ANNUAL MESSAGE FROM DOUGLAS K. MARTIN ARIZONA STATE MINE INSPECTOR Our Agency Mission is to administer and enforce the Mining Code of the State of Arizona for the protection of life, health and safety of the mine employees and the public in Arizona’s active, inactive, and abandoned mines. The State Mine Inspector is a state-wide elected constitutional officer and the director of the Office of the State Mine Inspector. The Office was established by the Constitution of the State of Arizona, Article XIX. This agency enforces statutes, rules, and regulations applicable to mine safety, health, abandoned mines, and land reclamation under ARS Title 27 Minerals, Oil and Gas and Arizona Administrative Code Title 11 - Mining. The agency inspects the health and safety conditions and practices at active mining operations; investigates mine accidents, employee and public complaints; and conducts federally certified miner and instructor safety training. The agency administers $110 million in reclamation assurance bonds and enforces the Mined Land Reclamation laws, rules and regulations for the restoration of disturbed lands to a safe and stable environmental condition. The agency promotes public safety regarding abandoned mines by “Stay Out Stay Alive” promotions, presentations and publications; complaint investigations; mine owner compliance notifications (ARS 27-318); identification, hazard assessment, prioritization, posting and securing of safety hazards. Four interagency programs exist to accomplish our mission. The Mine Safety Enforcement Program performs frequent health and safety inspections at active mines and related facilities; conducts investigations of mine accidents, employee and citizen complaints; and provides certification classes in mine rescue and first aid. The program issues notices of violations, cessation orders, mine elevator operating permits and underground diesel equipment operating permits as tools to promote safe and healthful work conditions. Operations under this program’s jurisdiction include asphalt hot plants, concrete batch plants, aggregate pits, quarries and processing plants; underground and open pit mines, mills, SX-EW Plants, smelters, refineries, and rod plants. Jurisdiction also covers contractor employees working at mine sites. Additionally, Deputy Mine Inspectors perform complaint investigations and land owner compliance inspections (ARS 27-318) at abandoned mines to support the Abandoned Mines Remediation and Inventory Program.

The Abandoned Mines Remediation and Inventory Program’s efforts fall into two categories; the inventory of abandoned mine sites and the administration of the securing, remediation, and closure of abandoned mines. Field surveys locate mines within the 72,931,840 acres that comprise the State of Arizona. This survey records the exact location of abandoned mines using a global positioning satellite system. The inventory’s objective is to produce an accurate count of abandoned mines, and describe the significant safety hazards and potential environmental hazards occurring with them. The database of surveyed abandoned mines is used for prioritization of significant public and environmental hazards for remediation and reclamation planning. The inventory also allows the agency to accurately investigate public concerns and complaints, about abandoned mines in a timely manner. An abandoned mine may be used for criminal activities, such as a cache for stolen explosives or a body disposal site. The program assists law enforcement investigations and body recoveries. The administration of securing abandoned

2000 Annual Report mines first prioritizes sites listed in the inventory based on the severity of the threat posed to public and environmental safety. Through this prioritization, structures are designed as necessary for abandoned mine closures on state lands. The cost of field construction to secure these mines is provided by the Abandoned Mine Safety Fund through mining industry donations, private citizen donations, and a matching appropriation from the legislature. Regular monitoring is conducted to assure mine closures remain in good condition. The program coordinates identifying and securing abandoned mines with local, state, and federal agencies and other states and volunteers. Groups include the Yuma County Sheriff’s Search and Rescue Group, the Maricopa County Sheriff’s Office Mountain Search and Rescue Group, Arizona Department of Mines and Mineral Resources, Maricopa County Parks, Arizona State Land Department, Arizona Game and Fish, Arizona State Historic Preservation Office, Arizona Department of Environmental Quality, Department of Labor Mine Safety and Health Administration, Bureau of Land Management, Forest Service, Environmental Protection Agency, Western Governors Association, and the National Association of Abandoned Mined Land Programs, which is comprised of 27 states and three Indian Tribes.

