She Should Have Seen it Coming...

A Woodland Hills psychic was arrested Saturday on accusations of grand theft. The 28-year-old self-proclaimed psychic, who had an office in her house on Topanga Canyon Blvd., was exposed by a private investigator. Bob Nigard worked with five known victims from San Diego to Los Angeles who accused the woman of stealing thousands of dollars. One victim, who found the psychic on Yelp, was told the psychic was doing “spiritual work” for her at night to cleanse the negativity around her, and in order to achieve happiness she had to make a temporary sacrifice of certain amount of money. The victim said “It was weird. She did know very specific things about me. How could I be so stupid? I went to college...” The signs on Topanga have been taken down now and the psychic was jailed following the investigation by Nigard.

Walnut Acres Eldercare Approved

The eldercare facility planned for 6221 Fallbrook Avenue in Woodland Hills, (at Erwin) was approved by the Zoning Administrator in a Letter of Determination issued January 11. The project from Community Multihousing Inc. is a onestory eldercare facility with 50 guest rooms in approximately 33,500 square feet. It is anticipated from emails and flyers distributed by the group “Preserve Walnut Acres” that an appeal to the South Valley Area Planning Commission regarding this decision will be forthcoming. The property was most recently a preschool, and had gone through the zoning process before opening to get that designation approved.

Assemblyman Matt Dababneh, far right, this week delivered over 450 suits to benefit “Suits for Soldiers.” The national campaign collects donated men’s and women’s suits for veterans transitioning back to the workforce. The campaign was founded by Farmers Insurance to help vets dress for success. “Initially the goal was to collect 45 suits from the residents in the 45th Assembly District, however, due to the incredible amount of support we were able to collect over 450,” said Dababneh. Shown at right with the Assemblyman are Steve Fazio and Nicole Kluft of Fazio Cleaners. “When Assemblyman Dababneh told us about the Suits for Soldiers program we were delighted to provide our cleaning services at no charge to help support veterans who have bravely served our country,” stated Fazio. Battle Between Feds and Sanctuary Cities

Holzer As we all have read, a multitude of local jurisdictions have announced that they are sanctuaries for people residing in the country illegally and have further announced that such jurisdictions will oppose any effort by the federal government to identify and deport such persons. There thus appears to be a potential confrontation on the horizon between the feds and such jurisdictions, as the new Administration has announced it is opposed to such sanctuary policies. So which position has the law on its side? As in many controversial political issues, the answer is not entirely clear. The key statute is 8 USC Section 1324 (“Bringing in and harboring certain aliens”). “The statute makes it a felony for anyone who, “knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated

by” the federal government. Section 1324 subsection (a). It could be argued that sanctuary cities do bring in or attempt to bring in to the United States persons not entitled to be here, because the offer of sanctuary is arguably enough to serve as an inducement for illegal entry. However, it is difficult to envision the Courts forming a consensus that this subsection should apply to sanctuary cities, because the fact that the cities want to protect such persons once here does not necessarily mean the cities have attempted to bring in or have brought the persons into the country in the first place. Subsection (b) makes it a felony for anyone who, “knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law….” Arguably, any jurisdiction that facilitates

movement of people here illegally (e.g., public transportation to jobs) runs afoul of this subsection; but, again, it is not at all clear that the Courts would form a consensus going this far. Subsection (c) will probably emerge as the key weapon in any federal government effort criminally to punish any local jurisdiction that declares itself a sanctuary (or to punish officials in such jurisdiction who implement such a sanctuary policy). Subsection (c) makes it a felony for anyone who, “knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building (Continued to page 18)

“Learning is a lifelong activity,” Dean Wayne Smutz of UCLA Extension told Valley News Group. He should know he comes to UCLA after a long tenure at the OSHER Lifelong Learning Institute at Penn State. “With the changing nature of the economy, more jobs are going to be ‘new’” he continued. “Our job is to offer courses to help people advance in their careers.” Smutz is overseeing the opening of a new UCLA Extension Campus in Warner Center. Located at 21650 Oxnard Street, the location was specifically designed “because of traffic,” Smutz laughed. “L.A. traffic is horrible. People can’t always get to Westwood to take classes. So we brought the classes to the valley.” The demographics of the valley were an important factor as well. The average extension student is 25 to 35 and a young professional. Many of them already have a Bachelor’s or Master’s degree. The wide range of courses, offered in the evenings to accommodate working professionals, includes academically-approved credential programs in engineering, technology, the arts, etc. They are designed to teach information to be directly applied at work, Smutz explained. There is even a course on craft beer, which he loves

A highlight of the time-honored tradition will mark the return of the Mandarin-speaking Megatron who will engage guests in conversation characteristic of his persona as the leader of the Decepticon. “Rogue One” The Force is With You

