2. Fertilizer and Chemicals - The use of any fertilizer (natural or artificial) or any chemical including but not limited to weed killer and/or pesticide is prohibited anywhere on one’s property. Except for the use on flowers or gardens, plants set back a minimum of 100 feet from the shoreline. 3. Watercraft with/and Trailer - No boat and/or its boat trailer shall be allowed to enter Fence Lake waters unless it has been washed with a bleach and water mixture and rinsed thoroughly. Owners are encouraged to sanitize all watercraft and trailers before transporting them to Fence Lake. This procedure is required to prevent the introduction of Zebra Mussels, foreign algae or other foreign invasive species from entering Fence Lake. 4. Watercraft Contents Prior to launching any watercraft, all water and/any liquid held within that watercraft must be drained away from the boat launch area. If your boat is equipped with a bilge pump you must drain and sanitize any tank and/or water line with a bleach/water mixture prior to bringing the boat to Fence Lake. 5. Plants - The planting of non-native plants (plants not found within the Fence Lake eco-system) within 100’ of the Fence Lake Shoreline is prohibited. Planting invasive specie (i.e. purple loosestrife, buckthorn, garlic mustard, etc.) is prohibited anywhere within our Fence Lake boundaries. 6. Bait - The use of live minnows procured from any source outside Fence Lake is prohibited. Fishermen are required to dispose of all unused live bait (worms, leeches) away from the water. Under no circumstances shall unused live bait be disposed of in Fence Lake. 7. Fish Species - The introduction of any foreign fish species into Fence Lake is prohibited. 8. No Wake Hours - There shall be no wake before 10:00 a.m. or after 5:00 p.m.

9. Decal for Watercraft - All watercraft is required to display a Secluded Shores decal. Decals are available to owner watercraft only through the Fence Lake Owner’s Association. 10. Unauthorized Users All unauthorized boaters, fisherman, or other persons found within the boundaries of the Fence Lake property are subject to arrest for trespass. 11. Guests - An association member may allow family and friends (“guests”) to use their property and the lake without the owner being present provided that: a) The guest abides by all association restrictions and rules including but not limited to the use of “authorized watercraft bearing a Fence Lake property sticker”; and b) The use is for noncommercial purposes only; there shall be no rental fees charged for the use of the property; and c) In the event of a rule violation the owner shall be responsible for and subject to those sanctions currently specified by the enforcement rule. 12. Outhouses – There shall be no outhouses permitted at Fence Lake unless prior approval is obtained from the Baraga County Health Department. Provided, however that in no event shall an approved outhouse be: (a) (b) (c) (d)

Visible from the lake; Placed within 100 feet of the lake shoreline; Constructed of other than natural material; Exceed 4’x4’x7’ in size.

All existing outhouses which do not conform to the requirements above shall be removed by their owners no later than October 1, 2008. All owners are urged and encouraged to feasibility of portable composting toilets installation of a vaulted outhouse.

13. Sheds – In recognition of that fact that limited storage is often necessary prior to construction of a home and appurtenant garages, sheds shall be allowed, provided that: (1) 2

Size shall not exceed 8 feet x 12 feet. No concrete pads shall be poured. Height of wall shall not exceed 8 feet. Roof pitch shall be 6/12. Set back from the lake shall be a minimum of 100 feet. Building shall not be visible from the water. Natural building materials shall be utilized in construction. No plumbing shall be allowed to or inside building.

Architectural

Shoreline Buffer Zone – In recognition of the fact that:

Maintaining the quality of the water in Fence Lake is critically important to all owners and that in order to control what flows into the lake by runoff and drainage a buffer zone is essential and because the removal of shore trees and shrubs expose the adjacent shallow water to more sun and to increased sediment and phosphorus runoff and to increased light and Warmer water and additional nutrients result in increased algae and nuisance plant growth which in turn leads to less water clarity, the following rules shall be strictly enforced: (a) 50 Feet Buffer Zone - All owners shall required to maintain a minimum of fifty (50) feet natural setback (buffer zone) from the water’s edge;

(b) 10 Feet Width Access - A maximum of ten (10) feet width clearing shall be allowed to access the lake for a dock or otherwise;

Cutting from within the buffer zone

Owners shall be allowed a limited amount of cutting within the fifty (50) foot buffer zone in order to create “a view” provided that: (i) utilized removal;

