PURPOSE:

The purpose of this bulletin is to provide schools with information on the annual notification procedures for parents of English learners (ELs), as required by Title III of the No Child Left Behind (NCLB) Act of 2001.

MAJOR CHANGES:

This bulletin replaces REF-2638.2, titled Annual Parent Notification Requirements Under Title III of the No Child Left Behind Act for Elementary Schools, dated July 17, 2008.

BACKGROUND:

Title III, Part A, is officially known as the English Language Acquisition, Language Enhancement, and Academic Achievement Act. The purpose of Title III is to ensure that limited-English-proficient (LEP) students (referred to as ELs under California law), including immigrant children, develop English proficiency and meet the same challenging academic content and achievement standards that all students are expected to meet. Schools using Title III funds are to implement language instruction educational programs designed to help EL students achieve these standards. Additionally, school districts using Title III funds must implement an effective means of outreach to parents of ELs. Parents of ELs must be notified annually of their child’s participation in a language instruction educational program. Schools must inform parents about how they can be active participants in assisting their child to learn English, achieve at high levels in core academic subjects, and meet the same challenging state academic content and student achievement standards that all students are expected to meet [Title III, Section 3302 (a)].

INSTRUCTIONS:

I.

PARENTAL NOTIFICATION REQUIREMENTS Schools have the obligation to communicate with parents in a language that parents comprehend. When fifteen percent or more of the student population speaks a single primary language other than English, as determined on the preceding year’s Language Census Report (R30), the

school is required to send all correspondence to parents in English and the primary language (EC 48985). Title III requires schools to inform parents in writing of the following: A. Reasons for identifying their child as an EL student and for placing their child in a language instruction educational program B. Child’s English proficiency level, including how the level was assessed and the status of the child’s academic achievement, as measured by the California English Language Development Test (CELDT) and California Standards Test (CST) C. Methods of instruction that will be used in the instructional program, including a description of Alternative Programs D. How the program will meet the educational strengths and needs of the child E. How the program will help the child learn English and meet academic achievement standards for grade promotion F. Program exit requirement (reclassification), including the expected rate of transition from the current program to a Mainstream Englishclassroom G. How the program will meet the objectives of an Individualized Education Program (IEP) for a child with a disability H. Information pertaining to parental rights, which includes: 1. The right to have their child immediately removed from a language instruction educational program upon their request 2. The options that parents have in declining enrollment of the child in such a program or in choosing another program or method of instruction, if available 3. Guidance assisting parents in selecting among various programs and methods of instruction, if more than one program or method is offered To meet the above requirements, parents/guardians of ELs are provided oral and written descriptions of the Master Plan instructional program BUL-4872.0 Office of Curriculum, Instruction, and School Support

options, including all educational opportunities available to students, and the educational materials to be used in the different program options at the time of enrollment, annually and upon request (5 CCR 11309[b][1]). II. ANNUAL PARENTAL NOTIFICATION TIMELINE For ELs who were enrolled in the district the previous school year, parental notification must be provided no later than 30 calendar days after the beginning of the school year/track. The annual notification process applies to continuing EL students only. NOTE: Refer to the Initial Notification Requirements for Parents of English Learners reference guide for notification requirements of newly enrolled EL students. III. PARENTAL NOTIFICATION PROCEDURES To meet Title III parent notification requirements, the Annual Assessment Results and Program Placement for English Learners letter is available on the Student Information System (SIS). This letter contains current Master Plan program and test information for continuing EL students. In addition to this letter, schools must inform parents in writing of the instructional program options as well as the program exit criteria using the following: 1. Instructional Programs for English Learners Parent Brochure 2. Parent Notification of Reclassification Criteria Parents must annually confirm their child’s instructional program placement using the Annual Assessment Results and Program Placement for English Learners letter. Schools must confirm the student’s program placement by reviewing the placement options section of the letter. In addition, the letter must contain the parent’s signature in order to be valid. NOTE: If a selection is not made the school must follow up with the parent to confirm program placement.

The following steps will ensure that schools meet the Title III annual parent notification requirements: 1. Verify the accuracy of Master Plan program placement information in SIS, Screen 5, Field 164. 2. Review and update, if necessary, the ELD Assessment Portfolio level in SIS Screen 6. 3. Print the Annual Assessment Results and Program Placement for English Learners letter using SIS, Screen 14, Option 39. The parent notification letter will print in English and/or Spanish, based on the parent language code entered in Screen 3, Field 39. If the parent’s language is other than English or Spanish, the letter must be completed by hand in the parent’s primary language and attached to the English letter. Translations of the Annual Assessment Results and Program Placement for English Learners are available in Armenian, Chinese, Korean, Russian, and Vietnamese (Attachments A-1 through A-7). 4. Make copies of all the letters to keep on file at the school site until the original letter is returned with a parent signature. 5. Attach the Parent Notification of Reclassification Criteria to the Annual letter. Translations of the Parent Notification of Reclassification Criteria are available in Spanish, Armenian, Chinese, Korean, Russian, and Vietnamese (Attachments B-1 through B-7). 6. Attach the Instructional Programs for English Learners Parent Brochure to the letter. Translations of the Parent Brochures are available in Spanish, Armenian, Chinese, Korean, Russian, and Vietnamese (Attachments C-1 through C-7). 7. File the returned Annual Assessment Results and Program Placement for English Learners letter in the student’s Master Plan Folder in the cumulative record. IV. ADMINISTRATOR RESPONSIBILITIES “The custodian of records shall be responsible for the security of pupil records and shall devise procedures for assuring that access to such records is limited to authorized persons [CCR, Sec. 433(a)].” The principal, as the custodian of records, is responsible for the Master Plan Folder, its contents and security and must ensure that all documents are current and accurate. When EL documentation is missing from the Master Plan Folder or the cumulative record, a reasonable attempt to obtain the documents must be made. The procedures for sending EL documentation and making a reasonable attempt are: 1. Annotate the school’s copy indicating the original date sent. 2. If the original is not returned within a reasonable amount of time (5-7 days), annotate the copy on file by indicating the date of the second notification attempt. Resend a copy of the annotated document to the parent/guardian. 3. If the original is not returned within 3-5 days, contact the parent/guardian by telephone as a reminder and request return of the document. If contact by telephone is not successful, annotate the document by indicating the date and time the third attempt was made. File the annotated document in the student’s Master Plan Folder. When an EL has demonstrated proficiency in English and has met the reclassification criteria, the student will reclassify as Fluent-English Proficient (RFEP) per Education Code Section 313(d) guidelines. The established criteria for reclassification are as follows:
