Description General Discussion - Prior to the meeting, Haldimand County was sent the Draft Project Description Report and the Notice of Proposal to Engage in a Project and Notice of Public Open House. - Hard copies of the Draft Project Description Report were provided at the meeting, so that they could be placed in each of the four Haldimand municipal offices for area residents to be able to review. - Lidy Romanuck was identified as the point of contact for Haldimand County regarding the Project. - An overview of the Project was provided including the proposed Project timeline. - Proposed layout maps were shown and indicated that the layout was draft and still needed to be finalized. - The “REA Consultation Form: municipalities, local authorities” was provided and a description of the REA process, timelines and reporting was explained. - Details about the Project plans were provided including the Project size. The County was aware there will be two other projects being proposed and would be developed around the same time in the area. - The County will be getting organized to facilitate the proposed projects and to put together an internal team with representatives from each relevant department for the wind farms. They would like to have someone present to review all of the turbine locations once determined. This person will also drive around with our engineers/technicians to identify any potential issues with our proposed construction plan (drainage considerations, etc.). - A reminder was provided about the upcoming Public Open Houses for the Project.

Total Area of Site (hectares) The Project Location encompasses approximately 215.96 hectares of land, plus 52.55 km of collector lines in the municipal road allowance.

Provide a description of the facilities equipment or technology that will be used to convert the renewable energy source or any other energy source to electricity. The basic components of the Project include 58 Vestas model V90-1.8 MW wind turbine generators with a total installed nameplate capacity of 104.4 MW. Capital Power has elected to assess and seek approval for up to 60 potential turbine sites (therefore, two alternate turbine sites). Final selection of sites to be used will be based on the results of the detailed design and engineering work, as well as the conditions experienced during construction. Other Project components include a 34.5 kV underground and overhead electrical power line collector system, a substation, an operation and maintenance building, a meteorological tower, and turbine access roads. The electrical power line collector system will transport the electricity generated from each turbine to the substation, located adjacent to an existing Hydro One Networks Inc. 230 kV transmission line. Reference: Port Dover and Nanticoke Wind Project Dear Lidy Romanuk: I am writing to provide you with some additional information regarding the proposed Port Dover and Nanticoke Wind Project. In late November 2009, Capital Power L.P., a unit of Capital Power Corporation, acquired the Port Dover and Nanticoke Wind Project that had previously been under development by Tribute Resources Inc. Capital Power has now assumed responsibility for the development of the Project. Capital Power is a growth-oriented North American power producer, building on more than a century of innovation and reliable performance. Headquartered in Edmonton, Alberta, Capital Power has interests in 31 power facilities in Canada and the U.S. totaling approximately 3,400 MW of generation capacity. More information about Capital Power can be found at www.capitalpower.com. Tribute Resources Inc. commenced the provincially mandated Renewable Energy Approvals (REA) process, Ontario Regulation 359/09 (Regulation), for the project including identifying the Project Location Area. Upon the project transitioning to Capital Power, it was decided by the Capital Power Project Team to extend the boundaries of the northwestern portion of the project area (please see the attached updated Project Location map).  

  Capital Power held two initial public open houses in December 2009 for the project. The open houses provided community members the opportunity to learn more about the preliminary details of the project, to ask questions and to provide comments. Copies of the information boards displayed at the open house are enclosed for your review, as well as two recent studies Wind Turbine Sound and Health Effects – An Expert Panel Review, December 2009 and The Impact of Wind Power Projects on Residential Property Values in the United States: A Multi-Site Hedonic Analysis. Two additional public open houses for the project will be held to provide an opportunity for community members to review the results of our environmental studies with our Project Team and to raise additional questions and concerns regarding the project. It is anticipated that the two additional open houses will be held this summer. Notices of the open houses will be mailed to landowners within the Project Location area and identified organizations and agencies at least 60 days prior to the open houses and posted in local newspapers and on our project website at www.capitalpower.com/portdovernanticoke.

