INTRODUCTION REQUEST FOR PROPOSAL #616 TYEE PARK ELEMENTARY SCHOOL INTERIOR PAINTING In accordance with Proposal Documents

Clover Park School District is soliciting proposals for the painting of the interior walls at Tyee Park Elementary School. The District is using the contractors registered with the Purchasing Department’s small works roster. The District tentatively plans to begin this project in stages beginning as soon as April 2016 working nights and weekends or upon completion of the school year in June. Depending on the schools end year and testing schedules. INTENT OF THIS PROPOSAL The intent of this proposal is to include all items necessary for the proper execution and/or completion of interior painting at Tyee Park Elementary School. Work not explicitly covered in the District proposal documents is not required unless it is consistent therewith and is reasonably inferable there from as being necessary to produce the intended results. Words and abbreviations which have well-known technical or trade meanings are used in the proposal documents in accordance with such recognized meanings. Term Vendor and Contractor are used in exchange and reference those completing the proposal requirements. Vendors are expected to propose their best solution to meet the District’s needs as defined in this RFP. The District will not tailor these needs to fit solutions that a particular Vendor may have available. The District wishes to avoid experimentation on this project. The Vendor shall propose only established products under this agreement, unless otherwise declared by the Vendor and agreed upon by the District. Established products are defined as those that have been used successfully in customer sites

prior to the execution of this contract. Other evidence offering substantially the same level of assurances in the District’s judgment may be considered in place of this requirement. The District prefers functions and supplies that are commercially proven and provided. However, Vendors have the opportunity to propose modifications where typical features are not available. While a single provider is desired, the District may elect to grant multiple awards if in the best interest of the District.

VENDOR/CONTRACTOR CONSIDERATION Only Vendors responding formally to this RFP, following all of the requirements, will be considered for selection. All proposals and Vendor conduct shall be in accordance with all applicable local, state and federal laws and regulations.

REJECTION OF PROPOSALS Clover Park School District reserves the right to reject any or all proposals and to waive informalities or irregularities in any proposal or in the opening. In consideration for the District’s review and evaluation of its proposal, the Vendor waives and releases any claims against the District arising from any rejection of any or all proposals, including any claim for costs incurred by Vendors in the preparation and presentation of proposals submitted in response to this Request for Proposal. In addition, the Vendor waives the costs of providing additional information as requested.

EXPECTATION OF CONTRACT The selected Vendor is expected to enter into a contract with the District based upon Vendor’s response to this RFP and the terms and conditions of the RFP. Failure to complete required documentation will result in disqualification. This is a public works/prevailing wage project. After award recommendation, a notice of award will be issued that will require compliance with RFP documents (insurance, bonds) for the release of the notice to proceed.

ANTICIPATED PROJECT SCHEDULE ESTIMATED TIMELINE The District intends to have this project assigned beginning in April for Nights and Weekend work. The District and the selected Vendor will work out a detailed project schedule that is mutually agreed upon between District and Vendor, and ultimately approved by the District. It is estimated that the project will follow a timeline similar to the following (subject to change at District discretion).

TIME FOR COMPLETION Vendors responding to this RFP agree that the project being proposed can begin implementation in April 2016, and substantial completion by a date to be determined. The District reserves the right to extend

this timeline at District discretion if deemed necessary. Date of delivery and/or completion stated in the proposal documents shall become part of the contract.

INSTRUCTIONS TO CONTRACTORS INTRODUCTION It is understood that the contractor, in submitting a proposal, accepts these Instructions to contractors, along with all specifications, terms and conditions, requirements, and any other items listed within this RFP.

EXAMINATION OF PROPOSAL DOCUMENTS By responding to this proposal, each contractor represents that: •

The contractor has read and understands the proposal documents and its proposal is made in accordance with them. The District will in no case be responsible for any loss of unanticipated costs that may be suffered by the Vendor as a result of the contractor’s failure to be fully informed to all conditions pertaining to this RFP and the contract. The contractor has submitted the required proposal documents. The contractor’s proposal is based upon the materials, systems, services and equipment required by the proposal documents, without exception.

INTERPRETATION OF PROPOSAL DOCUMENTS Any person contemplating submitting a proposal, who is in doubt as to the true meaning of any part of the proposal documents, or finds discrepancies in or omissions from the proposal documents, shall submit to the Purchasing Department a written request for interpretation or correction thereof. Such request shall be submitted and received no later than March 25, 2016. Any interpretation or correction of the proposal documents will be made in writing by addendum duly issued to all Vendors. The District will not be responsible for any other explanation or interpretations of the proposal documents.

