Parking Control Department Standard Operating Procedures Section: 1.1 Subject: Introduction ______________________________________________________________________________ The Parking Control Department has been established for the enforcement of city parking ordinances. This Department will be assigned designated areas within the Unified Government of Wyandotte County/ Kansas City Kansas. This manual will address the operations and functions of the Parking Control Department and will be utilized by personnel assigned to the Parking Control Department. The policies, procedures and guidelines for processing the violation of city parking ordinances are outlined in specific detail and serve to establish a consistent mode of operation. The Division Manager or County Administrator or The County Administrator‟s Designee has the authority to issue, amend and approve any written directive applicable to this manual.

Unified Government of Wyandotte County-Kansas City, Kansas Division 3 Code of Ethics Sec. 2-187. Declaration of policy It is the policy of the unified government that the proper operation of democratic government requires that elected officials, officials and employees be independent, impartial, and responsible to the people; that government decisions and policy be made in proper channels of the government structure; that public office not be used for personal gain; and that the public have confidence in the integrity of government. In recognition of these goals, a code of ethics for all the Unified Government elected officials, officials and employees is adopted. (Ord. No 0-25-98, § 1, 5-21-98) Sec. 2-188. Purpose (a) The chief executive and commission recognize that the representative form of Government is dependent on the trust of the people in their public officials. (b) The citizens of the unified government are dependent on their elected officials, officials and employees to preserve the safety, health, and welfare through the fair and impartial enforcement of laws, imposition of taxes, and expenditures of public funds. (c) Each citizen of the unified government has a right to be assured of impartial and independent judgment from elected, officials and employees. (d) In order to guard against the undue influence or the appearance of improper influence, and ensure public trust in the government, the chief executive and commission adopt this division: (1) To encourage high ethical standards in official conduct by the unified government and employees; (2) To establish guidelines for ethical standards of conduct for all such elected officials, officials and employees by setting forth those acts or actions that are incompatible with the best interests of the Unified Government.

Parking Control Department Standard Operating Procedures Section: 3.1 Subject: Division Manager I.

Division Manager A. Responsible over a group of employees engaged in the enforcement of parking ordinances, school crossing guard activities and securing of cityowned parking lots. This encompasses the parking control officers, parking lot attendants and school crossing guards. Duties include: 1. Is under the supervision of the Public Works Director or his/ her designee. 2. Manages the Parking Control Department. 3. Monitors demand for service. 4. Adjust personnel deployment accordingly. 5. Ensures the adherence to rules, regulations, policies and procedures. 6. Review employee performance and evaluate immediate subordinate supervisors. 7. Investigates complaints on subordinate personnel. 8. Assigns the work and duties of subordinate supervisors. 9. Maintains personnel records on supervisors 10. Assist the Supervisors in the training of new hires. 11. Establishes policies and procedures and offers input. 12. Attends court when properly issued a subpoena for cases related to the performance of duty. 13. Develop and maintain knowledge of all computer systems in the department. 14. Reviews an annual assessment of school crossing zones to determine the need for modifications. This assessment should be completed with

Administrative Support Supervisor A. Responsibilities: 1. Make personnel assignments and insure that personnel are at their assigned areas. 2. Verify parking lot revenues and enter information into the computer. 3.

Assign and regulate parking spaces to employees of the Unified Government according to established guidelines.

