President’s Message Troy Maynard Hello Fellow TLA Members: I have had a number of Locksmiths tell me April was a terrible month, we had a fair month at our shop but if you track your company month by month year after year, I bet you will see last April was close to this one. I‘m ready for May to be over, that will be the end of the legislative year then we‘ll know what bills passed and how they may affect us as Locksmiths….. Not to mention no more 3 days‘ notice telling us we have to testify before a Senate Committee. Billy and I found out that‘s all the notice we get to be at these meetings at the capitol……It has been a VERY interesting year going to the capitol and seeing how things work, not as you might think!!! I want to tell you where we are with the 2013 Convention, we are looking at Corpus they have made us what looks like an offer we can work with…….How would you like to see your convention held in Austin and Plano every other year on the same weekend???? I want you to think about this, it will save the Association money, the board time to work on other things over the year; our vendors would also like to see this…..Unless you have served on the board you just don‘t know how much time it takes to set the convention up every year. So again I am asking for your input on our future conventions. Email me at [email protected] or give me a call 512-563-7815……. Thanks to all of you that have taken the time to give me a call, the numbers climb every month…….

Secretary’s Report Mark Dawson The summer heat is fast approaching and the spring rains have been non existent. I hope that all of you are well and I would like to extend my concerns to those that are experiencing a loss of family or friend at this time. The Secretary‘s office is going to get a little quite concerning mail delivery. Effective immediately the U.S. Mail will be received once a month. This should not impair any members‘ ability to contact the board due to the ability to e-mail us with comments or questions. The savings for implementing the sleep cycle on TLA‘s mail is estimated to be $45.00 a month. If you need to contact any member of the board please use [email protected] to do so. You will be pleased at the response times. We are currently answering most inquiries within 24 hours.

2012 Convention If I may wear another hat for a few moments we are starting to contact and nail down instructors and classes for the 2012 Plano Convention and Expo. We have had very limited input from the membership concerning these items. If you desire to enroll in a particular class or enjoy the teaching of a particular instructor speak now or you won‘t have the right to complain later. Steve Sharp is the 2nd VP and the Education Chairperson. Please forward all class desires to him or myself.

Sgt-at-Arm’s Report Jim Holzberlein Hello everybody one more month gone by and one more trip to Austin. I don't know how many of you are taking advantage of the current climate in America but safe sales the last 2 years have gone very very well in Abilene, Texas. At our shop we focus on Amsec BF gun safes. They are more expensive than a Cannon, Browning, Sentry or Hollon safe, but my wife Greta And I decide 4 years ago that since we are in a security business that we were more interested in quality American made safes, so that's the line we carry and we have sold a lot of them. Another interesting trip to Austin to the PSB meeting. Not much involving locksmith rule wise but some disturbing rulings on letting a locksmith have their licenses after being denied previously. They allowed two locksmiths with aggravated assaults get their license reinstated and one owner/ manager license was reinstated as a child sex offender. I know that there are extenuating circumstances in all cases but I feel if there is a victim involved there should be no allowances made (my personal opinion not that of the TLA board). We are are in a very special business that requires the highest level of trust and feel if you believe as I do,you should contact the PSB about those concerns. The TLA board has been working on 2013 convention and Corpus Christi looks good lets give Troy some feed back. Also we are wanting input into an idea Troy has by setting regularly schedule conventions, split between Austin And the Dallas area. We need input from all who are interested, we feel it would make it easier for locksmiths to plan the year, when they know where and what weekend of the month we have convention. Much like we know when Hans Johnson has it's show. Sounds good but we need to know if you have any reasons why you think the idea won't work. 7

Membership Director’s Report James ‘Jake’ Hall The new Membership Director has been taking care of some family issues and will be back on track in the next two weeks. Please bear with us while we get caught up on the membership packets.

Parliamentarian’s Report Steve Stanhope I am happy to announce that a check for $1200.00 is being mailed to TLA from the Panhandle Locksmith Assoc. We dissolved a few years ago but had money left over. ALOA will match $0.50 for each dollar we donate. The money will be put in the legislative fund where we feel it will do the most good. I want to thank Robert Vineyard of Borger for helping with the donation of this money.

