Frequently Asked Questions (FAQs): 1. What is RoHS? RoHS stands for Restriction of Hazardous Substances. EU RoHS The original EU RoHS is the European Directive 2002/95/EC. EU RoHS (Recast) or EU RoHS 2 refers to the European Directive 2011/65/EU. EU RoHS (Recast) of 8 June 2011 was published in the Official Journal on 1 July 2011 and required Member States to transpose the provisions into their respective national laws by 2 January 2013. China RoHS China RoHS, also known officially as Administrative Measure on the Control of Pollution Caused by Electronic Information Products, is the labeling requirement that is required for all Electronic Information Products to be marketed and sold in China. RoHS in other countries Vietnam RoHS, California RoHS, Turkey RoHS and Korea RoHS, among others, were modeled after the EU RoHS, and cover the same substances, threshold levels, and exemptions.

2. What is EU REACH and how does it affect Elo Touch Solutions? REACH is the European Community Regulation on chemicals and their safe use (EC 1907/2006) and stands for Registration, Evaluation, Authorization and Restriction of Chemicals. Under REACH, chemical producers in the EU and importers of chemicals into the EU have certain responsibilities to register the chemicals that they produce/import in quantities of 1 metric tonne per year in/into the European Union. For each chemical substance, only one dossier is required for submission to the European Chemicals Agency (ECHA), the organization that overseas the REACH implementation. intended use of the chemicals. ECHA maintains a database of detailed information on chemical substances, which can be found on their website http://echa.europa.eu. As an electronic and electrical equipment manufacturer, Elo Touch Solutions is not in scope for REACH’s registration requirements, but we are required to comply with the REACH chemical substance requirements: - REACH Annex XVII specifies restrictions on the use and marketing of dangerous chemical substances for certain applications, some of which are pertinent for Elo’s products. - REACH Substances of Very High Concern (SVHC) Candidate List lists out the chemical substances, which, if present above 0.1% (by weight) in an Elo product, will require Elo to communicate to customers, information regarding the presence of the chemical substance in the product and product safe use. We also have the responsibility to notify ECHA in the case when a REACH Candidate List SVHC is present above 0.1% (by weight) of an Elo product and is used in quantities over 1 metric tonne per year by Elo.

3. How do I know whether products from Elo Touch Solutions are EU RoHS compliant? As of December 2003, Elo Touch Solutions began to work towards EU RoHS compliance across our entire product portfolio. Since 2006, all Elo products have complied with the EU RoHS, with the exception of certain legacy products. In the past, EU RoHS compliance was demonstrated by a ‘Directive 2002/95/EC (RoHS) Compliant’ green sticker on the product’s shipping carton. With the repealing of EU RoHS Directive 2002/95/EC by EU RoHS Recast Directive 2011/65/EU in January 2013, compliance with EU RoHS (Recast) of Elo Touch Monitors and Touch Computers, which fall in scope of EEE category 3 of EU RoHS Recast, will be demonstrated by the CE Mark. Other Elo products, such as Touch Controllers and Touch Screens, which we do not sell to endusers and/or do not fall within the EEE category set out in EU RoHS (Recast) will continue to bear the ‘Directive 2002/95/EC (RoHS) Compliant’ green sticker to demonstrate compliance to the EU RoHS substance restriction requirements. These stickers will progressively be replaced by new ‘Directive 2011/65/EU (RoHS2) Substance Compliant’ green stickers. 4. Are Elo Touch Solutions products EU REACH compliant? Elo is aware and is committed to fulfill the obligations we have under the EU REACH Regulation No. 1907/2006, as a manufacturer of articles. In accordance to REACH Article 33, we will notify our customers in the case that any of the REACH Candidate List SvHC is present in our products above 0.1% (by weight). A list of REACH Candidate List SvHC that has been identified to be present in our products can be found here.