4. Direct authority over 8 lot attendants, and assist with the supervision of 37 school crossing guards. 5. Management of records regarding, revenues generated by municipal parking lots, permits issuance records of reserve parking permits, and all daily revenues and hourly permit sales generated by the parking lots. 6. Responsible for payroll preparation, scheduling employees for holidays, vacations, flex, and comp time. 7. Responsible for the daily review of all reports generated by each lot attendant for accuracy and compliance with Department policy. 8. Receive and resolve complaints from the general public. The Division Manager will be kept apprised of all complaints that are received. 9. Responsible for accountability of cash retained in the office for the purpose of securing end of day lot receipts and monies to provide change to Lot Attendants. 1. Maintain sign in sheet for entry into the office safes. 2. Report and document any discrepancies by the end of the following day of business. 10. Complete employee evaluations on all subordinates. 11. Complete all duties assigned by the Division Manager. 12. Maintain training records on all employees. Parking Control Officer II A. Responsible over a group of employees engaged in the enforcement of parking ordinances, school crossing guard activities and securing of cityowned parking lots. This encompasses the parking control officers, parking lot attendants and school crossing guards. Duties include: 1. Make personnel assignments and insure that personnel are at their assigned areas. 2. Assign subordinates to fill in for absent school crossing guards. 3. Receive and resolve complaints from the general public. The Division Manager will be kept apprised of all complaints that are received. 4. Maintain necessary reports such as completing accident, injury, and equipment condition reports. 5. Supervise parking control officers in the field and help resolve situations involving parking control officers that are out of their scope of authority. 6. Parking Control Officer I A. Responsible for patrolling assigned areas for parking ordinances compliance. Duties include: 1. Patrol the area assigned for parking ordinance violations. 2. Patrol any parking lots owned by the City and ensure compliance with monthly parking permits. 3. Monitor how long a particular vehicle is parked in a restricted zone and issue ticket appropriately. 4. Issue citations to vehicles parked illegally in alleys, loading zones, handicap parking, fire lanes or vehicles double parked or parked in reserved spaces, as per city ordinances. 5. Attend court when properly issued a subpoena for cases related to the performance of duty. 6. Perform assignments the supervisor or Division Manager deem necessary. 7. Assume the duties of school crossing guard when vacancies dictate. 8. Relieve lot attendants when necessary. 9. Assume the duties of parking lot attendants when vacancies dictate.

Parking Attendant A. Responsible for providing parking service activities. Duties include: 1. Provide parking directions to public upon entering parking lot/structure. 2. Insure efficient utilization of parking spaces. 3. Collect parking fees from customers and record all transactions on the activity log, according to established guidelines. At no time will money be left in booths overnight or taken home until the next business day. 4. Report equipment malfunctions and failures to immediate supervisor.

Parking Control Department Standard Operating Procedures Section: 3.7 Subject: School Crossing Guard Reference: Kansas Guidelines for School Crossing Guards I.

School Crossing Guard A. Duties include: 1. Responsible for the safe movement of school children across city streets & roadways at their assigned area of responsibility. 2. Control and monitor safe passage of students by use of Department issued, hand held stop sign, when safe to do so. 3. The crossing guard will follow the guidelines established by the Kansas Guidelines for School Crossing Guards. All crossing guards will receive instruction/training regarding the “Kansas Guidelines for School Crossing Guards”. 4. The crossing guard will always direct the children when to cross the street. 5. Crossing guards will always wear the safety vest issued to them while performing their duties. 6. Crossing guards must always be at their assigned areas at the time designated. If the guard is to be late or absent, they must notify the Parking Control Officer II or Administrative Support Supervisor. 7. Provide general assistance to children as needed. 8. Log vehicle identification information on traffic violators and notify supervisors and/or police officers of the incident. 9. Report malfunctioning traffic or warning signals. 10. Report unruly children that effect safety to themselves and/or others. 11. Complete the annual assessment form for each school –crossing zone that they are assigned to. 12. Perform other duties at the discretion of the sergeant or division commander.

Parking Control Department Standard Operating Procedures Section: 4.1 Subject: Assignment of Reserved Parking Spaces I.

Assignment of Reserved Parking Spaces A. All Unified Government employees parking in a U. G. parking lot are required to pay for their respective space. The requirements outlined within this Standard Operating Procedure will be strictly enforced. The best and preferred method of payment for a parking space is through payroll deduction. 1. Those employees that currently have a reserved parking space are entitled to keep their space as long as they pay for that space, when payments is due, and otherwise comply with this policy. All monthly parking fees paid by cash are paid to the U. G. Treasurer‟s Office and are due by the 15th of the month. Any payments received beyond the 15th of the month are considered late. Anyone paying later than the 15th may have their parking privileges revoked and forfeit their space. Revoking of parking spaces will require the approval of the Department supervisor or division manager. 2. Employees that wish to obtain a reserved parking space must apply to the Parking Control Department. Only the Parking Control Department will assign reserved spaces. If there are no reserved spaces available employees will have the option of placing their names on a waiting list. Employees with 10 years of service or more are also afforded the opportunity of having their names placed on the waiting list, should they wish to apply for a “choicer” parking space. 3. The Parking Control Department will assign reserved spaces according to seniority. Seniority of employment will determine where you are placed on the waiting list, from the employee with the most seniority to the least. If at any time, should more than one employee with the same date-of-hire apply; birthdates will be used to determine seniority. If a senior employee should decline an available space and wish to remain on the waiting list, they will be passed over and come back to, when their name comes up again.