LEGISLATIVE UPDATE The legislative session has reached a fevered pitch with only a few weeks left before the final gavel falls on the 82nd session. The Texas Locksmiths Association legislative team is also operating at a high level as we fight to get our legislative agenda passed before time runs out. HB 2577 by Representative Sid Miller, Chairman of the Homeland Security and Public Safety Committee, creates a penalty for anyone who is found in possession of lock pick tools, if criminal intent can be proven. The language in the bill states: UNLAWFUL USE OF A CRIMINAL INSTRUMENT OR MECHANICAL SECURITY DEVICE. “A person commits an offense if the person possesses a criminal instrument or mechanical security device with the intent to use the instrument or device in the commission of an offense, or with knowledge of its character and with the intent to use a criminal instrument or mechanical security device or aid or permit another to use the instrument or device in the commission of an offense, the person manufactures, adapts, sells, installs, or sets up the instrument of device.” The bill defines ―Mechanical security device‖ as ―a device designed or manufactured for use by a locksmith to perform services for a customer who seeks entry to a structure, motor vehicle, or other property.” If the bill passes and becomes law, a person found guilty of committing a crime with lock pick tools can be prosecuted for the additional violation of using the tools to commit the crime. 9

SB 1400 by Senator Dan Patrick and Representative Allen Fletcher is our ‗omnibus bill‘. This bill has new definitions of ‗locksmith‘, new definitions of ‗locks‘ and will add a locksmith to the Private Security Board, (PSB). When the PSB was created by the legislature the legislation required that the board be comprised of one licensed investigator, one security guard company representative, one burglar and fire alarm representative and four public members. At the time the board was created, locksmiths were not regulated by the board. The changes in the definitions of ‗lock‘ and ‗locksmith‘ in the bill are designed to keep up with the rapid changes taking place in the locksmith profession due largely to changes in technology. The new definition of ‗lock‖ in the bill is: “Lock” means a fastening device that: (A) is used to secure, regulate, activate, or control a door, gate, drawer, cabinet, safe, or automobile by means of a mechanical or electric device, including a latch, bolt, key, transmitter, card-reader, keypad, or proximity key fob; and (B) is not monitored by security personnel or services and does not send a signal to which law enforcement or emergency services respond.” The new definition of ‗locksmith‘ in the bill is: ―An individual acts as a locksmith for purposes of this chapter if the person: (1) for a fee and with legal authorization, sells, installs, services, maintains, bypasses, or defeats electronic access control devices or mechanical security devices, including deadbolts and locks; or (2) advertises or offers locksmith services to the public or represents to the public that the person is a locksmith.” *Only the underlined sections are new language

We expect these bills to help the locksmith profession clear up any ‗grey areas‘ where individuals are offering locksmith services that are un-licensed and may indeed be wanted felons, and give law enforcement officers an additional tool to prosecute those who would use lock pick tools illegally. The TLA legislative team has done a great job of working with the legislature to pass these measures. The united efforts of the Texas Locksmiths Association have been noticed by the Texas Legislature and we look forward to many legislative successes.

TLA LAC REPORT The TLA LAC committee is still active involved in Austin, meeting with committees, and attending PSB meetings. On April 12 there was a meeting with the House Committee on Criminal Jurisprudence where HB2577, or as it has come to be known, The Lock Pick Bill was presented. We answered the questions that were asked from committee and received a rather positive response. The bill did pass committee and is still waiting for passage from the House floor and later the Senate. This is the bill, if passed into law, will increase the penalty one must receive if they use locksmith tools in the commission of a crime. SB1400, the Omnibus Bill, a: puts a locksmith on the PSB board and b: gives a better definition of locksmith and locksmith tools. It did pass the Senate and was referred to the House for passage. It is waiting to be put on the calendar for a vote on the House floor. The companion bill, HB1867 was set aside after passage of SB1400. On April 21 there was teleconference meeting of the LAC committee where we heard first hand from Keith Oakley of the status of the two bills we have in legislature. Overall, it sounds like we are good shape as we are experiencing no opposition. Those in attendance at the teleconference were: Billy Garrett, Troy Maynard, Don Hiser, Jake Hall, Mark Dawson, Shane Williams and Keith Oakley. Members not able to attend were: Bonnie Morse, Tim McMullen, Scott Cook, Tommy Warren, John Arnold. On April 29, 2011 locksmiths from across the state met in Austin for the PSB meeting. Private Security Board Meeting Report April 29, 2011 I counted 11 Locksmiths in attendance at this regular third quarterly PSB Board meeting. TLA President~Troy Maynard, TLA Treasurer~Billy Garret, TLA Sgt-at-Arms~Jim Holzberlein, TLA Editor~John Helweg (who also represents the Alarm folks), and a number of Locksmiths from the Austin and San Antonio area joined representatives from the Guard, Alarm, and Private Investigators Industries. A FULL PSB Board was present including Mr. Edwards & Mr. Black newly appointed members at large. Reports from the RSD-PSB staff included: Licensing & Registration Supervisor~Reggie Andrews and Compliance & Enforcement ~Captain Jay Alexander. (reports may be viewed on TDPS website – current active Individual Registrations are 128,861). Assistant Director~Capt. Bowie was present and introduced Sherry Johnson (SJ) head of the Shared Services section of RSD who provided an update on ‗pocket cards‘. The expected date falls early 2012. Repeal of 35.41 ―Company Name Selection‖ was sent to committee. Amendment to 35.43 ―Military Discharges‖ was sent to committee. Amendment to 35.46 ―Guidelines for Disqualifying Convictions‖ was passed. Repeal of Subchapter G ―Motorcycle Escorts‖ was passed. Amendment to 35.281 ―Training Personal Protection Officers‖ was passed. Amendment to 35.291 ―Continuing Education Requirements‖ was passed. Amendment to 35.292 ―Requirements for CE Courses‖ was passed. Amendment to 35.341 ―Requirements for Security Officer Commission‖ & 13

