MINNESOTA STATE LOTTERY GAME PROCEDURES eSCRATCH™ GAME NO. 228

1.0.

Name of Game The name of eSCRATCH™ Game No. 228 is “SCRATCH YER BOOTY”.

1.1.

Price of eSCRATCH™ Game Ticket Tickets for eSCRATCH™ Game No. 228 shall be two dollars ($2.00) per Ticket.

1.2.

Definitions A.

“Account Activation Email” means the electronic correspondence sent to a player from the Lottery confirming that the player has successfully registered an account on the Site.

B.

“ACH Process” means the process where funds are electronically transferred to/from a player’s bank account to/from the Lottery’s bank account.

C.

“Claim Code” means the sixteen (16) character alpha and numeric code appearing on the Email notification to the player and in the player’s iLottery account notifying the player that he or she has won a prize.

D.

“Debit Process” means the process by which funds are electronically transferred from a player’s bank account via debit card or the ACH process through card processing networks to the Lottery’s bank account.

E.

“Director” means the Director of the Minnesota State Lottery.

F.

“EIT” or “Electronic Instant Ticket” means the electronic version of a Minnesota State Lottery scratch game ticket.

G.

“eSCRATCH™”, means a Lottery game that is an electronic version of the Lottery’s paper scratch game ticket, and that is played electronically via the Site. eSCRATCH™ is also a trademark of the Minnesota State Lottery.

H.

“Game Ticket”, “eTicket” or “Ticket” means an acceptable evidence of Play, which is a Ticket or an electronic wager produced by a Terminal or a validly registered Play which meets the specifications defined in these procedures.

I.

“Geolocation Verification” refers to the process by which the player’s location is checked against internet service providers’ and/or mobile providers’ records and technology that indicate a general, physical location of a player accessing the Site.

J.

“Graphics” means the images on the eSCRATCH™ Game Ticket outside of the play area where the Play Symbols appear.

K.

“Identity Verification” refers to the process by which information collected from the player is compared against age and identity services’ records to verify that the person exists and is 18 years old or over. This process also verifies that the player is not listed on the U.S. Department of Treasury’s Specially Designated Nationals or Blocked Persons lists.

L.

“iLottery & eTicket Claim Form” means the claim form that must be completed by the player and submitted to the Lottery to claim a prize of $600 or more arising from a purchase on the Site.

M.

“Lottery” means the Minnesota State Lottery.

N.

“Lottery Retailer” or “Retailer” means a person or entity that is authorized by the Lottery to sell lottery tickets.

O.

“Site” or “iLottery Site” means www.mnlottery-ilottery.com.

P.

“Terminal” means a device which is authorized by the Lottery to function in an online, interactive mode with the Lottery's computer system for the purpose of issuing lottery Tickets and entering, receiving and processing lottery transactions including purchases, validating Tickets and transmitting reports.

Q.

“Terms of Service – Electronic Instant Tickets” means the “Minnesota Lottery Terms & Conditions for iLottery” describing the Minnesota Lottery’s www.mnlottery-ilottery.com website and the terms and conditions to which all subscription players are subject.

R.

“Ticket ID” or “Ticket Identification” means the unique nine (9) digit code displayed on each EIT next to the designation “Ticket ID”.

S.

“W allet” means the iLottery account that the player has with the Lottery. The wallet is the sum of two accounts that the player has with the Lottery where the balance of deposits made by the player (“Deposit Account”) and winnings deposited (“Winning account”) by the Lottery are listed.

T. “Wallet Check Request Confirmation Email” means the electronic correspondence sent to the player from the Lottery confirming that the player has requested to receive a check for the total value in the player’s Wallet.

U. “Symbol” means the symbols that appear under the electronic rub-off area of the “SCRATCH YER BOOTY” eSCRATCH™ Ticket. There are two (2) types of Symbols in the “SCRATCH YER BOOTY” eSCRATCH™ Game: “SCRATCH YER BOOTY” eSCRATCH™ Game “Play” Symbols and “SCRATCH YER BOOTY” eSCRATCH™ Game “Prize” Symbols. The possible “Symbols” are: 1.

Purchase of eSCRATCH™ Game Tickets Through the Site A.

The Site permits an eligible player to purchase eSCRATCH™ Game Tickets from the Site. To purchase a “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket from the Site, a player must register on the Lottery’s web site at www.mnlottery-ilottery.com. In order to register, a player must be at least 18 years of age or older and be a resident of the United States.

B.

An eligible player who wishes to purchase eSCRATCH™ Game Tickets for “SCRATCH YER BOOTY” through the Site agrees to be bound by the “Terms of Service – Electronic Instant Tickets” and such terms and conditions are incorporated by reference herein. Players must accept the “Terms of Service – Electronic Instant Tickets” for specific information related to electronic purchases, instructions on how to use the Site, and to purchase eSCRATCH™ Tickets via the Site.

C.

To register for the Site, a player must enter the information required by the “Terms of Service - Electronic Instant Tickets”.

