Processor Pricing for IBM WebSphere MQ Broker Products Overview In response to your feedback, it is now simpler to do business with IBM. You now pay for IBM software licenses on a per-processor basis for: • • •

WebSphere MQ Integrator  V2.1 WebSphere MQ Integrator Broker for Multiplatforms V2.1 WebSphere MQ Event Broker V2.1

This is a change from the per-capacity-unit model of charging for software licenses. You should expect no general increase or decrease in net costs. However, any change in cost will depend on your unique circumstances, relating to the number of processors in your machines.

If you do not have a Software Maintenance contract, you are not affected by this change and should continue using your programs under the capacity-unit terms. Processor-priced products will have their equivalent capacity unit products withdrawn on May 5, 2003.

Migration for customers who have existing capacity unit license entitlements will be at the time of Software Maintenance renewal. A standard conversion rate of two capacity units to one processor license unit will be used. In the majority of situations, this conversion will ensure that customers have sufficient entitlements. However, where machines have five or more processors (and in a few other cases), the standard conversion will not give the required number of entitlements. In this case, when contacted by IBM, you should discuss acquiring additional entitlements to be correctly licensed under the new pricing model. You will not be charged for additional entitlements granted under this process, but the Software Maintenance renewal will be amended based on the number of entitlements needed.

Description Charging Charges for authorized use of the program are based on processor license units (PLUs). The use of the program on any server machine requires one PLU to be acquired (from IBM or an IBM Business Partner) for each processor contained in the server machine on which any copy of the program is to run. PLUs are required for every server machine on which the program is installed. You are also required to obtain a corresponding number of additional PLUs if the program installation is moved to a server machine with a greater number of processors, or if any additional processors are added to the server machine on which the program is installed.

For Software Maintenance renewals for deployments on servers of five processors and greater, and new software purchases for deployments on servers of five processors and greater, you are eligible for special bid on the software.

Failure to comply with the requirement for the appropriate number of PLUs will invalidate the terms of this license. For Software Maintenance renewals for deployments on servers of five processors and greater, and new software purchases for deployments on servers of five processors and greater, you are eligible for special bid on the software.

Note: The announcement for WebSphere MQ Integrator Broker for Multiplatforms V2.1 introduced a “single processor entry charge (one capacity unit).” This allowed limited information brokering on a uniprocessor machine with connections to up to three end points. Customers who subscribed to this offering, and have Software Maintenance in place, are entitled to conversion to a single PLU under the new licensing terms. The single PLU does not have any restrictions on its use. There is no follow-on “entry charge” program for new orders on the PLU terms.

Additional Information

Users who upgrade from an earlier release of each program under Passport Advantage can use their existing capacity units and then acquire additional PLUs to satisfy the requirements given below. The capacity units from the previous release will be converted to PLUs (at a rate of two capacity units to one PLU) and counted as all or part of the customer entitlement.

Charging

Use of Hewlett Packard Java RTE V1.3 (for HP-UX only): The HP-UX version of the program includes a Java Runtime Environment (RTE) supplied by Hewlett Packard (HP). Any use of the HP RTE is subject to the HP software licensing and warranty terms set out in the IBM License Information. Users of the program will be asked to indicate their acceptance of the HP license and warranty terms, when installing the program. If the HP license and warranty terms are not acceptable, then you should return the program immediately to your supplier, for a full refund of any money paid by you for it.

Failure to comply with requirement for the appropriate number of PLUs will invalidate the terms of this license. No separate server authorizations are required to license any other component part of the program. You should retain your original product and all Passport Advantage documents as PoE. Specific restrictions also apply to various components of the program, as described below.

Software Maintenance Applies: Yes

Software Maintenance, previously referred to as Subscription and Technical Support, is now included in the Passport Advantage Agreement. Installation and technical support for the products announced in this letter are provided by the Software Maintenance offering of the IBM International Passport Advantage Agreement. This fee service enhances customer productivity by providing voice and/or electronic access into the IBM support organizations.

MQSeries /WebSphere MQ: The program includes a copy of MQSeries or WebSphere MQ (together, “MQSeries”). For each PoE you are authorized to install and use MQSeries in association with your use of the program. You are authorized to install two copies of MQSeries for use with the program. You are authorized to use MQSeries only with messages generated for the program, and not for other purposes. To use MQSeries for other purposes, you must acquire a separate nonrestricted PoE for an MQSeries software product that authorizes such use.

IBM includes Software Maintenance with each program acquired during the coverage period. The coverage period means the period commencing on the date you acquire the program up to the first or second anniversary date, depending on whether you acquired coverage for one or two anniversaries. The coverage period for Software Maintenance acquired in the two months preceding an anniversary date will be extended to the next applicable anniversary date.

DB2 : The program includes a copy of DB2 Universal Database (DB2). For each PoE, you are authorized to install and use DB2 in association with your use of the program. You are authorized to install one copy of DB2 for use with the program. You are authorized to use DB2 only for the storage and management of data generated by the program, and not for other data management purposes. To use DB2 for other purposes, you must acquire a separate nonrestricted PoE for a DB2 Universal Database software product that authorizes such use.

While your Software Maintenance is in effect, IBM provides you assistance for your:

Microsoft Data Access Components (MDAC): The program includes a copy of MDAC. Use of MDAC by you is subject to the terms of the “End User License Agreement for Microsoft Software”, a copy of which is included with the program on the Supplemental CD-ROM. In particular, you are granted no right or license to redistribute MDAC. If you wish to acquire the right or a license to redistribute MDAC, you should contact Microsoft Corporation to obtain the necessary authorization.