CONTACT AND COMMUNICATION INTEREST IN RESPONDING Contractors planning to respond to the District’s RFP are encouraged contact the District Purchasing Office via email [[email protected]], by March 28, 2016 to declare an interest in responding. This in no way binds or obligates the contractor to the District in any way, and the contractor is not obligated to respond to the RFP. This communication shall include the contractor’s company name, product name(s), company representative name, address, phone number, email and fax. The purpose of this is to ensure that the district can communicate any addenda and additional information to all interested parties. Contractors who do not contact the District Purchasing Office by March 22, 2016 will

COMMUNICATION Upon release of this RFP, all communication regarding this RFP and this project must be directed to the District Purchasing Department (listed below and on cover page), no later than close of business (4:30 p.m.) on March 28, 2016. Formal questions must be submitted in writing. Simple clarifications may be conducted via phone and email to the District Purchasing Office. All questions and answers will be distributed to all responding/ registered parties via email. Unauthorized communication by potential contractors to any District representative, other than via the Purchasing Department, may result in misdirected information and disqualification. Note that the District will be hosting a pre-proposal conference. PRE-BID/PROPOSAL MEETING The District will hold a contractor site visit on March 22th, 2016 at Tyee Park Elementary School at 3:30 p.m. Please sign in at the front office and meet in their lobby area. The Maintenance and Operations staff will escort the attendees and answer questions. If any questions are asked these will be recorded and added to the Addenda. This meeting is informational and it is encouraged to attend, please see page 11 regarding site investigation and conditions.

PREPARATION AND SUBMITTAL OF PROPOSAL The district recommends that proposals are prepared simply and economically, providing a concise delineation of the capabilities proposed to satisfy the requirements of the RFP. Completeness and clarity of content shall be emphasized. Unnecessary elaborate bindings, brochures, descriptions, or other expensive presentation materials are not required beyond what is being requested in this RFP. Vendors may submit responses in black and white rather than color.

FORMAT This is a small works roster invitation. All RFP document submissions are to be filled in electronically or manually in ink and final submissions to be made to [email protected] Hard copies are allowed, please submit as annotated in the addressing and shipping section of this RFP. It is the responsibility of the Vendor to ensure that the formatting is correct and that all calculations are accurate. For economy all Vendors may submit in black and white rather than color.

N UMBER OF C OPIES One (1) complete copy of the signed, sealed Proposals (if in hard copy) and any accompanying documents must be received at the District Purchasing Office on or before the specified date and time.

INITIAL OF CHANGES Any edits, changes, interlineations, alteration, or erasure of a response made by the Vendor must be initialed by an authorized representative of the Vendor.

ADDRESSING AND SHIPPING All proposals must contain all information requested in this RFP. If hand delivered or mailed the proposals must be submitted in a sealed opaque envelope, with the Vendor’s name, return address and RFP Number clearly displayed. SUBMISSION DEADLINE Proposals must be received by Clover Park School District #400 in the Purchasing Department, Room 26, 10903 Gravelly Lake Drive SW, Lakewood, Washington 98499 by March 31st, 2016 on or before 3:30 p.m. Proposals received after the fixed time cannot be considered. The date/time clock in the Purchasing office will be referenced as the official time for the proposal submission. It is the responsibility of each vendor to insure that their proposal is physically received in the District Purchasing Department prior to March 31, 2016 and on or before 3:30 p.m. No responsibility will be taken by the district for delays in the U.S. mail, internal district mail, misaddressing, miswriting or wrong delivery by any Vendor.

All responses become the property of Clover Park School District, regardless of selection or rejection of proposal. No proposals will be returned to the Vendor.

PRICING AND COST INSTRUCTIONS PROPOSAL PRICES The proposal price shall include everything necessary for the execution and completion of the project, except as may be noted otherwise in this RFP. Proposals shall include any freight, shipping and handling charges, rental fees for equipment, prevailing wages and all other charges necessary to successfully complete the project.

TAXES Proposals are to exclude sales tax.

COST OF PROPOSAL The District is not liable for any costs incurred by the Vendor in the preparation and evaluation of proposals submitted. Product demonstrations and/or samples of items may be requested by the District.

WORDS AND FIGURES Final sums shall be expressed in both words and figures; in case of discrepancy between the two, the amount written in words shall govern.

ADDENDA If at any time the District changes, revises, deletes, clarifies, increases or otherwise modifies the RFP, the District will issue a written Addendum to the RFP which will be mailed, emailed, faxed and/or delivered to all interested parties registered with the Purchasing Department. Copies of the Addenda will be made available for inspection online and wherever the proposal documents are on file for that purpose. In each proposal, Vendor shall acknowledge receipt of all Addenda issued during the proposal process. Failure to acknowledge receipt of all addenda may result in a proposal being determined nonresponsive.

