Official Contest Rules: Accessible Peterborough Photo Contest October 1, 2016 to November 15, 2016

Contest Period 1.

The contest entry period starts at 9:00 a.m. on Saturday, October 1, 2016 and ends at 11:59 p.m. on Tuesday, November 15, 2016 (the "Contest Period").

Eligibility 2.

This contest is sponsored by the City of Peterborough Accessibility Office and is open to individuals who are residents of Ontario, except employees of the Corporation of the City of Peterborough, contest judges. All contestants must comply with the Contest Rules.

3.

Contestants under the age of 18 at the time of entering the contest must provide the City with written permission to participate in the Contest from the contestant’s legal guardian. Permission may be provided by e-mail directly from the guardian to [email protected].

4.

To be eligible, all photo submissions must be taken by, created by and be the property of the contestant. Contestants must be the sole owner of all rights to the photos submitted.

5.

Submission of a photo is acknowledgement of, and agreement to, the terms and conditions of the contest.

How to Enter 6.

The contest theme is: highlighting accessible places, spaces and experiences in the City of Peterborough. These may be personal experiences that illustrate how the City of Peterborough contributes to enhancing the quality of life for all residents.

7.

Contestants may enter the contest by completing the Accessible Peterborough Photo Contest Submission Application (Application) at www.peterborough.ca/accessibility . The Submission must be completed in full. For information on alternative accessibility options for submitting entries please contact [email protected] or 705-742-7777 extension 1785.

8.

Any personal information collected by the City of Peterborough is collected under the authority of the Municipal Act, S.O. 2001, and is intended to be used for the Page 1 of 6

following purposes: to conduct and administer the Contest, including but not limited to contacting contestants, validating eligibility and the awarding of the prize(s); promotion and advertising purposes, including using photos received in marketing materials, for the City's internal and/or external communication and to comply with legal requirements. All photos must be original photos taken in the City of Peterborough, and must fall into one of the following categories: 

Inclusive Indoors: This category includes photos that highlight the inclusive indoors. The indoor spaces used in the photo must be of a facility owned or operated by the City of Peterborough. For example a photo can include people participating in an inclusive indoor program or highlight an indoor accessible feature.



Integrated Outdoor Experiences: This category includes photos that highlight accessibility in outdoor spaces or outdoor amenities owned or operated by the City of Peterborough. For example a photo can include people participating in an accessible outdoor program or highlight an outdoor accessible feature.

10.

Contestants may enter up to five (5) photos in each category. However, the same photo cannot be entered into both categories.

11.

The photo subject must be relevant to the photo contest’s theme and the category in which the photo is submitted. Photos must be appropriate for posting on a public government website. Photos that contain obscene, provocative, defamatory, nudity, sexually explicit or otherwise objectionable or inappropriate content will not be considered. The City of Peterborough will determine, in its sole discretion, what constitutes such content and may remove/delete or destroy photos with such content without notice.

12.

Photos that do not meet the contest criteria will not be considered as eligible for prize consideration.

13.

No purchase or participation fee is necessary.

14.

Photos entered must be in JPEG or PNG format, of at least 1920 x 1080 pixels. Photos can be in colour, black and white, sepia tone or duotone. A contestant may be requested to provide a high-resolution file.

Copyright and Use of Photographs 15.

Photos must have been taken by the person submitting them to the contest. The contestant must be the sole owner of all rights to the photos that the contestant submits.

17.

All eligible photo entries may be posted to the City’s website www.peterborough.ca.

17.

Contestants retain copyright and any other intellectual property rights in their submitted photos. However, by entering the contest, all contestants are agreeing to give a royalty-free, world-wide, perpetual, non-exclusive license to the City, and anyone it authorizes, to display, distribute, modify, crop reproduce, and create derivative works, of the photo in any media now existing or subsequently developed including the Internet, for any City purpose including, but not limited to, advertising and promotion. Such license is provided without any fee or other form of compensation, or any requirement for additional approvals. Photo credit will be given where reasonably possible.

18.

The contestant waives all moral rights in any of their winning entries.

19.

