Terms and Conditions of the Game Air France/Festival de Cannes Facebook Quiz

Article 1: ORGANISER Air France, registered with the Bobigny chamber of commerce under the number 420495178, a private limited company with €1,901,231,625 in capital, headquartered at 45 Rue de Paris, 95747 Roissy-CDG, France. To celebrate the Cannes Film Festival, which will take place from May 12th to the 23rd 2010 in Cannes, France, Air France is organizing an Internet game entitled “Air France Music x Festival de Cannes” which is free of charge, no purchase necessary. The game will be open to participants from Tuesday April 27th 2010 at 10:00 (local time Paris, France) thru May 4th 2010 at 23:59 (local time Paris, France). Article 2: PARTICIPATION Participation in the game is free of charge, no purchase is necessary, but reserved for members of the Facebook social network in France (www.facebook.fr) and the USA (www.facebook.com) -

In France, participating Facebook members must be over 18 years old, live in metropolitan France and not be employees of the organizing companies or members of their families (same name, same address).

In the United States and the District of Columbia, participating Facebook members must be 21 years of age or older, legal adult in the state where they live, must live in the USA and must not be employees of the organizing companies or members of their families (same name, same address).

Participants hereby declare that they are in possession of a passport that is valid for at least six months after their departure date and enables them to freely visit France. Participation in the game implies complete, unreserved acceptance of the terms and conditions set forth herein, of the current Internet code of ethics, and of the rules and regulations that apply to free Internet games. Failure to respect any of these terms and conditions will render the participation invalid. Article 3: GAME ANNOUNCEMENTS This game will be announced through invitations to members of the Facebook network, via an enewsletter sent by Air France to members of the company’s Flying Blue loyalty program, as well as via links on the company’s two websites (airfrance.us and airfrance.fr). Article 4: PRACTICAL DETAILS To participate, Internet users must first become Air France Music Facebook fans by clicking on the link entitled “J’aime” or “I like” on the Air France Music Facebook page. If they are already an Air France Music Facebook fan, they do not need to repeat the process.

The game is presented as follows: To play, the participant must download the Air France Music x Festival de Cannes Quiz application on Facebook. After clicking on “play the game”, he/she must answer 2 multiple choice questions, complete and submit the entry form with his/her full name and email address. If he/she answers the 2 questions correctly, he/she will automatically be entered into the raffle drawing. Article 5: DETERMINING THE WINNERS There will only be one winner of the game in France and one in the USA. The random drawing will be performed electronically by a computer based on the list of participants who correctly answered the 2 questions on the quiz. The winners will be notified in writing. In France, the winner’s name will be randomly drawn from the list of participants living in metropolitan France who correctly answered the 2 questions on the quiz, under the supervision of the bailiff, Jean-Louis HAUGUEL, on the first work day following the end of the contest, which is set for May 5th 2010. In the USA, the winner’s name will be randomly drawn from the list of participants living in the USA who correctly answered the 2 questions on the quiz, on the first work day following the end of the contest, which is set for May 5th 2010. The winners will be notified by email after the drawing, between May 5th and May 7th 2010. Article 6: NUMBER OF AUTHORIZED PARTICIPANTS Participants must complete all required fields on the entry form at the end of the quiz and click on the button entitled “Je valide mon inscription”/“I confirm my entry”. Any incomplete or incorrect entry forms will be considered invalid and will not be taken into consideration for the drawing. Only one person can participate in each household: same family name or same email address. Anyone who attempts to participate in the drawing using several different email addresses will be disqualified. Any attempts to commit fraud will lead to the participant’s immediate elimination from the drawing and render all of his/her entry forms invalid. Article 7: THE PRIZE The prize includes the following: For the winner in the USA:  Round-trip plane tickets to Paris for two people from the Air France destination in the USA closest to the winner’s home or that of the winner’s guest (see the list of optional departure cities/airports : Boston ,New York JFK , Newark , Washington DC , Atlanta, Miami, Houston , Chicago , Detroit, Los Angeles , San Francisco, and Seattle) in Air France’s economy class entitled “Classe Voyageur”. It is specified that the 2 round-trip plane tickets included in the prize must be reserved together and used on the same flights operated by Air France. Flight dates are non-negotiable. The departure flight from the Air France destination in the USA chosen by the winner must take place on May 21st 2010. The return flight from Nice via the