4. The waiting lists for the Unified Government lots E-Reserved, D-Reserved and 2-Reserved, shall be accessible for review on the Unified Government webpage, “MYUG” and also posted on the 5th floor outside of the Parking Control Office, Rm. 503.

5. Spaces in Lot F (formerly VIP lot) are designated for certain Unified Government positions and assigned by the City Administrator‟s office. If an employee in one of the designated positions does not wish to use the reserved space, then the City Administrator‟s office will reassign the parking space. 6. Upon assignment of any reserved space, a complete application will be filled out at that time, including license plate numbers of not more than two vehicles, which may be driven by the employee and parked in the reserved space. An access card will be issued for entry to the reserved parking lot, but shall remain the property of the Parking Control Department. Upon separation of employment or the canceling of a reserved parking space for any reason, the access card must be returned to Parking Control or the individual will be charged for its replacement. There is a $30 service fee for replacement of all lost or stolen access cards. 7. No employee shall allow another to park in his/her reserved space in their absence, nor will any parking space be sub-leased. This will be grounds for immediate revocation of reserved parking. 8. Parking Control has the right to reassign parking spaces when deemed necessary by the division manager. 9. Employees must obey all traffic regulations in Unified Government parking lots. 10. All employees must pay to park in Unified Government reserved parking lots, even if they are driving UG-owned “take home” vehicles or driving their own vehicle on UG business. Each permit, including those for reserved spaces, must be paid for at the rate applicable for the lot.

Parking Control Department Standard Operating Procedures Section: 4.2 Subject: Monthly Parking Permits and Cards I.

Assignment of Monthly Permits and Access Cards B. Unified Government employees or businesses that desire to park in U.G. parking lots will be issued either a monthly parking permit or an access card.

C. The employee will have to come, in person, to the Parking Control Department. Once the appropriate paperwork is filed and the fee paid, the permit or card will be issued. If the person desires to have an access card the issuer will pay a deposit according to established fee schedule. The Unified Government is not responsible for lost or stolen permits or access cards. If the person loses their permit/access card, a new one must be purchased. Lost access cards will be disabled. D. The individual that uses the permit will have to enter the parking lot through the gate that dispenses the hourly ticket. The person will also have to show this ticket and their permit when exiting. The parking attendant will write, “Monthly permit” on the back of the ticket. The attendant will also have to write the person‟s monthly permit number on the ticket, as well. If driver does not have the hourly ticket and/or your monthly permit, he/she may be required to pay for a full days parking fee. E. The individual that uses an access card must use the access card entrance and exit of the parking facility it is issued for. If the person has trouble with their card, they will need to bring this to the attention of the attendant or contact Parking Control. Access cardholders will not utilize the entrances or exits that are issued hourly tickets. If access cardholders choose to take a ticket and exit the attendant booth, they may be required to pay for the full days parking rate. The cardholder must enter and exit utilizing the card reader gates. If the cardholder uses an hourly ticket and then exits using his card, the card reader is going to consider this an unlawful transaction and your card could be turned off. The same would apply if you use the card to enter the lot, but then exit by way of the attendant gate. The computer only recognizes a particular card number and the entering of the card and the exiting of the car. Any deviation to this causes the computer to recognize it as an unlawful transaction and the card is shut down. The computer will reset, after 24 hrs, and the access card will become operable again. F. The person will have to apply every month, in advance, for that month‟s parking permit or card. The person can forgo this mandate if he or she has the fee payroll deducted or is invoiced for parking; otherwise payment is due by the 5th working day of every month. Parking Control will request proof of the payroll deduction or of cash payment before the card or permit is issued. Permits are currently picked up either at Parking Control or the UG Treasurer‟s Office. For accountability, access cards will only be picked up at the Parking Control Office. If the employee chooses to have an access card the card will remain active in the computer for as long as the employee provides proof of the payroll deduction. A current monthly parking permit must be displayed by the 5th working day of every month. G. Any person who is issued a monthly parking permit or access card assumes the responsibilities incumbent upon this privilege. These privileges can be suspended or revoked for misuse. Misuse includes but is not limited to: 1. Pass backs – in which the cardholder allows others to use their card to enter the parking lot. 2. Selling or otherwise allowing anyone other than the purchaser to use the permit or access card. 3. Unlawfully copying the permit for use by others or making a facsimile or parking permits for use on UG owned and/or operated parking lots. 4. Late Payment – in which the access cardholder‟s payment is not received by the due date, which is the 15th of the month for invoiced and/or reserved parkers and the 5th working day of the month for month-to-month parkers paying by cash/check. H. It is Parking Control policy not to pro-rate parking fees. Refunds are not issued for partial monthly use. If a patron parks in a Unified Government lot for any portion of a month, they will owe for the entire month. To avoid paying for a full month‟s use, the patron must cancel their monthly parking prior to that month.

