Physical Therapy Advisory Committee Minutes The Physical Therapy Committee of the Board of Medical Licensure and Supervision met on June 3, 2016, in accordance with the Open Meeting Act. The meeting was held at the office of the Board, 101 NE 51st Street, Oklahoma City, Oklahoma. Advance notice of this regularly scheduled meeting was transmitted to the Oklahoma Secretary of State on October 1, 2015, and posted on the Board's website on June 1, 2016. The notice and agenda were posted in prominent public view on the front doors of the Oklahoma Board of Medical Licensure and Supervision building located at 101 NE 51st Street, Oklahoma City, Oklahoma on June 1, 2016 at 2:45 p.m. Members present: Carolyn Craven, DPT, PT, Chair David Haynes, PT, AT, Vice Chair Randy Titony, PTA Mitsy Martin-Davis, PT Member not present: Position Vacant - Public Member Others Present: Reji Varghese, Executive Deputy Director Barbara J. Smith, Executive Secretary Teresa Mitchell, Licensing Director Having noted a quorum, Ms. Craven called the meeting to order at 9:05 a.m. Following Committee review, Mr. Haynes moved to approve the Minutes of April 15, 2016 as written. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. Pursuant to current rule Okla. Admin. Code 435:20-1-3(c), Committee elections are allowed at the first Committee meeting following July 1st of each year. Because the term of Ms. Craven, Committee Chair, expires on June 30, 2016, Staff was issued a directive to defer all questions usually reserved for Committee Chair to David Haynes, Vice-Chair, from July 1, 2016 – August 18, 2016. The next meeting of the Committee is scheduled for August 19, 2016. BEN WADE, Physical Therapy Assistant, appeared in response to his non-compliance regarding the completion of required Continuing Education double hours for the 2014-2015 compliance period. At the time of the meeting, he had completed the required double hours, albeit late. The Committee referred to Okla. Admin. Code 435:20-9-2(c) which states as follows:

(c) Any applicant for renewal who cannot meet the requirements for continuing education may not renew until deficient hours are obtained and verified. Additionally, within the next compliance period the licensee will be required to obtain double the required hours of approved continuing education. At least half of the required hours must be Category A. Proof of meeting the additional requirements, as verified by an audit, will be required in order to renew at the end of the next compliance period. Failure to meet these additional requirements will result in disciplinary action. (Emphasis added.) Mr. Titony moved to recommend allowing Mr. Wade to renew his license currently and, based on the rule above, for Staff to refer the matter to the Medical Board for disciplinary action with the recommendation that double hours be imposed for the current compliance period as said discipline. LOBAT MEFTAH-KHAKPOUR appeared in support of her request to sit for the Federation of State Boards of Physical Therapy ("FSBPT") licensure examination for a third time. Following review of the Committee and discussion, Mr. Haynes moved to recommend allowing Ms. Meftah-Khakpour to sit for the FSBPT licensure exam a third time. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. SANDRA NICHOLS, applicant, Physical Therapist licensure, appeared via web video in support of her application. Ms. Nichols is currently licensed in California; however, she received a Foreign Credential Commission on Physical Therapy ("FCCPT") report stating her education is not equivalent for licensure in Oklahoma. After review and discussion, Mr. Haynes moved to recommend approval of licensure by endorsement pending completion of the file. Mr. Titony seconded the motion and the vote was unanimous in the affirmative. TIM NICHOLS, applicant, re-entry of Physical Therapy Assistant licensure, appeared via web video in support of his application. Mr. Nichols stated he has been practicing as a PTA since 2011 and is currently licensed in California. Mr. Haynes moved to recommend approving re-entry of Physical Therapy Assistant licensure pending completion of the file. Mr. Titony seconded the motion and the vote was unanimous in the affirmative. Following Committee review, Mr. Haynes moved to recommend approval of the following complete applications for Physical Therapist licensure. Following Committee review, Mr. Haynes moved to recommend approval of the complete application of STEPHANIE DIANA BAUGH for re-entry of Physical Therapist Assistant licensure. Ms. Davis seconded the motion and the vote was unanimous in the affirmative. Following Committee review, Mr. Haynes moved to recommend approval of the incomplete application of TROY EVERETT McGUIRE, JR for re-entry of Physical Therapist Assistant licensure pending completion of the file. Following discussion, Ms. Davis moved to approve the continuing education units ("CEUs") previously reviewed which are included on the list attached hereto (See Attachment #1) plus other CEUs submitted for approval which were reviewed by Committee members prior to the meeting (See Attachment #2). Mr. Haynes seconded the motion and the vote was unanimous in the affirmative. Ms. Craven stated that the reviewers in Tulsa have completed a tremendous amount of CEU review work which has been quite helpful to the Committee. The Committee expressed their appreciation for the work of the reviewers. Mr. Titony moved to elect David Haynes as Voting Delegate and Mitsy Martin-Davis as Primary Alternate Delegate to attend the annual meeting of the Federation of State Boards of Physical Therapy in November of 2016. Mr. Haynes seconded the motion and the vote was unanimous in the affirmative. Ms. Barbara Smith will supply the appropriate travel-request forms to Mr. Haynes and Ms. Davis, as well as ensure registration with FSBPT, immediately following the conclusion of this Committee meeting. Ms. Craven reported that the Continuing Competence Subcommittee is continuing to work on revising the language in Subchapter 9 of the Rules. She further stated that her term on the Advisory Committee will expire on June 30th and she will also step down from the Continuing Competence and Continuing Education Review Subcommittees. Ms. Jennifer Ball will take over the leadership role for the Continuing Competence Subcommittee. Mr. David Haynes will assume the leadership role of the Continuing Education Review Subcommittee. Ms. Craven announced that Jennifer Ball, PT/ATC, MHR, was appointed by the Medical Board effective July 1, 2016, to commence upon completion of the term held by Ms. Craven through June 30, 2016. Ms. Craven also announced that there is currently a public member vacancy on the Advisory Committee. Pursuant to Title 59 O.S. § 887.4(B)(3), "The lay member shall not be a physical therapist or a licensed health care professional or be related by adoption, blood, or marriage within the third degree of consanguinity to a physical therapist or a licensed health care professional." Ms. Barbara Smith, on behalf of the Medical Board and Staff, thanked Ms. Craven for her tireless dedication to the Committee. Ms. Craven has been a source of great knowledge and expertise for the Committee. Her guidance and attention to detail will be missed. There being no new business, the meeting was adjourned at 9:50 a.m.
