SAN GABRIEL CITY COUNCIL MINUTES OF A REGULAR COUNCIL MEETING TUESDAY, SEPTEMBER 16, 2014

1.

CALL TO ORDER Mayor Harrington called the regular meeting of the San Gabriel City Council to order at 7:33 p.m. on Tuesday, September 16, 2014, in the Council Chambers at City Hall, 425 South Mission Drive, San Gabriel, California, 91776.

PLEDGE OF ALLEGIANCE City Manager Steven A. Preston led the pledge of allegiance.

ATTENDANCE: COSTANZO, HARRINGTON, LIAO, PU, SAWKINS PRESENT: Mayor Harrington, Vice Mayor Pu, Councilmembers Costanzo, Liao, and Sawkins; City Manager Preston, City Attorney Kress, and Deputy City Clerk Aguilar.

PUBLIC COMMENT: This is the time set aside for members of the public to address the City Council on items of interest that are not on the agenda, but are within the subject matter jurisdiction of the San Gabriel City Council or items appearing on the consent calendar. The City Council values your comments; however, pursuant to the Brown Act, the City Council will not answer any questions. The Council will refer matters as appropriate to the responsible department for research, response or to provide further information. The City Council is prohibited from taking any action until such time as the matter may appear as an item on a future agenda. The following spoke on the condition of a residence at 707 Los Olivos Drive and were requesting City Council’s assistance to secure results: Lawrence Yang (presented a handout to the Council), William Loskota, Val Loskota, Jim Perea, Corina Weaver, Vernice McNutt, Merrill Francis. It was noted that staff will provide a progress report to the Council at the October 21, 2014 meeting regarding issues raised by residents. Charles Sances, resident, reported a family of raccoons began living in an abandoned home and may become a hazard in the neighborhood. Mario Rodriguez, informed the Council of a subsidized employment program that he manages and offered his services to needed City departments. Brian Lewin, made comments on Items 5A and 5B of the September 2, 2014 Minutes. Item 5A, his public comment documented in the minutes do not correctly reflect his comments. He asks the Council to change the wording to “protested the checking of licenses at DUI (Driving Under the Influence) checkpoints unless those actions are related to reasonable suspicion of a DUI or some other legally enforceable issue. Item 5B, Mr. Lewin asks the Council

to approve the DUI program with clarification that the San Gabriel Police Department check drivers licenses only if a DUI is suspected. 5.

CONSENT CALENDAR: All items listed under the consent calendar are considered routine and recommendations will be approved in one motion unless a member of the City Council or audience requests separate discussion. Councilmember Sawkins moved to pull Items A and B for further discussion; seconded by Councilmember Liao. Police Captain Perrine responded to the implementation of the DUI program for Item 5B.

APPROVAL OF MINUTES The City Council will consider approval of the minutes for the Regular Meeting of September 2, 2014 which are a record of the official actions taken at the Council meeting. Recommended Action: Approval Amended public comments on Item 5A. Approved as part of the consent calendar.

B.

SELECTIVE TRAFFIC PROGRAM GRANT The City Council will consider the acceptance of a grant from the Office of Traffic Safety (OTS) for the Police Department to participate in the Selective Traffic Enforcement Program (STEP) for Federal Fiscal Year 2015. Recommended Action: 1. Approve the program as outlined in the staff report. 2. Increase the Estimated Revenue Budget Account 147-3229 by $111,000.00 to reflect receipt of the grant funds. 3. Increase the Police Department Expenditure Budget by $111,000.00, Account 147-751-00, which will be used for overtime costs and purchase of related equipment. Approved as part of the consent calendar.

REQUEST SUBMITTED ON BEHALF OF L.A. STAGE ALLIANCE OVATION AWARDS FOR THEATER RENTAL FEE WAIVER The City Council will consider a request from Ovation Awards to waive the theater rental fees for the upcoming performance on November 2, 2014. Recommended Action:

Approve the L.A. Stage Alliance’s request to waive the theater rental fee of $2,200 for the upcoming Ovation Awards event on November 2, 2014. Approved as part of the consent calendar. D.

INVESTMENT REPORT This is a presentation of City investments for the Month of July 2014. Recommended Action: Receive and file Approved as part of the consent calendar.

E.

