Dodd Frank – Frequently asked questions I forgot to include the DF1073 code-word. Can I send an amendment request through a service message asking you to amend my original instructions and insert the code-word? Q:

A: Wells Fargo executes your payment internationally within minutes, and most often within seconds

of receiving your payment order. By the time you send your amendment, the payment most likely will already have been executed. The DF1073 codeword you insert does two things: 1. It determines how we will charge the payment, and

2. It directs us to route the payment in a way intended to eliminate intermediary bank fee deductions. If you omit the codeword, we will bill you according to your standard commercial payment profile and we will route the payment without applying the specific DF1073 routing methodology. Once the payment is executed, we cannot change the routing methodology.

What if I forgot the DF1073 codeword? Should I recall the payment?

A:

By the time you realize that the code was omitted, Wells Fargo will have most likely executed the payment. Recalling an international payment is time consuming –usually taking several days – and results in return fee deductions. In addition, if the beneficiary had already received the funds and was expecting them, they will generally not be willing to return the funds. Wells Fargo will execute your payment regardless of whether or not you included the Dodd Frank 1073 (DF1073) codeword. Assuming all other information in the payment is correct and we are able to identify a way of routing the payment, the beneficiary will get their funds. The difference with not including the codeword is that the payment may incur intermediary lifting fees (covered fees), so the amount paid to the final beneficiary maybe less than what you disclosed to your consumer. This may result in an error claim, which your institution will need to resolve. Moreover, the payment will not be identified in our reporting to you as a DF1073 payment. Lastly, if you have differentiated pricing between your consumer and commercial payments, any payment not containing the DF1073 codeword will be charged the rate we charge for your commercial payments.

Do I need to include intermediary bank information?

A: Please do not include any U.S. based intermediary banks. Our payment system will automatically route the payment by selecting the necessary USD clearing correspondent for the indicated Beneficiary’s Bank. However, while our payment system contains over 52,000 routing records and we use other public and commercial sources of routing information, we may not have routing information for every single financial institution in the world. This could especially be the case with small foreign financial institutions that do not have a direct USD correspondent clearing relationship with a CHIPS or Fedwire participating bank. Such financial institutions may not even have a SWIFT BIC. In some cases, they may have a SWIFT BIC but it is offline (you can recognize these institutions because the number one (1) will be the eighth character of their SWIFT BIC). Small foreign financial institutions that do not have a direct USD correspondent clearing relationship will typically settle USD payments through another intermediary bank within their home country (“second intermediary”) or region. That larger bank, the second intermediary, will typically maintain direct USD correspondent relationships with CHIPS and Fedwire participating banks. While Wells Fargo has routing records for many of these smaller institutions, we may not have it for every single one you may be asked to pay. In the event your sender has information related to a nonU.S. based intermediary bank (the second intermediary, a local bank in the country or region where the beneficiary bank is located), please include that second intermediary information in your payment instructions. In most cases, these smaller banks provide their second intermediary information as part of the smaller banks’ routing instructions to those beneficiary’s wanting to receive funds on their account with these smaller banks.

Dodd Frank – Frequently asked questions Q: I unintentionally sent my DF1073 payment as a BTR (Bank-to-Bank Transfer) instead of as a CTR (Customer Transfer). I did include the DF1073 codeword. Will you process that payment as a DF1073 payment? A: No. By its nature, a DF1073 payment has a non-bank originator (the sender has to be a consumer). As such, the payment should not be sent as a Fedwire BTR (Bank Transfer). It is unlikely that we will reject such a payment since, as long as the syntax is correct, our system will process it as a bank to bank transfer. However, we will not apply DF1073 specific routing or in any other way process the payment as a DF1073 payment. Fee controls will not be applied and Wells Fargo will not be liable for any deductions taken by any banks. Additionally, please note that the beneficiary’s bank will most likely not be able to apply funds as instructed. This could cause a considerable delay in the application of funds to the final beneficiary. 

