All our Cruises depart from THE INTERNATIONAL CONVENTION CENTRE QUAY SIDE; please arrive 15 minutes before the trip is due to commence. Nearest Car Park is Brindleyplace, off Sheepcote Street. We require a 50% deposit on all Standard Charters. Final payment required 2 weeks before the trip. All our boats are FULLY LICENSED and centrally heated (except for Waterbus.) Commentaries are available upon request. Catering, entertainment, wine, decorations are optional. Catering order must be placed *4 weeks before the trip. * In the case of a late booking, where catering is required, please ask for details. Customers are advised to restrict their catering order to one choice of menu plus vegetarian (if required). The Charter

Conditions of Charter Hire Please read these conditions carefully. These conditions are part of the reservation agreement and contain details of legal obligations and liabilities of the Hirer. Definitions In these conditions and the reservation agreement ‘The Company’ shall be Sherborne Wharf Limited, ‘The Hirer’ shall be the person or persons named on the reservation form and confirmation. In the event of more than one Hirer they shall be individually responsible and liable. ‘’The Conditions’ mean the conditions set out herein. ‘The Price’ means the price for the reservation as set out in the reservation confirmation, plus any catering, entertainments etc. ‘Hire Date’ means the date of the Charter hire. Booking Agreement

Whilst the Company will endeavour to operate the trips as reserved and shown on the booking confirmation, no liability whatsoever will be accepted for any cancellations, breakdown or unpunctuality, however caused. In the event of adverse weather conditions where we cannot cruise the boat hire will be static at the International Convention Centre and no discount will be offered. All other facilities (entertainment and catering) will be provided. Cruising times are approximate only. The Hirer is responsible for ensuring that all his/ her party arrives in due time for departure. Lost time cannot be made up for on the Charter. A deduction in cruising time will follow a late start, where necessary. The Captain, at his sole discretion, for any reason, may vary the route of the trip. In the event of the Company cancelling a trip, all monies paid by the Hirer will be returned in full, and the Hirer will have no further claim against the Company. Cancellations and Charges

A reservation is a legal agreement. Telephone reservations and submission of a completed reservation form are offers by the Hirer to hire and do not create a legal agreement and an offer by the Company to hold a reservation is not legally binding. The booking agreement is only made when the Company confirms by written booking confirmation. All booking agreements include these standard conditions, which the Hirer accepts as having read and agreed to them. The entire contract between the Company and the Hirer is contained within these conditions and booking form, and no representations, warranty or condition expressed or implied shall be deemed to have been made or agreed or imported by reference to any writing, advertisement or conversation. No agent, servant or representative of the Company has any right to alter or vary or waive any of these conditions. These conditions can only be varied by written permission of the Company, signed by a Director of the Company. The Hirer accepts that no statement or representation which may have been made by, or on behalf, of the Company induced the Hirer to enter into contract and that any such statement or representations do not form any part of the contract. Any liability of the Company and any remedy of the Hirer in respect of such statement or representation is excluded save in so far as liability of any statement or representation may not be excluded by law.

In the event of cancellation the Hirer shall notify the Company in writing at least 14 working days before the date of the cruise. The hire deposit is not returnable. In the event of cancellation within 14 working days the Hirer shall be responsible for the full cost of the boat unless the Company can re-let. In addition, a cancellation charge will be levied for any entertainment or catering ordered and subsequently cancelled. Safety, Rules and Passengers’ Property If, during a trip and after due warning, these conditions of hire are not observed, the Captain may immediately terminate the trip without making any refund of the fee paid: •

Passengers must have due regard for their own safety and in particular must not lean out or reach over the side of the boat. Subject to the Unfair Contracts Terms Act 1977, the management will not be liable for any injury, loss or damage whilst aboard the craft or on the premises of the Company, however caused.

No smoking is permitted aboard any of our boats.

•

Passengers must not drop any items of litter, etc. over the side of the boat.

•

No food or beverage may be brought on board by passengers except by prior arrangement with the management.

Prices and Payment The booking form must be returned completed and accompanied by a DEPOSIT of 50% of the hire charge, unless all money is due immediately because of proximity to charter date. Full payment (or balance due) including refreshments and entertainment charges must be received no later than 14 days prior to the date of the trip. Overdue accounts will be surcharged at 2.5% per month or part thereof. All prices quoted are correct at time of printing and normally exclude VAT at the current rate (unless otherwise stated) However, should the rate of VAT change then the Hirer shall be liable unless full payment has already been received. At the discretion of the management a Security Deposit may be levied for certain parties, held for the duration of the trip and returned after inspection of the boat.

Maximum Boat Capacities The total number of passengers, including caterers, entertainers and children, must not exceed the limit allowed by the Department of Trade and Industry i.e. Jericho: 48 Euphrates: 50 St. Catherine : 42

Unsuitable Hirers The boat will be at all times under the control of the Captain and crew. Please note that in the event of unruly behaviour etc. the Hirer will be held responsible for any such behaviour and damage caused by them whilst on our premises. The Company reserves the right to close the bar and stop at any time. The Company reserves the right to refuse bookings without assigning any reason for so doing. The Management, at its sole discretion, reserves the right to refuse to take on board any person who in their opinion, either by behaviour or other cause, is considered undesirable.

Jurisdiction The contract shall be deemed to have been made in England and shall be governed in all aspects by English law, unless the Company opts to pursue legal proceedings against the Hirer from the Courts of any other country.
