"air c a r r i e r " m e a n s a c o m m e r c i a l air transport operator p r o v i d i n g either a scheduled or a non-scheduled air service; " a i r c r a f t " m e a n s any m a c h i n e that can d e r i v e support in the a t m o s p h e r e from the reactions of the air, other than the reactions of the air against the surface of the earth; "aircraft a c c i d e n t " m e a n s the o c c u r r e n c e as defined in C h a p t e r 1 of A n n e x 13 to the C o n v e n t i o n ; "aircraft i n c i d e n t " m e a n s an o c c u r r e n c e as defined in C h a p t e r 1 of A n n e x 13 to the C o n v e n t i o n ; "air n a v i g a t i o n facility" m e a n s any p r e m i s e s , structure or place to which the public h a v e restricted access and in w h i c h a service is rendered for the operation of a designated airport or for the p u b l i c at a designated airport, airport or heliport, and includes any aid p r o v i d e d for p r o m o t i o n of the safe, orderly and expeditious m o v e m e n t of air traffic, and, w h e r e applicable, any building or structure in or on w h i c h such aid or part thereof is h o u s e d or attached, and includes the p r e m i s e s on which such aid or part thereof is situated, w h e t h e r such building, structure or p r e m i s e s is situated within the b o u n d a r i e s of a designated airport, airport or heliport or not; " a i r n a v i g a t i o n i n f r a s t r u c t u r e " m e a n s a navigation infrastructure as defined in the Air Traffic N a v i g a t i o n Services C o m p a n y Act, 1993 (Act N o . 4 5 of 1993); "air s e r v i c e " m e a n s an air service defined in Section 1 of the Air L i c e n s i n g Act, 1999 (Act N o . 115 of 1999); " A i r s e r v i c e o p e r a t o r " m e a n s a c o m m e r c i a l air transport operator providing o n e or m o r e of the following namely, a scheduled, a n o n - s c h e d u l e d or a general air service; " A i r Traffic S e r v i c e " m e a n s a service provided for the p u r p o s e of safe and efficient c o n d u c t of flight, e x p e d i t i o u s and orderly flow of air traffic, assisting in aircraft search and rescue, and i n c l u d e s — (a) an a e r o d r o m e control service; (b) an a p p r o a c h control service; (c) an area control service; (d) an a p p r o a c h radar control service; (e) a flight information service; (/) an a e r o d r o m e flight information service; (g) an area radar control service; (h) an advisory service; and (i) an alerting service; " A i r traffic s e r v i c e u n i t " m e a n s an air traffic control unit, flight information c e n t r e or air traffic service r e p o r t i n g office;" " a i r p o r t " m e a n s an a e r o d r o m e as defined in section 1 of this Act; " a i r p o r t m a n a g e r " m e a n s any person appointed in writing by the m a n a g e m e n t of a designated airport to act in such capacity or any person in control of an airport, and includes any person a p p o i n t e d in writing by the airport m a n a g e r or the m a n a g e m e n t of a designated airport to discharge any function imposed, or to exercise any p o w e r conferred, upon the airport m a n a g e r by this Act; " a p p e a l c o m m i t t e e " m e a n s an appeal c o m m i t t e e established in t e r m s of section 122; " a p p o i n t e d m e m b e r " m e a n s a m e m b e r of the Civil Aviation A u t h o r i t y B o a r d a p p o i n t e d by the Minister in t e r m s of section 7 7 ; " a u t h o r i s e d officer" m e a n s an officer designated in terms of section 88(1) of this Act; "authorised person" m e a n s — (a) any m e m b e r of the Service as defined in section 1 of the South African Police Service Act, 1995 (Act N o . 6 8 of 1995); (b) any p e r s o n appointed in writing b y the m a n a g e m e n t of a designated airport, with the a p p r o v a l of the M i n i s t e r or any person authorised b y h i m or her to furnish such approval; (c) any m e m b e r of the S o u t h African National Defence F o r c e , as defined in paragraph (a) of the definition of ' m e m b e r ' i n section 1 of the D e f e n c e Act, 2 0 0 2 (Act N o . 4 2 of 2 0 0 2 ) ; (d) any person designated in writing by the Director as an authorised person in terms of section 88(1); or