Paris Charles de Gaulle airport to the Air France destination in the USA chosen by the winner must take place on May 24th 2010. These tickets can only be used by the winner and his/her designated guest and are subject to certain terms and conditions. The tickets will be in economy class. They cannot be changed, refunded or exchanged. The winning tickets do not qualify for the Flying Blue customer loyalty program. If the winner and/or his/her guest are members of the aforementioned program, they cannot accrue miles from this free travel offer.  Lodging in Paris on the night of May 22 to 23, in a three-star hotel, including breakfast.  Round-trip tickets between Paris and Nice for two people in Air France’s economy class entitled “Classe Voyageur” (departing on May 23rd, returning on May 24th 2010). These tickets can only be used by the winner and his/her designated guest and are subject to certain terms and conditions. The tickets will be in economy class. They cannot be changed, refunded or exchanged. The winning tickets do not qualify for the Flying Blue customer loyalty program. If the winner and/or his/her guest are members of the aforementioned program, they cannot accrue miles from this free travel offer.  Transfer from the Nice airport to the site of the film festival in Cannes, France.  Access to the red carpet arrival of the stars and climbing of the steps on Sunday, May 23rd; to the Awards Ceremony and to the Closing of the 63rd annual Cannes Film Festival.  One night’s stay in a three-star hotel including breakfast, for 2 people, arriving May 23rd, departing May 24th 2010.  Dinner for 2 people on May 23rd 2010.  Lunch for 2 people in Cannes on Sunday (time depending on the flight arrival) at a restaurant chosen by Air France. The winner and his/her guest are responsible for their own transit expenses between their residence in the USA and the selected Air France airport in the USA as well as transit between the CDG airport and the hotel in Paris on Saturday, May 23rd and to the Orly airport for the flight from Paris to Nice. Likewise, any expenses incurred by the winner and/or his/her guest at the festival site remain their own personal responsibility. For the winner in France:  Round-trip plane tickets for two people from an Air France destination in France to Nice, via Paris if necessary, in Air France’s economy class entitled “Classe Voyageur”. It is specified that the 2 round-trip plane tickets included in the prize must be reserved together and used on the same flights operated by Air France. Flight dates are non-negotiable. The departure flight to Nice from the Air France destination in France chosen by the winner must take place on May 23rd 2010. The return flight from Nice to the Air France destination in France chosen by the winner must take place on May 24th 2010. These tickets can only be used by the winner and his/her designated guest and are subject to certain terms and conditions. The tickets will be in economy class. They cannot be changed, refunded or exchanged. The winning tickets do not qualify for the Flying Blue customer loyalty program. The total commercial value of the prize is estimated at: € 350 for a return ticket from Paris to Nice (average value of the ticket, to be confirmed depending on the winner’s departure city) $ 1500 for a return ticket from the USA to Paris (average value of the ticket, to be confirmed depending on the winner’s departure city) €800 for the lunch, the hotel stay at the Carlton, the gala dinner, and access to the Cannes Film Festival ceremonies

Article 8: PRIZE ATTRIBUTION PROCEDURES Winner notification and confirmation: Winners will be notified by email. If a winner fails to accept his/her prize within 2 days after the email has been sent, the latter will be considered as having declined the offer. In this case, Air France will be free to hold a new drawing as quickly as possible, to determine a new winner from the list of participants who correctly answered both questions on the quiz. Winners must respect all of the terms and conditions set forth herein. If a winner does not comply in any way to the criteria set forth herein (e.g. not a member of Facebook, does not live in metropolitan France or the USA, is not over 18 (for France) or not over 21 (for USA) or does not have a passport that is valid for at least six months after the departure date and allows them to freely travel in and out of France/the USA), Air France will not be able to give him/her the prize. Prizes cannot, in any case whatsoever, be traded in or exchanged for their cash value or for another prize; nor can they be turned over to a third party. However, in the event of force majeure or should the circumstances require it, Air France reserves the right to substitute the proposed prizes with other prizes of equivalent value at any time.

The prizes cannot lead to any sort of dispute or complaint of any kind. The winners hereby commit to not hold Air France responsible for the prizes, particularly with regard to their delivery, their state or quality. Article 9: CHANGE OF DATES FOR THE GAME ITSELF Air France cannot be held responsible in any way if, in the event of force majeure or other events beyond the company’s control, it has to cancel the aforementioned game, reduce it, prolong it, postpone it or change any of the conditions. Any change in the present terms and conditions will give rise to an addendum certified by the bailiff whose name is specified in article 13. Article 10: VERIFICATION OF THE PARTICIPANTS’ IDENTITY The participants hereby authorize Air France to check on any aspect of their identity, their place of residence and their Facebook membership. These verifications will be conducted in strict accordance with article 10 of the French civil code. Any indication of a false, fraudulent, distorted, misleading, inaccurate or incorrect address or identity will lead to the elimination of the participant. Article 11: RESPONSIBILITY Air France will not be held responsible for any potential malfunctioning of the Internet which might eventually interfere with a participant’s access to the game or with the game’s operation. In particular, Air France will not be held responsible for any external, malicious acts. Air France makes every effort to provide participants with tools and information that’s available and verified. It cannot however be held responsible for: errors such as displays on the game site, erroneous email messages sent to participants, delivery of emails, etc.; lack of availability of information and/or viruses on the website. Participation in this game implies a certain awareness and acceptance of the characteristics and limits of the Internet, the lack of protection for certain data against eventual hijacking or piracy, and the risks of contamination by potential viruses circulating on the network. It is each participant’s own responsibility to take appropriate measures to protect the data and/or software stored in their computer and telephone equipment against any sort of abuse. Everyone’s connection to the game site and participation in the game is entirely their own personal responsibility. Furthermore, Air France is not responsible for any of the following: ‐