Parking Control Department Standard Operating Procedures Section: 4.3 Subject: Collection of Monies I.

Collection of Monies A. The only employees in the department who are allowed to collect money are the parking lot attendants, a designated parking control officer, department supervisors, and division manager. Employees must follow the guidelines specified in regard to the collection of money. Each employee is responsible for their record-keeping and must be able to verify, at anytime, the monies that they have collected. Employees that are found to have stolen money, by any means, are in violation of state and local law. The Unified Government, City of Kansas City, Kansas, will not tolerate any violation of law and will refer cases for criminal prosecution and termination of involved employees. Employees will follow the procedure outlined below: 1) Lot attendants will complete a Parking Attendant Activity Report (Refer to Appendix D). The Activity Report must have the date, attendant‟s name, and lot number and hours filled in. 2) The attendant will need to get a ticket issued from the ticket dispenser at the beginning and ending of their shift. These ticket numbers will be entered on the log under “starting ticket number” and “ending ticket number”. 3) The attendant will log all tickets that bear the authorized validation sticker by entering the ticket number under the validation column of the log. 4) The attendant will log all cash transactions by entering the ticket number under the appropriate fee amount. The attendant may utilize the back page of the log, if needed. The attendant will put the cash collected into the collection moneybag. A separate “change” bag will only be used for the

purpose of making change. Any money collected will only go into the collection moneybag. 5) The attendant will bundle each ticket received by separating them by fee amount or validation. 6) The attendant will total the number of validation tickets received and all columns of cash fees collected at the end of their shift. They will write the total cash amount in each section marked „Totals‟ under the appropriate fee amount column. A fee table has been provided to assist in the calculations. 7) The attendant will total the bundles of each fee amount and verify that the cash tickets received is the same amount of actual cash obtained. Once verified, the attendant will write the total amount collected on the report. The attendant will write the total number of all tickets collected on the report, as well. 8) The attendant will subtract the beginning ticket number from the ending ticket number. This number will be used to total how many tickets were issued. This total will be written on the report. 9) The attendant will then calculate the amount of missing tickets, using the information obtained under the total tickets issued and tickets collected. The attendant will then sign the report and also indicate the date and time the report was completed. This signature attests that during that attendant‟s tour of duty, they collected all money presented to them and that money has been counted and corresponds with the cash tickets received. 10) Designated parking control officer will then count the money in the money collection bag and insure that it is the same amount reflected on the Activity Report. If there is a discrepancy, the money will be counted together again. If the money counted is still not the same amount as written on the report, then a supervisor will be called to respond and assist in the matter. 11) Once the money collected is verified and is found to be correct, the designated Parking Control Officer will sign their name and write the date and time on the report, indicating this. The Parking Control Officer will take control of the money bag and place the Activity Log in the bag. If this is the first shift‟s money, parking control will take it directly to the Wyandotte County Treasurer‟s Office. If there is a discrepancy in the money the treasurer will notify the Administrative Supervisor immediately advising him/her of the discrepancy in the money count.

