The decision of the Competent

Authority will be binding and final. LOADING OF TENDER: All tenders shall be required to indicate overall efficiency figures. All tenders except the one who quoted the highest overall efficiency, shall be loaded for the higher KWH bill, taking ` 6/- per unit as the rate for 24 hours working for 2 years. For this, the I.I.T. / NISAKI / ETDC / SAMEER tested efficiency shall be taken as the basis. Please note that the CUPS efficiency shall not be lower than that specified by I.I.T./ NABL approved testing lab NISAKI should be enclosed. Proof of efficiency for their CUPS of similar capacity, recently tested by ETDC / SAMEER / IIT / NISAKI should be enclosed. Technical specification format and price bid format should be enclosed in separate envelopes and should be sealed.

OVERRIDING CONDITIONS: No overriding conditions will be accepted by LIC of India.

The Chief Engineer, LIC of India, Zonal Office is not bound to accept the lowest tender and reserves the right to reject any or all tenders without assigning any reason whatsoever. No claim or compensation will

from

any

regarding

rejection/

non-acceptance of their tender. 8.

FORFEITURE OF E.M.D.: The Earnest Money Deposit shall be forfeited by the Life Insurance Corporation of India, in the event of the tender being accepted and the contractor failing to execute the contract, when called up on to do so.

GENERAL CONDITIONS OF CONTRACT

FOR SUPPLY, INSTALLATION, TESTING & COMMISSIONING OF 2 Nos 40 KVA, 3 PHASE UPS WITH 30 MINUTES BACKUP WITH PARALLEL REDUNDANT CONFIGURATION IN LIC OF INDIA, DIVISIONAL OFFICES AT ERNAKULAM AND COIMBATORE 1. Interpretations: i)

Employer shall mean the Life Insurance Corporation of India and their heirs, legal representative’s assigns and successors.

ii)

“CHIEF ENGINEER” shall mean the person occupying the post of CHIEF ENGINEER OF THE LICI’s Zonal Office.

iii)

“Corporation’s Engineers” shall mean the officer who shall from time to time be appointed by the corporation for supervision of various works of corporation including CUPS testing or any purpose in connection therewith.

iv)

Supplier shall mean the Supplier whose tender is accepted by LIC of India and his (their) heirs, legal representatives, assigns and successors.

v)

“Contract” shall mean agreement between LIC of India and Supplier.

2. Scope of Contract: Supply, Installation, Testing and Commissioning of 2 Nos 40 KVA, 3 Phase UPS with 30 configuration in

Coimbatore according to the requirement of LIC of India.

3. Date of Completion: In 30 days of receipt of order including obtaining certificate from the concerned testing authorities and producing to the LIC Offices. 4. Terms of payment: 1.

90% against supply, installation, testing and commissioning of Centralised UPS Systems and duly certified by the LICI Engineer.

2.

Balance 10% of value of the contract will be paid on completion of defects liability period of Two years from the date of Commissioning of the Centralised UPS System and put into regular use. However, the same may be released if the contractors furnish the bank guarantee for equivalent amount valid for 2 years with grace period of 6 months from the date of completion.

5.

DEFECTS LIABILITY PERIOD: The defects liability period shall be 24 months reckoned from the date of Installation of CUPS with Battery. It is also responsibility of the successful tenderer to replace the batteries at free of cost to LIC of India in case of defects during the Defect liability period of 2 years.

6.

Attendance during warranty period: During the Guarantee period of 24 months the CUPS shall be serviced by the contractor by deputing the service personnel once in every three months or earlier as directed by the corporation including attending to all break down calls at his cost and all necessary materials are to be provided for repair and replacement by the vendor at his cost. All the expenses towards Travelling expense, incidental charges, etc. incurred for deputing the personnel for carrying out the servicing/ breakdown calls are to be borne by the vendor.

APPENDIX TO THE CONDITIONS OF CONTRACT (FOR CENTRALISED UPS SYSTEMS WITH PARALLEL REDUNDANT CONFIGURATION) 1) Date of Commencement : Immediately on receipt of acceptance letter 2) Date of Completion

The manufacturer / supplier shall warrant that the goods supplied under this contract are new and incorporate all recent improvement in design and materials.

The manufacturer shall further warrant that all CUPS

supplied shall have no defect arising from design, materials or workmanship or from any act or omission of the manufacturer that may develop under normal use of the supplied CUPS in the conditions prevailing at the final destinations. b)

This warranty shall remain valid for 24 months after the CUPS with Battery have been delivered, tested and accepted at the final destination.

c)

It is also responsibility of the successful tenderer to replace the batteries at free of cost to LIC of India in case of defects during the Defect liability period of 2 years.

d)

Under warranty the manufacturer shall with all reasonable promptness speed, repair or replace the defective CUPS or parts thereof, without any additional cost to the purchase.

If the manufacturer/supplied been notified, fails to remedy the defects within 24 hours, the purchaser may proceed to take such remedial action as may be necessary, at the manufacturer’s risk and cost.

f)

Comprehensive Annual Maintenance Contract: After the Guarantee period of 2 years, the vendor should carry out Comprehensive Annual Maintenance Contract for the systems supplied as per the rates mentioned in the price bid. The CAMC charges given shall be all inclusive comprehensive maintenance for UPS unit including all taxes but excluding batteries and Service Tax. The normal terms & conditions for CAMC is enclosed as Annexure- “B”.

ANNEXURE – “B” SERVICES TO BE DONE DURING DLP PERIOD & CAMC PERIOD DLP Period : During the Defect liability period the successful Tenderer has to attend the following: 1.

