WRECKER SERVICE & STORAGE REQUEST FOR PROPOSAL The City of Bessemer seeks a qualified company to submit proposals to provide Wrecker Service and Storage including transporting all automobiles and other vehicles, which are removed from streets by any police officer of the City under the authority of the Code of Ordinances of the City of Bessemer and the Code of Alabama, the provisions of which are incorporated herein and made a part hereof by reference. Written Proposals will be received by Beverly Wheeler, Acting City Clerk, 1800 3rd Avenue North, (2nd Floor), Bessemer, Alabama no later than 2:00 p.m. Central Standard Time (CST) on January 16, 2015. Late proposals will be kept by the City, but not considered for award. The City will not consider for award any proposals submitted via facsimile, email or other forms of electronic transmission. The complete Request for Proposal is on file with and may be obtained from the City Clerk’s Office, Beverly Wheeler - Acting City Clerk, 1800 3rd Avenue North, (2nd Floor), Bessemer, Alabama. The Request for Proposal can also be obtained from the City’s website http://bessemeral.org/online-services/bids-contracts. . It is the responsibility of the Vendor to check the website to stay current on all Q&A and any addendums. It will not be the City’s responsibility to ensure that the most current information is available in any additional way other than posting on the website. I. Introduction The City of Bessemer (hereinafter referred to as the “City”) a qualified company to submit proposals to provide Wrecker Service and Storage including transporting all automobiles and other vehicles, which are removed from streets by any police officer of the City under the authority of the Code of Ordinances of the City of Bessemer and the Code of Alabama, the provisions of which are incorporated herein and made a part hereof by reference. This RFP is intended to encourage proposers to clearly show that they are qualified to provide wrecker service and storage in an efficient and cost effective manner in observance of the terms contained herein. This document provides the vendor with general information, specific requirements, and instructions needed for participating in the process of selecting and assisting the City of Bessemer with a solution for wrecker service and storage.

II. Bid Requirements A. All bid proposals shall be received by the City of Bessemer Clerk’s Office no later than January 16, 2015 by 2:00 p.m. in a sealed envelope. Important: Clearly mark on the outside of the envelope, box, or package with the following information and format: Respondent Name City of Bessemer Proposal for Wrecker Service and Storage Proposal Submitted on: the ___ day of ___________, 2015 Proposals must be received at: City of Bessemer Clerk’s Office 1800 3rd Ave N (2nd Floor) Bessemer, AL 35020 Proposals received after the date and time set for proposal opening will not be considered. 1. Bid proposals not conforming strictly to the following requirements may be rejected: (a) Bids will consist of and must be made on the blank bid form provided. (b) Bids must be complete and specific. The City of Bessemer reserves the right to reject all bids or any portion thereof, to waive any informality in any bid, and accept any bid considered to be advantageous to the City. (c) Bids will be free of alterations and erasures. (d) Bids will be properly signed by the bidder or by a legally authorized officer or agent of the bidder. (e) Bid Bond Required. Under the Alabama Bid Law it is required for any contract exceeding $10,000.00 the vendor shall submit with their proposal a certified check,

cashier’s check or a bid bond in an amount equal to 5% of the proposal, not to exceed $10,000.00. Proposal security or original bid bond must be received with proposal; copies of proposal/bid bonds are not acceptable. (f) Performance Bond. The successful vendor will be required to provide a 100% performance bond, upon execution of a contract based on the provisions as contained herein. (g) Certified Statement of Company Finances. A certified statement of net worth or balance sheet must be enclosed. A statement from the Bidder setting out information which shows its: i. State the full name and address of your organization. If you are a subsidiary, indicate your parent company. Specify the branch office or other subordinate elements that will perform, or assist in performing, the work herein. Indicate whether you operate as a partnership, corporation, or individual. Include the place in which incorporated or licensed to operate. Include a copy of incorporation documentation. ii. Include a compiled financial statement for the most current quarter and last year-end including Balance Sheet, Income Statement and Statement of Cash Flows. This should reflect the current financial condition and net worth of the Bidder. Statement shall also include similar information as to any parent corporation of the Bidder, and any individual, corporation, association or company under contract with the Bidder to furnish any service required to or for the Bidder, and include a description of any litigation in which you are currently involved. iii. The Financial Statements requested hereinabove must be certified by an independent accountant or bookkeeper. (h) Management Structure and Information Concerning Leased Equipment. Give an overview of the project team including project leadership and reporting responsibilities. i.