Problems with telephone connections



Problems with equipment or software



Destruction of any information provided by participants for any reason that cannot be attributed to Air France



Human or electronic errors



Disturbances that could affect the smooth operation of the game, or any malfunctioning of the automated drawing process



Cancellation or postponement of the Cannes Film Festival, or repercussions of eventual traffic delays or accidents that occur between the airport and the festival site



Accidents which cannot be blamed on Air France that might involve the winners and/or their guests throughout the duration of the festival, including the transportation and/or transfers



Deterioration or breakage of furniture, objects, or anything that could be present at the lodging or the festival



Air France is not responsible for any consequences of eventual delays, losses, thefts or mishaps in the delivery of postal or electronic mail which cannot be attributed specifically to it; complaints should be made by the addressees themselves directly to the companies responsible for the delivery of such mail

In any case, if the game’s smooth administrative and/or technical operation is disrupted for any reason beyond Air France’s will the company reserves the right to interrupt the game. Any fraud or non-compliance with these terms and conditions can lead to the perpetrator’s exclusion from the game. Air France reserves the right, in such a case, to file a law suit against the alleged perpetrator. Air France cannot be held responsible for any participant’s or guest’s physical inability to take the flight or to travel to France due to any irregularity of their paperwork/travel documents (lack of required visa, of a valid passport, etc.). Article 12: REIMBURSEMENT Participants who access the website from a modem or via a telephone line invoiced prorata based on the length of the connection/call can receive reimbursement for the cost of their connection to the website www.facebook.fr and/or facebook.com based on a daily flat fee corresponding to the cost of a six-minute local phone call from a land line (including taxes). The expenses incurred (the price of a standard postal stamp) by the participant to submit this request will be reimbursed on simply demand. One request per participant (same family name, same address and/or same email and/or same RIB/RIP/bank account references) will be taken into consideration for the entire game. Given the current state of technical and service offers available through certain Internet access providers which allows for free Internet connection or bundled packages which include Internet use, it is hereby agreed that any such Internet access (for example via cable, ADSL or special links) cannot give rise to any sort of reimbursement. Likewise, it is imperative that any request for reimbursement be submitted within less than 10 calendar days of receipt of the corresponding phone bill. The date taken into account will be the one which appears on the phone bill. The request for reimbursement should include the following items: the participant’s last name and first name, his/her postal and electronic mailing address (all of which should be identical to the information submitted on the entry form), bank or postal account details (RIB/RIP), the exact dates and times of the connections, the email address and password used, and as soon as available, a photocopy of the corresponding phone/Internet bill showing the dates and time of these connections, clearly underlined. This photocopy will also serve as proof of residence. The name and address of the person requesting reimbursement must be the same as those specified on the phone/Internet bill.

Requests for reimbursement must contain all of the abovementioned information and documents and must be sent to: Air France “Festival de Cannes Quizz Facebook”, Service DXEP, 45 Rue de Paris, 95747 Roissy, France. Article 13: DESIGNATION OF THE BAILIFF (for drawing in France only) These terms and conditions are registered with the bailiff Jean-Louis HAUGUEL, at 14 rue du Faubourg Saint-Honoré, 75008 PARIS. A copy can be freely and directly consulted via the Facebook quiz. The complete terms and conditions can be obtained via postal delivery, free of charge, by simple request in writing to Air France “Festival de Cannes Quizz Facebook”, Service DXEP, 45 Rue de Paris, 95747 Roissy, France. Article 14: INTERPRETATION OF THE TERMS AND CONDITIONS Air France will come to a decision regarding any issues relating to the application of these terms and conditions in strict compliance with the French legislation. These decisions are definitive and cannot be appealed. Any complaints or disputes with regard to this game must be submitted in writing and sent to the game’s official address and cannot be taken into consideration beyond one month after the official end of the game. Article 15: APPLICABLE LAWS AND COMPENSATION These terms and conditions are subject to French law. Article 16: DATA PROTECTION AND FREEDOM Air France respects the protection of your personal data. You therefore have the right to access, rectify or delete any data that concerns you personally. The winners and their guests, hereby accept to be filmed in Cannes throughout the entire duration of their stay. They also hereby agree to allow Air France to use their image for one year in the company’s communications relating to this game, in any type of media including the Internet, without any financial compensation, rights or advantages whatsoever. The winners and their guests hereby give free and explicit authorization to Air France to use and publicize their names on the Air France Facebook webpage, and/or any other Air France medium including any advertising or promotional campaign materials relating to this game. The transmission to a third party of any personal data collected by Air France within the context of this game is subject to the participant’s explicit prior approval.