Quarterly services to be done for UPS. Any parts etc., to be replaced at Free of Cost to LIC.

2.

Incase of breakdown calls the Contractor has to attend to it immediately within 24 hours informed over phone / writing by LIC.

CAMC Period : The Comprehensive AMC will automatically commence from the date of expiry of defect liability period. 1.

Quarterly services to be done for UPS. Any parts etc. to be replaced at free of cost to LIC.

2.

Incase of breakdown calls the Contractor has to attend to it immediately within 24 hours informed over phone / writing by LIC.

3.

The Contractors should submit the bills along with service reports Quarterly for Payment from concerned LIC Divisional Office.

4.

Incase of any defect in the machine the Contractor has to provide a stand by unit until the original machine is repaired.

5.

The Chief Engineer, LIC of India, reserves the rights to cancel the contract at any point of time, if the services rendered are not satisfied. Any breakdown call intimated orally over phone or in writing by the LIC Engineer should be attended immediately within 24 hours otherwise proportionate days delay of amount may be deducted from your AMC Bill or we may removed from our Approved list.

SPECIAL CONDITIONS OF CONTRACT FOR SUPPLY, INSTALLATION, TESTING & COMMISSIONING OF 2 Nos 40 KVA, 3 PHASE UPS WITH 30 MINUTES BACKUP WITH PARALLEL REDUNDANT CONFIGURATION IN LIC OF INDIA, DIVISIONAL OFFICES AT ERNAKULAM AND COIMBATORE 1)

Visit to site of the work: The tenderer shall visit the site for work before filling in his tender and get acquainted with all the information required before submitting the tender. No extra claim on account of any extra work required after submission of tender will be entertained.

2)

The prices quoted shall be FIRM until completion of the work and not subject to any variations. The tender prices shall include for all packing and unpacking, all loading and unloading, all freight, customs duty, octroi and testing charges payable to concerned testing authorities but excluding Service tax. The charges shall also include for delivery of the equipment at the site of work. No claim for extras or otherwise on account of the foregoing shall be entertained as the rates quoted shall be deemed to be inclusive of the charges applicable.

3)

No out of pocket expenses incurred by the tenderer in submitting his tender will be reimbursed whether his tender is accepted or not.

4)

Taxes, duties, etc: The percentage of sales tax and excise duty applicable should be clearly indicated and rate quoted should be inclusive of all taxes, duties, works contract tax etc but excluding service tax.

Service Tax: The rates quoted shall be exclusive of service tax under partial reverse charge mechanism. Contractor have to quote their rate excluding the service tax liability for its full extent i.e. 100% service tax on Serviceable portion. In case of service provider being a corporate entity, service tax shall be paid fully by them to the concerned authority directly and reimbursement will be made by LICI on production of proof of remittance. No recovery towards service tax will be effected from their bill. However, if the service provider is other than corporate entity (Individual, HUF, Proprietary, Partnership firm, LLP and AOP). LIC will remit 50% of service of service tax liability towards services recipient (LIC) liability and Contractor has to directly remit to the concerned Authorities remaining 50%of Service tax towards their liability (Service provider) and reimbursement will be made by LICI on production of proof of remittance. No recovery towards service tax will be effected from their bill.

Overriding/Printed conditions: a) Any overriding conditions imposed by the tenderer are liable to render the tender non-bonafide. b) Any printed conditions of the tenderer on his letter head or otherwise will be ignored and will not be accepted 7) Storage and Living Accommodation: The employer may try to provide space for storage of equipment at site. In case he is unable to make the same available the tenderers will have to make their own arrangements for storage of the equipment in the vicinity of site of erecting of the equipment. In case storage space is provided by the LICI necessary locking arrangement will have to be made by

A penalty @ `6/- (Rupees six only) per unit for 24 hrs per day for 730 days shall be recovered from the vendor’s bill.

Example of loading :-In case of a 10 KVA UPS three vendors have quoted as under: Overall efficiency Vendor 1 (V1) 80% (V2) 82% (V3) 84% V3 price bid shall not be loaded as V3 has quoted highest efficiency. Testing :

The supplier shall have facilities to carry out tests at factory / center, and tests will have to be satisfactorily carried out & certified for the UPS as per Testing Format for UPS enclosed in the tender before acceptance of material. Non-Compliance to tendered specifications during testing shall liable the system for rejection.

Third Party Test / Report

Tests shall be carried out &certified in presence of representatives of the LICI Engineer in the Vendors Factory or nearest Engineering College or NABL approved testing lab NISAKI are Testing agency where testing facilities are available and as directed by LICI. UPS units for testing will be selected in random by LICI LICI shall depute Engineer in order to witness the tests. The testing equipments should have been calibrated and tested in Lab with certificate

38. Safety factor : All components used in UPS shall have sufficient safety factors

39. General Notes: i)

If the UPS does not conform to specifications either during factory test or at site, LICI reserves the right to reject the same. The successful tenderer shall then have to remove the same at his cost from site and supply a new piece conforming to the specifications. A second failure shall result in cancellation of order, forfeiting of EMD amount & blacklisting of vendor from LICI.

ii)

The successful tenderer shall have to make all arrangements for all types of loads and electric supply required for the tests mentioned herein. Standby power supply arrangements using D.G. set etc. must be kept ready to be used in case of power failures / in case the successful vendor does not have sufficient sanctioned load to carry out the tests.

iii)

The tested UPS shall be Sealed, Signed & labeled by LICI Engineers in a manner so as to avoid tampering & to insure correct delivery of tested equipment at site.
