____________________ (Name of the contractor), S/O ___________________ resident of _________________(hereinafter referred to as the second party), to execute the work of construction of _____________________ (hereinafter referred to as works) on the following terms & conditions.

5) Notice by Contractor to Engineer The second party, on the works reaching each stage of installation, issue a notice to the first party or the Engineer nominated by the first party (who is responsible for supervising the contractor, administering the contract, certifying the payment due to the contractor, issuing & valuing variations to the contract, awarding extensions of time etc.) to visit the site for certification of the stage completion. Within 15 days of the receipt of such notice, the first party or the contractor nominated by it, will ensure issue of stage completion certificate after due verification. 6) Completion time The work should be completed in Two months from the date of this Agreement. In exceptional circumstances, the time period stated in this clause may be extended in writing by mutual consent of both parties. 7)

If any of the compensation events mentioned below would prevent the work being completed by the intended completion date, the first party will decide on the intended completion date being extended by a suitable period : a.

The first party does not give access to the site or a part thereof by the agreed period.

b.

The first party orders a delay or does not issue completed drawing, specifications or instructions for execution of the work on time.

c.

Ground conditions are substantially more adverse than could reasonably have been assumed before issue of letter of from information provided to second party or from visual inspection of the site.

d.

Payments due to the second party are delayed without reason.

e.

Certification for stage completion of the work is delayed unreasonably.

Any willful delay on the part of the second party in completing the construction within the stipulated period will render him liable to pay liquidated damages. @ 0.5 % of the total work value per weak, this will be deducted from payment due to him. The first party may cancel the contract and take recourse to such other action as deemed appropriate once the total amount of liquidated damages exceeds 5% of the contract amount.

9) Duties & responsibilities of the first party a)

The first party shall be responsible for providing regular & frequent supervision & guidance to the second party for carrying out the works as per specifications. This will include written guidelines & regular site visit of the authorized personal of the first party, for checking quality of material & construction to ensure that it is as per the norms.

b)

Possession of the site will be handed over to the second party within 10 days of signing of the agreement.

c)

The engineer or such other person as may be authorized by the first party should be meeting once in a week where a second party or his representative at site will submit the latest information including progress report & difficulties if any , in the execution of the work. The whole team may jointly inspect the site on a particular day to take stock of activities.

e)

The engineer shall record his observations/instructions at the time of his site visit in a site register maintained by the second party. The second party will carry out the instructions & promptly rectify any deviations pointed out by the engineer. If the deviations are not rectified, within the time specified in the engineer‟s notice, the first party as well as the engineer nominated by it, may instruct stoppage or supervision of the construction rectified at the cost of the second party.

10) Duties & Responsibility of the second party. The second party shall: a)

Take up the works & arrange for its completion within the time period stipulated in clause 6;

b)

Employ suitable skilled persons to carry out the works;

c)

Regularly supervise & monitor the progress of work;

d)

Abide by the technical suggestions / direction of supervisory personal including engineers etc. regarding building construction;

e)

Be responsible for bringing any discrepancy to the notice of the representative of the first party & seek necessary clarification;

f)

Ensure that work is carried out in accordance with specifications, drawing & within the total of the contract amount without any cost escalation;

g)

Keep the first party informed about the progress of work;

h)

Be responsible for all security & watch & ward arrangements at site till handing over of the project to the first party.

i)

Maintain necessary insurance against loss of material / cash etc. or workman disability compensation claims of the personal deployed on the works as well as third party claims.

j)

Pay all duties, taxes and other levies payable by construction agencies as per law under the contract (First party will effect deduction from bill in respect of such taxes as may be imposed as may be under the law)

11) Variations / Extra Items

The works shall be carried out by the second party in accordance with the approved drawing & specifications or directives from the engineer in –charge. 12) Securities The Performance Security shall be provided to the Employer no later than the date specified in the Letter of Acceptance and shall be issued in an amount and form and by a bank or surety acceptable to the Employer, and denominated in Indian Rupees. The Performance Security shall be valid until a date 28 days from the date of expiry of Defects Liability Period [ 3 Years] and the additional security for unbalanced bids shall be valid until a date 28 days from the date of issue of the certificate of completion . 13) Termination 13.1) The Employer may terminate the contract if the other party causes a fundamental branch of the contract. 13.2) Fundamental branches of contract include, but shall not be limited to the following (a)

The contractor has stopped the work for 15 days & stoppage has not been authorized by the engineer.

(b)

The contractor has become bankrupt or goes into liquidation other than for a reconstruction or amalgamation;

(c)

The engineer gives notice that failure to correct a particular defect is a fundamental branch of contact & the contractor fails to correct it within a reasonable period of time determined by the engineer.

(d) The contractor does not maintain a security which is required; 13.3) Notwithstanding the above, the Employer may term the contract for convenience.

14) Payment upon Termination 14.1 If the contractor is terminated because of a fundamental branch of contract by the contractor, the engineer shall issue a certificate for the value of the work done less advance payment received up to the date of the issue of the certificate, less than other recoveries due in terms of the contract, less taxes due to deducted at sources as per applicable law. 14.2 If the contract is terminated at the Employer„s convenience, the engineer shall issue a certificate for the value of the work done, the responsible cost of removal of equipment, repatriation of the contractor„s personal employed solely on the works & the contractor‟s costs of protecting & securing the work & less advance payments received up to the date of the certificate, less other recoveries due in terms of the contract & less taxes due to be deducted at source as per applicable law. 15) Dispute settlement If over the works, any dispute arises between the two parties, relating to any aspects of this Agreement, the parties shall first attempt to settle the dispute through mutual & amicable construction. In the event of agreement not being reached, the matter will be referred for arbitration by a sole Arbitrator not below the level of retired Superintending Engineer, PWD to be appointed by the first party. The Arbitration will be conducted in accordance with the Arbitration & Conciliation Act 1996. the decision of the Arbitrator shall be final & binding on both the parties.
