An Act to amend certain Acts consequential upon the enactment of the Environmental Management and Pollution Control Act 1994 [Royal Assent 16 December 1996]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: Short title

This Act may be cited as the Environmental Management and Pollution Control (Consequential Amendments) Act 1996. 1.

Commencement

2. This Act is taken to have commenced on the day on which section 105 of the Environmental Management and Pollution Control Act 1994 commenced.

Environment Protection (Sea Dumping) Act 1987 (No. 60 of 1987) 1. Section 3(1) is amended by omitting "Environment Protection Act 1973 other than a police officer or municipal officer referred to in that definition" from the definition of "inspector" and substituting "Environmental Management and Pollution Control Act 1994 other than a police officer or a council officer, within the meaning of that Act". 2. The methods of treatment applied to effluents from a factory for the purposes of subsection (3) are to be methods which do not conflict with the requirements of(5)

any conditions attached to a permit issued in accordance with the Land Use Planning and Approvals Act 1993 that relate to the methods of treatment of effluents from that factory; or

(b)

an environment protection notice issued in accordance with section 44 of the Environmental Management and Pollution Control Act 1994 that relates to the methods of treatment of effluents from that factory.

(5A) Notwithstanding subsection (5), if there is a conflict between the methods of treatment applied to effluents from a factory for the purposes of subsection (3) and the requirements of conditions attached to a permit issued in accordance with the Land Use Planning and Approvals Act 1993 or an environment protection notice issued in accordance with section 44 of the Environmental Management and Pollution Control Act 1994, the requirements of the permit conditions or the environment protection notice prevail.