The Education and Training Program certifies mine safety instructors, develops lesson plans, conducts classes, and organizes safety conferences for mine safety education and training. The emphasis is placed on miner’s rights and current health and safety regulations in compliance with the Federal Mine Safety and Health Act of 1977, Title 30 CFR, Part 46, 48, 49, 56, 57, and 62. In addition to mining company employees, contractors, vendors and others regularly exposed to mine hazards are required to have various levels of training. Certain employees of the Department of Environmental Quality, Risk Management, and emergency response personnel are required to have this training.

The Mined Land Reclamation Program, working in cooperation with mining companies, consultants, and other state and federal governmental agencies, approves or rejects mine reclamation plans and financial assurance mechanisms; all metalliferous mining units and exploration operations with surface disturbances greater than five acres are subject to this requirement. Annual reviews and on-site inspections are a part of the continual monitoring process to establish compliance to the Mined Land Reclamation laws, rules and regulations.

Our team of experienced mine safety professionals continually strive to improve Agency programs and services so Arizona will be not only a leader in mining production, but in SAFE PRODUCTION as well.

MINE SAFETY ENFORCEMENT During calendar year 2000, the inspection team performed 465 health and safety inspections which identified 934 violations of the mining code for corrective actions by the mine operators. Thirty-one elevator inspections were conducted and annual operating permits issued. Forty underground diesel equipment operating permits were issued. Seven serious mine accidents, three fatal and four permanent disability, were investigated. Thirtythree citizen complaints regarding dust, noise, and blasting from nearby mining operations, eleven employee complaints concerning unsafe conditions, and sixteen complaints referred from other state and federal agencies were investigated.

FATAL ACCIDENTS In 2000, three fatal accidents were reported and investigated: Fatal of Mr. Jose Villanueva Jose Villanueva, an underground miner, was fatally injured on January 31, 2000, when a 9-ton rock slab fell from the back (roof) of the 215-North Stope at the ASARCO Mission underground mine. The slab fell and struck the extended boom of a JLG 600S High Lift manlift. Mr. Villanueva and co-worker Joe Olson were positioned inside the raised manbasket when the slab struck the boom. The two men were thrown out of the manbasket and fell to the stope floor, killing Mr. Villanueva and seriously injuring Mr. Olson. Javier Vargas, underground equipment operator, was standing on the stope floor operating the Getman ANFO loader truck and was struck by the Getman manbasket or the slab as it rolled off the JLG manlift boom to the stope floor. Mr. Vargas was also seriously injured.

Fatal of Mr. Jack Clark On July 21, 2000, Jack D. Clark, loader operator at the Rockland Materials Plant #1, was severely injured when the bucket of the front-end loader he was operating ruptured a high pressure transmission natural gas line, resulting in an explosion and fire. He died of complications from severe burns to 80% of his body on September 9, 2000.

Fatal of Mr. Kenneth Axtel Kenneth Axtel, a redi-mix driver at the Cemex Ina Road Plant, was fatally injured on September 20, 2000, when he became pinned between the bridge axle and the rear end of the drum of a cement truck. Mr. Axtel was washing down the rear of the truck and slumping the concrete load at the time of the accident.

SERIOUS ACCIDENTS Joe Olson and Javier Vargas were seriously injured on January 31, 2000, when a 9-ton rock slab fell from the back (roof) of the 215-North Stope of the ASARCO Mission underground mine.

Severiano Serrano, a crusher operator at the Central Mountain Materials Mortimer Mine, was seriously injured on December 27, 2000 when his jacket sleeve was caught in the chain of the tail pulley of a pan feeder.

EDUCATION AND TRAINING The Education and Training Program, through a federal grant, provides mine health and safety training for miners throughout the state. This past year, Education and Training has focused on training miners who work at sand and gravel and smaller mining operations which do not have the benefit of a full-time safety-training professional. The Education and Training Program also trains contractors who are exposed to the same hazards as miners on mine properties. Our objectives are to teach subjects that meet the federal training requirements and meet the needs and hazard exposure of the students. One of the skills learned in New Miner and Annual Refresher Training is First Aid, a lifesaving skill that is used at and away from the workplace. In addition to providing training, the Education and Training Program maintains a video library and lends training tapes to the mining community for use in their safety training programs. Education and Training also coordinates activities and assembles programs and speakers for the annual May seminar and the October International Mine Safety and Health Conference.

