Dear Sirs, We, the undersigned Bidder, have read and examined in detail the specifications and bidding documents for Design, Supply, survey, installation, erection, testing and commissioning, on turnkey basis under R-APDRP Part-B scheme for Deoghar-Town under Dum ka Electric Supply Area Board for New Renovation/ Augmentation of 33kV Line by ACSR Dog/ Panther; R&M works of selected existing 33/ 11 KV PSS; Augmentation of power transformer capacity from 3.15/ 5 MVA to 5/ 10 MVA in selected existing 33/ 11 KV PSS; Additional 33 & 11 KV bays in existing 33/11 KV PSS; New 11 KV feeders (O/H, U/G) as required; Bifurcation of selected 11kV lines by U/G cable; Renovation/Augmentation of 11kV line by ACSR/ DogRabbit; Guarding of 11kV/ 33 kV lines; New 11/0.433 kV Distribution Substations of 200/100/63/25 KVA; Augmentation of existing 11/0.433 kV distribution transformer capacities; New LT lines with ACSR rabbit conductor & AB cable; Conversion & rearrangement of LT line by AB cable; Providing additional pole in existing LT Line (required during conversion from ACSR Conductor to AB Cable); Replacement of identified single phase & three phase energy meters and service lines; R&M of selected DSS; 11 kV New Line with 185 Sq.mm ABC (For New Feeder/ Interconnection) etc. and all other allied supplies & work as applicable according to bill of quantity.

2.0

PRICES AND VALIDITY

2.1

The price schedule have been duly filled in and furnished in Part-III i.e. Price Part and sealed under separate envelop, clearly super scribed as Price Part i. e. Part III.

2.2

All the prices and other terms and conditions of this proposal are valid for a period of twelve (12) calendar months after the date of opening of the bids. We further declare that prices stated in our proposal are in accordance with the General Conditions and the Technical Specification of the tender.

2.3

We do hereby confirm that our lump sum bid prices as quoted include the cost of supply and erection (including Civil work) of whole of the plant, equipments & materials including all types of taxes, duties, insurance, freight, etc. except State or local taxes e.g. Entry Tax and Octroi. We understand that Concessional Sales Tax declaration forms, as admissible/ permissible, would be issued to us on request, for all items to be supplied directly by us as well as for the items to be supplied by the sub-suppliers as sale in transit.

We further declare that while quoting the Ex-works price, the due credit under MODVAT scheme, re-christened as CENVAT scheme, as per relevant Government policies wherever applicable, have been taken into account. We declare that if any Income Tax, surcharge on income tax or any other corporate tax is attracted under the law, we agree to pay the same. We are aware that the Price Schedule do not generally give a full description of the supplies to be made and work to be performed under each item and we shall be deemed to have read the Technical Specifications and other bidding documents and drawings to ascertain the full scope of work included in each item while filling in the rates and prices. We agree that the entered rates and prices shall be deemed to include the full scope as aforesaid, including overheads and profits. We understand that in the price schedule, if there is discrepancy between the unit price and total price, the same shall be corrected as per provisions of the General Condition. We declare that prices for items left blank in the schedules will be deemed to

have been included in other items. The TOTAL for each schedule and the TOTAL of Grand Summary shall deemed to be the total price for executing the facilities and Sections thereof in complete accordance with the Contract, whether or not each has been priced. 3.0

CONSTRUCTION OF THE CONTRACT We declare that we are making the offer on the basis of a divisible Supply-cumErection contract on a single source responsibility basis. (i) First Contract :

For supply of all equipment and materials.

(ii) Second Contract : For erection including civil works, testing and commissioning including performance testing in respect of all the equipment supplied under the "First Contract" and any other services specified in the Bid Documents. (iii)

Both these contract will contain interlinking cross fall breach clause specifying that breach of one contract will constitute breach of the other contract.

PERFORMANCE GUARANTEE We declare that the ratings and performance figures of the equipment to be furnished and erected by us are guaranteed. The Guaranteed particulars of different equipment are enclosed in the DATA REQUIREMENT SHEET. BID PRICING We further declare that the prices stated in our proposal are in accordance with General Conditions and other conditions laid down in the bid documents and other conditions laid down in the bidding documents. QUALIFICATION DATA

We confirm having submitted the Qualification Data along with this proposal in original plus two copies in a separate envelop (in soft copy- CD also). WORK SCHEDULE If this proposal is accepted by you, we agree to submit engineering data, provide services and complete the entire work from time to time, in accordance with PERT chart to be submitted. We duly understand that the time schedule stipulated in this proposal is the essence of Contract, if awarded.

