By participating, entrants agree to release Hunt Brothers Pizza, LLC, Bad Boy, Bass Pro Shops, Winnebago Industries, Inc. and Facebook and each of their respective officers, directors, employees, agents or representatives (collectively, “Released Parties”) from and against any and all claims, demands, losses and liabilities of any nature whatsoever, which entrant may now or hereafter be entitled to assert, including but not limited to, any death, injury, loss of enjoyment, damage to computer equipment, or other harm or loss of any nature whatsoever caused or contributed to by participation in the Sweepstakes, the prizes awarded in the Sweepstakes and/or in connection with the awarding, receipt and use or misuse of prize. Released Parties are not responsible for misdirected, late, lost, delayed, inaccurate, damaged, garbled, incomplete, postage-due or undelivered entries or any combination thereof, for whatever reason, for lost, interrupted or unavailable network, wireless service provider, cable, satellite, Internet Service Provider (ISP) or other connections, or for errors, omissions, interruptions, deletions, defects, phone transmissions or delayed transmissions or in operations or transmission of information, in each case whether arising by the way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines, or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise and any mechanical, electronic, network, computer, printing, typographical, human or other error relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of prizes or in any Sweepstakes-related materials. Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond their reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of this Sweepstakes or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Random Selection of Winners: On or around December 14, 2016, a random drawing will be conducted by an independent sweepstakes administrator from among all valid, eligible entries received over the course of the Sweepstakes Period. All decisions shall be final and binding in all respects. Odds of winning a prize depend upon the total number of eligible entries received during the Sweepstakes Period. Certain potential prize winners will be notified by email and/or phone call within twenty-four (24 hours) of the random drawing. Such potential prize winners will be required to reply to the prize notification attempt within five (5) days of attempted notification or potential prize winner will be disqualified and an alternate potential winner will be selected at the sole discretion of the Sponsor. Potential Prize winners may be required to sign an Affidavit of Eligibility/Release of Liability/Publicity and Advertising Consent and Release (except where prohibited by law), a W-9 form, and such other documents reasonably required by Sponsor. All such documents must be signed and returned within ten (10) days of prize notification or prize will be forfeited and an alternate winner may be selected. Sponsor is not responsible for any prize notification that does not reach the intended recipient due to spam filtering or other issues. Return of any prize notification as undeliverable will result in disqualification. Potential winners are subject to verification before the prize will be awarded. In the event that a potential winner is disqualified for any reason, an alternate winner may be selected in a random drawing from all eligible entries received during the Sweepstakes Period, at the sole discretion of the Sponsor. The Sweepstakes participant is solely responsible for entering the Sweepstakes during the Sweepstakes Period and properly claiming a prize if selected as a winner. The reporting and payment of any tax liabilities (federal, state and local) incurred by a prize winner as a result of this Sweepstakes are the sole responsibility of the winner. Prizes & Approximate Retail Value (“ARV”): One (1) Grand Prize: A Bad Boy Stampede™ 900 4x4. Sponsor will determine all features of the Bad Boy Off-Road Stampede vehicle including but not limited to color of exterior and interior. Vehicle pictured in advertising or collateral material may include options or accessories not included in the promotion. Winner must be a licensed driver and will be required to provide proof of insurance at time of delivery. Winner is responsible for title, license, registration, auto insurance and other fees associated with prize. Winner must go to dealer specified by Textron Specialized Vehicles Inc. to redeem prize, and complete full warranty and vehicle registration. Winner is responsible for transporting vehicle from dealership at their own expense. Approximate retail value of the Grand Prize is $14,799 One (1) First Prize: Use of a Winnebago vehicle for seven (7) consecutive days. Use of Winnebago is subject to the terms and conditions of the vehicle provider; including the requirement that Winner indemnify Winnebago Industries, Inc. from all liability relating to Winner’s usage of the Winnebago vehicle. Other restrictions may apply. Winner must be a licensed driver and will be required to provide proof of insurance at time of Winnebago vehicle prize award. Use of the Winnebago vehicle must take place by September 30, 2017. Conditions of Participation & Certain Restrictions: Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participating, each entrant (or his/her parent or legal guardian, as applicable) agrees that any and all disputes, claims and causes of action arising out of, or connected with, this Sweepstakes or any prize (if awarded to him/her) shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in Davidson County, Tennessee, and litigation and/or trials will be decided solely by a judge.