"Aviation S a f e t y I n v e s t i g a t i o n B o a r d " m e a n s the Aviation Safety Investigation B o a r d established in t e r m s of section 10; " b o a r d " m e a n s a b o a r d of inquiry appointed under section 7 0 ; "Civil A v i a t i o n A u t h o r i t y " m e a n s the South African Civil Aviation Authority established in t e r m s of section 7 1 ; "Civil Aviation A u t h o r i t y B o a r d " m e a n s the Civil Aviation Authority B o a r d established by section 7 5 ; " c o m m a n d e r " , in relation to an aircraft, m e a n s the c r e w m e m b e r d e s i g n a t e d as c o m m a n d e r of that aircraft by the operator thereof, or, failing such a designation, the person w h o is at that t i m e the pilot in c o m m a n d of that aircraft; " c o m p a n y " m e a n s the c o m p a n y as defined in section 1 of the Airports C o m p a n y Act, 1993 (Act N o . 4 4 of 1993); " C o n s t i t u t i o n " m e a n s the Constitution of the R e p u b l i c of South Africa, 1996; " C o n t r a c t i n g S t a t e " m e a n s any State w h i c h is a party to the C o n v e n t i o n ; " c o n t r o l l e d a i r s p a c e " m e a n s an airspace of d e n n e d d i m e n s i o n s within w h i c h an air traffic control service is provided to IFR (Instrument Flight Rules) flights and to V F R (Visual Flight Rules) flights in a c c o r d a n c e with the airspace classification as prescribed b y regulation; " C o n v e n t i o n " m e a n s the C o n v e n t i o n o n International Civil Aviation d r a w n up in C h i c a g o on 7 D e c e m b e r 1944, as set out in S c h e d u l e 3, and i n c l u d e s any a m e n d m e n t s and additions ratified and p r o c l a i m e d in a c c o r d a n c e with section 3(1 )(b); _ " C o n v e n t i o n c o u n t r y " m e a n s a country in which the C o n v e n t i o n o n Offences and Certain O t h e r A c t s C o m m i t t e d on B o a r d Aircraft, the C o n v e n t i o n for the S u p p r e s s i o n of Unlawful Seizure of Aircraft or the C o n v e n t i o n for the S u p p r e s s i o n of Unlawful A c t s against the Safety of Civil Aviation is in force; " C r i m i n a l P r o c e d u r e A c t " m e a n s the Criminal P r o c e d u r e Act, 1977 (Act N o . 51 of 1977); " D e p a r t m e n t " m e a n s t h e National D e p a r t m e n t of Transport; " d e s i g n a t e d a i r p o r t " m e a n s any c o m p a n y airport as defined in section 1 of the Airports C o m p a n y Act, 1993 (Act N o . 4 4 of 1993), and includes any airport, helistop or heliport d e s i g n a t e d by the Minister in terms of section 4 ( 5 ) ; " d i f f e r e n c e s " m e a n s the departures from international standards and p r o c e d u r e s contained in Article 38 of the C o n v e n t i o n ; " D i r e c t o r " m e a n s t h e Director of Civil Aviation appointed in t e r m s of section 8 5 ; State of Registry, the State of the Operator, the State of D e s i g n , the State of M a n u f a c t u r e , any State having suffered fatalities or serious injuries to its citizens and any State that p r o v i d e d relevant information, significant facilities or e x p e r t s ; "registered o w n e r " in relation to an aircraft m e a n s the p e r s o n in w h o s e n a m e the aircraft is registered, and includes any person w h o is or has been acting as an agent in the R e p u b l i c for a foreign owner, or any person by w h o m the aircraft is hired at the t i m e ; " r e g u l a t i o n " m e a n s any regulation m a d e u n d e r this Act; " R e p u b l i c " m e a n s the R e p u b l i c of S o u t h Africa including any territory and territorial waters in respect of which P a r l i a m e n t is c o m p e t e n t to legislate; "restricted a r e a " m e a n s any area, building or place at a designated airport, in respect of w h i c h access control has been instituted for security p u r p o s e s by, or with the c o n c u r r e n c e of the m a n a g e m e n t of such designated airport, or in respect of which the Minister has directed t h e m a n a g e m e n t of the designated airport, or any organisation c o n d u c t i n g b u s i n e s s at a d e s i g n a t e d airport, to institute access control and in respect of w h i c h access control has b e e n so instituted; " s e a r c h " with the e x c e p t i o n of C h a p t e r 4, includes h a n d searches of luggage or the use of metal detectors for p e r s o n s and metal detectors, X - r a y e q u i p m e n t and e x p l o s i v e detecting e q u i p m e n t for personal effects, b a g g a g e , vehicles, cargo, mail and other g o o d s for the p u r p o s e of s c r e e n i n g ; " S o u t h A f r i c a n a i r c r a f t " m e a n s an aircraft registered in the R e p u b l i c and includes any aircraft that is operated by j o i n t air transport operating organisations or international operating a g e n c i e s established b y the State and any other c o n v e n t i o n country and that is d e c l a r e d by the M i n i s t e r by notice in the Gazette, to be a South African aircraft; " S t a t e o f D e s i g n " refers to the state h a v i n g jurisdiction o v e r an organisation r e s p o n s i b l e for the t y p e of design of an aircraft; " S t a t e of M a n u f a c t u r e " refers to t h e state h a v i n g jurisdiction o v e r an organisation r e s p o n s i b l e for the final a s s e m b l y of an aircraft; " S t a t e of O c c u r r e n c e " m e a n s the state in w h o s e territory an aircraft accident or aircraft incident occurs; " S t a t e of R e g i s t r y " m e a n s the state on w h o s e register the aircraft is registered; " S t a t e of t h e O p e r a t o r " m e a n s the State in w h i c h the o p e r a t o r ' s principal place of business is located or, if there is n o such place of business, the o p e r a t o r ' s p e r m a n e n t residence; " t e c h n i c a l s t a n d a r d " in relation to civil aviation regulations, m e a n s a standard p u b l i s h e d under the authority of the Director that specifies the technical r e q u i r e m e n t s , data, information or g u i d a n c e relating to an acceptable m e a n s of c o m p l i a n c e with such regulation; " t h i s A c t " includes any S c h e d u l e to this A c t or regulation m a d e u n d e r this Act; " T r a n s i t A g r e e m e n t " m e a n s the International A i r Services Transit A g r e e m e n t d r a w n up at C h i c a g o on 7 D e c e m b e r 1944, and set out in S c h e d u l e 4. (2) T h e definition of " a e r o d r o m e " in subsection (1) d o e s not d e r o g a t e from the ordinary m e a n i n g of the w o r d " a i r p o r t " . (3) For the p u r p o s e s of this Act an aircraft is r e g a r d e d to be in flight— (a) from the m o m e n t w h e n all its external d o o r s are closed following e m b a r k a t i o n until the m o m e n t w h e n any such d o o r is o p e n e d for d i s e m b a r k a t i o n or, if the aircraft m a k e s a forced landing, until the m o m e n t w h e n the c o m p e t e n t authorities of the country in w h i c h the forced l a n d i n g takes place, take over the responsibility for the aircraft and for the persons and property on b o a r d ; or Cb) d u r i n g any period w h e n it is on the surface of the sea or land but not within the territorial limits of any country. (4) (a) For the p u r p o s e s of this A c t an aircraft is regarded to be in service from t h e start of the pre-flight preparation of such aircraft by g r o u n d personnel or by the c r e w for a specific flight until twenty-four h o u r s after any landing. (b) T h e entire period d u r i n g w h i c h the aircraft is in flight in t e r m s of subsection (3) is included for the p u r p o s e of p a r a g r a p h (a).

