NIH Public Access Policy Consolidated Appropriations Act, 2008 Division G, Title II, Section 218 of PL 110-161 SEC. 218. The Director of the National Institutes of Health shall require that all investigators funded by the NIH submit or have submitted for them to the National Library of Medicine’s PubMed Central an electronic version of their final peer-reviewed manuscripts upon acceptance for publication to be made publicly available no later than 12 months after the official date of publication: Provided, That the NIH shall implement the public access policy in a manner consistent with copyright law.

With this Notice, NIH informs grantees that in Spring, 2013, at the earliest, NIH will delay processing of non-competing continuation grant awards if publications arising from that award are not in compliance with the NIH public access policy. The award will not be processed until recipients have demonstrated compliance. Submitting an RPPR with a non-compliant publication will generate an automated email notifying the grantee that the progress report includes citations that are out of compliance with the public access policy and requesting a response by a specified due date two weeks prior to the next budget start date. As indicated above, no sooner than Spring, 2013, the non-competing continuation award will be delayed until a reply to the e-notification is received from the grantee with evidence of compliance or a satisfactory explanation.

For non-competing continuation grant awards with a start date of July 1, 2013 or beyond:  1) NIH will delay processing of an award if publications arising from it are not in compliance with the NIH public access policy.  2) Investigators will need to use My NCBI to enter papers onto progress reports. Papers can be associated electronically using the RPPR, or included in the PHS 2590 using the My NCBI generated PDF report.

White House Office of Science and Technology Policy issued this memorandum on 2/22/13 directing federal agencies, with $100 million or more in extramural funding, to develop a mechanism for archiving and assuring public access to publications and digital data resulting from federal funding. The agencies have six months to submit a plan.

PMID vs NIHMSID vs PMCID   

All citation/abstract records in PubMed have a PMID Once a final peer-reviewed manuscript is submitted, it will get a temporary NIHMSID All full-text articles in PubMed Central have a PMCID

How To Comply 

What needs to be submitted 

Research articles published in a peer-reviewed journal, and



Articles accepted for publication on or after April 7, 2008, and



Articles resulting from NIH funded research, and



Articles written in a Latin-based language

Determine Submission Method There are 4 submission methods. The publisher's policy determines which method is used (A, B, C, or D). One task is to figure out which method applies.    

Journal deposits the final published article into PubMed Central without author involvement. http://publicaccess.nih.gov/submit_process_journals.htm If you publish in a Method A journal, you can use PMC Journal in Process at the end of a citation in your NIH application, proposal, or progress report until the PMCID is available. Method D 







Publisher deposits final peer-reviewed manuscript as a service to their NIH-funded authors for no fee. Publishers have different mechanisms for determining whether they will deposit the manuscript or not. Search SHERPA/RoMEO to determine publisher guidelines, check the publisher’s website, and/or use the Method D list of publishers Corresponding author approves the submission itself and later approves the PMC Web Version.

Method C 







Author (or a third party) deposits the final peer-reviewed manuscript (or published article if publisher allows) into PubMed Central via submission system and NIHMSID is applied Selected author approves the submission itself and later approves the PMC Web Version After both approval steps are complete, the article is put into a queue for upload to PMC and the PMCID is applied. Make sure final peer-reviewed articles are submitted upon acceptance for publication (unless they are exempt from the policy) Include evidence of compliance for all citations dated 2008 to the present in NIH applications, proposals and progress reports Think about including a library expert as a Delegate for both your My Bibliography and Other Citation accounts. Respond quickly to requests from the NIH Manuscript Submission System to do approvals. Respond promptly to emails from NIH about noncompliance with the policy.