D.

The Lottery may reject a registration if the player does not agree to be bound by the “Terms of Service – Electronic Instant Tickets”, is not a resident of the United States, is under 18 years of age, the Lottery cannot verify that the person is 18 years of age or older, or if the player’s name appears on the U.S. Department of Treasury’s Specially Designated National and Blocked Persons list.

E.

The Lottery will attempt, in good faith, to ensure that all transactions are processed. In the event that either the Lottery or the gaming system providers experience system failures, outages, interruption in services or any other failure that prevents the processing of a player’s transactions, neither the Lottery nor any third party system provider will be responsible for any losses claimed by a player.

F.

Players will have the ability to select which “SCRATCH YER BOOTY” scene they would like to play. The scenes have no bearing on the outcome of the game.

Determination of Prizewinners A.

The determination of prizewinners is subject to the general Ticket validation requirements set forth in Section 4.0 of these procedures; Minnesota Statutes, Chapter 349A; Minnesota Rules, Chapter 7857; and the requirements set out on each eSCRATCH™ Game Ticket.

B.

For players’ information and convenience, the Site contains a demonstration eSCRATCH™ Game which the player may play to familiarize him/herself with how the game is played. A player may access the demonstration game by selecting the “Try Now” button on the Site’s purchase screen. This is used for demonstration purposes 4

only, and a player wins no money when playing a demonstration game. C.

To determine if an eSCRATCH™ Game Ticket is a winning Ticket, the player must play through the entire ticket by selecting the Play Symbols and Prize Symbols. The player may also select an autoplay feature on the eSCRATCH™ Game Ticket that will allow the system to automatically play through the eSCRATCH™ Game. If there are situations where the player is unable to complete the play, and it is prior to the last date to claim a prize, the Lottery has the ability to complete the play on the player’s behalf, if requested by the player. All unplayed eSCRATCH™ Game Tickets will be completed by the Lottery prior to the last date to claim a prize. The ticket must pass all validation checks on the iLottery Site and as required by the Lottery’s validation process. The revealing of the Play Symbols on the eSCRATCH™ Game Ticket does not determine if an eSCRATCH™ Game Ticket is a winning Ticket. The revealing of the Play Symbols is offered for entertainment purposes only.

D.

An apparent prizewinner in the “SCRATCH YER BOOTY” eSCRATCH™ Game is determined when the play area on the Ticket is revealed electronically to expose the twelve (12) “SCRATCH YER BOOTY” eSCRATCH™ Game “Play” Symbols and the twelve (12) “SCRATCH YER BOOTY” eSCRATCH™ Game “Prize” Symbols.

E.

To play the “SCRATCH YER BOOTY” eSCRATCH™ Ticket Game, a player must select all twelve (12) question mark symbols to reveal a “Play” Symbol. A player may also select “Auto Play” to automatically reveal the “P la y” Symbols.

F.

The holder of a Ticket that reveals a “SCRATCH YER BOOTY” eSCRATCH™ Game “Play” Symbol wins the amount indicated by the “SCRATCH YER BOOTY” eSCRATCH™ Game “Prize” Symbol immediately below the “SCRATCH YER BOOTY” eSCRATCH™ Game “Play” Symbol.

G.

The holder of a Ticket that reveals a “SCRATCH YER BOOTY” eSCRATCH™ Game “Play” Symbol wins double the amount indicated by the “SCRATCH YER BOOTY” eSCRATCH™ Game “Prize” Symbol immediately below the “SCRATCH YER BOOTY” eSCRATCH™

The possible combined prizes that may be won from a single “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket are:

eSCRATCH™ Game Ticket Validation Requirements A.

To be a valid “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket and eligible to receive a prize, a ticket shall satisfy all the requirements established by the Lottery for validation of a winning ticket. Neither the Lottery nor any third party systems providers shall be responsible for tickets that have been altered or modified in any manner. For prizes of less than $600, the player will be notified via Email and the Lottery will place a notification in the player’s iLottery account informing the player that he or she has won, and the amount that the player has won. All such prizes will be automatically validated by the Lottery’s system, and the prize will automatically be placed into the player’s W innings Wallet.

B.

For Prizes of $600 or greater, the player will be notified via Email and the Lottery will place a notice in the player’s iLottery account informing the player that he or she has won a prize of $600 or greater. The notification will provide the player with a Claim Code and instructions on how to claim a prize of $600 or greater. The Lottery will attempt to validate the prize at the time that the player presents the iLottery and eTicket Claim Form, the Claim Code, and proper identification to the Lottery.

C.

