ince my last report to you in our newsletter much has happened. Although some of the projects we have been working on together continue to move forward I am pleased to be able to say that we have made solid progress.

That agreement provided Local 30 members with benefits security and wage increases over the next two years. In addition, there were changes to the contract language which will

At the City of Hope our contract negotiations continue to move forward. Meetings with the employer have been productive and we anticipate a settlement of our issues very soon.

Kaiser San Diego and CSC Ratify New Two Year Agreement

T

he National Agreement reached in late May and recommended by the National Delegate’s Conference in mid June has been ratified by Local 30 members in a unanimous vote. The packages voted on by members in both the KP San Diego and California Service Center (CSC) units included local contract extensions for two years as well as the terms of the new National Agreement. Voting took place June 29th for CSC and July 1st for Kaiser San Diego. The contract includes 3% across the board wage increases for each of the two years of the agreement, funding for the educational funds, PSP, and the LMP, and language changes to enhance and strengthen accountability, continue to build high performing Unit Based Teams, and further support the work of Partnership. This agreement also protects all health care and pension benefits throughout this contract with no reductions in any benefits for Local 30 members. The parties have agreed to meet

and discuss ways to reduce benefit costs going forward in order to prepare for 2012 bargaining. “Our members at KP and the CSC were very clear about their priority for this round of negotiations with their employer; please protect our benefits above all else,” stated Local 30 Executive Director Walter Allen. “I am pleased to report that we did just that, and managed to get pay raises as well. These are difficult times for everyone and KP is in the same boat as their competitors. But while other employers are cutting benefits, shifting costs to employees, and limiting wage increases if not reducing wages, KP continues to lead the way and live up to the promises of Partnership. I am very pleased with this outcome and now we know our members are too.”

inally, summer! These past few months have been among the busiest Local 30 has had in recent years. Between the National bargaining for the KP and CSC units, the USC and City of Hope bargaining, the contracts being negotiated in Arizona, and the International Union convention, our officers and staff have been at it day and night. I would like to recognize them all for their dedication and commitment to all of our causes and to our members’ needs. You will read more about the progress of these negotiations in the Executive Director’s Report in this edition but I would like to mention that, once again, Local 30 members at KP and CSC have done very well at the bargaining table. As a member of the Common Issues Committee (CIC), the committee of leaders at the bargaining table in National Bargaining, I was once again proud of Local 30 for the leadership role our Union played in these talks. In this round of bargaining the CIC was expanded to include rank and file members, some 150 members Continued on page 2

It’s Time For Us To Lead, Says August

ohn August, Executive Director of the Coalition of Kaiser Permanente Unions (CKPU), told delegates that OPEIU is an extremely influential union. “OPEIU definitely impacts the labor movement, well beyond its size,” said August. “Your influence in the labor movement is known every-

where, and you have greatly influenced my life and everyone that I work with, so thank you for your dedication.” August then spoke about the Kaiser model, a very different model of health care delivery in the United States. “What separates it from other models is its working relationship with member unions through the CKPU,” said August. OPEIU is a founding member of CKPU and represents Kaiser employees in Local Unions 2,17,29,30 and the new affiliate, HNA/OPEIU Local 50. “The union role in health care is to be part of the solution, not

he OPEIU International Union Convention was held June 21st thru 25th in Washington, DC to conduct the business of the union. The every three year event includes delegates from all the local unions of the International union including of course our own Local 30. The work of the convention included the passing of constitutional amendments, resolutions, and statements and policies that will govern the union in the coming three years. In addition, election of officers were held for the President, Secretary-Treasurer, and International Vice Presidents from the various regions of the country.

from across the country were assembled to be a part of these historic negotiations. As before, Walter Allen led bargaining for Local 30 along with Vice President Cathy Young and I. After many very long sessions and much discussion, a deal was reached. The high point of this contract was clearly no benefit changes, especially no reductions. I want to thank Walter for standing by us as we resisted any effort to roll back the clock on us, and for making sure that at the end of the process we also received wage increases that will help us to take care of our families in the years of this agreement. Our International Union convention was held in late June in Washington, DC. The business of the convention included resolutions and statements about organizing, political action, jobs, wage and benefit protections, and many more issues of importance to all union members. We heard from great speakers such as Clayola Brown of the A. Phillip Randolph Institute, Stephanie Miller of the ‘Stephanie Miller Show’ on satellite radio, Arturo Rodriguez, President of the United Farm Workers Union, and John August of the Coalition of Kaiser Permanente Unions to name a few. One of the most important events of the convention was certainly the election of officers and I am happy to report that President Mike Goodwin was re-elected without opposition. Mike has always been a great friend of Local 30 and we are pleased that he will continue to lead our International Union for the next three years. I am also very pleased to announce that our own Walter Allen was reelected to his position of International Vice President for Region V. Walter has been our Regional VP for OPEIU since 2002 and will also continue in that role for the next three years. Congratulations to Walter and to Mike. There is always more to do, but for now at least, I hope our team will enjoy the success we have had this year, rest up, and be ready for the next challenge. Enjoy your summer.