Application of Act 2 . (1) This Act, the C o n v e n t i o n , the Transit A g r e e m e n t and Protocol, e x c e p t w h e r e expressly e x c l u d e d u n d e r this Act, apply t o — (a) every aircraft, a e r o d r o m e , air navigation facility, aviation facility, d e s i g n a t e d airport, o p e r a t o r s , p a s s e n g e r s or any person b o a r d i n g an aircraft or entering an a e r o d r o m e , air navigation facility, aviation facility or designated airport and registered o w n e r s of aircraft in the R e p u b l i c ; (b) every p e r s o n e m p l o y e d at or in connection with such a e r o d r o m e , air navigation facility, aviation facility or designated airport; (c) all foreign registered aircraft and personnel of such aircraft operating in the Republic or o v e r the territorial waters thereof; and (d) all South African aircraft and personnel of such aircraft, w h e t h e r within or outside the R e p u b l i c . (2) F o r the p u r p o s e of subsection (1) the personnel of an aircraft is r e g a r d e d to i n c l u d e the c o m m a n d e r or any other p e r s o n in charge of the aircraft, and all the other m e m b e r s of the c r e w of the aircraft. (3) T h i s Act, the C o n v e n t i o n and the Transit A g r e e m e n t d o not apply t o — (a) an aircraft b e l o n g i n g to the South African National D e f e n c e F o r c e and the South African Police Service; (b) airports, heliports or helistops b e l o n g i n g to the South African N a t i o n a l D e f e n c e F o r c e and the South African Police Service; (c) an aircraft or airports in use exclusively by the South African National Defence F o r c e or S o u t h African Police Service, or to any p e r s o n e m p l o y e d on or in c o n n e c t i o n with such aircraft or airports, irrespective of w h e t h e r such person is so e m p l o y e d in a military or civil capacity: P r o v i d e d that the Minister, after consultation with the Minister of Defence or the M i n i s t e r of Safety and Security, as the c a s e may be, m a y by notice in the Gazette apply any of the said provisions with or without modification to any such aircraft, a e r o d r o m e or p e r s o n ; and (d) an aircraft used by c u s t o m s services. (4) N o t w i t h s t a n d i n g subsection (3), Part 1 of C h a p t e r 11 and the Civil Aviation R e g u l a t i o n s , 1997, a p p l y t o — (a) an aircraft b e l o n g i n g to the South African National D e f e n c e F o r c e a n d South African Police Service; and (b) an aircraft in use exclusively by the South African National D e f e n c e F o r c e and South African Police Service, w h e r e such aircraft are in flight t h r o u g h controlled airspace or in u s e at non-military a e r o d r o m e s and heliports.

F u n c t i o n s of M i n i s t e r in c o n n e c t i o n w i t h A c t , C o n v e n t i o n a n d T r a n s i t A g r e e m e n t 4. (1) T h e M i n i s t e r is r e s p o n s i b l e for the carrying out of this Act, the C o n v e n t i o n and the Transit A g r e e m e n t . (2) Every p e r s o n a p p o i n t e d u n d e r or c o n c e r n e d with the carrying out of this Act, e x c l u d i n g m e m b e r s of the South African National Defence F o r c e or the South African Police Service, m u s t p e r f o r m his or her functions and exercise any discretion expressly or impliedly vested in h i m or her in a m a n n e r which gives effect to this Act. (3) With the written c o n s e n t of the Minister any p e r s o n in w h o m any discretion is vested as is c o n t e m p l a t e d in subsection (2), m a y delegate the p o w e r to exercise such discretion on his or her behalf to any other specified person. (5) T h e M i n i s t e r may, in addition to the c o m p a n y airports d e n n e d in section 1 of the A i r p o r t s C o m p a n y Act, 1993 (Act N o . 4 4 of 1993), by notice in the Gazette, designate any other airport for the p u r p o s e s of this Act.

(1) Subject to the M i n e r a l and P e t r o l e u m R e s o u r c e s D e v e l o p m e n t Act, 2 0 0 2 (Act N o . 28 of 2 0 0 2 ) , the National E n v i r o n m e n t a l M a n a g e m e n t Act, 1998 (Act N o . 107 of 1998), the National Water Act, 1998 (Act N o . 36 of 1998), and the Constitution, the M i n i s t e r of M i n e r a l s and Energy m a y p e r m i t the use of land held under any r e c o n n a i s s a n c e p e r m i s s i o n , exploration, p r o s p e c t i n g or m i n i n g authorisation or p e r m i s s i o n , for the establishment of airports or heliports. T r e s p a s s , n u i s a n c e , responsibility for d a m a g e a n d i n s u r a n c e for d a m a g e o r loss by registered o w n e r s a n d o p e r a t o r s of aircraft 8. (1) N o action lies in respect of trespass or in respect of nuisance, by reason only of the flight of aircraft o v e r any property at a height, w h i c h , h a v i n g regard to wind, w e a t h e r a n d other c i r c u m s t a n c e s of the case, is r e a s o n a b l e , or the ordinary incidents of such flight, so long as this Act, the C o n v e n t i o n and the Transit A g r e e m e n t are duly complied with. (2) W h e r e material d a m a g e or loss is c a u s e d b y — (a) an aircraft in flight, taking off or l a n d i n g ; (b) any p e r s o n in any such aircraft; or (c) any article falling from any such aircraft, to any person or property on land or water, d a m a g e s m a y be r e c o v e r e d from the registered o w n e r of the aircraft in respect of such d a m a g e or loss, without proof of n e g l i g e n c e or intention or other c a u s e of action as t h o u g h such d a m a g e or loss had been c a u s e d by his or her wilful act, neglect or default. (3) S u b s e c t i o n (2) d o e s not apply w h e r e the d a m a g e or loss w a s caused by or contributed to by the n e g l i g e n c e or wilful act of the p e r s o n by w h o m it w a s suffered. (4) W h e r e any d a m a g e s r e c o v e r e d from or paid by the registered o w n e r of an aircraft u n d e r this section arose from d a m a g e or loss c a u s e d by the wrongful or negligent action or omission of any p e r s o n other than the registered o w n e r or s o m e person in his or her e m p l o y m e n t , the registered o w n e r is entitled to r e c o v e r from that person the a m o u n t of such d a m a g e s . (5) A registered o w n e r or operator of an aircraft m u s t h a v e insurance as prescribed for any d a m a g e or loss that is caused by an aircraft to any person or property on land or water.