12) If the money collected by the parking control officer is at the end of the day, when the Treasurer‟s Office is closed, the parking control officer will take the money bag directly to the office. The supervisor will count the money, in the presence of the Parking Control Officer, and the total will be checked to insure it matches what the Activity Report indicates was collected. The report will be placed inside the money bag and the bag will be placed in the safe. At the beginning of the next day‟s business, the supervisor will open the safe and take the money bag to the Treasurer‟s Office. If the supervisor desires to have the Parking Control Officer do this, the money will be counted in front of the parking control officer before they would take custody of it. 13) If the supervisor is not in the office, the parking control officer will fill out a log sheet. The log sheet will have date, time, and amount of drop. The following morning the supervisor counts the amount and verifies it with the parking control officer‟s account. 14) The Activity Report is to stay inside the moneybag, wherever it goes, until the Treasurer‟s Office takes custody of the money. The report would then be turned into the parking control office. The scan net system will provide accurate accountability for comparison and audit.

Radio Procedure A. Refer to General Order 80.6 1. Parking Control Officers as well as the department supervisors have been issued portable radios. The portable radio will be checked out at the beginning of each duty day and will be that officer‟s responsibility until the radio is turned in at the end of their tour of duty. 2. The officer will have their portable radios with them at all times while on duty. The radio will be turned on and at an audible level so that that officer can properly monitor radio traffic. Officers will monitor the radio at all times, including during meal breaks. 3. The frequency of “1” has been assigned to the Parking Control Department. This frequency is shared with the Animal Control Department. Officers will not transmit while another officer is using the air, unless it is an emergency.

Parking Enforcement A. Authority 1. Kansas State Statute 8-2002. Powers of Authority: The provision of this act allows local authorities to reasonably exercise authority in respect to streets and highways. 2. City Ordinance 23-14. Complaints and notices to appear; services: Parking Control officers, among other entities of the Unified Government, are authorized to serve a complaint and notice to appear on accused individuals by personal service, mail or by leaving it at his house or usual place of abode with some person of suitable age and discretion then residing therein. 3. City Ordinance 35-32. Enforcement Officers: Parking meter officers in the department of Parking Control shall concurrently with the police department enforce the provision of this chapter concerning violations for unlawful or prohibited parking. 4. City Ordinance 35-452. Citation on illegally parked vehicles: Whenever any motor vehicle without a driver is found parked, standing or stopped in violation of this chapter, or regulations promulgated pursuant to this chapter, the officer finding such vehicle shall take its registration number and may take any other information displayed on the vehicle which may identify its user and shall conspicuously affix to such vehicle a traffic citation. 5. City Ordinance 35-454. Vicarious responsibility: Every person in whose name a vehicle is registered shall be absolutely responsible for violations

of any ordinances or regulations regulating the stopping, standing, or parking of vehicles. It shall be no defense to such charge that the vehicle was illegally parked by another unless it is shown that at the time of the violation the vehicle had been stolen and had not been returned to the registered owner. B. Patrol Procedures 1. Parking Control Officers will maintain a consistent knowledge of the areas in their district that concern the parking of vehicles and the lots they are to secure. 2. Officers will attempt to patrol each area of their district several times throughout the day. 3. Officers will remain vigilant for suspicious activity, person‟s or circumstances while patrolling their assigned areas and lots. Officers should familiarize themselves with the physical layout of the areas to which they are assigned. 4. Officers will mark tires, when appropriate, and check within a reasonable amount of time, for the vehicle, to insure ordinance compliance. 5. Parking Control does not have powers of arrest as law enforcement officers. Officer will always obey traffic regulations when operating their assigned department vehicles. If, while checking vehicles for compliance, they have to block any part of a driving lane, they will activate the warning lights on top of their department vehicle. If there is any place nearby that they could legally park, they will do so without having to resort to blocking or hampering the normal flow of traffic. They will never operate their department vehicle as an emergency vehicle and are not empowered by ordinance or state statute to do so. 6. Officers will issue citations, when appropriate, and maintain professionalism when doing so. If contact is made with the public during their course of duty, they will be courteous, yet maintain control of the situation. 7. If the public needs assistance or asks a question, officers will render the assistance necessary or direct them to the appropriate agency or person, i.e. a citizen reports to you that a parking meter is broke and that the meter would not accept their money. Officers should check the meter themselves or immediately call their supervisor so that Building and Logistics is made aware of the problem and can fix it. Officers would then need to notify other employees so that citations are not written for vehicles parked at the broken meter. Officers should never tell the public that the maintenance of meters is not their job.

