Equality Act 2010 Statement of Compliance The following statement has been approved in the context of legal requirements placed on the College by the Equality Act 2010. Equality Equality is all about making sure everyone is treated fairly and given the same life opportunities. Historic injustices and inequalities are recognised and action taken to reverse the effects of them. This is supported by legislation to tackle unlawful discrimination (based on the protected characteristics of age, disability, gender, race, religion or belief, gender reassignment and sexual orientation). It is not about treating everyone the same as they may have different needs to achieve the same outcomes. There are also legal requirements for all public bodies, including Colleges, to take positive steps to promote equality of opportunity, ensure non-discrimination, to challenge prejudice and promote positive attitudes to, for example, disability, and where appropriate to undertake positive action. Diversity Diversity is about recognising, respecting and valuing individual differences and raising awareness about them within a human rights and equality framework. Equality and diversity work at Itchen College is the responsibility of all staff and students but it is overseen by Bev Luckman (TTM and Equality & Diversity Lead) and Vanessa Cass (Deputy Principal). The 2010 Equality Act protects students from discrimination and harassment based on ‘protected characteristics’. These protected characteristics are race, disability, gender, age, sexual orientation, religion and belief, gender reassignment and pregnancy and maternity. The categories of people covered by the further and higher education institution provisions are:  Prospective students (in relation to admissions arrangements).  Students at the institution (including those absent or temporarily excluded).  Former students (if there is a continuing relationship based on them having been a student at the institution).  Disabled people who are not students at the institution but who hold or have applied for qualifications conferred by the institution.

Unlawful discrimination is defined in the Act as:  Direct discrimination (including discrimination based on perception or association).  Combined discrimination.  Indirect discrimination.  Discrimination arising from disability.  Failure to make reasonable adjustments (for disabled people).

DEFINITIONS: Race means a person’s:  colour, and/or  nationality (including citizenship), and/or  ethnic or national origin A racial group is composed of people who have or share a colour, nationality or ethic or national origins. A person has the protected characteristic of race if they belong to a particular racial group, such as ‘British people’. Racial groups can comprise two or more racial groups such as ‘British Asians’.

Disability means people with (for example):  Physical or sensory impairments  Mental health difficulties  Long term medical conditions  Learning difficulties  Neuro diverse conditions such as dyslexia, autism, tourettes or ADHD (attention deficit hyperactivity disorder)

Gender refers to the fact that a person is male or female. In relation to a group of people, it refers to either men or women or to either boys or girls. The College celebrates and values the diversity brought to its workforce by individuals, and believes that the College will benefit from engaging staff from a variety of backgrounds, thus allowing it to meet the needs of a diverse student population within society. The College will treat all employees and students with respect and dignity, and seek to provide a positive working and learning environment free from discrimination, harassment or victimisation.

The College will seek not only to eliminate discrimination, but also to create a working and learning environment based on positive relations between all members of the college. To this end, the College undertakes to provide training and support for staff, to consult with staff about their experience of the working environment, and to provide diverse images in any material which it produces for learners and staff. It allows organisations to: provide facilities or services (in training, education or welfare) to meet the special needs of people from particular groups (for example, English language classes); target job training at particular groups that are under-represented in a particular area of work; encourage applications from groups that are under-represented in particular work areas.

4.3 The College undertakes, once the results of monitoring are available, to consider targets to reduce any disadvantage suffered by minority employees and learners. If monitoring reveals that specific minority groups are disadvantaged, some targets may relate to those specific groups. The targets will be published in the updated Single Equality Objectives (updated annually). 4.4 Positive action strategies are intended to be temporary measures only. They must be kept under regular review and can not be used once the special needs have been met or if the underrepresentation no longer exists. The College will ensure that when using positive action as a strategy, it falls within the law. 5

Complaints

6.1

The College will seek to provide a supportive environment for those who make claims of discrimination or harassment.

6.2

Acts of discrimination (direct or indirect), harassment, victimisation or abuse will be treated as a serious disciplinary offence.

6.3

Learners who feel they are being discriminated against by other learners or members of staff should raise the matter through either talking to their tutor or sending a complaint via the IRIS Feedback button. If the accusation is upheld it will be treated as a serious disciplinary offence.

6.4

Staff who feel they are being discriminated against by other members of staff should raise the matter under the Grievance/Harassment Procedure, which will, if the accusation is upheld, be treated as a serious disciplinary offence.