Also enclosed for your review is our first Port Dover and Nanticoke Wind Project community newsletter. Dear: County Staff Member I am writing to provide you with information regarding the Port Dover and Nanticoke Wind Project, a renewable energy project that Capital Power is proposing in Haldimand and Norfolk Counties. Capital Power is a growth-oriented North American power producer, building on more than a century of innovation and reliable performance. Headquartered in Edmonton, Alberta, Capital Power has interests in 31 power facilities in Canada and the U.S. totaling approximately 3,500 MW of generation capacity. More information about Capital Power can be found at www.capitalpower.com. In late November 2009, Tribute Resources Inc. sold the Port Dover and Nanticoke Wind Project to Capital Power. Capital Power has now assumed responsibility for the development of the Project. Most recently, on April 8, 2010, Capital Power was offered a contract through the Ontario Power Authority’s Feed-In Tariff (FIT) program for the proposed Project. Although we are very excited about the possibility of bringing additional renewable energy to Ontario, receiving this contract is one, of many milestones that must be reached before final decisions about the Project can be made. Tribute Resources Inc. commenced the provincially mandated Renewable Energy Approvals (REA) process, Ontario Regulation 359/09 (Regulation), for the Project including identifying the Project Location Area. Upon the project transitioning to Capital Power, it was decided by the Capital Power Project Team to extend the boundaries of the northwestern portion of the Project area (please see the attached updated Project Location map). Capital Power held two initial public open houses in December 2009 for the Project. Two additional open houses for the Project will be held on Tuesday, June 8th and Wednesday, June 9th. Item: Introduction to Project, Schedule, and Renewable Energy Approval (REA) Requirements Capital Power provided overview of Project. Haldimand County has been through the REA process once before; staff have an understanding of the process, the Municipal Consultation Form, and the information that would need to be shared between Capital Power and the County. Capital Power is targeting the Municipal Consultation Form to be sent to Haldimand County in June 2010. Stantec noted that mapping provided in the Draft Project Description Report prepared in October 2009 is outdated. The Project has an updated Study Area and the turbine layout will change. Information Requirements: Planning and Development Department Planning and Development Department interested in the following information:        

Heritage features First Nation consultation with respect to archaeological assessment Natural heritage features and Environmental Impact Study (LPRCA will play a role) Acoustic assessment in accordance with MOE requirements Effect on high quality agricultural lands Shadow flicker assessment (Stantec noted the new REA turbine setback requirements) Impact to local roads Decommissioning plan

Impact to Local Roads and Traffic There is some question as to how impact to local roads would be determined per project, with three wind projects proposed in the same area. Some ideas were: 

A pre-condition survey be completed for the main roads to be used (the municipality would complete this)



The projects may have different construction seasons, therefore issue may be minimized;



Split the cost of repairs between the three proponents;



Pick one major hauling route, and the County would do a pre-construction survey;



Major roads, which are the potential shared haul routes, may not be a problem, since some are already designed for big trucks (issue to consider are the entrances to access roads).

A transportation plan would be developed for the Project, but details regarding haul routes, etc. would be determined by the Contractor. Haldimand County noted that if the plan was not available during the REA process, the County would need to be provided enough information to determine effects on roads. Haldimand County asked about the expected volume of truck traffic for the Project. Capital Power indicated that approximately 400 m3 of cement is required per foundation, which is approximately 20 cement loads per foundation, plus 15 truck loads of turbine parts per site. Capital Power indicated that about 10 turbines would be constructed per week. The County noted that there is a ½ load restriction from March 1 – April 30. The County noted that most secondary roads are tar and chip, or gravel. Access Roads and Crossings Capital Power explained the difference between construction roads and final access roads. The County asked if larger culverts are used for the wider construction roads, and then replaced with smaller culverts when the road width is decreased at the end of the construction phase. Capital Power and Stantec replied that it is undesirable for environmental and cost reasons to change culvert length between construction and operation phases of the Project. The County noted that they often take over the maintenance of the culverts, and would therefore need the specifications. Capital Power would be providing that information at the time it is available. ACTION: Capital Power to provide specifications for culverts to County when available. Capital Power would be required to obtain Entrance Permits. The municipal fee for these permits includes the follow-up inspection. ACTION: Capital Power to obtain Entrance Permits for the Project. The County has design standards for culverts on website. ACTION: Capital Power to obtain design standards from County website and incorporate into design specifications.

It was noted that LPRCA requirements re: culverts would be more restrictive than the County’s. Collector Lines Capital Power noted that they would likely be installing new poles for the collector lines as the existing poles may not be suitable. The County indicated that they would like to see facilities co-located with existing ones (i.e., they don’t want poles on both sides of the road). It was determined that there are options for this issue, including putting in larger poles and having Haldimand Hydro put distribution lines on these larger poles, or Capital Power may consider working with other proponents to share poles. The County would give consent for poles to be placed in the municipal road right-of-way, and would require approximately two weeks to complete necessary site visits. The County recommended that Capital Power have a meeting with Haldimand Hydro (contact Ed Galinski), who is the primary contact for siting collector lines in the right of way. ACTION: Capital Power to set up meeting with Haldimand Hydro. Identification of Utilities and Services The County explained that there are few locations in the Study Area where buried utilities might create congestion issues for the siting of new facilities (e.g. Nanticoke area). The County has GIS mapping of municipal infrastructure (sewer and water). ACTION: Stantec and Capital Power to draft a list of GIS mapping layers for County that are needed for the Project. Emergency Management County asked about transformers. Capital Power explained that dry transformers are used. REA has general requirements. Capital Power noted that they are a safety-conscious company, and that a lot of time and effort would be devoted to this issue. Capital Power would look into options for participating in training sessions with County emergency services personnel. They have an operational wind plant with resources/operator that can help develop emergency management protocols for this Project. Building Permits Building permits would be required for towers, transformer station, operation and maintenance building. The County has copies of many of the permits applications and forms the Project may require (Ministry of Transportation, Ministry of Labour, civic addresses, etc.). A civic address would be required for each turbine location. Drainage Act Requirements