A p p l i c a t i o n of C h a p t e r to aircraft a c c i d e n t s a n d aircraft i n c i d e n t s 9. (1) This C h a p t e r applies in respect of aircraft accidents and aircraft incidents in or over— (a) the R e p u b l i c ; (b) any place that is u n d e r the R e p u b l i c ' s air traffic control; and (c) any other place, if— (i) t h e R e p u b l i c is r e q u e s t e d to investigate the aircraft accident and aircraft incident b y an appropriate authority in t e r m s of the C o n v e n t i o n ; or (ii) the aircraft accident a n d aircraft incident involves an aircraft in respect of w h i c h , or that is o p e r a t e d by a p e r s o n to w h o m , a South African aviation authorisation, aviation certificate or any aviation approval d o c u m e n t has been issued. (2) T h e application of this C h a p t e r in respect of aircraft accidents and aircraft incidents referred to in section 12(4) is subject to such restrictions in the interests of national security as are p r o v i d e d in the D e f e n c e Act, 2 0 0 2 (Act N o . 4 2 of 2 0 0 2 ) , or as prescribed by the Minister. (3) In this C h a p t e r " d e p a r t m e n t " m e a n s any d e p a r t m e n t in the national sphere of Government. 10. T h e Aviation Safety Investigation B o a r d , w h i c h is a juristic p e r s o n , is h e r e b y established. O b j e c t s o f A v i a t i o n Safety I n v e s t i g a t i o n B o a r d 11. ( 1 ) T h e objects of the Aviation Safety Investigation B o a r d are to a d v a n c e aviation transportation safety b y — (a) c o n d u c t i n g i n d e p e n d e n t investigations, including, w h e n necessary, public inquiries into selected aircraft accidents and aircraft incidents in order to m a k e findings as to their causes and contributing factors; (b) identifying safety deficiencies as e v i d e n c e d by aircraft accidents and aircraft incidents; (c) m a k i n g r e c o m m e n d a t i o n s d e s i g n e d to eliminate or r e d u c e any such safety deficiencies; (d) reporting publicly on its investigations and on the findings in relation thereto; (e) p r o m o t i n g c o m p l i a n c e with the p r o v i s i o n s and p r o c e d u r e s of A n n e x 13 to the Convention; (f) investigating aircraft accidents and aircraft incidents in c o m p l i a n c e with the provisions and p r o c e d u r e s of A n n e x 13 to the C o n v e n t i o n ; and (g) d i s c h a r g i n g all other functions and obligations in c o m p l i a n c e with the p r o v i s i o n s and p r o c e d u r e s of A n n e x 13 to the C o n v e n t i o n . (2) T h e Aviation Safety Investigation B o a r d m u s t not apportion b l a m e or liability in any report following the investigation of any aircraft accident or aircraft incident, and the sole objective of the investigation is accident prevention. (3) In m a k i n g its findings as to the causes and contributing factors of an aircraft accident and an aircraft incident, it is not the function of the Aviation Safety Investigation B o a r d to assign fault or d e t e r m i n e civil or criminal liability, but the B o a r d m u s t not refrain from fully r e p o r t i n g on the causes and contributing factors m e r e l y b e c a u s e fault or liability m i g h t be inferred from the Aviation Safety Investigation B o a r d ' s findings.

(4) N o finding of the Aviation Safety Investigation B o a r d m u s t b e construed as assigning fault or d e t e r m i n i n g civil or criminal liability. (5) T h e findings of or the e v i d e n c e before the Aviation Safety Investigation B o a r d are not b i n d i n g on the parties to any legal, disciplinary or any other p r o c e e d i n g s and m a y not be used in any civil, criminal or disciplinary p r o c e e d i n g s against p e r s o n s g i v i n g such evidence. (6) W h e r e the c a u s e s and contributing factors of any aircraft accident or aircraft incident is k n o w n to the Aviation Safety Investigation B o a r d it m a y refuse to investigate such aircraft accident or aircraft incident. (7) Subject to the p r o v i s i o n s of the South African M a r i t i m e a n d A e r o n a u t i c a l Search and R e s c u e Act, 2 0 0 2 (Act N o . 4 4 of 2 0 0 2 ) , and the C o n v e n t i o n , the South African Police Service, shall h a v e rights of prior access to any s c e n e of an aircraft accident or aircraft incident.