5. What steps do Elo take to ensure that all our products are compliant with prevailing regulations? Step 1: Staying current on prevailing regulations and standards Elo utilizes resources to keep up-to-date with regulations and standards that may affect Elo products. We also take into account customer requirements when determining our product environmental compliance requirements. We specifically maintain a document that specifies all the environmental regulation and standard requirements that all the parts and products our suppliers supply us need to comply with. Step 2: Designing for Environmental, Health, and Safety When designing products, Elo Engineers take into account product environmental compliance considerations. Elo Engineers specify only parts that comply with our substance restriction requirements and work with suppliers to ensure that all the parts and products they supply to Elo comply with our product compliance requirements and have the necessary technical documentation to demonstrate compliance. Step 3: Addressing and investigating product non-conformance When Elo finds reason to believe the possibility of product non-conformance, Elo Engineers will work with suppliers to investigate and address the issue. Often times, non-conformance is suspected due to test reports that demonstrate EU RoHS substance presence above EU RoHS limits and does not take into account applicable EU RoHS exemptions. In general, Elo will take necessary actions to correct and address any noncompliance that may be identified in our products.

6. What is the EU WEEE Directive? The original EU WEEE (Waste Electrical and Electronic Equipment) Directive is the EU Directive 2002/96/EC. EU WEEE Recast refers to the new WEEE Directive 2012/19/EU that was published in the Official Journal on 24 July 2012 and will repeal the EU Directive 2002/96/EC. EU WEEE (Recast) requires Member States to transpose the provisions into their respective national laws by 14 February 2014. Under the WEEE Directive, any natural or legal person who is classified as a WEEE producer in an EU Member State has the obligations to register as a producer and provide recycling arrangements in that EU Member State. Under WEEE, private households should be able to return WEEE, at least free of charge. For non-private household end users, producers have the obligation to at least pay for WEEE recycling of products that they put in the market after August 13, 2005.

Elo Touch Solutions has made WEEE arrangements with ENVIRON and EARN (European Advanced Recycling Network) to set up web-based Recycling Arrangements in EU Member States. To make use of the WEEE Arrangements Elo has in place, go to http://www.elotouch.com/AboutElo/ewaste-program/weee.asp.

How can I send End of Life Elo Products for recycling? Elo have set up recycling arrangements in certain US States and EU Member States. Information regarding WEEE collection and recycling arrangements available in the United States can be accessed at www.elotouch.com/AboutElo/ewaste-program. Information regarding WEEE collection and recycling arrangements available in the European Union can be accessed at http://www.elotouch.com/AboutElo/ewaste-program/weee.asp. 8. What happens to monitors when they are recycled? When Elo monitors are sent for proper recycling with an authorized facility, they will be disassembled properly. Components and materials those are reusable or recoverable that can be processed for reuse will be removed. It is important to recycle monitors. Monitors should not be disposed of as unsorted municipal waste into landfills, since it contains small amounts of hazardous substances, such as mercury in CCFL (Cold Cathode Fluorescent Lamps) in LCD backlights and lead in the glass of CRT (Cathode Ray Tubes). Though under normal operation these substances are not likely to cause harm to users, these chemical may leach out over time spent sitting in landfills. To ensure that hazardous chemicals are treated appropriately, monitors should be disposed of properly at authorized facilities that have the technology for handling WEEE disposal and recycling.

9. Do Elo Touch products contain Mercury? Will I be exposed to the Mercury? LCD (liquid-crystal displays) backlights composed of CCFL (Cold Cathode Fluorescent Lamps) may contain Mercury. Mercury is present as vapor in the glass tubing of the CCFL, and is an essential component of CCFL for efficiently converting electric energy to light energy. A single CCFL may contain about a few milligrams of Mercury. Under normal operating conditions, Mercury will not leak out from CCFL. Mercury will leak out only if the CCFL glass tubing is cracked or broken due to a very hard impact. While some Elo touchcomputers and touchmonitors still use CCFL LCD panels to display images and videos, others have transitioned away to use LCD panels that use LED (light emitting diodes) as LCD backlights.

10. What is Halogen-Free? Halogen-Free is an industry-driven standard that promotes companies to limit the usage of Chlorine and Bromine in their products. This standard is driven by the concern that Chlorine and Bromine in electronic and electrical waste that is not properly incinerated will result in the production of very toxic chemicals such as dioxins and furans. Dioxins and furans are produced due to incomplete combustion of organic materials in the presence of Chlorine or Bromine, and metal catalysts. A product that is labeled as “Halogen-Free” does not necessarily mean that the product contains absolutely zero halogens. Chemically, halogens refer to the original Group 17 of the periodic table, and refer to chemicals: Fluorine (F), Chlorine (Cl), Bromine (Br), Iodine (I), and Astatine (At). In the electronics industry, halogen-free often either implies that: 1.

