The defendant, in violation of Section 578.012, RSMo, committed the class D felony of animal abuse, punishable upon conviction under Sections 558.011 and 560.011, RSMo, in that on or between April 15, 2012 and May 15, 2012, in the City of St. Louis, State of Missouri, the defendant purposely caused injury or suffering to a male black and white pit bull, and the suffering caused was the result of torture consciously inflicted by the defendant while the animal was alive.

Count 4: Animal Neglect Or Abandonment - 1st Offense (Class C MISDEMEANOR) RSMo 578.009 FROM 3/15/2012 TO 4/15/2012 Place: 53XX Wells (SCC 36530) The defendant, in violation of Section 578.009, RSMo, committed the class C misdemeanor of animal neglect, punishable upon conviction under Sections 558.011 and 578.009, RSMo, in that on or between March 15, 2012 and April 15, 2012, in the City of St. Louis, State of Missouri, the defendant had a male black and white pit bull in his custody or ownership and knowingly failed to provide adequate care for the animal by failing to provide food or water and the dog was defecating in the same area it was living in.

Count 5: Animal Neglect Or Abandonment - 1st Offense (Class C MISDEMEANOR) RSMo 578.009 FROM 3/15/2012 TO 4/15/2012 Place: 53XX Wells (SCC 36530) The defendant, in violation of Section 578.009, RSMo, committed the class C misdemeanor of animal neglect, punishable upon conviction under Sections 558.011 and 578.009, RSMo, in that on or between March 15, 2012 and April 15, 2012, in the City of St. Louis, State of Missouri, the defendant had a black pit bull in his custody or ownership and knowingly failed to provide adequate care for the animal by failing to provide food or water and the dog was defecating in the same area it was living in.

PROBABLE CAUSE STATEMENT DATE: May 22, 2012 I, Douglas McPherson , a law enforcement officer for the City of St. Louis, State of Missouri,, knowing that false statements on this form are punishable by law, state that the facts contained herein are true. 1. I have probable cause to believe that Darick Dashon Stallworth, a Black Male DOB: XX/XX/80 Age: 31, committed one or more criminal offense(s). The facts supporting this belief are as follows: The defendant was seen in possession of a male black and white pit bull and a second black pit bull at 53XX Wells by C.D. C.D. observed both dogs chained in the backyard of the residence. The dogs appeared to be extremely malnourished and had no source of food or water. The dogs were chained in such a way that they were living in their own feces. The dogs were surrounded by flies. The defendant admitted to police that he snapped his dog’s neck. That dog is a male black and white pit bull called “Face.” The defendant told police that he then threw “Face” in the basement of the vacant house at 53XX Wells. “Face” was found by police and Stray Rescue staff on the second floor of 53XX Wells hanging over the windowsill with a cable cord on the floor underneath the dog. “Face” was deceased and had defecated on the floor under the windowsill. Dr. E.F. examined “Face” and determined that he died in that position on the windowsill. “Face” had a crushed larynx believed to be caused by a cable cord. There was a red, brown and white dog found deceased in the basement of 53XX Wells. When this dog was found it had a cord around its neck and the head was nearly severed at that position. The dog was determined to have died from this strangulation. The remains of another dog were also found on the couch of the first floor of 53XX Wells. The dog had a cable cord around its neck. The dog was severely decomposed. The skin on the face had been scraped off. The mechanism for how these two dogs were killed was the same mechanism used to kill “Face.” No other person was known to be in the residence at 53XX Wells during the time frame that these animals were killed. The residence is vacant and C.D has not seen anyone at the residence in over a year. 531335