J u r i s d i c t i o n of Aviation Safety I n v e s t i g a t i o n B o a r d 12. (1) N o t w i t h s t a n d i n g any other legislation, the Aviation Safety Investigation B o a r d must, in c o m p l i a n c e with A n n e x 13 to the C o n v e n t i o n , investigate any aircraft accident and aircraft incident for the p u r p o s e of carrying out its objects. (2) N o t w i t h s t a n d i n g any other l e g i s l a t i o n — (a) no d e p a r t m e n t , other than the D e p a r t m e n t of D e f e n c e , m a y c o m m e n c e an investigation into an aircraft accident or aircraft incident for the p u r p o s e of m a k i n g findings as to its causes and contributing factors, if— (i) that aircraft accident or aircraft incident is being or has b e e n investigated by the Aviation Safety Investigation Board u n d e r this A c t ; or (ii) the D e p a r t m e n t has been informed that that aircraft accident or aircraft incident is p r o p o s e d to be investigated by the Aviation Safety Investigation B o a r d u n d e r this A c t ; and (b) w h e r e an investigation into an aircraft accident or aircraft incident is c o m m e n c e d by the Aviation Safety Investigation B o a r d u n d e r this A c t after an investigation into that aircraft accident or aircraft incident has been c o m m e n c e d b y a d e p a r t m e n t other than the D e p a r t m e n t of D e f e n c e , that d e p a r t m e n t m u s t forthwith d i s c o n t i n u e its investigation, to the extent that it is an investigation for the p u r p o s e of m a k i n g findings as to t h e c a u s e s and c o n t r i b u t i n g factors of the aircraft accident or aircraft incident. (3) Subsection (2) d o e s not p r e v e n t — (a) a d e p a r t m e n t from c o m m e n c i n g an investigation into or c o n t i n u i n g to investigate an aircraft accident or aircraft incident for any p u r p o s e other than that of m a k i n g findings as to its c a u s e s and contributing factors, or from investigating any matter that is related to the aircraft accident or aircraft incident and that is not being investigated by the Aviation Safety Investigation B o a r d ; or (b) the South African Police Service from investigating t h e aircraft accident or aircraft incident for any p u r p o s e for w h i c h it is e m p o w e r e d to c o n d u c t investigations. (4) T h e Aviation Safety Investigation B o a r d m a y investigate an aircraft accident and aircraft incident that i n v o l v e s — (a) a military c o n v e y a n c e and an aircraft, n o n e of w h i c h is a military c o n v e y a n c e ; (b) a military c o n v e y a n c e and a civil aviation facility; or (c) a military aviation facility and an aircraft, n o n e of w h i c h is a military conveyance. (5) W h e r e the Aviation Safety Investigation Board d o e s not investigate an aircraft accident or aircraft incident, n o d e p a r t m e n t is prevented from investigating any aspect of the aircraft accident or aircraft incident that it is e m p o w e r e d to investigate. (6) T h e Aviation Safety Investigation B o a r d must not inquire into any aircraft accident or aircraft incident in respect of w h i c h a p r o s e c u t i o n , an inquest or an inquiry by a c o m m i s s i o n has been established by the Minister w h i c h w a s instituted or c o m p l e t e d before the c o m m e n c e m e n t of this A c t . Coordination of investigations and remedial actions 13. (1) W h e r e , at any t i m e during an investigation into an aircraft accident or aircraft incident u n d e r this Act, a d e p a r t m e n t other than the D e p a r t m e n t of D e f e n c e investigates

that aircraft accident or aircraft incident, or u n d e r t a k e s r e m e d i a l m e a s u r e s with respect to that aircraft accident or aircraft incident, t h e Aviation Safety Investigation Board and such d e p a r t m e n t m u s t take all reasonable m e a s u r e s to ensure that their activities with respect to that aircraft accident or aircraft incident are coordinated. (2) W h e r e conflicting interests arise b e t w e e n t h e Aviation Safety Investigation B o a r d and a d e p a r t m e n t in coordinating their activities p u r s u a n t to subsection (1), the r e q u i r e m e n t s and interests of the Aviation Safety Investigation B o a r d , subject to subsection (3) and any a g r e e m e n t entered into u n d e r section 2 7 , take p r e c e d e n c e a n d are p a r a m o u n t to the extent of the conflict. (3) N o item in subsection (2) gives the r e q u i r e m e n t s and interests of the Aviation Safety Investigation B o a r d p r e c e d e n c e over those of the South African P o l i c e Service, or p r e v e n t s a d e p a r t m e n t from taking e m e r g e n c y remedial m e a s u r e s u n d e r any other legislation. (4) W h e r e an aircraft accident or aircraft incident referred to in subsection (1) is being investigated by the Aviation Safety Investigation Board, the D e p a r t m e n t of D e f e n c e , the S o u t h African Police Service or a visiting force, the Aviation Safety Investigation B o a r d and the Minister of Defence m u s t take all r e a s o n a b l e m e a s u r e s to e n s u r e that the investigations are coordinated.

Compatible procedures and practices 14. (1) T h e Aviation Safety Investigation B o a r d m u s t take all r e a s o n a b l e m e a s u r e s to e n s u r e that the investigation p r o c e d u r e s and practices that it follows in relation to aircraft accidents and aircraft incidents are c o m p a t i b l e w i t h — (a) any international a g r e e m e n t s or C o n v e n t i o n s to which the R e p u b l i c is a party; and (b) investigation p r o c e d u r e s and practices followed by the judicial inquests in t e r m s of the Inquests Act. (2) T h e Aviation Safety Investigation B o a r d m u s t m a k e all r e a s o n a b l e efforts to enter into a g r e e m e n t s in order to e n s u r e that the p r o c e d u r e s a n d practices followed by the Aviation Safety Investigation B o a r d are c o m p a t i b l e as far as possible with those followed by the judicial inquests in t e r m s of the Inquests Act.