 1500 ppm of Cl + Br / homogenous level

INEMI Standard: a.

Non-halogenated epoxide with a glass transition temperature of 120 oC minimum. Total halogens contained in resin plus reinforcement matrix should contain Bromine and Chlorine below the IPC Standard: i.  900 ppm of Cl / homogenous level, ii.  900 ppm of Br / homogenous level, and iii.  1500 ppm of Cl + Br / homogenous level

b.

For components other than the printed board and substrate laminates, each plastic within the component should contain Bromine and Chlorine below: i. < 1000 ppm of Br (if Br source is from Brominated Flame Retardants) ii. < 1000 ppm of Cl (if Cl source is from Chlorinated Flame Retardants, PVC, or PVC Co-polymers)

Elo Touch Solutions is aware of the industry-driven demand for Halogen-Free products. Currently, we do not require our suppliers to only supply Halogen-Free products, and thus our products do not yet comply with Halogen Free standards.

11. What are Conflict Minerals? The Conflict Mineral Statutory Provision defines the term “conflict mineral” as Cassiterite, Columbite-Tantalite, Gold, Wolframite, or their derivates. It is commonly used to refer to Tin (Sn), Tantalum (Ta), Tungsten (W), and Gold (Au) (collectively referred to as “3TG”), which are the four metal derivatives that come under the spotlight of the SEC implemented Conflict Minerals Rules.

On August 22, 2012, the SEC (Securities and Exchange Commission) adopted final rules for implementing Section 1502 of the Dodd-Frank Act concerning Conflict Minerals (“Conflict Minerals Rules”). Under the Conflict Minerals Rules, companies who report to the SEC, including all US publicly traded companies, will need to submit an annual report to the SEC that discloses the origins of the 3TG that is “necessary for the functionality or production” of their products. In particular, such companies need to investigate and disclose whether the 3TG present in their products are sourced from mines or trade routes in the Democratic Republic of Congo (DRC) that are controlled by armed groups. Although Elo is not directly subjected to the SEC Conflict Mineral Rules, Elo strives to assist our customers with their compliance efforts. 12. How do I get a Certificate of Compliance from Elo that certifies compliance of Elo products to prevailing regulations and standards? Glossary EU RoHS Exemptions Annex III of European Directive 2011/65/EU lists out the use of EU RoHS chemical substances in applications that are exempted from the RoHS restriction limits. Exemptions for the use of RoHS chemical substances for certain applications are granted only when: -

Substitution the chemicals is not possible from a scientific and technical point of view,

The negative environmental, health, and consumer safety impacts caused by substitution are likely to outweigh the environmental, health, and consumer safety benefits of the substitution, or

-

The reliability of substitutes is not ensured.

EEE EEE stands for Electronic and Electrical Equipment. In the original WEEE Directive, EEE is defined as being equipment which is dependent on electric currents or electromagnetic fields in order to work properly and equipment for the generation, transfer and measurement of such currents and fields. under the following ten categories of EEE and designed for use with a voltage rating not exceeding 1000 V for alternating current and 1500 V for direct currents: 1). Large household appliances 2). Small household appliances 3). IT and telecommunications equipment 4). Consumer equipment 5). Lighting equipment 6). Electrical and electronic tools with the exception of large-scale stationary industrial tools 7). Toys, leisure and sports equipment 8). Medical devices with the exception of all implanted and infected products 9). Monitoring and control instuments 10). Automatic Dispensers The original EU RoHS Directive 2002/95/EC adopted the WEEE definition of EEE and defined EEE as those that depend on electric current or electromagnetic fields for its primary function. With the EU RoHS 2 Directive 2011/65/EU, EEE in scope of the directive are those that depend on electric current or electromagnetic fields to fulfill at least one intended function. EU RoHS 2 thus brings into scope EEE that may previously have been out-ofscope of the original EU RoHS. A new EEE category was additionally introduced under EU RoHS 2, Category 11. Other EEE not covered by any of the categories above.