If in LPRCA Regulated Area, would need a permit from LPRCA. No permit from County is required for work in the municipal drains (won’t need severance, etc.). If something does need to be done (e.g. change to the engineering report), it can be done outside of the REA process. The County has GIS mapping of municipal drains that they can provide. If the Project is near a drain, they can provide us with the detailed report. ACTION: County to provide copy of drainage reports. ACTION: Stantec to add municipal drain mapping to GIS mapping request list. The County noted that Mutual Agreement Drains do exist within the County. These are drainage features subject to an agreement between two or more private landowners. The County does not administer these agreements so Capital Power would need to negotiate directly with the landowners if these features are expected to be affected. Locations of these features would come up in Title Searches for optioned properties. Operation and Maintenance Building County asked for confirmation that this building would be covered as part of the REA process, and won’t require land use approval. ACTION: Stantec to confirm that the building is covered as part of the REA. Identification of Project Infrastructure during Operation Underground infrastructure in municipal road right of way (e.g. at the property line) – the County wanted to know how their Staff would know if there is underground lines. Does this information go into One Call? For safety reasons, the County would like to see the lines marked with a stake or similar marker. ACTION: Capital Power will confirm what their operating wind plant has done to mark underground infrastructure, or if they made sure the poles started before the ditch/ROW. Timing Restrictions New noise bylaw coming into effect, but exemptions can be obtained (Staff report would have to go to Council for approval). Construction is okay from 7:00 a.m. – 7:00 p.m., but is also restricted outside of this time and on weekends and holidays. ACTIONS: The LPRCA will provide CA-related timing windows (exemptions are possible) to Stantec. Tree Cutting Municipal tree cutting bylaw applies. Information is also available in the Official Plan. Review of Information by Haldimand County The County noted that they would prefer to review the draft REA application prior to formal 4

submission to the MOE. Stantec noted that the mandatory 90-day Municipal Consultation Form review period will allow the County to review draft REA documents prior to formal application submission to the MOE. Capital Power noted that some information (e.g. layout) would be available to the County prior to the Municipal Consultation Form. Therefore, feedback can be incorporated while drafting reports County staff are available to have informal meetings and site visits so that comments can be incorporated as early in the process as possible. Haldimand County Staff indicated that Council will need to approve Staff’s comments on the Draft REA reports and the Municipal Consultation Form before County will provide completed form and final comments to Capital Power. Capital Power provided a general overview of the Project, environmental work completed to date, archaeological work completed to date and information on the waterway assessments. Capital Power provided an overview of the REA process and the expected timeline of the municipal consultation review period and public review period. Indicated that Capital Power will be submitting four reports to Haldimand County for review: Draft Project Description Report, Draft Construction Report, Draft Design and Operations Report and Draft Decommissioning Report.