12.0

CONTRACT PERFORMANCE BANK GUARANTEE We further agree that if our Bid is accepted we shall provide an irrevocable Bank Guarantee towards Contract Performance , of value equivalent to fifteen percent (15%) of the Contract Price initially valid for a period of 4 years from the date of LOA with a claim period of further one year (in the form of Bank Guarantee), in your favour within thirty (30) days from the date of Letter of Award and enter into a formal agreement with you within this period.

GUARANTEE DECLARATION We guarantee that the equipment offered shall meet the rating and performance requirements stipulated in this specification. The Guarantee Declaration, which shall attract levy of liquidated damages for non- performance are indicated in separate schedule herewith.

CHECKLIST We have included a checklist duly filled in. (For Joint Venture only) We, the partners of joint venture submitting the Bid, do agree and confirm that in case of Award of Contract of the joint venture, we shall be jointly and severally responsible for the execution of the Contract in accordance with contract terms and conditions. That the Contractor is obliged and shall remain absolutely responsible for the safe

transit/ protection and custody of the Equipment at the JSEB project site against all risks whatsoever till the Equipment are duly used/erected in accordance with the terms of the Contract and the Plant/Package duly erected and commissioned in accordance with the terms of the Contract, is taken over the JSEB. The Contractor undertakes to keep the JSEB harmless against any loss or damage that may be caused to the Equipment. 3.

The Contractor undertakes that the Equipment shall be used exclusively for the

performance/ execution of the Contract strictly in accordance with its terms and conditions and no part of the equipment shall be utilized for any other work or purpose whatsoever. It is clearly understood by the Contractor the non-observance of the obligations under this Indemnity Bond by the Contractor shall inter-alia constitute a criminal breach of trust on the part of the Contractor for all intents and purpose including legal/penal consequences. 4.

That JSEB is and shall remain the exclusive Owner of the Equipment free from all

encumbrances, charges or liens of any kind, whatsoever. The equipments shall at all times be open to inspection and checking byEngineer-in-Charge/ Engineer or employees/ agents authorized by him in this regard. Further the JSEB shall always be free at all times to take possession of the other Equipments in whatever form the Equipments may be, if in its opinion, the Equipment are likely to be endangered, misutilised or converted to uses other than those specified in the Contract, by any acts of omission or commission on the part of the Contractor or any other persons or on account of any reason whatsoever and the Contractor binds himself and undertakes to comply with the directions of demand of JSEB to return the equipment without any demur or reservation. 5. That this indemnity Bond is irrevocable. If at any time any loss or damage occurs to the Equipment or the same or any part thereof is mis-utilised in any manner whatsoever, then the Contractor hereby agrees that the decision of the Engineer-in Charge/ Engineer of the JSEB as to assessment of loss or damage to the Equipment shall be final and binding on the Contractor. The Contractor binds itself and undertakes to replace the lost and/or damaged equipment at its own cost and/or shall pay the amount of loss of the JSEB without any demur, reservation or protest. This is without prejudice to any other right or remedy that may be available to the JSEB against the Contractor under the contract and under this Indemnity Bond. 6.

Now the Condition of this Bond is that if the Contractor shall duly and punctually

It is expressly understood by the Contractor that handing over dispatch title documents in respect of the said equipments only endorsed by the JSEB in favour of the contractor shall be construed as handing over the Equipment purported to be covered by such title documents and the Contractor shall hold such Equipments in trust as a Trustee for and on behalf of the JSEB. 2.

That the Contractor is obliged and shall remain absolutely responsible for the safe

transit/ protection and custody of the Equipment at the JSEB's project site against all risks whatsoever till the Equipment are duly used/ erected in accordance with the terms of the Contract and the Plant/ Package duly erected and commissioned in accordance with the terms of the Contract, is taken over the JSEB The Contractor undertakes to keep the JSEB harmless against any loss or damage that may be caused to the Equipment. 3.

The Contractor undertakes that the Equipment shall be used exclusively for the

performance/ execution of the Contract strictly in accordance with its terms and conditions and no part of the equipment shall be utilized for any other work or purpose whatsoever. It is clearly understood by the Contractor that non-observance of the obligations under this Indemnity Bond by the Contractor shall inter-alia constitute a criminal breach of trust on the part of the Contractor for all intents and purpose including all legal/ penal consequences. 4.