8. Officers will physically check each vehicle in Unified Government parking lots for monthly permits. Citations should be issued to vehicles that are not in compliance. 9. Use of Force A. Non-sworn members of the Department must recognize that they are not law enforcement officers as described in State Statute 22-2401 and therefore are not authorized to make arrests or use force as a law enforcement officer. B. Parking Control Officers and Non-Sworn Supervisors are to disengage if a situation becomes violent. The immediate response is to call for assistance on the radio. The person should then utilize her or his vehicle to exit the area. C. Get as complete a description as possible. Maintain contact with the officers that arrive so that all necessary information is captured for the prosecution of the individual. D. All members of the Department should try to always diffuse any situation where a person has become upset over the enforcement of parking ordinances. Suggestions in diffusing the situation are as follows: 1. Use a polite, unexcited, or reasoning approach whenever possible. 2. Be businesslike and self-assured. 3. Be civil and courteous. 4. Do not display a hard and tough attitude. 5. Maintain control of the situation, yet be able to allow people to vent. E. Reporting unusual occurrences.

1. Officers should complete an Investigative Report whenever they are faced with a citizen who is combative, either physically or verbally. 2. A supervisor must always be contacted immediately if any situation like this arises.

Parking Control Department Standard Operating Procedures Section: 5.1 Subject: Discipline Reference: AFSCME, Human Resource Guide, Civilian Rules and Regulations I.

Discipline A. The Unified Government has the responsibility for maintaining discipline and the efficient and orderly operation of the various divisions and departments. All employees are expected to comply with the Unified Government‟s standard of behavior and performance. Any noncompliance with these standards will result in corrective action. B. The Department is comprised of employee‟s whose job description or position classified either placed them as AFSCME employees or non-AFSCME employees. Employees who are covered by the American Federation of State, County and Municipal Employees Department will consult their Memorandum Agreement manual under Section 11 for questions in regard to discipline. Employees that are non-AFSCME will consult the Unified Government Human Resource Guide under Section 7.1 and 7.2 for questions in regard to discipline. C. The Kansas City, Kansas Police Department Civilian Rules and Regulations and General Orders govern all discipline that is not covered by effected labor contracts or agreements.

II.

Grievance Procedure A. Employees of the Department will refer to their individual guide or contract for information on their procedure for grievances.

Parking Control Department Standard Operating Procedures Section: 5.2 Subject: Daily Attendance and Activity I.

Daily Attendance A. The department supervisor will insure that the daily attendance report is taken to each parking attendant so that they may enter their signature on the report. B. A separate daily attendance report has been made for the school crossing guards. Since it is impractical to go to the numerous crossing guard locations, the department supervisor will mark the hours that the crossing guard actually worked and send this to the timekeeper‟s office. C. The immediate supervisor of each employee shall attest to the employee‟s signature and status by initialing the appropriate area on the daily attendance report.

II.

Daily Activity Log A. The Department Supervisor, Administrative Support Specialist, and Parking Control Officers will complete a daily activity log each working day. The log will be turned in to their supervisor at the end of their shift. B. Employees will log every call or activity that they do during their tour of duty. The employee will write the time the activity or call was initiated, the type of call or activity, the location of the call or activity and the time the call or activity was completed. The employees will also note if a ticket was issued and the ticket number. C. Supervisors will review the activity logs to insure completeness and accuracy. The supervisor will use the information captured on the activity log for statistical documentation. The supervisor should also use this information to insure that employees are utilizing their time effectively.

D. Lot attendants will complete their own activity log that has specifically been designed to meet their needs for the collection of monies. (Refer to Section 4.3) E. School crossing guards will not need to complete a daily activity log. III.

Day off Request Procedure A. No request for days off will be accepted more than sixty days before the day(s) being requested, except where governed by the AFSCME contract. B. Request for days off will be approved no later than 48 hours prior to the beginning of the officer‟s shift on the requested day off but shall in no instance be permitted to detract from providing adequate parking control service. If the requesting officer is not on duty it will be the responsibility of the requesting officer to contact the department for confirmation of denial or approval of the day of request.