Generally, if you do find that you have sent a DF1073 payment as a BTR instruction instead of a CTR instruction, we strongly suggest that you recall the payment by sending us a request to do the same via an authenticated Fed service message (10 90). You can then consider re-executing the payment as the correct message type once you have received confirmation of recall.

Dodd Frank – Frequently asked questions Q: I received a message from Wells Fargo stating that a foreign bank is claiming their investigation or inquiry fees. Why is Wells Fargo asking my bank to pay those fees? Additionally, sometimes, when I receive a return of funds, it is less than the amount we originally sent out. Are foreign banks deducting return fees? A:

The monthly investigation fee Wells Fargo charges is intended to cover Wells Fargo’s expenses related to the processing of your investigations and inquiries. Our fee is not a “guaranteed” all-in investigation fee because it does not cover claims foreign banks may present for their investigation and inquiry fees (which on a cumulative basis can typically be well in excess of Wells Fargo’s monthly investigation fee). Just like any institution a foreign bank incurs costs to process your inquiry and claims such fees from the inquirying party. Wells Fargo passes that fee claim to you, and we strongly urge you to positively reply with authorization to pay once you receive it. Please note that consistent refusals to pay such fees may result in the foreign bank’s reluctance to expeditiously process any future inquiries received from your bank through Wells Fargo. As a best practice Wells fargo would strongly suggest that you do not raise a “beneficiary claims non-receipt” inquiry or a “please confirm date and amount paid” inquiry until at least 3-5 business days from the date of your payment (or at least until past the Date Funds will be Available as indicated in your disclosure). This will provide the beneficiary’s bank sufficient time to apply funds. If, in the meantime, your consumer inquires about the fate of the payment, please note the CyberInquiry does provide you the ability to view, copy and print the actual SWIFT or CHIPS message we used to execute the payment. This typically is sufficient show that the payment was delivered to the beneficiary’s bank. Dodd Frank – Inquiry Best Practices In order to minimize the potential costs of inquiries and investigations related to DF1073 payments we suggest the following best practices: 

Only initiate “Beneficiary claims non-receipt” or “Advise date and amount credited to beneficiary” inquiries after 3-4 business days from the date of payment – Foreign banks may not make funds available to the final beneficiary immediately. The beneficiary may receive the funds by the time the beneficiary’s bank receives the inquiry.



Use CyberInquiry to access our outbound payment message. On the day after the payment date, you can access a copy of the actual SWIFT and/or CHIPS message we sent to execute the payment internationally. These messages are evidence that the payment reached the beneficiary’s bank, and often are sufficient to confirm that the payment has been properly executed.



Set your own customer’s expectations as to how quickly you may have a response for them. Wells Fargo’s ability to provide you further information may often depend upon the responsiveness of foreign banks. Some banks require time to research and advise the status of a payment.



As much as possible please contact the appropriate Wells Fargo customer service team for your inquiry. We provide different contacts for your USD payments vs your FX payments. While we are glad to pass your inquiries internally, you will be best serviced by directing the inquiry to the team responsible for the payment. This will assure correctness and expediency in processing your inquiry.

FI to FI Information (Field 6500) Usage The Dodd-Frank 1073 Qualifying Codeword or any codeword must be placed in the first position of a line in field 6500. Only 1 codeword is acceptable per line. This field can be used for additional information for the Receiver or to downstream participants of the transaction. Each item for which a code exists must start with that code and may be completed with additional information. Each code used must be between slashes and appear at the beginning of a line. It may be followed by additional narrative text. 

Field 6500 must never be used for information for which another field is intended.



Narrative text relating to a preceding code, which is continued on the next line(s), must start with a double slash '//', and, if used, must begin on a new line.



Narrative text should preferably be the last information in this field.



Use of field 6500, particularly with un-coded instructions, may cause delay, because, in automated systems, the presence of this field will normally require manual intervention.

Dodd Frank Qualifing codewords Only use the codeword agreed with your GPS Sales manager. If you use a codeword other than your agreed DF codeword Wells Fargo will not process as a DF qualifying payment.