In addition to the above, in order to be a valid “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket, all of the following requirements must be met: 1.

the Ticket ID number that appears on the eSCRATCH™ Game Ticket must appear as a winning Ticket in the player’s iLottery account and in the Lottery’s computer validation file. It must also allow the Lottery to determine if the eSCRATCH™ Ticket is a winner and the prize level of the Winning eSCRATCH™ Ticket; 6

the Claim Code associated with the winning eSCRATCH™ Game Ticket ID must not be altered or modified in any way, must not be produced in error and must have been issued by the core iLottery system;

3.

the winning eSCRATCH™ Game Ticket Claim Code must have been issued by the Lottery in an authorized manner;

4.

the Ticket ID Number of an apparent winning eSCRATCH™ Ticket must be verified as a winning Ticket on the Lottery’s computer system and the Ticket must not have been previously paid;

5.

An eSCRATCH™ Ticket produced through the Site must meet all of the Lottery’s confidential security checks.

D.

The Ticket must pass all additional validation tests provided for in these game procedures, the Lottery Statute (Minnesota Statutes, Chapter 349A), the Lottery’s Prize Payment Rules Minnesota Rules, Chapter 7857) and any confidential validation tests of the Lottery.

E.

Any Ticket not passing all the validation requirements is void and is ineligible for any prize.

Procedures for Claiming eSCRATCH™ Game Ticket Prizes A.

Prizes of less than $600 from eSCRATCH™ Game Tickets purchased through the Site will be paid to the person who had registered on the Site and who made the eSCRATCH™ Game Ticket purchase. The player will be notified by email, a notice will be placed in the player’s iLottery’s message account, and the amount won will be deposited to the player’s Wallet.

B.

A player may elect to withdraw his or her winnings, or a portion thereof at any time. Under the “Terms of Service – Electronic Instant Tickets”, the minimum withdrawal amount a player can request is ten dollars ($10.00), unless the amount of the Winnings Account portion of the player’s Wallet is less than $10.00, in which case, the player may request the total remaining balance of the Winnings Account. Once the election has been made, the player will receive a Wallet Check Request Confirmation Email and the Lottery will issue a check to the player for the total amount in the player’s W innings Wallet. A player may apply some or all of the funds in his/her Wallet toward future ticket purchases on the iLottery site. Money in the players Wallet will not earn interest. If there is no activity in the player’s account for a period of three (3) years and there is a balance in the player’s Wallets, the Lottery will notify the player regarding the player’s 7

balance. If there is no response from the player within thirty (30) days of such notification, the amount in the player’s Wallets will be treated as unclaimed property in accordance with Minnesota law. The Lottery reserves the right to collect from a player’s Wallet any amount owed to the Lottery due to nonpayment for an eSCRATCH™ Game Ticket purchase made by the player. 5.2.

Allowance for Delay of Payment A.

The Lottery may delay payment of the prize, pending a final determination by the Director, under any of the following circumstances: 1)

if a dispute occurs or it appears likely that a dispute may occur regarding the prize;

2)

if there is any question regarding the identity of the claimant;

3)

if there is any question regarding the validity of the Ticket presented for payment; or

4)

if the claim is subject to any setoff for delinquent debts owed by the claimant under Minnesota Statutes, Section 349A.08, subdivision 8.

No liability for interest for any delay shall accrue to the benefit of the claimant pending payment of the claim.

Payment of Prizes to a Person Under 18 No prize in the “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket may be paid directly to a person under 18 years of age.

5.4.

eSCRATCH™ Game Ticket Claim Period All eSCRATCH™ Game Ticket prizes must be claimed within one (1) year of the announced end of the eSCRATCH™ Game. However, if the one (1) year deadline is a Saturday, Sunday or a legal holiday, a claim must be submitted by close of business the following business day.

6.0.

eSCRATCH™ Game Ticket Ownership A.

When an eSCRATCH™ Game Ticket purchase made through the Site is validly and properly registered with the Lottery, the player who has registered the ticket shall be the owner of the ticket and shall be entitled to any prize attributable thereto.

B.

If there is a valid agreement among more than one (1) person agreeing to share an eSCRATCH™ Game Ticket prize, and the prize 8

being claimed is over six hundred dollars ($600.00) the Director will make payment to each person who is party to a valid prize sharing agreement. 7.0.

Number and Value of Prizes There will be approximately 1,200,000 Tickets in “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket No. 228. The expected number and value of prizes in the game are as follows:

The actual number of Tickets in the game may be increased or decreased at the sole discretion of the Lottery. The overall odds of winning a prize in “SCRATCH YER BOOTY” eSCRATCH™ Ticket Game No. 228 are 1:3.54. 8.0.

Emergency Termination of the “SCRATCH YER BOOTY” eSCRATCH™ Ticket Game The Director may, at any time, announce the termination of “SCRATCH YER BOOTY” eSCRATCH™ Game Ticket No. 228 without advance notice, at which point no further Tickets in the game may be purchased.

9.0.

Governing Law In purchasing an “SCRATCH YER BOOTY” eSCRATCH™ Ticket, the player agrees to comply with and abide by these game procedures; the “Terms of Service – Electronic Instant Tickets”, Minnesota Statutes, Chapter 349A; the Lottery's Prize Payment Rules; and all final decisions of the Director. 9
