NOTICE OF INTENTION TO DESIGNATE AN ARCHAEOLOGICAL SITE AS A PROTECTED ARCHAEOLOGICAL SITE Archaeology Act Cap. A-17.1 Regulations TAKE NOTICE THAT I, Premier and Minister Responsible for Aboriginal Affairs and Archaeology in the Province of Prince Edward Island, intend to designate the following archaeological site as a protected archaeological site, as described in the attached legal description, in accordance with the Archaeology Act and the regulations: Red Bank, Mount Stewart (CcCr-51 and CcCr-52) Mount Stewart, Prince Edward Island PID 784702 Government of Prince Edward Island (Owner) I am satisfied that in accordance with the Act and the regulations, this site represents a significant archaeological feature in Prince Edward Island and I intend to designate this site, including all land appurtenant to it, as a protected archaeological site on or after September 1, 2012 to be protected under the authority of the Act. Where a site is designated as a protected archaeological site, no person shall build on or undertake works that may affect any site designated under the Act without a permit. By the authority of section 4 of the regulations, no person shall change or alter the site or area for a period of 120 days from the date of service of this notice, unless this notice is otherwise cancelled under the Act or the regulations. Any prescribed person or interested or affected party likely to be effected by the intended designation order may object to the intended designation by serving a notice of objection to a protected archaeological site designation within 30 days of the date of the publication of this Notice in the Gazette. Service of a notice of objection to a protected archaeological site designation must be made on me, in care of: Hon. Robert Ghiz Premier and Minister Responsible for Aboriginal Affairs and Archaeology P.O. Box 2000, Charlottetown, PE C1A 7N8. A notice of objection to a protected archaeological site designation form may be obtained from that office. If a notice of objection to a protected archaeological site designation is served upon me within the prescribed time, I am required to proceed in accordance with subsection 6(2) of the regulations. If no notice of objection to a protected archaeological site designation is served as prescribed, I may proceed with the designation in accordance with subsection 6(1) of the regulations. REGULATIONS EC2012-304 OCCUPATIONAL HEALTH AND SAFETY ACT FALL PROTECTION REGULATIONS AMENDMENT (Approved by His Honour the Lieutenant Governor in Council dated May 29, 2012.) Pursuant to section 46 of the Occupational Health and Safety Act R.S.P.E.I. 1988, Cap. O-1.01, Council made the following regulations: 1. The Occupational Health and Safety Act Fall Protection Regulations (EC633/04) are amended by the addition of the following after section 2: 2.1 (1) Where, in accordance with subsection 2(1) or (4), an employer of a worker provides the worker with a means of fall protection for use at a work area, the employer shall ensure the worker is trained in the use of the means of fall protection by a competent person and that the training includes (a) training in the use, care and inspection of the means of fall protection; and (b) a review of the provisions of these regulations that apply to the means of fall protection.

(2) An employer shall (a) maintain a training record for each worker during, and for a period of two years following, the worker’s employment with the employer; and (b) make the record available to an officer upon the officer’s request.

(3) A training record referred to in subsection (2) shall include (a) the name of the worker who received the training; (b) the date on which the training took place; (c) the name of the competent person providing the training; and (d) any training material provided to the worker.

EC2012-305 REVENUE TAX ACT REGULATIONS AMENDMENT (Approved by His Honour the Lieutenant Governor in Council dated May 29, 2012.) Pursuant to subsections 57(1) and (2) of the Revenue Tax Act R.S.P.E.I. 1988, Cap. R-14, Council made the following regulations: 1. Subsection 1(1) of the Revenue Tax Act Regulations (EC262/60) is amended (a) by the revocation of clause (b.1) and the substitution of the following: aquaculturist
(b.1) “aquaculturist” means (i) an individual who (A) is actively engaged in the cultivation and harvesting of aquatic plants and animals for sale, (B) has the appropriate aquaculture leases, licenses or permits issued by the federal government, and (C) earns (I) at least $10,000 of the individual’s gross annual income from the sale of aquatic plants and animals, or (II) at least 25 per cent of the individual’s gross annual income from the sale of aquatic plants and animals, if the individual does not earn at least $10,000 of the individual’s gross annual income from the sale of aquatic plants and animals, (ii) a corporation that

(A) is registered in this province under the Companies Act R.S.P.E.I. 1988, Cap. C-14 or the Extra-Provincial Corporations Registration Act R.S.P.E.I. 1988, Cap. (ii) a corporation that (A) is registered in this province under the Companies Act or the Extra-Provincial Corporations Registration Act, (B) is actively engaged in the cultivation and harvesting of forest trees for sale, and (C) earns (I) at least $10,000 of the corporation’s gross annual income from the sale of forest trees, or (II) at least 25 per cent of the corporation’s gross annual income from the sale of forest trees, if the corporation does not earn at least $10,000 of the corporation’s gross annual income from the sale of forest trees, or (iii) a partnership that (A) is registered in this province under the Partnership Act, (B) is actively engaged in the cultivation and harvesting of forest trees for sale, and (C) earns (I) at least $10,000 of the partnership’s gross annual income from the sale of forest trees, or (II) at least 25 per cent of the partnership’s gross annual income from the sale of forest trees, if the partnership does not earn at least $10,000 of the partnership’s gross annual income from the sale of forest trees; 2. These regulations come into force on June 9, 2012. EXPLANATORY NOTES SECTION 1 replaces the current definitions for the words “farmer”, “commercial fisherman”, “aquaculturist” and “silviculturist” with improved definitions. These new definitions clarify which persons in such occupations qualify for a Revenue Tax Exemption Certificate by -requiring a corporation and partnership included in these definitions to be registered respectively under the Companies Act or the ExtraProvincial Corporations Registration Act and the Partnership Act; -correcting a reference in the definition for “farmer” to the Future Farmer Program to recognize that only an individual, and not a corporation or a partnership, can be registered in the Future Farmer Program; and

-adding an alternative income test, similar to the one currently in the definition of “farmer”, to the definitions for “commercial fisherman”, “aquaculturist” and “silviculturist” to expand the reach of these terms. This section also amends the definition of “hybrid vehicle” to include vehicles that derive their motive power solely from electricity. SECTION 2 provides for the commencement of these regulations.
