ROAD MAINTENANCE IN SENEGAL & PERFORMANCE-BASED CONTRACTS

1. Institutional Framework The difficulty of road maintenance in Senegal was always a major concern for the government. Since the 1970s, the government has implemented a series of reforms for institutional management and regulation of the road network. The actions taken are the following:

1. Institutional Framework Establishment of the Directorate of Roads, which deals with the strategy and road policy in Senegal. It is part of the Ministry of infrastructure; Creation of AGEROUTE Senegal in 2010 out of the Autonomous Agency of Road Works (Agence Autonome des Travaux Routiers AATR). It is responsible for the implementation of new work, road maintenance and management of the road network. AGEROUTE Senegal has a dual role: technical with the Ministry in charge of the road network and financial with the Ministry of Finance;

Creation of an Autonomous Road Maintenance Fund (Fonds d’Entretien Routier Autonome FERA) charged with financing current and periodic maintenance of the road network.
Establishment of a performance-based contract, a strategic instrument in guiding the agency`s activities.

2. Description of AGEROUTE Senegal
AGEROUTE-Senegal is in charge, in general terms, of the implementation of all construction work, the rehabilitation and road maintenance, bridges and other engineering work, as well as, management of the road network.
The agency is managed by 2 authorities: a deliberating, supervising and controlling body (Oversight Council) and an executive body (General Direction).
The General Direction is in charge of the execution on all of AGEROUTE-Senegal missions.

2. Description of AGEROUTE Senegal The strategy for implementing the Agency`s activities is « Do - Do » (Faire-Faire): using qualified companies, consultants and control entities for implementing work, studies and supervision;
Providers are mainly chosen as a result of an open tender. 6

Performance-Based Contract AGEROUTE – Government: Generalities A Performance-Based Contract is a commitment resulting from the Orientation Law n° 2009-20 of May 4, 2009 for the executing Agencies, of the decree n° 2009-522 of June 4, 2009 supporting the organisation and the functioning of the execution Agencies and of the decree n° 2010-1812 of December 31, 2010 related to the performance-based contract applicable to the execution Agencies; Moreover, the Senegalese Government subscribed to commitments in front of the IMF as part of its economic and financial program (ISPE). 7
3. Performance-Based Contract AGEROUTE – Government: General Points The first performance-based contract (2014-2016), between
the government, represented by the Ministry of Finance and the Ministry of Infrastructure, and AGEROUTE, was signed on
June 30th, 2014. Performance-based contracts are implemented by the General Direction and the follow-up is assured by the Oversight Council. Performance-based contracts are a strategic instrument to 8
implement AGEROUTE`s activities.
3. Performance-Based Contract AGEROUTE – Government: Generalities
With a PBC, Global objectives are fixed in terms of performance, and it serves as an instrument
to improve
AGEROUTE`s management skills and the level of service offered to the users. With a PBC, the Government has a ``best endeavour`` obligation and evaluation depends on the resources provided by the Government and the fixed objectives. 9
4. CDP: Commitment of the Government A. Commitment in terms of administration and legal The Government undertakes to: Encourage every measure in terms of administration, organizational and/or legal in order to achieve the mission of AGEROUTE;
Ensure that the General Director of the Agency stays in his position for the duration of the performance-based contract, so far as permitted by law & regulations. Approve AGEROUTE`s budget in the 15 days following the submisission; Honor commitments made with and by technical and financial partners10
and the agreed upon financing agreements.

Ensure AGEROUTE allocates the finances necessary to implement the programs; Increase the resources for maintenance so AGEROUTE can reach the assigned objectives; Timely make resources available to the Agency for maintenance and for
road projects in accordance with the forecasted disbursement prepared by AGEROUTE. 11

4. CDP: Commitment of the Agency
Commitment in terms of administration: AGEROUTE undertakes to
respect the procedure manual and to update in accordance with the current legislation, to its organisation and stick to the objectives referred by the performance-based contract; Commitment on to manage human resources: AGEROUTE undertakes to recruit enough staff for the execution of its missions and to develop a
yearly training plan for its staff. Commitment to manage of the material resources: AGEROUTE undertakes to obtain material and necessary equipment for the execution of its missions and to ensure it keeps them in working order.

CDP: Commitment of the Agency (II) Commitment in terms of technical: AGEROUTE undertakes to execute the work while respecting technical and environmental standards, deadlines and quality of the work. Commitment in terms of financing: AGEROUTE undertakes to: Prepare and present to the supervisory body within the deadline prescribed and
according to the rules a realistic budget of the project AGEROUTE undertakes to produce and deliver to the financial supervision, the financial statements and the budgetary implementation reports within the
deadline fixed by the regulation so they may can review and approve it, Cover the fiscal and social debts, Prepare a detailed summary at the end of every trimester of any debt outstanding to suppliers.

5. Adjustment of the maintenance strategy to the requirements of the CDP The test runs carried out with the different strategies allowed us to bring to the forefront what was lacking in the existing maintenance strategy implemented between 2005 and 2009. It excludes periodic maintenance in favour of costly operations of rehabilitation. In reality, the problem of road maintenance is just as much about adopting an adequate strategy as well as increasing the relevant financial resources. 15

The BDR of AGEROUTE Senegal is built around : a system of road information (SIR); data collection activities for the data feed and its update; data analysis activities by help programming tools (HDM4 and L2R programmes) 16

9. Institution of the multi-year markets The logic of a multi-year program of road maintenance - a 3 year rolling program (``Programmes Trinaux Glissants or PTG``) - allows AGEROUTE to establish multi-year markets which ensure the continuity of operations during the three years of implementation of the which is focused on periodic maintenance. This strategy permitted to avoid the gaps related from the long-cycles of markets procurement which cause an acceleration of the roads deterioration between the end of a budget exercise and the beginning of the next one.
The following results were obtained with the implementation of the second year of the performance-based contract combined with the new approach
