Affidavit of Non-Collusion ►

Required with All Proposals



Affidavit certifies that „ the bidder has not conspired with or solicited another company to create a fake bid for comparative purpose; „ that the bidder has not asked competitors to refrain from bidding; „ that the bidder has not conspired with a competitor or other company to create an unfair advantage over other bidders.



Must be notarized by a registered Notary Public



Must be signed by the authorized company officer

Affirmative Action Plan ►Language in the contract will certify that the proposer will comply with the Non-Discrimination and Affirmative Action Practices endorsed by the City of Los Angeles. Actions required: ƒ Designate an Equal Employment Opportunity Officer; ƒ Identify the EEO Officer on the Vendor Identification Form;

Child Support Obligations ►Language in the Contract will require that all contractors and subcontractors performing work for the City make court mandated child support payments, and comply with reporting requirements and wage and earning assignments. ►Failure to return the certification as part of the proposal can result in rejection of the proposal.

Contractor Responsibility Program ► The Los Angeles World Airports (LAWA) Contractor Responsibility Program (CRP) requires LAWA to make a determination that contractors have the necessary quality, fitness and capacity to perform the work set forth in the contract. ► Failure to comply with the provisions of the Contractor Responsibility Program can result in disqualification from the proposing process or contract termination. ► All proposers are required to complete and submit the Contractor Responsibility Questionnaire and Pledge of Compliance with the proposal. ► The information contained in the CRP Questionnaire is subject to public review for a period of not less than 14 days.

Living Wage/ Service Contract Worker Retention Ordinances ►

Contractor agrees to pay employees a living wage – updated July 1st of every year. The living wage is currently $10.30 per hour if the contractor pays for health benefits or, if health benefits are not provided, then $14.80 per hour for Airport Employees and $11.55 per hour for all other City Employees.



Contractor must provide at least 12 compensated days off per year for each employee’s sick leave, vacation or personal necessity, and at least 10 days off uncompensated.

Service Worker (if applicable) - Contractor agrees to offer to employ and retain for a 90-day period the employees who worked for at least 12 months for the terminated contractor/subcontractors earning less than $15.00 per hour. ► Policy must be read and agreed to, but does not require signed form for submission.



Municipal Lobbying Ordinance ►

Certifies that the bidder acknowledges and agrees to comply with the disclosure requirements and prohibitions regarding their lobbyist activity.



Bidders are required to complete and submit the Bidder Certification CEC Form 50 with the bid.



Any bid made without the CEC Form 50 may be considered not responsive.

Selected Contractor Requirements „ Equal Benefits Ordinance (Complete and Sign) „ Approved Insurance „ Minority / Women and Other Business Enterprise Program „ First Source Hiring

Equal Benefits Ordinance ► Selected Bidder/Proposer submits forms. ► The EBO requires City contractors who provide benefits to employees with spouses provide the same benefits to employees with domestic partners. ► Domestic partners are defined as two adults living together, jointly responsible for living expenses, committed to an intimate and caring relationship and registered as domestic partners with a governmental entity. ► City of Los Angeles Public Works determines Compliance with EBO.

Insurance ► The City of Los Angeles has to protect itself against loss which would significantly affect personnel, property, finances, or the ability of the City to perform Airport operations. Therefore, we ask that our Contractors/Vendors obtain insurance. ► Coverage amount depends on nature of work to be done. Where required, both prime and subcontractors have to show proof of coverage prior to starting work. ► Get an estimate or quote from your insurance agent or brokers and factor that into the bid/proposal you are preparing. ► Do not spend any money to meet the insurance requirements until you are awarded the contract by LAWA. ► LAWA has special endorsement forms. Minority/Women/ Other Business Enterprise Program ►

LAWA projects with an estimated value of $50,000 or greater, will be reviewed for MBE/WBE subcontracting opportunities



Levels are set based on subcontracting opportunities and availability of certified MBE/WBE Firms.



Certified provided by a member of the California Unified Certification Program. In the Los Angeles County area, the City of Los Angeles, Los Angeles County Metropolitan Transportation Authority (Metro), and the California Department of Transportation (CalTrans).



This project contains a 15% anticipated level of MBE/WBE participation.

Meeting the Good Faith Effort (GFE) MBE/WBE/OBE ► All

Proposers, regardless of status, must perform a “Good Faith Effort” to outreach to certified firms.

► If

you are one of the top selected Candidates, you must submit documentation of the “Good Faith Effort” within 3-days of notification from LAWA.

► To

meet the Good Faith Effort, Prime Contractors must achieve 75 out of 100 points.

First Source Hiring Program ► The First Source Hiring Program (FSHP) is a contractual obligation for all entities with whom LAWA contracts, whether it is a new contract or contract renewal. ► Companies that have a non-construction vacancy must notify the FSHP and we will provide candidates for interview consideration with 5 days. ► LAWA Contractor will: ƒ Exercise good faith in conducting interviews of qualified PIA residents for a 2-week period before opening the position to the general public; ƒ Keep records of candidates for LAWA review; ƒ Be assessed damages for noncompliance. ► For further information, please contact Business and Job Resources Center at (310) 417-6490.
