FALLOWFIELD TOWNSHIP BOARD OF SUPERVISORS Regular Meeting June 27,2012

Call to Order:

Supervisor Sadler called the meeting to order at 6:00p.m. prevailing time and led the Pledge of Allegiance. Roll Call:

The Fallowfield Township Supervisors met in regular session, on June 27, 2012, at 6:00 P.M., at the Fallowfield Township Municipal Building, 9 Memorial Drive, Charleroi, Pa. Present where Supervisor Earl Sadler, Supervisor Olga Woodward, Supervisor Wilbur Caldwell, Secretary/Treasurer Karen Talbert, and Assistant Solicitor Thomas P. Agrafiotis. Approval of the Agenda:

Supervisor Sadler moved for the approval of the Agenda. Supervisor Woodward requested an addition to the Agenda, i.e., a request from Mid Mon Valley Transit Authority regarding the adoption of a Resolution certifying provision of local match for state operation for financial assistance payable by July 31, 2012. Supervisor Sadler questioned the price of the match and stated that the request would be handled under New Business. Supervisor Woodward reported that the cost was $598.00 and with this addition to the Agenda moved for the adoption of the Agenda, second by Supervisor Caldwell. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell - yes . Public Discussion of the items to be voted on:

Supervisor Sadler opened a public discussion regarding the items to be voted upon. Johnna Pro - Discussed the problem of the individual who had been target shooting in Latchem Plan; the adoption of Ordinance #206 and the Township's intent with regard to Ordinance #206. Ms. Pro stated that there were many good ideas from the public at the last meeting and questioned why those changes were not made and Ordinance #206 was not being adopted at the meeting with these corrections. Ms. Pro was advised by the Supervisors and Attorney Agrafiotis that it had been discussed at the agenda meeting and that they were going to propose some different alternatives and go from there. Supervisor Caldwell as advised that the Board was looking into what other townships of our size have done regarding this matter and that the Supervisors want to look into it thoroughly in order to do whatever is in the best interest of the Township.

Approval of the Minutes:

Supervisor Sadler requested a Motion be made to approve the Minutes of May 30, 2012. Supervisor Woodward made a Motion to approve the minutes of the May 30th, 2012, meeting, second by Supervisor Sadler. RCV : Supervisor Sadler - yes, Supervisor Woodward- yes, Supervisor Caldwell abstain. Approval of the Bills and Payroll:

Supervisor Caldwell moved for the approval of the payment of the June, 2012, bills and payroll, second by Supervisor Woodward. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes.

Correspondence:

None. Supervisor Caldwell stated that he appreciated the outpouring of sympathy from everyone in the Township in the passing of his mother, and stated that the family appreciated the cards, calls, emails and donations to the Church. Old Business: A. The first order of Old Business was the opening of the bids for the John Deere Tractor and Woods Mower which were as follows :

a. Matt Magarul, 101 Ernest Avenue, Monongahela, PA, bid what appears to be $14.00; however, it is believed that the comma was misplaced and the bid was actually for $1,400.00. b.

Daniel X. Matesich, 121 Dague Road, Brownsville, PA, bid $4,011.00.

c.

Ed Zippay bid $3 ,537.00.

d. William T. and Leslie Ann Rothhaar, 100 Deer Street, Bentleyville, PA bid $4,101.99. Supervisor Caldwell made a motion to accept the highest bid of William T. and Leslie Ann Rothhaar for the purchase of the John Deer Tractor and Woods Mower, second by Supervisor Woodward. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes. B. Ordinance #206 - Supervisor Sadler advised the public that everything is coming together regarding this Ordinance; however, it will be discussed again at the work session on July 16, 2012,@ 6:00p.m. Supervisor Sadler further advised the public that if the Board is able to come up with something satisfactory regarding this Ordinance at the work session, then it will 937





be advertised for the next meeting and will be voted upon. Supervisor Sadler urged all who are interested to attend the work session. Supervisor Sadler moved to table acting on Ordinance #206 at the June 2ih meeting, second by Supervisor Caldwell. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes. C. Resolution #432 - Retention of Specific Public Records. Solicitor Agrafiotis reported regarding the Local Government Records Committee and that they are responsible for making all decisions regarding retaining your records, and on December 16, 2008, the Committee approved the Municipal Records Manual. At the last couple of meetings, discussions were held regarding the Township's desire to follow that version and begin purging the old records that are no longer needed. Resolution 432 declares the Township's desire to follow these schedules and procedures for the records disposal and retention as in the aforementioned manual. Supervisor Woodward moved for the adoption of Resolution #432, second by Supervisor Caldwell. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes. D. Return of Bond to Jack Kruell for the stone bid for 2011-2012 - Supervisor Woodward moved to return the Bond of Jack Kruell for the stone bid for 2011-2012, second by Supervisor Caldwell. RCV: Supervisor Sadler - yes, Supervisor Woodward - yes, Supervisor Caldwell - yes. E. Parks & Recreation - Supervisor Caldwell reported that at the last working meeting, questions were raised regarding insurance papers and personnel clearances for the Recreation Board. Supervisor Caldwell recently met with the Parks and Recreation Board and was provided with the insurance information and clearances which apparently had been put together for the second time. Supervisor Caldwell stated that he had not had a chance to review the documents in detail; however, the packet was provided to the Secretary/Treasurer. Supervisor Caldwell further stated that the Board has never received waivers executed by each of the players at any time in the past, and stated that the leagues carry insurance and he believed that this documentation had also been provided in the packet. Supervisor Caldwell stated that he believed that the documentation provided was sufficient based on the Resolutions/Ordinances that had been passed at previous meetings, which he believed to have been in 2010. Attorney Agrafiotis stated that he thought that each individual player had to provide this information; however, Supervisor Caldwell stated that he believed it was "and/or". Supervisor Caldwell suggested that once the sports season is over, that all parties set down and reevaluate everything and come up with some fair and equitable resolution for all parties.

