Restricted Tests Some tests published by The Riverside Publishing Company, including but not limited to the Stanford-Binet Intelligence Scale, the WoodcockJohnson Psycho-Educational Battery-Revised, the Das •Naglieri Cognitive Assessment System, the Aphasia Diagnostic Profiles, and the Scales of Cognitive Ability for Traumatic Brain Injury, must be administered by a trained, certified examiner. Purchase of these tests is therefore restricted to qualified institutions and examiners, as defined below.

Qualifications for Ordering Tests The Riverside Publishing Company requires all first-time test purchasers to furnish evidence of their qualifications to use tests. See Qualification Form. Riverside reserves the right to require evidence of qualification on any or all subsequent purchases. Riverside reserves the right to accept, reject, or withdraw whole or part orders for materials when the recommended standards are not met. Riverside may also reject orders that conflict with local school district or state department of education policies that restrict the distribution of test materials.

Educational Institutions Accredited schools and colleges must submit orders on an official purchase-order form or the school’s official stationery. The order must be signed by a school administrator. Initial orders from private schools must be submitted with the Test Purchaser Qualification Form.

Teachers Teachers must submit their orders on the school’s stationery, accompanied by a purchase order if required by the school. The order must be countersigned by the school principal or by another authorized administrator.

Hospitals, Rehabilitation Centers, and Private Practices Accredited hospitals, rehabilitation centers, and other medical facilities must submit orders on an official purchase-order form or the institution’s official stationery. The order must be signed by an administrator. Initial orders from private practice groups must be submitted with the Test Purchaser Qualification Form.

Individuals To qualify for purchasing the test products in this catalog, an individual must indicate membership in a qualified professional organization or hold professional licensure or certification from a qualified agency. Unless qualified by one of these methods, individuals in private practice and business and government agency staff members who have not previously ordered Riverside

test materials must submit the Test Purchaser Qualification Form or a letter outlining all the information requested on it. Additional verification of qualifications may be required.

University Students Graduate and undergraduate students and researchers may order test materials for research purposes. Their orders must be countersigned by the professor heading the research study or by another qualified administrator who is willing to accept responsibility for guaranteeing security and proper use of materials and services.

University Training Programs Riverside supports and encourages the use of its individually-administered clinical assessments in college and university courses for training professionals. Faculty who teach these courses know the need for test security and the ethical and professional standards for valid use of these tests. College or university faculty using individuallyadministered tests published by The Riverside Publishing Company may qualify for a special 40% discount on complete or basic test kits. This discount does not apply to group-administered tests such as the Iowa Tests of Basic Skills, to tests which Riverside distributes but does not publish, or to university libraries ordering tests for uses other than training students in a specific course. To qualify for this discount, all orders must be placed using the University Training Discount Order Form. All orders are subject to a shipping and handling charge.

Prohibition Against Sale and Distribution of Tests Riverside products may not be resold or distributed without written permission from the publisher.

Prices, Terms, & Conditions of Sale The sale of Riverside test materials and services is based upon acceptance of the prices, terms, and conditions described here. A purchaser accepts these prices, terms, and conditions by signing an order form or purchase order. The Riverside Publishing Company is not bound to any modification or addition to the prices, terms, or conditions of sale unless agreed to in writing by an officer of the company. All materials are shipped F.O.B. shipping point. All orders should add a shipping and handling charge of 10% (20% for all rush orders) of the total price of all materials purchased. Payment is due net 30 days. Cash discounts are not available.