ABANDONED MINES REMEDIATION AND INVENTORY Project activities in 2000 focused on design and contract preparations for the closure and securing of abandoned mines on state lands. Actual construction costs to “plug, fill, fence” are paid by the Abandoned Mines Safety Fund (AMSF). Two large sites, Tonopah-Belmont Mine and Charleston Lead Mine, were the primary project development targets. The Tonopah-Belmont Mine is located southwest of Wickenburg. The mine receives extensive visitation and is home to a very large bat population. The closure project consists of fencing, grating, and bat gates. An engineering firm, Primatech, was chosen for design and construction of the project. Throughout the fall of 2000 and into early 2001, the agency worked closely with the engineers on closure design specifications to maintain the bat habitat and natural ventilation characteristics of the mine. The closure activities are to be completed by mid-2001. The second site is the Charleston Lead Mine near Tombstone. The mine is located on both state and federal lands. Closure was achieved as a joint project between the Bureau of Land Management and the State Mine Inspector. In addition to both state (AMSF) and federal funding, the agency wrote a grant proposal to the Western Governors Association for a waste clean-up grant. Arizona, along with Colorado and South Dakota, was chosen to be a pilot project under the grant. In the spring of 2000, seventeen hazardous mines on state land were prioritized for fencing. The sites included a shaft in Pinal County where two dogs fell in and died, a shaft in La Paz County near a well-traveled road, and several mines in northern Maricopa County near the new Anthem Development. Fieldwork in 2000 concentrated in identifying previously uninventoried mines on State Lands. The focus of these activities were concentrated southeast of Phoenix, especially in the area east of Florence. The potential financial litigation risk to the State of Arizona for abandoned mine accidents became reality in 2000. In 1994, a man perished in an abandoned mine accident on private land near Payson. He was four-wheeling after midnight and got his truck stuck in a collapsed mine opening near the edge of the trail. After getting out of his vehicle to investigate the problem he slipped into the opening and died from the fall. His widow filed a wrongful death suit against both the landowner and the state. In April 2000, the suit went to a jury trial in Gila County. The five-day trial resulted in a judgement against the State of over $800,000. The calendar year 2000 saw a marked increase in the number of public complaints of dangerous abandoned mines. In an average year only two or three complaints are received. In 2000, a total of 18 complaints were followed throughout the year., Throughout 2000, the Agency worked with State Procurement to develop specifications, award and administer a fencing contract to secure the Katherine Mine in Lake Mead National Recreation Area. This project resulted from an agreement established in 1996 between the Agency and the National Park Service to assist with mine closures in Arizona. Lake Mead National Recreation Area selected Katherine Mine near Bullhead City for the first site. After four years the funding from the National Park Service was forwarded to the state in early 2000. A contract was awarded mid-year 2000 for the construction of two fenced enclosures. The first fenced enclosure was approximately 700 feet in length to secure three deep shafts and adjacent undermined surface area. This fence was completed in November, 2000. The second fenced enclosure was approximately 6,000 feet in length and surrounded a tailings impoundment. Construction of the larger fence began in December and was completed in early 2001.

MINED LAND RECLAMATION Arizona’s Mined Land Reclamation Act and Rules requires all metalliferous mines with five or more acres of disturbance on private lands to submit reclamation plans and financial assurance mechanisms to the State Mine Inspector for review and approval. In 2000, one new reclamation plan was approved, one plan was submitted, two plans were under review, and one plan was granted an extension. Sixteen annual status reports were received and five mine sites were inspected for compliance. A total of 180 acres of mined land were reclaimed in 2000. The Reclamation Division staff particpated in the 9th Annual Integrated Mining and Land Reclamation Planning Short Course in Reno, Nevada, presenting a paper entitled Mined Land Reclamation in Arizona. The paper discussed Arizona’s reclamation standards, current reclamation projects, and new and innovative reclamation techniques which are being developed in the state.
