San Joaquin Delta College Associated Student Body Government Bylaws Election Code ARTICLE I: ELECTION COMMITTEE Section 1. Purpose. An Election committee chaired by the Senator of Legislative Affairs or designee approved by a simple majority vote of the ASBG, shall supervise the elections.

Section 2. Membership. The committee shall include a minimum of three (3) and a maximum of five (5) members of the ASB. Committee members shall not be candidates in the election and/or a campaign aid. Committee members shall be approved by a simple majority vote of the ASBG.

Section 3. Duties of the committee. The Election committee shall 1. Enforce the ASBG Election Code and ASBG Constitution and Bylaws. 2. Select the dates of the election, application deadlines, campaign dates, and orientation dates. 3. Choose the election process (i.e., paper ballots or computerized voting). 4. Have the power to disqualify a candidate found in violation of the ASBG Election Code and/or ASBG Constitution & Bylaws. 5. Hear all business and make decisions on issues pertaining to the elections, this includes but is not limited to: complaints, grievances, requests, reports of misconduct by candidates or campaign aids, and amendments to the Election Code. 6. Have the power to restrict the campaigning rights of candidates. 7. Have the power to disqualify and/or sanction candidates based on their actions or the actions of their campaign aids.

ARTICLE II: REQUIREMENTS FOR CANDIDACY

Section 1. Filing for candidacy. Candidate election packets shall include, but not be limited to: applications and petitions for candidacy, current election rules and regulations, facility operations and maintenance guidelines for campaigning, expenditures form and the current procedures for election violations, a copy of the ASBG constitution, and a calendar of dates for orientation meetings.

Section 2. Eligibility. At the time of election a candidate (includes write-in candidates) must meet the minimum requirements specified in California Education Code section 70601, SJDC Board Policy and the ASBG Constitution.

Section 3. Candidates Orientation Meetings. All candidates must attend at least one candidate orientation meeting. The dates, times, and locations of the meetings shall be decided by the Election Committee and the ASBG Advisor, and publicly posted. Not attending at least one (1) meeting shall be grounds for disqualification.

Section 4. Restrictions. Candidates shall not run for more than two elected ASBG positions.

ARTICLE III: GENERAL ELECTIONS

Section 1. Time and Duration. There shall be one General Election per year, to be held during the Spring semester. The election shall be held on two (2) consecutive weekdays between the hours of 9:00 a.m. to 2:00 p.m. and 4:00 p.m. to 6:00 p.m. for a minimum of six (6) hours. Elections shall be held a minimum of two (2) consecutive weekdays on all San Joaquin Delta College campuses, but not simultaneous (unless the election is conducted using an online balloting system) in relation to all San Joaquin Delta College campuses.

Section 2. Voting. The Election Committee shall choose to conduct the elections using a method (e.g., paper ballots, computerized voting, etc.) of their choice. A. Voter Eligibility a. Students shall present a valid student identification card or other type of valid photo identification at the time of voting. b. Student's enrollment status shall be verified at the time of voting. c. Voting shall be limited to students enrolled at San Joaquin Delta College. d. Proxy votes shall not be allowed.

Section 3. Polling. A. Hours. Polls shall be open a minimum of six hours. B. Polling location. The Election committee shall determine the polling location.

Section 4. Poll Workers. The Election Committee may choose to employ currently enrolled San Joaquin

Delta College students to serve as poll workers. A. Duties of poll workers Poll workers shall: 1. Verify student identification. 2. Distribute ballots and/or provide qualified students with access to ballots. 3. Enforce the Election Code. 4. Report violations to the Election Committee and/or Director of Student Activities. 5. Complete all other duties as assigned. B. Compensation. Poll workers may be compensated no more than the current minimum wage rate for the State of California. All poll workers (paid or volunteer) that work a minimum of two hours shall be entitled to a complimentary meal during the time of their shift.

Section 5. Results. The Director of Student Activities shall be responsible for informing candidates and the student body of election results. Results may be posted on the ASBG website. The winning candidate shall be determined by plurality.

A. If a candidate is elected to two positions he/she shall choose one position. The runner up in the unselected position shall be offered the position. B. Write-in Candidates must garner at least fifteen percent (15%) of the votes cast for the position(s) they are running for, in order to be eligible for election to office.

Section 6. Special Elections. Special Elections shall be conducted using the same procedures as General Elections. A Special Election may be held in accordance with Article V. Elections.

Section 7. Run-off Elections. A run-off election shall be held within three school days of an election. Run-off elections shall be conducted within the guidelines of the Election Code.

ARTICLE IV: CAMPAIGNING Section 1. Campaign Period. The campaign period shall begin no sooner than ten (10) days prior to the election. No time restrictions shall be placed on verbal campaigning. Violation of this section will be referred to the Election Committee for review.

Section 2. Restrictions. Candidates may not solicit voters or distribute campaign materials within fifty (50) feet of the voting area during the election days. Candidates may campaign during election days outside the fifty (50) feet radius. Violation of this section will be referred to the Election Committee for review.

Section 3. Tickets/Parties. If candidates wish to campaign as a ticket/party they must sign a form stating their partnership. Tickets or parties are two (2) or more candidates wishing to campaign together.

Section 4. Campaign Aids. Candidates having aid in campaigning must have all aids sign a campaign work agreement, in which aids understand the Election Code Bylaws and any regulations emplaced by the ASBG and/or Election Committee, as well as days and restrictions applying to the respective days during the progress of elections. Candidates are responsible for all individuals assisting them campaign in any manner.

Section 5. Campaign Materials. A. Campaign materials, literature to be posted or handed out may include: 1. Five (5) posters of a maximum size of three feet by two feet (3’x2’) 2. Unlimited fliers of any size up to a maximum size of eleven inches by seven inches (11”x7”) per candidate B. Any electronic/digital item(s) are considered campaign materials including but not limited to: 1. Exchange of emails 2. Mass webpages 3. Social networking sites 4. Personal webpages 5. Advertisements on webpages 6. Compact discs (CDs) 7. Digital video discs (DVDs) 8. Short message service (SMS) 9. Multimedia message service (MMS) C. Each candidate in a group may only use their campaign material to advertise for themselves or for the group. D. The Election Committee must approve all other campaign materials.

E. No campaign material may contain false statements, slander, or an attack on another person’s character, or anything else that would violate SJDC Student Handbook. Failure to abide by this

section will result in the offending materials being removed. Violation of this section will be referred to the Election Committee for review.

F. If a current officer or club officer decides to run for a subsequent term, no campaign activities or efforts should take place at the ASBG office, student activities office on any campus of SJDC. No ASBG or club supplies, materials, or equipment may be used for campaigning purposes, unless voted on and approved by the club and minutes are provided to the Election Committee. ASBG supplies, materials, or equipment may not be used under any circumstances. No campaigning may take place on social networking sites or internet sources that are operated and maintained by the ASBG. ASBG emails may not be used to send or receive campaign materials. Violation of this section will be referred to the Election Committee for review.