Conditions of Sale Test Security The following statement appears on all of Riverside’s invoices: These tests contain questions that are to be used solely for testing purposes. No test items may be disclosed or used for any other reason. By accepting delivery of or using these tests, the recipient acknowledges its responsibility for maintaining test security that is required by professional standards and applicable state and local policies and regulations governing proper use of tests and for complying with federal copyright law which prohibits unauthorized reproduction and use of copyrighted test materials. Maintaining test security is the direct responsibility of the test purchaser and/or user. Test security involves procedures for shipping, receiving, storing, disseminating, and controlling test materials. Materials should be released only to qualified persons designated as participants in the local testing program. School officials are responsible for providing in-service to ensure that all examiners are qualified to administer and use the tests. Test examiners must not reproduce the tests or paraphrase the directions when administering the tests since such practices may invalidate results. Also, administrators must follow test directions exactly as prescribed and strictly observe the administration times for timed tests to avoid invalidating the results. Practice tests may be used as an orientation to various tests. Under no circumstances, however, are old test editions to be used in place of practice tests. Some state or local laws or regulations require that a student, parent, or guardian be allowed to review a test and/or the examinee’s responses to the test. When honoring a request for test review, the school must have a representative of the school present at all times.

Warranties The Riverside Publishing Company warrants that each test offered for purchase is suitable for its intended use, meets educational and professional standards, and is manufactured in usable quality. Unless expressly agreed to in writing by an officer of the company, the company makes no other warranties, expressed or implied, including implied warranties of merchantability and fitness for a particular purpose. The purchaser and/or user assumes all responsibility for use or misuse of the tests. Return, replacement, or refund of all or part of the purchase price, based upon usability of the test materials and services, is the company’s sole option, and constitutes the sole and exclusive remedy of purchaser, in lieu of actual, consequential, special, incidental, or other damages in connection with a test, test materials, scoring, or other services, and any misuse of same. Riverside will not, under any circumstances, be liable for the purchaser’s and/or user’s expenses in using a test; for delays; for costs of substitute materials and shipping; or for possible lost income, grants, profits, or any other damages.

Ordering Information Copyright Restrictions All Riverside publications and many specialized forms and services are copyrighted. The purchaser and/or user acknowledges and agrees when ordering that the contents of the company’s tests, including proprietary and confidential material, property, procedures, and information owned by Riverside and/or its authors, constitute what is legally termed trade secrets. The tests and ancillary test materials, including answer documents, score reports, diskettes, and norms tables, are copyrighted. As such, they may not be reproduced, replicated, or transmitted, for any purpose, in whole or in part, in any form or by any means, electronic or mechanical, or be stored in a database or retrieval system, without prior written permission by an officer of the company.

Permissions and Licensing Riverside requires a license of all users of norm tables, including users in nonprofit institutions. Test norms are an integral part of the test. Copying test norms without authorization is a violation of copyright. Information about licensing procedures for use of norm tables and similar copyrighted tables may be obtained by writing to: Contracts and Permissions Department Riverside Publishing 425 Spring Lake Drive Itasca, Illinois 60143 Requests for permission to reproduce, translate, or modify all or any part of Riverside’s copyrighted materials, including out-of-print titles, should be forwarded to the Riverside Contracts and Permissions Department prior to the time any work has begun. The requests should include information about the nature and purpose of the research study, thesis, report, or publication for which the reproduction is needed. The exact description of what is to be reproduced, how the reproduction is to be made, and information about the distribution and/or sales of the publication in which the reproduction will appear must be provided. Answer documents—answer cards, answer sheets, answer folders, and answer booklets— are an integral part of the tests and are protected by copyright laws. All users, including school personnel, who wish to reproduce, modify, or adapt answer documents in any manner, including overprinting of generalized documents, are required to obtain licenses. Procedures for royalty payment, based on number of answer sheets reproduced, are included in the licensing arrangement. How to Order Test Materials Materials described in this catalog are usually shipped by UPS. If a specific method of shipment is preferred, please authorize such a shipment on the purchase order. Rush orders with short timelines will be shipped by the most effi-

cient means needed to meet the date requested. Rush orders require a shipping and handling fee of 20% ($10.00 minimum) of the total price of materials purchased. The delivery address should be checked for accuracy. Information about restricted delivery, including the hours of days during which shipments can be delivered, must be provided. Reshipments of undeliverable orders will be charged to the purchaser. All shipments should be checked as soon as they are received.