Capital Power provided a draft copy of the Municipal Consultation Form to Haldimand County Staff and provided an overview of the form. The following subjects were discussed: Project location – Provided a review of transmission line locations, discussed use of road corridors. Indicated that Capital Power would work with local utilities. Haldimand County indicated they do not want poles on both sides of roads and they will look at corridor and ensure Project plans will not interrupt any of the County’s future development plans. Project roads – Haldimand County indicated that entrance permits are required for access roads coming off municipal roads. Capital Power indicated that Vestas will be providing a transportation plan for the Project. Haldimand County provided Capital Power with the entrance permit application form and indicated Project should work through the Haldimand County (Kohler) Office with respect to entrance permits. staked and indicated Capital Power should arrange to have them staked at the same time. Traffic Management Plans - Capital Power indicated the proposed traffic management plan will be shared with the County when available. Haldimand County inquired where the Vestas manufacturing plant will be located. Capital Power indicated they are unsure at this time and waiting on details from Vestas. Haldimand County indicated the MTO has work scheduled in Haldimand County for the Highway 3 corridor. Indicated there is work scheduled for the Cayuga Bridge and on Dry Lake Road near Cayuga. Projects are expected to start construction in late 2011. Capital Power indicated the first scheduled delivery for the Project is expected to occur in June 2012. Haldimand County will provide Capital Power with the link from the MTO website so Capital Power can view future MTO Projects. Haldimand County indicted that oversized road travel permits also are dealt with in the Haldimand County Kohler Office. Haldimand County will provide Capital Power with the appropriate contact at the Kohler office. Haldimand County indicated they will require completion of a road condition survey in additional to a structures assessment. Capital Power indicated these surveys will be completed. Haldimand County indicated their half-load season runs from end of March to the beginning of May. Municipal Service Connections – Haldimand County asked if Capital Power will build maintenance sheds at each turbine. Capital Power indicated there would be one maintenance building located near the Project’s substation. Emergency Management Plans – Capital Power will provide Haldimand County with a detailed health and safety plan for review. Emergency Response staff will review and comment. Haldimand County to send list of appropriate emergency response personnel to Capital Power so it can be included in the emergency management plan within the Design and Operations Report. Haldimand County inquired if emergency response training will be provided by Capital Power. Capital Power indicated emergency training would be considered. Easements or Restrictive Covenants - Haldimand County indicated that private property easements are required and sign off is required by Haldimand County. Rehabilitation of any temporary disturbance - The wires from turbines to transmission lines will be located underground. Haldimand County requested that Capital Power flag lines well so County staff are aware of their location when they clean out ditches. Road Crossings – Haldimand County to send design criteria to Capital Power. Building Code Permits/Licenses - Provided building code permit information to Capital Power. Significant Natural Features – Capital Power indicated an Environmental Impact Study has been completed and submitted to the Ministry of Natural Resources (MNR) for comment. Capital Power indicated this report may not come with the other Draft REA reports, but will be provided to Haldimand County when comments have been received from MNR. Haldimand County indicated Capital Power should consult with Long Point Region Conservation Authority. It was indicated by Capital Power that discussions with the Conservation Authority have taken place. Archaeological Studies – Capital Power indicated that Stage 1 Archaeological Studies have been completed and submitted to the Ministry of Tourism and Culture. Capital Power is continuing to work on Stage 2 and 3 Archaeological studies. Indicated these studies will be approved prior to construction but will not be submitted prior to REA approval. Provided Capital Power with Haldimand County Staff contact that deals with landfills. Report Submission - Clarified that municipal Consultation package will be sent to Lidy Romanuk and she will distribute package among County Staff and will let Capital Power know how many copies of the reports they will require. Capital Power to let Haldimand County know when they can expect the reports and the expected timeline for providing comments back to Capital Power. Capital Power indicated the public will have an opportunity to review and comment on the draft REA reports 60 days prior to the final Public Open House sessions. Capital Power indicated that any comments Haldimand County can provide prior to the reports being made publically available would be appreciated by Capital Power.

Haldimand County (Haldimand) has completed their review of the draft REA documents for the Project. County Staff also completed a site tour of all proposed Project sites located within Haldimand County. Indicated County Staff expects to provide their final comments on the draft REA reports and the Municipal Consultation form to Council on February 7, 2010 for approval. Municipal Consultation Form Overview 5.1 Project Location - Haldimand completed site inspection, viewed proposed turbine locations from nearby roads. - Haldimand provided comments on each turbine location (see Site Investigation Results and Comments document). - With regards to Haldimand’s comment on urban boundaries (see MCF), it was indicated that this is not an issue for this Project. Capital Power asked if Haldimand County could indicate there are no urban boundary issues with the Project on the MCF. Haldimand confirmed they would do this. 5.2 Project Roads - There are a number of locations where access roads run parallel to the county roads; Haldimand requires more details and information about the gaps between these roads. Capital Power indicated that the roads will be wider for construction and then tailored back for Project operations. Capital Power noted that they will provide further detail once the detailed engineering for the Project has been completed and requests Haldimand County provide detailed specification. Haldimand County indicated that they prefer a 15 m buffer from the edge of the road. - Haldimand County requests there is a large enough turning radius at the base of the turbine to accommodate large vehicles during construction and throughout operations (i.e. emergency response vehicles, construction). Capital Power requested information regarding the turning radius requirements. At Capital Power’s existing operating wind power project, emergency vehicles would easily be able to access and turn, therefore there is no expectation that accommodating this radius is an issue. In addition, most farmers want as much land back after turbine construction. - Haldimand County requires that Capital Power complete Pre-Condition Surveys ahead of construction. Requests that Capital Power review load postings and restrictions on any structures. - Haldimand noted that the bridge in Cayuga (Hwy 3) would not accommodate turbine transportation or loaded dump trucks due to upcoming construction. There is proposed work for the Dunnville Bridge; however this is scheduled to be completed in July 2011.