(ii) an unlimited amount of dead trees or brush may be removed; (iii) under no circumstances shall hardwoods, (i.e. oak, maple, hickory, beech, etc.) or white pine be removed from within the fifty (50) foot buffer zone; (iv) under no circumstances shall more than five (5) percent of the allowable species (non hardwoods, i.e. fir etc.) be removed from the fifty (50) foot buffer zone; (v) in the event that a tree is removed, the stump shall remain in place, leaving the soil intact as near as possible to prevent erosion. (vi) under no circumstances shall any shoreline opening be created larger than the 10’ width for a dock/path as noted in Rule 14(b) above. (vii) an area not to exceed 300 square feet shall be allowed to provide a dock storage area, boat lift storage area, canoe/kayak rack or shoreline use area. (d) Paths - Lake shore access/paths shall be a permeable surface. In order to reduce runoff into the lake and to maintain aesthetics, straight access areas/paths are prohibited without ARC approval. In such cases the ARC may require runoff protection or grading to reduce runoff. (e) Fertilizers - The use of fertilizers, both artificial and natural, within the buffer zone is strictly prohibited. (See Rule 2 above.) 4

(f) Sand/Gravel - No sand, gravel or other unnatural materials shall be added within the buffer zone. DEQ prohibits depositing any sand/gravel into the water. (g)

Motorized Vehicles/ATV’s

Motorized vehicles operated within the fifty (50) foot buffer zone shall be prohibited except that an owner may operate an ATV on a limited basis in order to perform a specific task (i.e. moving heavy objects). Permitted use is confined to the access path and is limited to maintenance needs and access for those with disabilities. No other motorized vehicles shall be operated within the fifty (50) foot buffer zone. (h) Docks Only non-permanent docks shall be installed and may not exceed forty (40) feet in length. Any variance from the above shall be by Architectural Review Committee approval only. (i) Lighting - All proposed dock lighting must be approved in writing by the architectural review committee prior to installation. (j) Remediation - Compromise of the setback or buffer can have a significant impact for all landowners on the lake. Since the impacts on water quality and wildlife are cumulative, specific time limits for addressing violations of the association’s standards are very important. Landowners are responsible for maintaining the buffer zone and remediation. If necessary, the Association shall offer assistance in remediation to any landowner prior to the imposition of a fine or the attachment of a lien. (k) Watershed Expert/Waiver – Due to numerous factors which can affect the watershed, the ARC (with advice from a watershed expert where appropriate) may issue waivers of certain shoreline standards. Lot owners must request the waiver prior to commencement of activities within the buffer zone. If the services of a watershed expert are required by either ARC or the requesting lot owner, the lot owner shall be financially responsible for reasonable fees. Such waivers may include the introduction of mitigating obstructions or materials or extension of the buffer zone setback so as to slow or impede runoff within the watershed (both within and away from the buffer zone). The ARC has 5

no authority to waive any Federal, state, county or local laws or ordinances. 15. Fireworks – The possession of or use of all fireworks within the Fence Lake boundaries is prohibited. 16. Speed Limit – No motor vehicle shall exceed a speed of 20 mph on the road surrounding Fence Lake within the Fence Lake boundaries. 17. Fire Safety – In recognition of the fact that the number one cause of wildfires in Michigan is the burning of debris (i.e. grass, brush, leaves and trash); and the interests of all Fence Lake property owners are extremely vulnerable to wildfire; the following rule shall be strictly enforced, (a) A burn permit shall be required for any burning when the ground is not snow covered (attended camp and cooking fires excluded) (permits can be obtained through www.michigan.gov/burnpermit); (b)

No fires shall be left unattended at any time;

(c) All unattended fires shall be extinguished using either water, sand or soil to thoroughly extinguish all flames; (d) Camp fires and cooking fires shall be located in an area free of flammable tinder, pine needles, leaves, grass etc. said area shall be no less than ten feet in diameter preferably on mineral soil or within a fire ring.

GUIDELINE: 18. Ice Fishing Shanties – All ice fishing shanties (portable or permanent) shall be required to display a numbered Secluded Shores Boat Sticker. Stickers shall be available to lot owners only. The use of non-owner shanties at any time on Fence Lake shall be strictly prohibited.