By Theda Kleinhans Reichman Three decades ago the compelling, enduring franchise known as “Star Wars” burst into our earthly realm from a galaxy far-far away, It began with episodes IV, V and VI which introduced us to Princess Leia (Carrie Fisher), the oh, so handsome Han Solo (Harrison Ford) and Luke Skywalker (Mark Hamill). They were terrorized by Darth Vader (voiced by James Earl Jones), helped by Obi Wan Kenobi and inspired by “The Force” which was always with them. Years later there were the prequels, Episodes I, II and III. This trio of films, however, was not as compelling. Then last year the eagerly awaited “The Force Awakens” arrived on screen. In that film Leia and Han are older, maybe wiser and we find out they have a son who may be leaning to the dark side. After all, his grandfather was Darth Vader. With “Rogue One: A Star Wars Story,” we bounce back

once again in time, a time just prior to the first film “A New Hope” (IV in the first trilogy to hit the big screen). If this sounds confusing, it won’t be for the true “Star Wars” fan. And even if you are seeing a “Star Wars” film for the first time, “Rogue One” will be exciting if you love sci -fi action and adventure. The film begins on an isolated planet where scientist Galen Erso (Mads Mikkelsen) is living with his wife and young daughter Jyn Erso. Their peaceful life is interrupted by the arrival of an Imperial leader (Ben Mendelson) who has come to take the acclaimed scientist and his family back to the Imperial Forces’ headquarters in order to build the Death Star. Prior to his capture Galen’s wife sent their little girl into hiding. Eventually she is found and raised by a rebel extremist (Forest Whitaker). We learn very little about him, only that he cares for the child during her childhood. (Continued to page 12)

Minimally Invasive Sinus Surgery at Calwest

The Cancer Support Community will host a free “Healthy Eating Workshop and Cooking Demonstration” on Tuesday, January 31 at noon. The workshop and cooking demonstration will be led by Pam Braun, LMFT. She will share how her journey with cancer led to her extensive research on food and its relationship to cancer. Braun will focus on what experts now say we should and should not eat to help decrease the chances of cancer and its recurrence. Braun, a former chef and restaurant owner, was diagnosed in 2004 at the age of 52 with late-stage fallopian tube cancer. She was given a 15% chance of survival and a 75% chance of reoccurrence. Her fierce determination to do all she could through her cancer journey, in conjunction with traditional medical treatment, compelled her to begin researching the science of food and its relationship to cancer. Red Cross Sends Urgent Appeal

The American Red Cross has a severe winter blood shortage and is issuing an emergency call for blood and platelet donors to make a donation appointment now and help save patient lives. Even with the best intentions something conveniently comes up on a daily basis to render your workouts nonexistent. Sound familiar? This is a pattern that many of us fall into every year. Start small and realize that in today’s time-crunched society something is always better than nothing. I can’t see how the taxpayers should be responsible to defend people facing federal immigration matters. While the City is posting $2 million the County of Los Angeles is posting $3 million. An additional $5 Million is coming from the private sector. • • • March 7 is another election day in Los Angeles Our Mayor Eric Garcetti is facing an election in March along with half the City Council and the City Attorney and Controller. As far as the contests for Mayor, it is smooth sailing for Garcetti who is facing light opposition and has over $2 Million to spend. Both Mike Feuer, the City Attorney, and Ron Galperin, the City Controller, are both running unopposed. The City Attorney has raised $682,091,42 and the Controller has raised $446,838.88. The City Council Races will be featured in my next article. Student Interpretations of “Water is Life” on Display at LVMWD

A dazzling array of student artworks interpreting the theme, “Water is Life” will be displayed at Las Virgenes Municipal Water District (LVMWD) Headquarters, 4232 Las Virgenes Road in Calabasas, from January 24-31 during regular business hours. Each year thousands of young artists create water conservation messages in a contest sponsored by the Metropolitan Water District of Southern California, of which LVMWD is a member agency. (Continued from page 5) or any means of transportation….” Since sanctuary cities are not hiding the fact that they are protecting people illegally present who are within the jurisdiction’s borders, city officials could argue that they are not “harboring” such people in violation of the statute. The federal Ninth Circuit, however, has in one case rejected this argument. In United States v. Acosta (1976), 531 F. 2d 428, this Court stated, defendant’s “central contention is that the word “harbor” in [section] 1324… means to harbor so as to prevent detection by law enforcement agents and that, therefore, there was insufficient evidence to convict her. We disagree…. [Defendant] argues that the exclusion of employment from the definition of harboring in the statute implies that ‘harbor’ is used in the sense of concealment as part of a smuggling operation, or that if it is not, the exemption of employment is invidious. There may be something unfair about the exemption of employment from harboring-many of the aliens enter this country in search of jobs; the statute allows those who exploit their labor to escape punishment while penalizing persons who, in some instances, may be acting in a neighborly and humane fashion-but it is the kind of unfairness which it is for Congress, not courts, to cure.” However, in a subsequent opinion, United States v. You, (2004) 382 F. 3d 958, the Ninth Circuit approved a lower court’s jury instruction that, where a defendant is charged with the illegal harboring of a person not here legally, the jury must find that the defendant acted “for the purpose of avoiding [the illegals’] detection by immigration authorities.” Other cases around the country are split on whether “harbor” as used in the statute must include an element of concealment. It is not clear, therefore, that any effort by the federal government criminally to prosecute “sanctuary cities” or their officials will meet with success. Given the incendiary politics of the matter, moreover, it also is not clear that the feds would want to test the meaning in the statute of “harbor.” However, this conclusion hardly ends the leverage of the federal government over sanctuary cities. Many, if not all, of such cities rely on federal funds to carry out many functions, ranging from transportation to law enforcement. The Administration can as a discretionary matter likely cut off some or all of such funding, without Court approval. The above-discussed legal situation is why you hear mostly about such funding cutoffs and hear little about federal prosecution of sanctuary cities and their officials. Unless Congress amends the language of Section 1324 to make clear that to “harbor” an illegal violates the Section irrespective of whether the accused has also tried to conceal the illegal, expect the battle over sanctuary cities to remain mainly an issue of federal funding.