Amendment to 35.251 ―Training Requirements‖ was passed. Discussion concerning the need for a Rule to removed former employees from PSB database & industry company records was discussed. This is currently on a volunteer bases. (Have YOU removed your old employees?) Discussion concerning the need for a Rule relating to the training requirements for Computer Forensic Investigators was discussed. Public comment was allowed throughout the meeting and Bonnie Brown Morse thanked the Board for the time spent to clean-up 35.291 & 35.292 (CE related rules) and that the PSB Staff should now be prepared for the complaints that will be filed concerning NO CEU‘s taken throughout the industry. I did remain through the administrative hearings where a Locksmith registration was granted an employee of Cothron‘s from Buda, a Locksmith Owner/Manager registration was granted ERIC LOPEZ of San Antonio, and two Alarm registrations were denied by the PSB Board. — Bonnie Brown Morse

I looked at the site and they do have Gardall and Amsec safes for sale at a little above 20% off list, this tells me that one of our distributors is selling them. Our whole line is also not represented. Whomever [email protected] is, has not fairly presented the situation. I told you in good standing that Gardall does not sell box stores directly, I stand by my word.‖ ———————————————————————The TLA Board spoke about this on our recent phone conference call and believe that Gardall is telling the truth and is working on resolving this issue. David William Berry April 14, 1953 - May 6, 2011 David William Berry of Hutto, Texas, went to Jesus on May 6, 2011. He was survived by his wife Donna and daughters Cristina and Rachael. He was loved by many. The memorial service will be held at Shoreline Christian Center May 10, 2011 at 1:30pm. David Berry was born on April 14, 1953 in Iowa City, Iowa. He spent most of his childhood in St. Cloud Minnesota where he loved to fish and spend time at the lake. In 1972 David joined the United States Navy to see the world. In 1993 David started his career as a Locksmith this is when David and Troy Maynard started working together and they would continue to work together until the first part of 2010, when David was diagnosed with cancer. After David finished his treatment of chemo and radiation, Troy started picking David up on Thursdays. They would go to lunch and then right to the shop where David wanted to be the most, he loved getting back in the shop and seeing everyone. This continued up to the time that David passed on May 6, 2011. David will be greatly missed by his family and so many friends.

Norman L. Sharp July 8, 1936 - May 2, 2011 Norman L Sharp (Big Red to his friends and family) of Austin TX, passed away following a long illness. Red was preceded in death by his wife Geneva and his Mother, Virginia Potter. He leaves behind his son's Philip and Steven and his daughter Tami Sharp along with their spouses Judi 8 Nancy. He will be missed by his grandchildren, Steven Jr his wife Adum, Christopher and his wife Regina 8 Katy Sharp, Conner Boyett, Alexandra and Tristan McGinty and Ryan Cope. He also leaves behind his 2 brothers in California, Mel and Kenny Sharp as well as several great grand children, nieces, nephews and countless friends. A memorial service will be held at Angel Funeral Home at 1606 S First on May 12, 2011 starting at 2:00 p.m. Procession to the grave site will follow.

LockPAC Pledge Card It began as early as August 2005. It was published in the Advisor that there was a need for the locksmiths of the TLA to help with additional contributions to the Legislative Fund. The need was great then and even greater now. Just as in 2005 you are being encouraged to help with the following: 1. Would you pledge one service call fee a month for one year? 2. Would you make an honest attempt to sign up a non-member. There are many locksmiths who are not members, but should be. If each member of TLA pledges the above, we could continue to fund our lobbyist, Keith Oakley, as he works on our behalf in the legislature and with the PSB board. We could also increase our membership to approx. 800 members. We are anticipating many positive legislative changes this year, but those changes do not automatically happen. Will you join with other locksmiths in Texas affect changes for the future of our industry? Please sign up today! NTLA Meeting I recently made the journey to Dallas for the monthly North Texas Locksmiths Association NTLA meeting. The meeting was casual and the members seemed nice and welcoming, but there appeared to be a shortage of officers present at the meeting. ALOA had several representatives present. They spoke about the upcoming ALOA Convention in Nashville, TN. Tim McMullen gave a national legislative update and David Lowell spoke about the National Automotive Service Task Force (NASTF). I also spoke about the current Texas legislative environment. Our Omnibus bill SB1400 is looking pretty good. It‘s in the Calendars Committee and our friends on the alarm side have been at the capital meeting with all the committee members to make sure our bill moves and gets voted on. We should have some very good news by the time you receive this Advisor.