What’s Up In L.A./Arizona? Phoenix Rally Opposing the SB 1070 Bill Linda Winters

n Saturday, May 29, 2010 over 30 thousand people of all races and from all over the United States came to Phoenix to rally opposing the SB 1070 bill. Sarahi Uribe who is a representative of the National Day Laborer Organizing Network, which is based in California, helped organize the event. There was a Medicine Man from the North Dakota Indian Tribe who stated, “Today the eagle said it is a good day to protest.” There was an Indian Ceremonial Dance to bless the people who were at the rally. Richard Trumka from the AFL-CIO spoke about the climate of fear Arizona’s immigration enforcement has created and that the immigrants are not the cause of America’s problems. I met people from all different Unions from all over the United States such as Teamsters, Pipe Fitters, IBEW, CWA and Carpenters. I also proudly wore my Union Colors and thanked my Union brothers and sisters for coming to Phoenix for this cause. This law is not good for anyone. It discriminates against all Hispanic people, it hurts businesses, and it does not solve the immigration problem in the U.S. In closing, as the Reverend Warren Stewart of the First Institutional Baptist Church directed his comments to President Obama when he said, “God put you in the White House. You are a person of color. Stand with us.”

Local 30 Wins New Unit in Arizona

W

hen the supervisory employees at Veolia Transportation Company in Tempe, Arizona decided to join a Union, they chose OPEIU. Local 30 Business Agent Mark Bailey received the call and immediately followed up. Their issues included the usual; wages, benefits, and hours of work, but the most important concerns the group had were around job duties, safety, and respect on the job. After several meetings with the workers Local 30 filed a petition with the NLRB, an agreement was reached, and the election was scheduled. On April 4, 2010 the election was held and when the ballots were counted OPEIU, Local 30 had won the unit overwhelmingly. “These workers provide support and some oversight for the bus drivers in the Tempe unit,” reported Bailey, “Until now, they were the only workers who were not unionized and as a result are paid less, have fewer benefits, and faced numerous issues with their managers with no right to contest any decisions made.” “We had a united vote that made the company take notice,” said bargaining unit member Vernon VanPatten. “Nothing is impossible when you are persistent,” stated committee member Evelyn Brown.

Members of the Bargaining Committee are Franklyn Robertson, Vernon VanPatten, Perren Roberts and Markus Hines. Other Committee Members are Evelyn Brown and Robert Bean to name a few. “We are delighted that these employees have chosen Local 30 to help them improve their situation and look forward to having them be part of our union,” said Executive Director Walter Allen. The process of collective bargaining is now underway and the parties are at the table discussing the terms of a first agreement.

n April 17, 2010 at IBEW Local Union 266’s Annual Picnic, Office Manager Linda Long was honored for her thirty (30) years of service to Local 266. Linda was hired on January 21, 1980 as an Administrative Assistant and became Office Manager on May 1, 1998. Linda’s last day was April 29, 2010 and will be available for end of fiscal year assistance and training as well as training on the Labor Management Report, L/M 2. As an OPEIU Local 56 member, Linda held numerous officer positions and served Local 56 without pay for over 18 years negotiating numerous contracts and assisting members. After the merger of Local 56 with Local 30 she continued to serve as a steward. As Linda told the officers, members and stewards at the IBEW Local 266 picnic; “Serving the members and stewards has taught me a lot about unions and their many, many benefits and I have enjoyed assisting and working with you all.” She further stated “With union wages, paid healthcare, a pension and a 401(k) plan, you can not beat a union job.” 3

There is no estate tax in 2010 due to the inaction of our federal government, so you may want to review your trust to make sure you have the right language in your funding clauses in light of this change. In 2010 there is also no step-up in basis as of date of death for assets with more than a 1.3 million in gain or 3 million for community property of a surviving spouse. Unless the rules change in 2011, many beneficiaries will inherit the basis of the decedent and will have to pay a capital gains tax on the sale of the asset. These rules are likely to change in 2011, so it is imperative you stay tuned to what happens in 2010. Further, the consultation can be used to make sure you have properly funded your trust and that your beneficiary designated accounts are in order. If you have acquired new assets or have set up a new business entity, such as a limited liability company or corporation, then you should make sure these assets are properly coordinated with your estate plan as well as proposition 13. Maintaining your trust or upgrading from a will to a trust is extremely important as time goes by and changes occur in life. If a loved one has passed away and they had a trust, it is important to have an attorney review the trust and give advice on trust administration matters. The consultation can be used for initial trust administration matters. Also, if you are a beneficiary of a trust and the trustee is not following his or her fiduciary duties, then you should consult with an attorney to see what your rights are. Finally, if a loved one has passed away and they only had a will, no estate planning or had assets that were not titled in the trust, there may be a probate proceeding or some other court proceeding to transfer the assets to the beneficiaries, heirs or trust. Meeting with an attorney early on in this process is critical to avoid unnecessary delays, costs, taxes, litigation and other problems associated with probate. On the organizing front, I am very pleased to announce that Local 30 has won an NLRB election to represent transportation workers in Tempe, Arizona. These supervisory level employees working for Veolia Transportation Company have just begun the process of bargaining for their first contract. Congratulations to Local 30 Business Agent Mark Bailey for all his hard work to bring this unit into Local 30. We continue to settle in to our new San Diego offices at 6136 Mission Gorge Road, the building that we purchased last January. Our improvement plans continue to move