In the event that ownership of, or rights to, any photo submitted to the contest is contested in any manner, the City retains the sole discretion to disqualify that photo from the contest and discontinue use of the photo.

20.

The contestant will hold the City harmless from any infringement of any copyright or other intellectual property in the photos the contestant submits.

21.

All photographs submitted are considered to be part of a public record as defined by section 27 of the Municipal Freedom of Information and Protection of Privacy Act. There is no expectation of privacy and the photographer acknowledges that they have the consent of all people in the photograph.

Others’ Personal Information 22.

By submitting a photo, each contestant agrees that they have obtained consent from all identifiable persons in the submitted photos for use of their image in the photos. 23.

24.

The City reserves the right to refuse any photograph that does not meet all of the terms and conditions set out in the contest rules.

Prizes and Chances of Winning 25.

The chances of winning are dependent on the number of eligible photos received in each category and in the contest as a whole.

26.

There will be one winner for each category. Each category winner will receive a prize package including:  $100.00 Peterborough Downtown Business Improvement Area (DBIA) Money Coupon (can be used at most downtown Peterborough, Ontario, businesses), thanks to the generous donation of the Peterborough DBIA  A fine art print of the winning photo that will be featured in the Art Gallery of Peterborough meeting room for one month  Custom framing of the fine art print, generously donated by Christensen Fine Art

27.

Each entrant is only eligible to win once.

Judging Process and Criteria 28.

There will be five judges composed of two members of the Accessibility Advisory Committee, two members of the Council for Persons with Disabilities and the Art Gallery of Peterborough’s Curator.

29.

The judges will evaluate each photograph as it relates to the category in which the photo was submitted.

30.

The decision of the judges is final.

Winner Notification 31.

Winning photos will be announced at the International Day of Persons with Disabilities celebration on Saturday, December 3, 2016. All contestants will be invited to attend the celebration.

General Rules 32.

By entering the contest, the contestant, or if the contestant is a minor, their parent or, guardian, agrees to abide by the contest rules.

33.

No prize substitutions will be made, save for the City’s right, at its sole discretion, to make an offer or prize substitution of equivalent value.

34.

The City reserves the right to verify the full legal name and address of the contest winner(s) with the information on the selected entry form. To claim the prize, valid government issued photo identification may be required.

35.

The City reserves the right, at its complete discretion, to cancel or modify the contest in the event that, in its opinion, the holding of the contest would be prevented for any reason, including a technical failure or breakdown, an unauthorized intervention, fraud or any other cause beyond the control of the City, which would compromise the management, security, impartiality, integrity or smooth running of the contest.

36.

The City is not responsible for computer system, hardware, software or program malfunctions or other errors, failures, or delayed computer transactions or network connections that affect the contest or your participation in it. Furthermore, the City is not responsible for: 1) lost, misdirected, misplaced, illegible, unintelligible, incomplete or late entries or 2) any act, failure to act, or delay regarding the transmitting or processing of entries. The City is not responsible for any technical delays in submission emails, entries and/or uploads and updates.

37.

The City reserves the right to disqualify any contestant that it has reason to believe did not comply with the contest rules.

38.

The City is entitled to interpret these rules as required and its decisions are final.

39.

By entering the contest, the contestant agrees to hold harmless the City and its employees, agents and representatives from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from the contestant's participation in this contest, including the infringement of another person’s intellectual property rights. The contestant also releases the City, its employees, agents, and representatives from all responsibility and liability for any damages, injuries, claims, causes of actions, or losses of any kind the contestant may incur or suffer arising in whole or in part, directly or indirectly, from participation in this contest and, including without limitation, the use or misuse of any prize.

40.

This contest is subject to all applicable federal, provincial and municipal laws and regulations. These contest rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the contest.

41.

Any and all disputes arising from the contest will be resolved in the courts of the Province of Ontario and are subject to the laws of that Province.

42.

This contest is null and void where prohibited by law. Any dispute regarding the organizing or conduct of this contest may be submitted to the Accessibility Office City of Peterborough 500 George Street North, K9H 3R9.
