Phil Further to your recent correspondence with my colleague George Walker, please find attached a revision to our Position Statement for Barton Farm. The only amendment to the previous is additional paragraphs at the end of the Foul Water Treatment section to reflect the recent clarifications. Similarly we have amended the summary to reflect these changes. I would be grateful if you could review the attached and respond with your agreement. Dear Sir BARTON FARM, WINCHESTER – POSITION STATEMENT Further to recent telephone conversations and subsequent email and letter correspondence between Southern Water and ourselves, we wish to confirm the position of the above development with regards to surface water, foul water sewerage, foul water treatment and potable water supply. We would be grateful if you could review the below and confirm that it is a true statement of the current position. Surface Water In your letter dated 10 March 2009 (Your Ref: HWI/1005439) you stated: “There are no surface water sewers in the vicinity of the development site. It is recommended that the surface water runoff is discharged directly to soakaways if effective at this location or into a nearby watercourse” Our proposals for the surface water strategy on the site correspond with this statement. We propose that surface water be discharged to ground within the development boundary via soakaways and infiltration basins. Foul Water Sewerage In your letter dated 10 March 2009 (Your Ref: HWI/1005439) you assumed that the connection point to the public foul sewerage system would be at manhole reference SU46329101 for a flow of 92.6 l/s. This assumption formed the basis of the following statement: “The analysis indicates that the existing foul system downstream of manhole SU46329101 up to the inlet works at Harestock WWTW is inadequate to accommodate proposed foul flows of 92.6 l/s. Improvements to the sewerage system will be necessary to accommodate the development flow of 92.6 l/s. The options are to either: Increase the existing 300mm diameter sewer to 1100mm from manhole SU4632910 up to the WWTW. (Total length approx 187 metres) The proposed foul flow is discharged directly to the Wastewater Treatment Works.” We have reviewed the information available to us and we agree that the two options above are the only solutions available for foul sewerage from the development site. The preferred choice of connection is

dependent on outcome of topographical surveys in the area of the proposed connection and whether there is any recourse to third party land in providing the connection. If the latter was to occur the developer would seek to connect to the public sewer network through a requisitioned sewer. We understand that the cost for the foul water connection, to a point of adequacy on the public sewer network, will be borne by the developer whether it is procured through the requisition procedure or constructed as part of the development contract. Foul Water Treatment In your letter dated 10 March 2009 (Your Ref: HWI/1005439) you provided an initial analysis of the capacity at Harestock Wastewater Treatment Works which stated: “The proposed development flow of 92.6 l/s will have a considerable impact to the treatment process at the works. Recent upgrades to the treatment works provide sufficient capacity for the first 1000 houses (46.3 l/s) in the development. Further upgrades at the treatment works will be required to provide the remaining treatment capacity required.” This statement was supported further by your email on 11 May 2009, which stated: “Based on recent flow data there is currently DWF headroom for in excess of 4000 houses, however process capacity has only been built for around an additional 1000 houses. There is no scheme proposed in AMP5 to increase the process capacity at this works (as it is not expected that the additional 1000 will be delivered and occupied in the AMP5 period 2010 – 2015). For further growth, a new discharge consent application will be required. As part of the process, we will have to provide sufficient information for the Agency to determine the application and this will have to demonstrate compliance with whatever targets the Agency set for the increased discharge.” Based on the above statements and subsequent telephone conversations with Southern Water we are satisfied that there is sufficient capacity, in the treatment process, headroom and discharge consent, for the initial 1000 units at Barton Farm. The upgrade to the works, for treatment process capacity purposes, would take place in the next Asset Management Plan period (2016 onwards). The exact date for commencement of this work would be agreed with Southern Water once the development programme has been finalised. We understand that the cost for upgrading the treatment works for the additional 1000 units will be borne by Southern Water. In addition to the above it is also our understanding that Southern Water will be responsible for gaining discharge consents from the Environment Agency for the additional capacity at Harestock. In gaining this consent it is our understanding that Southern Water will meet all the Agency’s requirements for water quality and undertake an Appropriate Assessment to satisfy Natural England with regards to the River Itchen. Potable Water In your letter dated 11 May 2009 (Your Ref: HWI/1002668) you provided the following conclusions to the analysis of the water distribution system in the vicinity of Barton Farm:

“Having modelled this development in isolation using an estimated peak demand of 22.69 l/s, there would appear to be little impact within the local area. Therefore it is concluded that this development may proceed with connection to the 21” CI main, via a new 250mm dia main, where it crosses Andover Road south of the proposed development site at OS Grid Ref SU 4730 SE assuming the following: A local booster and metered connection are installed A new chlorination booster is installed at Westhill.” Following a review of the above letter we are satisfied that the development can be served by Southern Water’s existing water distribution system, subject to minor modifications. It is our understanding that, as the model shows there is little impact within the local area, the development can be served from within the existing abstraction licence held by Southern Water. Summary The current position with regards to drainage and water supply at Barton Farm can be summarised as follows: There is no surface water apparatus within the vicinity of the proposed development. All surface water generated will be discharged to ground within the development boundary. The foul water apparatus that exists within the vicinity does not have the capacity for the anticipated flows from the development. There are two possible solutions to the capacity issue; an upgrade to the existing sewer in Andover Road or a connection direct to Harestock Wastewater Treatment Works. Harestock Wastewater Treatment Works has the treatment capacity for 1000 units from the Barton Farm development. An upgrade of the works would be required in the next Asset Management Plan period to cater for the additional 1000 units. As part of this upgrade Southern Water would ensure that all the requirements of Environment Agency and Natural England are met. The development can be served by Southern Water’s existing water distribution system, and within the existing abstraction licence, subject to minor modifications. We trust that the above is self explanatory and we would be grateful if you could give Southern Water’s agreement to the above by return of letter. If you wish to discuss the above or any other matter relating to the drainage and water supply at Barton Farm please do not hesitate to contact us. In addition to the above we have recently purchased sewer records from Southern Water which do not cover the area we are interested in. In our letter to your Land Searches department we enclosed a plan of the site requesting that the records extend as far as Harestock Wastewater Treatment Works. Unfortunately the plans we received do not extend as far as requested. We would be grateful if you could resolve this. A copy of the original request and the received plans are enclosed for your information.

Dear Phil, Further to the recent meeting we had in Winchester I wondered if you had been able top make any progress with respect to the outstanding drainage issues at Barton Farm, which need to be resolved as part of our preparation of the Environmental Statement. As I understand it the principal outstanding issues are as follows: Confirmation of water supply capacity for the development. We have not yet received Southern Water's confirmation that the existing water supply network is capable of serving the development. From our discussions with the Environment Agency we understand that the abstraction licences held by Southern Water are very likely to have sufficient 'headroom' to enable the development to be supplied without the need for any uplift in abstraction volume and that hence there would be no need for any further Appropriate Assessment on the River Itchen with respect to water supply. It is however very important that we are able to confirm this definitively and so I would be very grateful if you could provide a formal response on water supply as soon as possible. Foul Sewerage Your recent correspondence confirms that there is insufficient capacity in the local foul sewers to accommodate the flow from the site and that the existing sewer would have to be upgraded or a new sewer laid to the treatment works. In order for us to determine the most appropriate engineering solution I would be grateful if you could provide sewer records between the site and the treatment works. (I understand there may be a charge for this and my colleague Adam Spiller will contact you shortly to arrange this if necessary). Sewage Treatment Southern Water has confirmed that there is currently sufficient treatment capacity at the Harestock Treatment Works for up to 1000units from the Barton Farm Development. I also understand that the further upgrading of the Works to accommodate the remaining 1000 units is currently within Southern Water's current Asset Management Plan. At our last meeting you agreed to check whether the discharge consent obtained for the initial upgrading works also included for the planned future capacity upgrade (on account that if so, no further Appropriate Assessment of the Itchen would be required) and I would be grateful if you could advise if any progress has been made on this. On the assumption that a further consent will be required for the future upgrading, are you able to advise whether Southern Water can give a commitment that it will comply with all of the Environment Agency's requirements with respect to discharge levels (particularly phosphates) and that accordingly an Appropriate Assessment will be undertaken as part of the upgrading consent application to demonstrate nil detriment to water quality? (Although I don't believe it will be necessary to undertake an Assessment for the Barton Farm planning application, we will as a minimum need to be able to confirm such a commitment from Southern Water to satisfy both the EA and Natural England and clearly we will need Southern Water's assistance with this.)

I appreciate that you are reliant upon others within Southern Water for the above information but time is running out and we need to make progress on these issues to enable us to complete our Environmental Assessment. It would assist us greatly if we could meet with you and your relevant colleagues to discuss and resolve the above issues and I would be grateful therefore if you could advise whether or not you are able to meet with us at this time and perhaps suggest a possible convenient date. Please do not hesitate to call me to discuss any of the above if necessary. 1

Dear Sirs We contacted Southern Water in October 2008, via your consultants Atkins, to undertake a Level 2 design capacity check for the above site. We require capacity information for the foul network in the vicinity of our development, an assessment of the capacity available at the nearest wastewater treatment works (Harestock) and the capacity in the local potable water supply network. Despite conveying the size of the development to your consultants we were told following the submission of our application that the development (2000 dwellings plus primary school and small commercial area) would be too large for their office to deal with and informed us we should contact corporate planning to discuss the way forward. We contacted yourselves in November 2008 to ascertain the best way forward in terms of the application and provided you with the information submitted in the application (which is attached for your information). We would be grateful if you could advise on the best way forward regarding the capacity analysis as the results are required urgently for inclusion in the Environmental Statement currently being prepared for the development. If you require any further information to proceed with the capacity analysis or wish to discuss any of the above please feel free to contact us, we will be happy to provide all the information we have available to ensure that the analysis can begin.
