Agents Entitlement to the Agent s Selling Fee (a) The Selling Fee will be payable upon settlement of a transaction if during the Authority Period: (i) at any time a buyer introduced by the agent to the seller or the property, contracts to buy the property, or gets another person or entity to buy the property or otherwise becomes a legal or beneficial owner of the property; or (ii) The Property is sold to a buyer in and of the above circumstances but settlement does not occur due to fault of the Seller. 6. The Agent may also use such information collected to promote the services of the Agent and or seek potential clients. The Agent may disclose information to other parties including media organisations, on the internet, to potential buyers, or to clients of the Agent both existing and potential, as well as to parties engaged to evaluate the property, owners corporations government and statutory bodies and financial institutions. Further, the Agent may disclose the information to other real estate and business agents who may in the future be purchasing or considering purchasing the Agents real estate business or other goodwill portion of that business. The Agent will only disclose information in this way to other parties who are required to perform their duties under this Agreement, to achieve the purposes specified above or as otherwise allowed under the Privacy Act 1988. If the Seller would like to access this information they can do so by contacting the Agent at the address and contact numbers contained in this agreement. The Seller can also correct this information if it it inaccurate, incomplete or out-of-date. Real estate and tax law requires some of this information to be collected. If the information is not provided the Agent may not be able to act effectively on the sellers behalf or at all.

The $99 Monthly fee is paid in advance for the whole month and is referenced as the ‘billing cycle’. The billing cycle runs from the date your advertisement is published on the internet and falls due on that same date for each following month. There are no pro rata payments for the Monthly fee. Failure to pay the ongoing monthly fees will result in your property being removed from our service.

In accessing this website, you acknowledge that data transmission and storage over the internet, including via this website, cannot be guaranteed to be secure and accordingly myHOMEisforsale does not warrant the security of any information you transmit.

All charges are inclusive of GST. Term

There is no minimum term for sign up. The property will be listed until it is sold or we are instructed by you to remove the listing. All requests to remove listings must be addressed to [email protected]. You will need Javascript to view this email address. We require at least 5 business days notice of your request to remove a listing. A failure to give the required notice will result in you being charged the next monthly fee of $99. 4.

Any failure by myHOMEisforsale to enforce a provision of these terms and conditions shall not constitute a waiver or affect the validity of these terms. In the event of any term or condition being held to be invalid, illegal, unlawful or otherwise being Incapable of being enforced, that term or part thereof shall be deemed to be severed and of no force and effect and the remaining terms and conditions shall remain valid and enforceable.

To access your client profile you will be issued with a username and password (UNPW). Once you log in you will be able to make changes to your listing, update inspection times, amend property descriptions and upload or change photography.

The parties warrant they have the authority to enter into this agreement. 12.

myHOMEisforsale must verify all uploads and amendments to all profiles. This process can take up to 2 business days. 5.

myHOMEisforsale assists the Seller to conduct a private sale of their property by providing marketing services does not act on behalf of the seller in relation to a sale.

General Terms Your use of this site is governed by the laws of Victoria and you agree to submit to the non exclusive jurisdiction of the Courts of Victoria.

You should immediately notify myHOMEisforsale if you consider that someone has accessed your client profile without your authorisation.

Website Security Policy myHOMEisforsale does not warrant the accuracy, completeness or suitability of any information provided on this website and excludes to the fullest extent permissible by law liability for any error, inaccuracy or omission contained on this website or any information provided by myHOMEisforsale.

The Listing fee is charged once and includes all administration charges in creating the property profile for you, including creating online advertising campaigns.

Customer Direct Debit Request (DDR) Service Agreement This is your Direct Debit Service Agreement with MY HOME IS FOR SALE (314011) 26 107 491 337. It explains what your obligations are when undertaking a Direct Debit arrangement with us. It also details what our obligations are to you as your Direct Debit provider. Please keep this agreement for future reference. It forms part of the terms and conditions of your Direct Debit Request (DDR) and should be read in conjunction with your DDR authorisation.

Debiting your account By signing a Direct Debit Request or by providing us with a valid instruction, you have authorised us to arrange for funds to be debited from your account. You should refer to the Direct Debit Request and this agreement for the terms of the arrangement between us and you. We will only arrange for funds to be debited from your account as authorised in the Direct Debit Request. or We will only arrange for funds to be debited from your account if we have sent to the address nominated by you in the Direct Debit Request, a billing advice which specifies the amount payable by you to us and when it is due. If the debit day falls on a day that is not a banking day, we may direct your financial institution to debit your account on the following banking day. If you are unsure about which day your account has or will be debited you should ask your financial institution.

Amendments by us We may vary any details of this agreement or a Direct Debit Request at any time by giving you at least fourteen (14) days written notice.

Your obligations It is your responsibility to ensure that there are sufficient clear funds available in your account to allow a debit payment to be made in accordance with the Direct Debit Request. If there are insufficient clear funds in your account to meet a debit payment:

you may be charged a fee and/or interest by your financial institution;

you may also incur fees or charges imposed or incurred by us; and

you must arrange for the debit payment to be made by another method or arrange for sufficient clear funds to be in your account by an agreed time so that we can process the debit payment.

You should check your account statement to verify that the amounts debited from your account are correct.

Dispute If you believe that there has been an error in debiting your account, you should notify us directly on 1300588200 and confirm that notice in writing with us as soon as possible so that we can resolve your query more quickly. Alternatively you can take it up directly with your financial institution. If we conclude as a result of our investigations that your account has been incorrectly debited we will respond to your query by arranging for your financial institution to adjust your account (including interest and charges) accordingly. We will also notify you in writing of the amount by which your account has been adjusted. If we conclude as a result of our investigations that your account has not been incorrectly debited we will respond to your query by providing you with reasons and any evidence for this finding in writing.

your account details which you have provided to us are correct by checking them against a recent account statement; and

with your financial institution before completing the Direct Debit Request if you have any queries about how to complete the Direct Debit Request.

Confidentiality We will keep any information (including your account details) in your Direct Debit Request confidential. We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information. We will only disclose information that we have about you:

to the extent specifically required by law; or

for the purposes of this agreement (including disclosing information in connection with any query or claim).