(1) T h e Aviation Safety Investigation B o a r d consists of a C h a i r p e r s o n , D e p u t y C h a i r p e r s o n and three other m e m b e r s a p p o i n t e d in a c c o r d a n c e with the following principles, n a m e l y (a) participation by the public in the n o m i n a t i o n and evaluation p r o c e s s ; and (b) transparency and o p e n n e s s taking into account the objects and principles of this Act. (2) (a) Before the m e m b e r s of the B o a r d are appointed, t h e M i n i s t e r m u s t , through the media, invite m e m b e r s of the public to apply or n o m i n a t e persons for a p p o i n t m e n t to the Aviation Safety Investigation B o a r d and w h o c o m p l y with the criteria c o n t e m p l a t e d in subsection (3). (b) T h e Minister m u s t after receipt of the n o m i n a t i o n s and applications c o n t e m p l a t e d in p a r a g r a p h (a) invite at least four aviation e x p e r t s and the Director to assist in the selection and evaluation of m e m b e r s eligible for a p p o i n t m e n t to the Aviation Safety Investigation B o a r d . (c) T h e aviation experts referred to in p a r a g r a p h (b) m u s t c o m p i l e a shortlist consisting of no m o r e than ten persons.

Cd) T h e aviation experts m u s t submit the shortlist to the D e p a r t m e n t for publication in the Gazette for public c o m m e n t for a period of not less than 3 0 d a y s , and the D e p a r t m e n t m u s t notify P a r l i a m e n t accordingly. (e) T h e M i n i s t e r must, after the period a l l o w e d for public c o m m e n t a n d consideration thereof as c o n t e m p l a t e d in p a r a g r a p h (d), appoint the m e m b e r s as referred to in 5 subsection (1) from a list c o m p i l e d by the aviation experts. (f) T h e Minister must, within 3 0 d a y s from the date of a p p o i n t m e n t of t h e m e m b e r s of the Aviation Safety Investigation B o a r d , notify Parliament of such a p p o i n t m e n t and publish such a p p o i n t m e n t in the Gazette. (g) T h e aviation experts c o n t e m p l a t e d in p a r a g r a p h (b) m a y i n c l u d e — 10 (i) a person with k n o w l e d g e of and e x p e r i e n c e in the aviation industry; (ii) a p e r s o n with k n o w l e d g e of and e x p e r i e n c e in aviation accident and incident investigations; (iii) a person w i t h a legal b a c k g r o u n d ; and (iv) a person with civil aviation a c k n o w l e d g e d technical c o m p e t e n c i e s involved in 15 organised labour from the aviation industry. (h) A n aviation expert c o n t e m p l a t e d in paragraph (b) receives such r e m u n e r a t i o n or a l l o w a n c e s as m a y be d e t e r m i n e d b y the M i n i s t e r after consultation with the M i n i s t e r of Finance. (3) M e m b e r s a p p o i n t e d to the Aviation Safety Investigation B o a r d m u s t be p e r s o n s 2 0 who— (a) are c o m m i t t e d to fairness, freedom of expression, o p e n n e s s and accountabil­ ity on the part of those entrusted with the g o v e r n a n c e of a public service; (b) w h e n v i e w e d collectively be k n o w l e d g e a b l e of aviation transportation h a v i n g regard to the following factors: 25 (i) Technical k n o w l e d g e in matters relating to civil aviation; (ii) special skills, professional standing, expertise or e x p e r i e n c e in m a t t e r s c o n c e r n i n g civil aviation; and (iii) p o s s e s s suitable qualifications, expertise and e x p e r i e n c e in the field of aviation accident and incident investigation or any other relevant 3 0 expertise or qualifications; and (c) h a v e p r o v e n k n o w l e d g e in accident reconstruction, safety e n g i n e e r i n g , civil aviation safety or transportation regulations. (4) In fixing a term of a p p o i n t m e n t or r e a p p o i n t m e n t , the Minister m u s t e n d e a v o u r to e n s u r e , to the extent that it is practical to d o so, that, notwithstanding periodic c h a n g e s 3 5 in the m e m b e r s h i p of the Aviation Safety Investigation B o a r d , it r e m a i n s constituted of p e r s o n s w h o h a v e had p r e v i o u s e x p e r i e n c e as m e m b e r s of the B o a r d . (5) A n y v a c a n c y on the Aviation Safety Investigation B o a r d arising by virtue of the provisions of section 16(3) or c a u s e d by the death of a m e m b e r , or for any other reason must, be filled b y the a p p o i n t m e n t by the Minister in terms of section 15(2) of another 4 0 person for the u n e x p i r e d portion of the period for w h i c h the vacating m e m b e r w a s appointed. (6) T h e Minister m a y a p p o i n t from the list c o n t e m p l a t e d in subsection (2) (d) any eligible person to a c t — (a) in any m e m b e r ' s stead; or 45 (b) in a t e m p o r a r y capacity in any vacancy in the Aviation Safety Investigation Board, for such period as the Minister m a y d e t e r m i n e . (7) T h e C h a i r p e r s o n and D e p u t y C h a i r p e r s o n are full time m e m b e r s a n d are a p p o i n t e d by the M i n i s t e r for a term of five years and m a y on the expiration of such term b e eligible for o n e further term only. 50 (8) A m e m b e r of the Aviation Safety Investigation B o a r d is a part t i m e m e m b e r and m u s t hold office for a term not e x c e e d i n g three years and is on expiration of such m e m b e r ' s term of office eligible for r e a p p o i n t m e n t . Disqualification a n d r e m o v a l o f m e m b e r s of Aviation Safety I n v e s t i g a t i o n B o a r d 16. (1) A p e r s o n m a y not b e a p p o i n t e d as a m e m b e r of the Aviation Safety Investigation B o a r d if h e or s h e — (a) is not p e r m a n e n t l y resident in the R e p u b l i c ; (b) is a public servant or the holder of any other r e m u n e r a t e d position under the State; (c) is a m e m b e r of Parliament, any provincial legislature or any m u n i c i p a l council;