That JSEB is and shall remain the exclusive Owner of the Equipment free from all

encumbrances, charges or liens of any kind, whatsoever. The equipments shall at all times be open to inspection and checking by Engineer-in-Charge/ Engineer or other employees/agents authorized by him in this regard. Further the JSEB shall always be free at all times to take possession of the Equipments in whatever form the Equipments may be, if in its opinion, the Equipment are likely to be endangered, mis-utilised or converted to uses other than those specified in the Contract, by any acts of omission or commission on the part of the Contractor or any other persons or on account of any reason whatsoever and the Contractor binds himself and undertakes to comply with the directions of demand of JSEB to return the equipment without any demur or reservation. 5.

That this indemnity Bond is irrevocable. If at any time any loss or damage

occurs to the Equipment or the same or any part thereof is mis-utilised in any manner whatsoever, the Contractor hereby agrees that the decision of the Engineer-in Charge/ Engineer of the JSEB as to assessment of loss or damage to the Equipment shall be final and binding on the Contractor. The Contractor binds itself and undertakes to replace the lost and/or damaged equipment at its own cost and/or shall pay the amount Jharkhand State Electricity Board

of loss to the JSEB without any demur, reservation or protest. This is without prejudice to any other right or remedy that may be available to the JSEB against the Contractor under the contract and under this Indemnity Bond. 6.

punctually comply with the terms and conditions of this Bond to the satisfaction of the JSEB, then, the above Bond shall be void, but otherwise, it shall remain in full force and virtue. 13. Tenderer to note and confirm that the installation shall be complete in all respects for efficient and trouble free service. For this purpose any part or parts required whether specifically mentioned or not shall be deemed to be within tenderer's scope. 14. During installation of equipments at site any minor modification of civil work like chipping, grouting, make chase or holes on the walls, floors etc. including materials such as sand, steel, cement as may be required shall be carried out by contractor at no extra cost to Jharkhand State Electricity Board. 15. Tenderer to note that erection tools and tackles as may be required to complete installation work shall be arranged by them at no extra cost to JSEB. All pre-commissioning checks and commissioning tools and instruments shall have to be arranged by the bidder at no extra cost to JSEB 16. Tenderer to note and confirm that connectors, hardware required for both line and substation shall be considered to be supplied which will be utilised shall be as per the approved drawing 17. Tenderer to note and confirm that without the written consent of JSEB they will not assign or sublet the total contract or any part thereof other than for any part of the work for which the maker are named in the contract. Such contract if given shall not relieve him from any obligation, duty or responsibility under the contract 18. 21. Tenderer to note and confirm that in final survey all support location are to be pegged for demarcation. Peg to peg horizontal distance, line deviation at corner location and other measurements required for preparation of survey report should be noted. 10 copies of plan (blue print) incorporating the following information should be submitted to JSEB for approval: a) The scale of final survey shall be 10 cm = 1 Km. b) Location of support c) Span in metre d) Angle of deviation at corner locations particularly of existing roads nearest to the line showing its type e) The alignment of line should also be shown at comer location with reference to the permanent land mark etc., any building, road distance, pillars, existing power line supply etc. f) Actual profile survey report should be furnished in case of National Highway crossing, river and railway crossing. The scale of profile survey report should be 1:200. g) Tenderer also to note that JSEB shall have the right to incorporate additions or alterations in the said route plan at any subsequent stage after the issue of such approval. 22. Bidder also to note and confirm that in way leave/ Right of way Tree cutting, which may be required shall have to be arranged by the tenderer at his risk and responsibility. Any types of compensation payable for arranging such way leave/Right of way and damage to the trees etc are to be made by the tenderer. JSEB shall not be held responsible for any claim on account of any damage to tree, crop and any other related to way leave etc. 23. Tenderer to note and confirm that the transformer shall be completely assembled and tested at the factory. Test shall be performed in compliance of relevant. I.S.S./ IEC/ REC specification (as amended up-to-date) CBIP regulations and JSEB's specifications. 24. Tenderer to note and confirm that impulse and heat run test and type test may be carried out as per IS 2026 or IEC publication on the transformer. The bidder shall be bound to submit free of cost copies of such test conducted on similar transformer earlier, if not conducted on the ordered transformer.