Description - Haldimand suggests Capital Power take photographs of the roads and complete our own pre condition surveys in addition to Haldimand County’s. Capital Power confirmed we would compile video footage of all roads once transportation routes are established with our contractor. - Haldimand County indicated they would need to review the Project’s Traffic Management Plan and Traffic Control Plan prior to Capital Power receiving any permits. Indicated these plans should be submitted prior to the pre-condition surveys so that the County can review. Capital Power indicated these plans would occur during the detailed design work of the Project and that it was our expectation that the plans would be developed with input from the County. - Haldimand requested that turbine access roads are well signed so that the local residents won’t drive on the roads. Capital Power would need to identify via appropriate signage, that access roads are not “public roads.” Additionally, the County requested that access road entrance signs indicate which turbines are located on the particular road. - Haldimand indicated that some County roads have “Half-Load Restrictions” in place. Haldimand will provide Capital Power with a GIS map that indicates which roads are and are not included. - Haldimand requested that Capital Power consider a set of entrances that are on opposite sides of a road as an intersection. Haldimand will provide further information as to the requirements for this signage specification. - Haldimand requested more information on how cranes would cross roads and the design of intersections for these crane paths. 5.3 Municipal or Local Authority Service Connections - Capital Power indicated that we have completed environmental studies on more lands than we actually use in the Project. Some of the lands we study do overlap with neighbouring Project, but actual Project locations do not overlap with each other. - Capital Power confirmed substation details are outlined in our preliminary engineering design site plan. Substation will be located on a 20-acre lot and will include a maintenance building, substation and switchyard. Drainage details for this are found in REA report. - Haldimand asked if zoning is covered under the REA. Capital Power indicated it was believed it is since the property is part of the REA and the REA covers all Project location and infrastructure. Haldimand noted that there were requirements for these operations, such as parking lot spaces, etc. Capital Power noted that the facility is part of the REA, but that a building permit would be sought through Haldimand. Haldimand offered to provide the link to the requirements for the facility. Capital Power will work with Haldimand on defining zoning and determining the appropriate permits. - Haldimand asked how turbine location properties and ancillary buildings are classified (i.e. Industrial F1/F2) under the Ontario Building Code and what applicable legislations are in place for the fire code. Description indicated we would try and find this information get back to Haldimand. - Haldimand will provide Capital Power with link on Haldimand website regarding any building specifications the County has in place. - Haldimand asked who completes the final Project inspection and who is responsible for signing the Project off. Capital Power indicated there will be an independent engineering inspection completed before operations begin. There will be an additional inspection by the ESA. - Haldimand provided Capital Power with all the applicable building and bylaw applications/forms and the appropriate County contact. 5.4 Facility Other - There are a number of turbines in clusters that are set back from road entrances. Haldimand requested that Capital Power create second entrances to turbines, where possible, such that emergency vehicles can get access if the main entrance is blocked. Capital Power to identify existing farm road accesses to see if any of these entrances would work. Haldimand indicated this was not really an issue with this Project. Haldimand indicated that turbine 548 and 549 are an example of where a second entrance would be needed. Capital Power will identify possible alternate accesses. - Haldimand asked who will maintain access roads. Capital Power confirmed the access roads will be maintained by Capital Power. 5.5 Project Construction - Haldimand requested that the Haldimand Drainage Superintendent attend any site visits CPC completes with the Conservation Authority. - CPC indicated that site visits usually inform the detailed design of the Project therefore the site visit will occur prior to the submission of the detailed design to Haldimand. - Road allowances for Road 55 and Rainham Road are reserved for future transmission corridor. Haldimand indicated there may be an issue with turbine 554 with regards to this future development. Haldimand will provide Capital Power with information on cross paths and details on what type of work they may be completing on these roads. - Haldimand asked if Capital Power would use existing poles with Haldimand Hydro. Capital Power confirmed we would be using joint poles with Haldimand Hydro. Haldimand asked if Capital Power is building a transmission line for the Project. - Haldimand advised Capital Power to contact Bell Canada well in advance if Project requires a special insulated wire to connect Project to operations control room. Capital Power indicated we would be using fiber optic wires instead. - Capital Power confirmed that all archaeological assessments will be completed before construction begins. Capital Power intends to submit report to Ministry of Tourism and Culture (MTC) in Spring 2011.