is an office-bearer or e m p l o y e e of any party, m o v e m e n t or organisation of a party-political nature; (e) or his or h e r family m e m b e r has a direct or indirect financial interest in the aviation industry; if) or his or her business partner or associate holds an office in or with, or is e m p l o y e d by, any p e r s o n or body, w h e t h e r corporate or u n i n c o r p o r a t e d , which has an interest c o n t e m p l a t e d in p a r a g r a p h (e); (g) is an unrehabilitated insolvent; (h) has been d e c l a r e d by a court to be mentally ill or disordered; (i) has at any time been convicted, w h e t h e r in the R e p u b l i c or e l s e w h e r e , of— (i) theft, fraud, forgery or uttering a forged d o c u m e n t , perjury, an offence in t e r m s of the Prevention of Corruption Act, 1958 (Act N o . 6 of 1958), the C o r r u p t i o n Act, 1992 (Act N o . 9 4 of 1992), Part 1 to 4,or section 17, 2 0 or 21 (in so far as it relates to the aforementioned offences) of C h a p t e r 2 of the P r e v e n t i o n and C o m b a t i n g of C o r r u p t Activities Act, 2 0 0 4 ( A c t N o . 12 of 2 0 0 4 ) , or any other offence involving dishonesty; or (ii) an offence u n d e r this A c t ; (j) has b e e n sentenced, after the c o m m e n c e m e n t of the Constitution of the R e p u b l i c of S o u t h Africa, 1993 (Act N o . 2 0 0 of 1993), to a period of i m p r i s o n m e n t of not less than one year without the option of a fine; or (k) has at any t i m e been r e m o v e d from an office of trust on a c c o u n t of misconduct. (2) A person w h o is subject to a disqualification c o n t e m p l a t e d in s u b s e c t i o n ( l ) f b ) to (h) m a y b e n o m i n a t e d for a p p o i n t m e n t as a m e m b e r of the Aviation Safety Investigation Board, but m a y only be a p p o i n t e d if at the time of such a p p o i n t m e n t he or she is no longer subject to that disqualification. (3) Subject to subsection (4), a m e m b e r of the Aviation Safety Investigation B o a r d m a y be r e m o v e d from office on a c c o u n t of— (a) misconduct; (b) inability to perform the duties of his or her office efficiently; (c) a b s e n c e from three consecutive meetings of the Aviation Safety Investigation B o a r d w i t h o u t the p e r m i s s i o n of the C h a i r p e r s o n of t h e Aviation Safety Investigation B o a r d , except on g o o d c a u s e s h o w n ; (d) his or her failure to disclose an interest in terms of subsection (\)(e) or (f); (e) h i m or her b e c o m i n g disqualified as c o n t e m p l a t e d in subsection (\)(b) to (k); or (f) his or h e r refusal to sign a p e r f o r m a n c e a g r e e m e n t . (4) A m e m b e r of the Aviation Safety Investigation B o a r d m a y b e r e m o v e d from office by the M i n i s t e r — (a) if such m e m b e r repeatedly fails to perform the duties of office efficiently; (b) if, d u e to any physical or mental illness or any other c a u s e , such m e m b e r b e c o m e s incapable of performing the functions of that office or performs them inefficiently; or (c) for m i s c o n d u c t . (5) T h e m e m b e r vacates his or her office i m m e d i a t e l y if he or s h e — (a) is c o n v i c t e d — (i) w h e t h e r in the R e p u b l i c or e l s e w h e r e of murder, robbery, theft, fraud, forgery or uttering a forged d o c u m e n t , perjury or any offence involving d i s h o n e s t y ; or (ii) of any offence in t e r m s of the Prevention and C o m b a t i n g of C o r r u p t Activities Act, 2 0 0 4 (Act N o . 12 of 2 0 0 4 ) , the C o m p a n i e s Act, 1973 (Act N o . 61 of 1973), Prevention of Organised C r i m e Act, 1998 (Act N o . 121 of 1998), the Public F i n a n c e M a n a g e m e n t A c t or of c o n t r a v e n i n g this Act; (b) is convicted of an offence during his or her term of office and sentenced to a period of i m p r i s o n m e n t without the option of a fine; or (c) b e c o m e s a political office bearer.

Performance management system 17. (1) T h e M i n i s t e r m u s t establish a p e r f o r m a n c e m a n a g e m e n t s y s t e m to m o n i t o r and e v a l u a t e the p e r f o r m a n c e of the m e m b e r s of the Aviation Safety Investigation Board. (2) T h e p e r f o r m a n c e m a n a g e m e n t s y s t e m m u s t — (a) set a p p r o p r i a t e key p e r f o r m a n c e indicators as a yardstick for m e a s u r i n g performance; (b) set m e a s u r a b l e p e r f o r m a n c e targets; and (c) set a p r o c e d u r e to m e a s u r e and r e v i e w p e r f o r m a n c e at least o n c e a year. (3) A s soon as is practicable after the a p p o i n t m e n t of the m e m b e r s of the Aviation Safety Investigation B o a r d a p e r f o r m a n c e a g r e e m e n t m u s t be c o n c l u d e d b e t w e e n the m e m b e r s of the Aviation Safety Investigation B o a r d and the Minister. (4) T h e evaluation of the p e r f o r m a n c e of the m e m b e r s of the Aviation Safety Investigation B o a r d m u s t be c o n d u c t e d by a panel constituted by the Minister. (5) T h e panel c o n t e m p l a t e d in subsection (4) must, after an evaluation of t h e m e m b e r s of the Aviation Safety Investigation B o a r d , submit a report to the Minister for consideration. (6) T h e M i n i s t e r m u s t c a u s e copies of the report submitted to h i m or her in t e r m s of subsection (5) to b e tabled in Parliament within 14 d a y s of receipt of that report, or, if P a r l i a m e n t is not then in session, within 14 d a y s after c o m m e n c e m e n t of its next e n s u i n g session.

