Data Protection Reform As from mid of September the data protection reform is again in the focus of the European Parliaments activities. It is still difficult to measure the impact of the Prism-scandal. However first discussions in and around the European Parliament took place and indicate as expected a tougher line in defense of the referring fundamental rights. The actual situation is probably a good opportunity to recall what the draft Regulation seeks to achieve. A summary, shall adress the most relevant changes :





Harm onisation: the reform has been prepared as a Regulation which is the strongest way to increase harmonisation and consistency across the EU; Consent: consent would need to be explicit, requiring a minimum of affirmative action by the data subject: The current practice of implied consent relying on inaction by the data subject would no longer be valid;



Data minim isation: data minimisation requirements in the current law would be expanded and would require to be incorporated into internal audit and privacy by design solutions;



Privacy by design: which requires on the one hand to implement appropriate technical and organisational measures and procedures so that the processing meets the requirements of the Regulation and ensures the protection of the data subject's rights; and on th eother hand the controller will have to implement mechanisms to ensure, by default, that only those personal data necessary for each specific purpose of the processing are processed, and that such data are not collected or retained beyond the minimum period necessary for those purposes;



Sensitive data: the definition of sensitive data including „financial data“, which implies a even stricter limitation with regard to the processing of personal data.



The right to be forgotten, which is more than just an extension of the existing right of erasure.



The right to portability: this obliges the controllers to ensure that information is available in a commonly used electronic format;



Personal data breach: the Regulation looks to impose a mandatory reporting obligation following a data breach within a short notice



The de lim itations on scoring, which endanger not only a business model integrally, but also may obliges creditors to approach risk on a lees individual way



Obligation to appoint a DP Officer: the draft Regulation proposes a requirement that companies employing more than 250 employees should appoint a Data Protection Officer. But according to Rapporteur Albrecht, it has now been proposed that different criteria should apply instead: where the processing of personal data "relates to more than 500 data subjects per year". This would shift the focus away from the size of the organisation and look instead at the volume of personal data being processed. The consequence would be that most collection agencies would need to appoint such an DP Officer. Severe Fines: up to 2% of the global turnover of a company maybe levied as fines. This dissuasive scheme is not limited to large corporates, but threatens also SMEs likewise.

By now it is not even clear whether the will be a vote in the LIBE Committee in October 2013. Informal negotiations between the European Parliament and the Council of the European Union are envisaged in the coming weeks. The positions in the Council are partially fully opposed to key elements of the reform. Continuous postponements may substantially impact the overall legislative timeline. Even once LIBE adopts its position on the draft, the Regulation will still need to be accepted by the EU Council and put to a vote by the full European Parliament. An orientation vote is now provisionally set for mid-October, as part of Reding’s push to ensure that the whole process closes before the European Parliament is re-appointed in 2014. If this deadline is not met, the new Parliament can decide to return the dossier to the Commission, and the legislative process would need to restart. The coming weeks until November are thus decisive for the actual reform.