SUBCONTRACTORS/SUBSITUTE OR RECOMMENDED PRODUCTS It is expected that all products and services being proposed are under the direct ownership and supervision of the Vendor submitting a response to this RFP, unless otherwise identified. Vendor agrees not to assign or sublet the whole or any part of the contract without prior written consent of the District. Vendors may provide for consideration at District’s discretion a list of alternatives or compatible products and/or services where Vendor does not offer their own solution. If accepted by the District, Vendor shall assume responsibility for this secondary solution, and

subcontractors shall comply with all conditions of this RFP and the contract between the District and primary Vendor. Secondary products and services shall be pre-tested and proven to work with the solution being proposed unless specifically noted. This paragraph does not apply to Third Party products and services that are clearly identified in the proposal as such and are not necessary for complete and successful implementation of the solution being proposed.

ERRORS IN RESPONSE Clover Park School District accepts no responsibility for any errors in Vendor responses. Vendors are liable for all errors or omissions contained in their responses.

WITHDRAWAL/MODIFICATION BEFORE DUE DATE At any time before the time and date set for submittal of proposals, a Vendor may submit a modification of a proposal previously submitted in the same form and manner as the original proposal. Proposals may be withdrawn by written notice, which must be received prior to the exact hour and date specified for the receipt of proposals. A proposal also may be withdrawn in person by a Vendor or authorized representative provided their identity is made known and they sign a receipt for the proposal, but only if the withdrawal is made prior to the exact hour and date set for receipt of proposals. Withdrawn proposals may be resubmitted up to the time designated for the receipt of proposals provided they are fully in conformance with all instructions of the RFP.

PROPOSAL WITHDRAWAL AFTER DUE DATE Except for claims of error granted by the District, no Vendor may withdraw a proposal after the date and time established for submitting proposals, or before the award and execution of a Contract pursuant to this RFP, unless the award is delayed for a period exceeding the period for proposal effectiveness. Request to withdraw a proposal due to error must be submitted in writing to the District Purchasing Office, along with supporting evidence for such claim, for review by the District. Evidence must be delivered to the District within two (2) business days after request to withdraw. The District reserves the right to require additional records or information to evaluate the request. Any review by the District of a proposal and/or any review of such a claim of error, including supporting evidence, create no duty or liability on the District to discover any other proposal error or mistake, and the sole liability for any proposal error or mistake rests with the Vendor.

Upon receipt of a timely and executed proposal the District will review each responsible and responsive contractor’s proposal per RCW 39.04.010. The lowest responsive bidder will be announced to all respondents.

PUBLIC WORKS PROVISIONS This project is considered public works/prevailing wage. No payments can be made until legal requirement are fulfilled. In compliance with the Department of Labor & Industries, prior to the start of work a Statement of Intent to Pay Prevailing Wages is required for the General Contractor and ALL subcontractors Upon completion of this project you must submit an Affidavit of Wages Paid for all laborers to include the general and subcontractor employees. You are also responsible for the filing of each form and the fees involved. These forms may be filed online at www.lni.wa.gov/TradesLicensing/PrevWage. There is a mandatory 45 day lien period once project is complete. For all projects exceeding $35,000, before retainage can be released and final payment made, the District will submit to the Department of Revenue, a Notice of Completion. Upon receipt of Letters of Release from the Department of Revenue and Employment Security, final payment shall be made. You may elect to have your retainage held in an escrow account, please provide the District with your request and escrow agreement. You may also request a retainage bond or request a bond waiver form however, this allows us to retain up to 50% of the contract price. This project will also require Insurance, Payment and Performance Bonds.

SITE INVESTIGATION AND CONDITIONS AFFECTING THE WORK The contractor acknowledges that it has taken steps necessary to ascertain the nature and location of the work, and that it has investigated and satisfied itself as to the general and local conditions which can affect the work or its cost, including but not limited to (1) conditions bearing upon transportation, disposal, handling, and storage of materials; (2) the availability of labor, water, electric power, and road; (3) uncertainties of weather, river stages, tides, or similar physical conditions at the site; (4) the conformation and conditions of the ground; and (5) the character of equipment and facilities needed preliminary to and during the work. The contractor also acknowledges that it has satisfied itself as to character, quality, and quantity of surface and subsurface materials of obstacles to be encountered insofar as this information is reasonably ascertainable from an inspection of the site, including exploratory work done by the Owner, as well as from the drawings and specifications made a part of this contract. Any failure of the contractor to take the actions described and acknowledged in this paragraph will no relieve the contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work.