New Business: A. Extension of 650 feet of Guide Rail on Kennedy Road - Supervisor Sadler reported that we installed 1,000 feet of guide rail on Kennedy Road between Route 481 and going to Alta Vista. He stated that we also need an additional 650 feet of guide rail on Kennedy Road between Route 481 and Crossridge Road. In order to save money we are going to be able to piggy back this additional guide rail with the first bid for guide rail @ a cost of $7,125 .00. Supervisor Caldwell questioned if the guide rail was used and Supervisor Sadler stated that it was used. Supervisor Sadler reported that our Engineer did a study and Morgan Excavating doubled check everything. Attorney Agrafiotis stated that since this was change order, it is acceptable and even 938





if it was something that needed a bid, as per the new bidding regulations, you do not have to get bids unless it is over $10,000.00. Supervisor Caldwell made a motion to purchase the additional 650 feet of guide rail, second by Supervisor Woodward. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes.

B. Adoption of Resolution #433 for lease purchase of the Caterpillar Backhoe: -

Supervisor Sadler reported that in order to finalize the financing of our new Caterpillar backhoe, we need to pass a Leasing Authorization Resolution; therefore, Supervisor Caldwell made a motion to pass Resolution #433 for the lease purchase of the Caterpillar backhoe, second by Supervisor Woodward. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes. C. Appointment of Michael Kresich to the position of Assistant Emergency Management - Supervisor Sadler discussed the importance of Emergency Management within

the Township in the event of a disaster. He reported that plans for Emergency Management have been being worked on over the past year or so. He reported that the Township has been preparing; attempting to build up the Township's equipment; etc. He further reported that: a) The Charleroi Area School District will become the Township's triage center; b) Anthony Fleming is head of the Emergency Management operations. There was some discussion about what exactly the title should be for this position and it was determined that if appointed, Michael Kresich' s title would be that of Assistant Emergency Management Coordinator. Supervisor Sadler stressed the importance of being prepared for any emergency situation. Supervisor Woodward made a motion to appoint Michael Kresich as Assistant Emergency Management Coordinator, second by Supervisor Caldwell. RCV: Supervisor Sadler- yes, Supervisor Woodward- yes, Supervisor Caldwell- yes. D. Resolution #434 - Mid Moo Valley Transit Authority - Supervisor Woodward moved for the adoption of Resolution #434 certifying our local match for state operating financial assistance to the Mid Mon Valley Transit Authority@ the cost of $598.00 which must be paid on or before July 31, 2012. Supervisor Caldwell questioned whether or not the Mid Mon Valley Transit Authority operates within our Township and was advised by Supervisor Woodward that they do operate within the Township. Supervisor Sadler stated that we have provided this assistance to the Mid Mon Valley Transit Authority for many years. The Resolution was seconded by Supervisor Caldwell. RCV: Supervisor Sadler - yes, Supervisor Woodward - yes, Supervisor Caldwell - yes. Other Business: None. Solicitors Report:- Nothing further. Code & Building Report: Not on file for the month of June. Zoning Report: Not on file for month of June. Road Report: Supervisor Sadler reported that the road crew has been cutting weeds on Colvin

Road; Fox Stop Road; Kinder Avenue; Cooper Road; Wisetown Road and also down near the 939

• Road Report: Supervisor Sadler reported that the road crew has been cutting weeds on Colvin Road; Fox Stop Road; Kinder Avenue; Cooper Road; Wisetown Road and also down near the North Charleroi area. Black top as follows: A total of 312 tons - 72 tons on Terrace Drive; 192 tons on Fox Stop Road; 32 tons on Brothers Road and 16 tons on Florence Drive which is not complete. Next we will be going to Dawson then out in the Van Voorhis area. We will then be reviewing everything and looking at how much money we have spent and what else we may be able to do. 312 tons of blacktop at $58.00 per ton is quite a bit of money. We have been trying to do section patching rather than patching holes because if we do put a road up for bid that has been section patched, the paving will be a little bit cheaper because they will not have to put the wearing course down. Supervisor Sadler requested that the pubic be patient because we have had a people off because of vacations, sick and bereavement time. Fire Report:- On file. There were 43 regular calls in May; two vehicle fires; and one life assistance call which overall is an easy month. Animal Control Report: -Nothing on file Public Discussion:

The following persons spoke during the Public Discussion: Mike Kresich - Mike Kresich, who was appointed Assistant Emergency Management Coordinator, provided the public with some personal information about himself, as well as his experience in fire, rescue, and police work. He also provided some information on the Township' s Emergency Management Plan. Gwen Houchins -Road conditions on Brushton Lane and Birch Street. Kevin Povich - Status of paving of Florence Drive; criteria for posting of speed limit signs; speed limit signs posted on Florence Drive by residents and not by township. Missy Stech - Complaint about Animal Control.

Supervisor Woodward made a motion to adjourn the meeting, second by Supervisor Caldwell. Supervisor Sadler reported that the next work session will be held on July 16, 2012; and the next regular meeting is set for July 25, 2012, @ 6:00p.m.
