Terms of Reference Senior Consultant- Modification and Revision of Odisha Relief Code, 2013 OSDMA/UNICEF 1. Background Odisha is prone to many natural and man-made disasters/calamities. According to the India Meteorological Department, the eastern coast of India is one of the six major cyclone prone regions in the world that is hit by four to six cyclones every year, of which one or two are severe in nature and scale. Similarly, floods are frequent in the State due to overflowing of major rivers of the State like Mahanadi, Brahmani, Baitarani, Subernarekha and Rushikulya etc. Drought and associated crop loss in the western districts as well as in the central table land have become a regular affair, prompting people to migrate. The State is also vulnerable to heat-wave during summer months, epidemics, fire outbreaks, accidents due to lightening, rail and road accidents. Under the administrative system of the nation, the responsibility for disaster management including prevention and mitigation primarily rests with respective state governments. The Government of Odisha has responded to calamities while strengthening the preparedness, prevention, mitigation, relief and rehabilitation. The relief, restoration and reconstruction is handled by the Special Relief Organisation, created under the Board of Revenue in 1965-66. The Special Relief Organisation, headed by the Special Relief Commissioner, functioning under the Department of Revenue and Disaster Management, coordinates with various departments and districts for quick relief and rescue operations, reconstruction and rehabilitation work. The functions of the Special Relief Organisation are mostly guided by the Odisha Relief Code (ORC) and guidelines/circulars issued by Government from time to time. It also promotes disaster preparedness at all levels in the State with the assistance of Odisha State Disaster Management Authority (OSDMA). OSDMA was set up by the Government of Odisha, post 1999 super cyclone, for working towards disaster preparedness, prevention and impact mitigation. The formation of OSDMA marked a paradigm shift in the approach to disaster management with the emphasis being increasingly laid on planning preparedness and prevention along with relief, restoration and rehabilitation. The process of relief and recovery, in the event of an emergency, has been guided by ORC, along with directives issued by the State Government from time to time. Recently, enactment of the Disaster Management act 2005, promulgation of the State Disaster Management Policy, modifications in the Calamity Relief Fund/ State Disaster Response Fund norms has created the necessity for modification of the existing relief code to make it more holistic for better management of disasters. Considering this, the Government of Odisha has decided to amend/ modify the Odisha State Relief Code to be able to provide comprehensive government relief to victims of calamities.

The Odisha State Disaster Management Authority will bring on board a senior level consultant, with the support of UNICEF, to assist OSDMA in preparation of the revised Odisha Relief Code referred to here as the Odisha Disaster Management Code. This Terms of Reference outlines the details of the assignment. 2. Purpose of assignment The main purpose of the assignment is to assist the Odisha State Disaster Management Authority in revision of the Odisha Relief Code/ Odisha Disaster management Code. 3. Oversight and Management Arrangement Steering Committee: Appointed by OSDMA and chaired by Managing Director, OSDMA. Represented by OSDMA, Office of the Special Relief Commissioner, development partners, and the Senior Consultant. Drafting Committee: Appointed by the Steering Committee, chaired by the Senior Consultant. This committee will include two Research Assistants selected by the consultant The Senior Consultant reports to the Steering Committee. _____________________________________________________________________ 5. Major tasks to be accomplished

Under the broad oversight of the Steering Committee, the major tasks to be accomplished by the consultant include: a. Review of existing Odisha State Relief Code and related circulars, guidelines, notifications issued by the Government from time to time. b. Undertake the review of the National Disaster Management Code/ Act/Rules/guidelines, Relief Codes of other states, especially, where the codes have already been revised, as well as emerging global policies, guidelines and frameworks in disaster relief, as deemed appropriate. c. Organize consultation/meetings with related line departments/ organizations, districts and other stakeholders as required, 2 at state level and 3 at district level. The consultant may be supported by 2 Research Assistants for the duration of the project. d. Develop the revised draft Odisha Disaster Management Code (2 drafts) incorporating provisions based on review and analysis of relevant literature and recommendations from consultations with relevant stakeholders. e. Guide and facilitate consultation workshop to share and deliberate upon relief code development process, and the key provisions of the code. f. Submit the revised drafts for review and feedback by the Steering Committee. g. Incorporate the feedback and finalise the Odisha Disaster Management Code.

Submit the final approved Odisha Disaster Management Code to the Steering Committee in hard and soft copies. ______________________________________________________________________ 6. End product/Deliverables and Timelines The key deliverables of the assignment include: a. Inception Report based on literature review (a note of 5-10 pages), highlighting board direction and key areas of revision. (by end of week2). b. Completion of all stakeholder consultations (by end of week 6). c. Draft one of revised Odisha Relief Code (by end of week 9). d. Draft two of revised Odisha Relief Code (by end of week 10). e. Final document of Revised Odisha Disaster Management Code (by end of week 12). 8. Estimated duration of contract

The consultant should have a Master’s Degree in a relevant subject A minimum of ten years of experience in working in Government/ development/humanitarian sectors. Excellent knowledge and understanding of global, national and state policy frameworks for disaster management. Experience of working at national/state level government with cross-departmental function an essential asset to coordinate the efforts across all departments. Experience in working in the field of disaster management. Ability to mobilize and maintain strong rapport with Government, civil society, academia and media. Excellent communication and writing skills. Only the shortlisted candidates will be called for interview. There will be no TA DA for attending the interview.