SCOPE OF WORK The District has determined that the interior painting of Tyee Park Elementary School classrooms will be be performed in stages. Attached to the end of this proposal is a diagram of the classroom painting sections intended to be part of the project plan. The work performed by the contractor shall include, but not be limited to, all labor, tools and material to prepare surfaces and apply paint as described below: GENERAL 1. Prior to starting work, the contractor shall check color and product to assure conformity to specified color and finish as described on the builder's decorator information sheet. 2. Material shall be that specified in Section B of this contract and applied following all the manufacturer's recommendations. Water based materials shall not be thinned more than one (1) pint per gallon and be a 1.5 dry mil thickness 3. Materials shall be applied without runs, sags or cracking. 4. The contractor is responsible for material damaged by paint and should cover material such as brick, concrete, roofing, cabinets and floors to avoid any potential damage. 5. The painter is to leave in the District a minimum of one gallon of each color and/or stain for touch up. Each can is to be clearly marked. Builder will supply the cans. A. INTERIOR 1. Any excessive drywall / concrete wall damages or missing t rim is to be brought to the attention of the project manager prior to priming the walls. 2. All dust must be wiped off walls and molding prior to applying all coats of paint. Floors must be covered prior to starting work. 3. Drywall is to be primed at 4 mils wet film thickness. Drywall can be sprayed, but it must be back rolled. 4. Sanding is required on all trim / Doors / Concrete Walls / drywall after the prime coat. Sandpaper grit #100 or finer should be used. Damage resulting from over sanding drywall / concrete walls / Trim / Doors will be the painter's responsibility to repair. 5. All point ups are to be sanded by painting contractor. 6. All rough trim is to be filled and sanded by painting contractor prior to final coat of paint.

7. Patches and point ups that are applied after the prime coat must be primed prior to applying the finish coat. All wall areas must have two coats of paint. 8. Drywall finish coat is to be applied at 4 mils wet film thickness to provide a uniform and even texture with no less than ½" nap roller. (Back rolling is acceptable but care is to be taken to assure 4 mils wet coverage.) 9. No paint on hinges, window tracks and locks, or subfloors that receive vinyl flooring or carpet. 10. Fill all nail holes with painter's putty (caulk not acceptable). Putty must dry 12 hours prior to application of oil finish coat. 14. Caulk the bottom edge of casing and floor jambs to vinyl floors. 15. Caulk all joints on casing and other interior trim. Joints or gaps in excess of 1/8" should be brought to the attention of the field manager. 16. Paint all six sides of doors. 17. Paint top of door frame and window casing. 18. Paint casing backband with gloss. 21. Handrails are to be painted with gloss trim paint. 23. Ceilings are not to be painted. 24. Finish coat must be 4 mils wet thickness and can be applied by spraying or brushing. No less than 1.5 mils dry film thickness. 25. Prime all metal doors with acrylic bonding primer. Prime all galvanized mechanical vents with a galvanized metal primer. 26. Paint top and bottom edge of all doors and windows. B. PAINTING SPECIFICATIONS INTERIOR: 1. Drywall sheetrock/ Concrete walls/ Doors/Trim/ to be minimum 4 mil wet and 1.5 dry thickness 2. First coat with (TBD specified color). 3. Second coat (TBD specified color). C. CLEAN UP All trash is to be disposed of properly at the direction of the project manager.

D. WARRANTY Contractor warrants to Owner that all labor performed and materials furnished by contractor shall conform to the specifications of this agreement, be of good quality and free of faults and defects, and be in accordance with the requirements of all applicable government authorities. Contractor expressly warrants that the work shall remain free of defect for a period of at least one (1) year from the date of purchase/completion of project by the Contractor. In addition to any other warranties provided herein, contractor hereby warrants its workmanship and materials in full accordance with the Warranty Corporation Program and all applicable sections of the Manual of Approved Standards for the product. All work not conforming to the aforementioned requirements shall be considered to be defective. If, within the time periods set forth in the foregoing warranty (or for a period of one (1) year for latent defects), any of the work is found to be defective or not in accordance with the terms of this agreement, contractor shall promptly correct such work or replace or repair any defective material upon notice from the District. Contractor agrees to make all repairs and correct such defects under the applicable warranty within five days (5) days of notice of such defect as determined by District. Contractor shall furnish all warranties and/or guarantees by manufacturers of the products provided E. SAFETY Contractor shall at its own expense provide proof on insurance that protect its employees and all other persons from risk of death, injury or bodily harm arising from or in any way related to the work. Contractor shall fully comply with all laws, orders, citations, rules, regulations, standards and statutes concerning occupational health and safety, accident prevention, safety equipment and practices, including, but not limited to federal and state OSHA regulations. Safety Contact Person Phone # ( ) Contractor shall prohibit/prevent the presence or use of alcohol or drugs by its employees, permitted subcontractors or suppliers at a job location or performance by any such person under the influence of alcohol or drugs. Contractor shall immediately pay all fines or penalties assessed upon contractor relating to the work. Furthermore, contractor shall immediately notify the District of any accidents or injuries on the work site. Contractor must supply the District with Material Safety Data Sheet (MSDS) for any hazardous material used in completion of the work performed for district.