If use of subcontractors is proposed, identify their placement in the primary management structure, and provide internal management description for each subcontractor. Indicate your proposed staffing for this project, including technical skill sets where applicable.

Copies of any contracts with other companies providing services required by this contract must be included.

(i) Execution of Attachments A, B, and C must be signed and provided. (j) Agreement to Abide with the City Policy with Regard to Private Towing. The City’s policy with respect to vehicles at the scene of an accident which are not impounded by the City and which require towing by a wrecker shall be as follows: That any qualified wrecker company requested by a citizen may be called to the scene of an accident by the Police Radio Dispatcher. The City of Bessemer Police Department reserves the right to call the City’s contract wrecker to the

scene provided the Police Officer determines that the vehicle is or is likely to become an obstruction or hazard; and that it is in the interest of the health, safety and welfare of the general public to remove the obstruction without undue delay. In the event that the citizen does not have a preference of wrecker service, the City’s contract wrecker will be called to the scene. (k) Execution of a completed Wrecker Service and Storage Agreement between the City and wrecker service in substantial form as Attachment D. 2. Understanding that by Submission of a bid proposal acknowledges Bidder’s acceptance of the above requirements further agrees as follows: (a) Indemnification. Vendor agrees and is required to indemnify and hold harmless the City of Bessemer, its officers, agents and employees. (b) Governing Laws. Vendor agrees that the laws of the State of Alabama will govern any and all agreements resulting from this proposal and the venue of any legal actions will be Jefferson County, Alabama. All disputes requiring litigation for any breach or issue related to this proposal and contract for services shall be heard in the Bessemer Division of the Jefferson County. (c) Laws, Ordinances and Regulations. The services will be operated in compliance with all applicable city, county, state and federal laws, ordinances and regulations. Successful Bidder must provide proof of a City of Bessemer Business License, upon execution of a contract based on the provisions as contained herein. (d) Non-Discrimination. Vendor shall not discriminate against client, employee or applicant for employment because of race, age, color, religion, sex, national origin, physical or mental disability, marital status or medical status. Vendor shall comply with all applicable sections of the American with Disability Act. (e) No Gratuities. The City of Bessemer may terminate this contract if it finds, after notice of hearing, that gratuities (in the form of entertainment, gifts or otherwise) were offered or given by a vendor, or any agent or representative of the vendor, to any officer or employee of City to secure favorable treatment with respect to the awarding, amending or making of any determination with respect to the performance of this contract. (f) No Collusion. Any agreement or collusion among vendors or perspective vendors in restraint of freedom of competition, by agreement, to submit a proposal at a fixed price or refrain from submitting a proposal or otherwise shall render proposals of such vendors void and shall cause such vendors to be disqualified from submitting further proposals to the City of Bessemer for future contracts. (g) Statement of Compliance with Alabama Code Section 31-13-9. By submitting this proposal and signing Certificate of Compliance contained herein, you certify that you will not knowingly violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the State of Alabama. Furthermore, any vendor found in violation of this provision will render said proposal or any agreement therefrom void as a breach thereof and such vendor shall be responsible for all damages resulting therefrom

III.

General Response Format

Each vendor is to provide one (1) original and one (1) copy of this proposal. The following section addresses "general requirements" for the vendor to consider in preparing his proposal response. Provide a Table of Contents/Checklist with the documents in the following order: 1. Exhibit A to Attachment D - Bid Form 2. Bid Bond 3. Attachment A – Company Information 4. Attachment B – Bid Document Questionnaire 5. Attachment C – Warranty 6. Attachment D* – Wrecker Service and Storage Agreement Surety Bond 7. Certificate of Compliance *Attachment D must be initialed in the bottom right corner and returned with your sealed bid package. You are not required to sign the contract or bond, but this is simply to provide acknowledgement that it was received. Information contained therein is what this request for proposal is based on.