REQUEST FOR TEMPORARY STREET CLOSURE & TEMPORARY USE PERMIT FEE WAIVER – SAN GABRIEL VALLEY HUMANE SOCIETY The City Council will consider a request from the San Gabriel Valley Humane Society for a temporary street closure and fee waiver of the $530 Temporary Use Permit for their 90th Anniversary Community Celebration event on Saturday, September 27, 2014. Recommended Action: Approve the temporary street closure and temporary use permit fee waiver request for the proposed September 27, 2014 subject to the conditions outlined in the staff report. Approved as part of the consent calendar.

PUBLIC HEARING: CHANGES TO THE MUNICIPAL CODE RELATED TO REGULATIONS GOVERNING TRAILERS PLANNING CASE NO. PL-14-087 The City Council will consider amendments to the Municipal Code relative to the parking and occupancy of house trailers which will streamline the existing regulations, expand the definition of vehicles covered, eliminate the distinction between temporary and permanent storage of vehicles and address recent resident concerns about trailer regulations. Recommended Action: Introduce and place on first reading Ordinance No. 614-C.S., “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL DELETING AND AMENDING EXISTING SECTIONS OF THE SAN GABRIEL MUNICIPAL CODE RELATED TO REGULATIONS GOVERNING TRAILERS.” Planning Manager Mark Gallatin presented the staff report. Mayor Harrington moved to open the Public Hearing; there were no objections, it was so ordered. The following spoke against the proposed ordinance to regulate parking of trailers in residential areas: Bill Huston, Pat Foltyn, Denise Menchaca, Brad Cadle, Corey Courson. Mayor Harrington moved to close the Public Hearing; there were no objections, it was so ordered. After much discussion, the Council reached a consensus to not approve the ordinance on first reading and to bring the item back to a future meeting for

changes and corrections by the following: Obscuring the size of trailer behind a wall, simplify the language of the ordinance, add graphics, and cover possible litigation issues. 7.

PUBLIC HEARING: SAN GABRIEL BICYCLE MASTER PLAN The City Council will consider the adoption of San Gabriel Bicycle Master Plan developed by ALTA Planning in consultation with San Gabriel residents, City staff and the San Gabriel Planning Commission as a component of a regional bicycle master plan in the San Gabriel Valley cities. Recommended Action: Adopt Resolution No. 14-26, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN GABRIEL ADOPTING THE SAN GABRIEL BICYCLE MASTER PLAN.” Assistant City Planner Fang-Zhou Zhou presented the staff report Mayor Harrington moved to open the Public Hearing; there were no objections, it was so ordered. Mayor Harrington moved to close the Public Hearing; there were no objections, it was so ordered. Vice Mayor Pu moved, seconded by Councilmember Costanzo to approve the recommended action with consideration a change of a Class 2 bike lane on San Gabriel Blvd. Motion passed by a vote of 5 ayes, 0 noes, and 0 abstentions.

8.

PROFESSIONAL SERVICES AGREEMENT WITH GKK WORKS FOR CONSTRUCTION MANAGEMENT SERVICES FOR MARSHALL COMMUNITY PARK The City Council will consider a Professional Services Agreement with GKK Works for construction management service for Marshall Community Park. These costs are part of the Proposition 84 Statewide Park Development and Community Revitalization Program of 2008 and will have no budgetary impact. Recommended Action:

Approve and execute the professional services agreement with GKK Works for construction management for the Marshall Community Park Project in the amount not to exceed $143,660 for the duration of the construction project. Community Services Director Rebecca Perez presented the staff report. Councilmember Sawkins moved, seconded by Councilmember Liao, to approve staff’s recommendation. Motion passed by a vote of 5 ayes, 0 noes, and 0 abstentions. 9.

CITY MANAGER ITEMS 1. Requested a minimum of 60 days to research community outreach regarding Town Hall meetings. 2. Conducted second annual Land Grant Roundtable with consultants Evans Brooks and Avant Garde. A Discussion on a grant proposal is planned. 3. Gave an update on the Strategic Planning process with City departments.

10.

COUNCIL COMMENTS AND CONFERENCE/MEETING REPORTS Each Councilmember may address the Council and public on matters of general information and/or concern. This is also the time for Councilmembers to report on conferences and/or meetings they have attended.