6.5

If, in the course of their work, College staff suffer discrimination from members of the public, the College will take appropriate action and provide appropriate support.

6.6

Any discriminatory behaviour directed against staff by students will be dealt with under the student disciplinary procedure.

Review and Consultation

7.1

This Policy will be reviewed on a regular basis (generally annually), in accordance with legislative developments and the need for good practice by Equality & Diversity Lead, and the Equality & Diversity staff and student groups.

7.2

As part of the review the above will seek and take into account the views of stakeholders including learners; work placement providers, the local consultation/negotiating arrangements within the College, and appropriate equality bodies (i.e. Equalities & Human Rights Commission).

Implementation The College, working in partnership with the recognised trade unions and employee representatives, will seek to ensure that all staffing policies and procedures (e.g. Recruitment and Selection Procedure) are non-discriminatory, and that monitoring and positive action processes are regularly reviewed and monitored. General This Policy should not be read in isolation, but cross-referenced with all relevant College employment and student policies.

Standards 1. Learners’ Achievements.    

The college sets suitable targets for the performance of individuals, groups and courses. Student retention/completion, results and destinations are monitored according to gender, race and ability/disability. If appropriate, action is taken as a result of this. Students’ other achievements are recognised and valued. Primary learning goals are set that are achievable whilst challenging the aspirations of students.

2. Teaching and Learning.      

Teaching and learning are planned effectively to meet the needs of all students. Teachers have appropriate knowledge to enable them to help students with particular needs. Teachers use appropriate methods to meet students’ individual learning needs and promote productive working relations. Teachers promote equality & diversity and the exploration of social, moral and social issues. Instances of prejudice and/or harassment within the classroom are clearly unacceptable and are immediately challenged. Students have suitable access to learning resources and materials to assist their learning.

3. Resources.       

The expertise of technical, administrative and support staff is appropriately and effectively used to support teachers and students. There is appropriate specialist equipment and resources to support teaching and learning. The college makes provision for auxiliary aids and services where these are required by individual students in order to achieve their potential. General facilities to support learning, including the library and IT areas, are of an appropriate quality and readily accessible to students. The college strives to make all areas of the college site as accessible as possible and takes action where areas are not accessible. The college caters effectively for students from particular groups, including those with physical disabilities. Teaching and support staff have suitable work areas and access to appropriate facilities.

Forms of assessment and opportunities for accreditation are appropriate and fair. Issues of equality & diversity are integral to the college’s Quality Assurance cycle. Information regarding enrolment, retention and completion, achievement and destinations is regularly assessed by gender, race and ability/disability. Action is taken, if appropriate. Students receive regular information and feedback (including targets and action plans) to enable them to measure their progress.

Within the context of the College’s mission, the curriculum meets the needs of all students, of employers and of other stakeholders. The curriculum is managed effectively and efficiently and provides continuity and progression for all students. Students have the opportunity to participate in extra-curricular activities. All students are interviewed at enrolment to discuss the appropriateness of their chosen courses. Students will be enrolled on courses which are appropriate for their needs and abilities. The College will aim to ensure that students will not be prevented from participating in any course or study activity/trips due to their background.

Equality & diversity will be a factor in determining the subjects, courses, and specifications offered by the College. 6. Guidance and support for learners.

      

Impartial guidance before and on entry to the College helps students to choose appropriate courses. The induction programme for students contains clear information about the College’s commitment to equality & diversity, and the policies/procedures/general information relevant to this issue. Systems are in place to enable staff to identify students with particular needs quickly. Students receive effective and appropriate support to meet their individual learning needs throughout their studies. Students have relevant support on personal issues. All members of the college are aware of the support available to them – including specialist support – and how to access this support. Impartial, appropriate and effective guidance is available to all students concerning progression from College into higher education/further education/employment.

7. Leadership and management.     

Equality & diversity is promoted and managed effectively throughout the College. Equality & diversity is integral to all decisions made about the College by any and all of its members, including governors. The College’s management structure and its lines of communication and accountability are fair and effective. Staff are provided with suitable opportunities for professional development. Governors fairly and effectively oversee the college’s strategic direction, and regularly monitor the College’s and their own performance.

The appropriate disciplinary action may result in sanctions up to and including expulsion or dismissal from the College.