This year that was the desire of our members from all locations. The language changes we wanted to talk about locally and any other improvements we may have wanted will have to wait until next time. Protecting everything we have now and getting a raise were the main goals for this committee.” Local 30 members of the Common Issues Committee (CIC), the National Bargaining

At our International Union convention last month Delegates re-elected our International President Mike Goodwin and SecretaryTreasurer Mary Mahoney to new three year terms. Local 30 congratulates them both and looks forward to continuing the progress we have made together. In addition to the elections the Delegates approved a number of resolutions, policy, and constitutional changes. One very significant highlight of the convention was the presentation of a charter to the Hawaii Nurses Association (HNA) making them OPEIU, Local 50. The HNA, already a part of the Coalition of Kaiser Permanente Unions decided to affiliate with OPEIU to Seabiscuit. So make plans now to join your Local 30 sisters and brothers as they enjoy another great day together, and a chance to be a big winner too. Watch for the flyer for this event coming soon. Also coming soon we will be calling on Local 30 members to help with another appeal from our Charity Fund. The United Farm Workers Union (UFW) which Local 30 has helped before is in dire need of support from all union members. As you know these low wage workers who provide the food we eat every day work under some of the most extreme conditions and for few Team in addition to Walter Allen included President Marianne Giordano, Vice President Cathy Young. Field Director MaryEllen Farrell and Senior Business Agent Annette Baxter were also involved in the process for Local 30. Finally, I too would like to add my congratulations to our KP and CSC bargaining committees for their work on the National and local agreements just ratified by our members. 2010 Local 30 Scholarship Fund Purpose: To generate funds to be distributed to Local 30 members and dependents for assistance with the high costs of higher education. Eligibility: Any member-in-good-standing in OPEIU, Local 30, or members of the Local 30 member’s immediate family including domestic partner, children, stepchildren, spouse, grandchildren, siblings, or stepsiblings who are accepted to and attending any accredited College or University the next fall. Process: In July of each year a notification letter, accompanied by an application will be sent by mail to each member in-good-standing in Local 30. All members of Local 30 are invited to submit an application for each eligible family member by the due date noted on the notification letter. All applications must be returned to the Local 30 office at the address listed on the notification letter. Applications will be kept in separate pools by San Diego membership and Los Angeles/Arizona memberships. A lottery style drawing will be conducted at the regular membership meetings in October. Two (2) winners will be drawn from the San Diego area pool and one (1) from the Los Angeles/Arizona area pool. Upon completion of the initial drawings, remaining applications will be combined and three (3) additional winners will be drawn. Each award will be in the amount of $1,250 and will be paid directly to the student to cover school related expenses. Winners need not be present to win, notice will be sent to all winners, and the information including the list of winners, will also be posted in the following edition of the Local 30 Newsletter. The Local 30 Scholarship Committee will report the results at the following meeting of the Executive Board. Rules: 1. Each award is a one-time, annual award and may be applied for each year while attending College. 2. All award checks will be drawn on the Local 30 Scholarship Fund and be made payable to the winner of the award. 3. Local 30 reserves the right to settle any disputes, which may arise out of the process through its Scholarship Committee. 4. Applications will be reviewed to assure member-in-good-standing status for the Local 30 member submitting the application. In the event that the member is not in good standing they will be notified and given the opportunity to correct any issues. Proof of attendance/acceptance at an accredited College or University shall be required with applications. 5. Local 30 members may submit as many applications as they have eligible family members. Each applicant shall be entitled to one (1) application each year. Duplicate applications will be eliminated from the drawing. 6. The drawing will be conducted by members of the Scholarship Committee in the presence of the members at the October meeting. 7. The drawing will consist of rank-in-file members of the union being asked to reach into the box of applications and randomly removing a single application. This process will be repeated six (6) times, one for each award. 8. Winners will be informed by the Scholarship Committee by letter within ten (10) days of the drawing. Arrangements will then be made to present the check to the winner and the eligible Local 30 member. 9. All records of the Local 30 Scholarship Fund will be kept in accordance with the US Department of Labor regulations and be included in the financial reports of the Chief Financial Officer of the union. Members are encouraged to apply on behalf of themselves or an eligible family member and return the application to the Local 30 office no later than September 30, 2010.