(1) T h e C h a i r p e r s o n and other a p p o i n t e d m e m b e r s of the Aviation Safety Investigation Board m u s t be paid the r e m u n e r a t i o n and other a l l o w a n c e s that are d e t e r m i n e d by the M i n s t e r as d e t e r m i n e d in consultation with the M i n i s t e r of Finance. (2) T h e m e m b e r s and the staff of the Aviation Safety Investigation B o a r d are entitled to be paid r e a s o n a b l e travel a n d living e x p e n s e s incurred by t h e m in the c o u r s e of their duties as m a y be p r e s c r i b e d by rule from time to time.

T h e C h a i r p e r s o n of the Aviation Safety Investigation B o a r d has exclusive responsibility for m a n a g i n g personnel matters, financial matters, property matters a n d for all o t h e r aspects of the internal m a n a g e m e n t of the Aviation Safety Investigation Board, including— (a) directing the staff a n d apportioning the w o r k of the Aviation Safety Investigation B o a r d ; (b) directing the m e m b e r s and a p p o r t i o n i n g their work, subject to section 2 5 ; and (c) c o n v e n i n g m e e t i n g s in a c c o r d a n c e with section 21 and presiding at m e e t i n g s in a c c o r d a n c e with any rules m a d e u n d e r section 31(3).

(1) A m e m b e r of the Aviation Safety Investigation Board m a y not, directly or indirectly, as owner, shareholder, director, officer, partner or o t h e r w i s e — (a) be e n g a g e d in an aviation u n d e r t a k i n g or b u s i n e s s ; or (b) h a v e an interest in an aviation u n d e r t a k i n g or b u s i n e s s or an interest, financial or o t h e r w i s e , in the m a n u f a c t u r e or distribution of aviation p l a n t or e q u i p m e n t , except w h e r e the distribution is m e r e l y incidental to the general m e r c h a n d i s i n g of g o o d s . (2) A n y m e m b e r of the Aviation Safety Investigation B o a r d or any m e m b e r of the staff or accredited representatives, experts and advisers of the Aviation Safety Investigation B o a r d or his or h e r s p o u s e , i m m e d i a t e family m e m b e r , life partner or b u s i n e s s associate, m a y not hold any direct or indirect financial interest in any civil aviation activity or the civil aviation industry without prior approval of the Minister, w h i c h approval is o p e n to inspection by the p u b l i c at the office of the Aviation Safety Investigation B o a r d d u r i n g business hours. (3) W h e r e any interest referred to in subsection (1) vests in a m e m b e r for the benefit of the m e m b e r by w a y of gift, will, a n d succession or o t h e r w i s e , the interest m u s t , within three m o n t h s after the vesting, be d i s p o s e d of by that m e m b e r . (4) D u r i n g the term of office of a m e m b e r , in addition to the prohibitions described in this section, the m e m b e r of the Aviation Safety Investigation Board m u s t not carry on any activity inconsistent with the p e r f o r m a n c e of the m e m b e r ' s duties u n d e r this Act.

(1) T h e m e m b e r s of the Aviation Safety Investigation Board, at m e e t i n g s c o n v e n e d in a c c o r d a n c e with section 2 1 , m u s t — (a) m a k e rules regarding the c o n d u c t of b u s i n e s s at m e e t i n g s of t h e Aviation Safety Investigation B o a r d ; (b) establish policies with regard to the classes of aircraft accidents and aircraft incidents to be investigated; (c) establish, either generally or in relation to specific classes of aircraft accidents and aircraft incidents, policies to be followed in the c o n d u c t of investigations: (d) r e v i e w reports s u b m i t t e d to t h e m by t h e Director of Investigations m e n t i o n e d in section 2 6 ( 1 ) and, after such review, m a y require the Director of In­ vestigations to c o n d u c t further investigation with respect to any aspect of an aircraft accident or aircraft incident; (e) d e t e r m i n e the Aviation Safety Investigation B o a r d ' s findings as to the causes and contributing factors of aircraft accidents or aircraft incidents; (f) identify any safety deficiencies as e v i d e n c e d by aircraft accidents or aircraft incidents; and (g) m a k e such r e c o m m e n d a t i o n s as they c o n s i d e r appropriate.

(3) T h e Aviation Safety Investigation B o a r d m u s t within the time required by the Public F i n a n c e M a n a g e m e n t A c t submit to the Minister an annual report pertaining to the financial state of affairs of t h e Aviation Safety Investigation B o a r d as at the e n d of the immediately p r e c e d i n g financial year, consisting of— (a) a balance sheet, an i n c o m e statement and a cash-flow statement w h i c h is a true and correct reflection of the state of affairs of the Aviation Safety Investigation B o a r d as at the end of that financial year; (b) a report b y the Aviation Safety Investigation B o a r d in a c c o r d a n c e with subsection (4); (c) a report by the auditor of the Aviation Safety Investigation B o a r d in a c c o r d a n c e with subsection (5); and (d) any other statement or report w h i c h the Minister or the Minister of F i n a n c e may require.
