Presentation of Salo Park Concert Series

Ms. Marilyn Jenson appeared before Council to present the 2016 Salo Park Summer Concert Series. Ms. Jenson reviewed the background of Salo Park and the Concert Series. The concerts are held at Silver Lake Village and are held on Thursday evenings 7:00 – 8:00 p.m. from June 23 – August 11. The amphitheater is located on 39th Avenue NE between Silver Lake Road and Stinson Boulevard. The schedule is as follows: June 23 – Ecuador Manta June 30 – St. Anthony Civic Orchestra July 7 – Jazz on the Prairie Big Band July 14 – Shoreview Northern Lights Variety Band July 21 – Calhoun Isles Community Band July 28 – 2 Cats Swing Aug 4 – Dennis Warner in Concert Aug 11 – Everett Smithson Band In case of inclement weather, concerts will be held at the St. Anthony Community Center, 3301 Silver Lake Road.

PUBLIC HEARING. A.

Temporary Drawdown of Mirror Lake

Mayor Faust opened the public hearing at 7:09 p.m. City Engineer Todd Hubmer presented a power point on the Mirror Lake Project. Mr. Hubmer reviewed the Lake History & Background Studies, Existing Conditions, Concept Plan Review and Project Benefits, Tree Removal and Replacement, Upcoming Timeline & Process, Rice Creek Watershed District (RCWD) & City Partnership (Cooperative Agreement) including Project Funding. The lake is bordered by St. Anthony and New Brighton and St. Anthony owns the property surrounding the lake. The Mirror Lake Concept Plan includes excavate lake, replace outlet structure, construct flood control berm, and stabilize shoreline. Mr. Hubmer reviewed each portion of the plan in detail. The upcoming project schedule was reviewed. The permit from the Army Corp of Engineers is still pending but expected to be received soon. City Engineer Hubmer stated a public hearing is being held to review the temporary drawdown of Mirror Lake in accordance with Minnesota Statutes 103G.408. Mr. Hubmer reviewed the Mirror Lake improvement project goals, design features, anticipated project schedule, and the temporary normal water elevation drawdown. Ms. Marisa Patron, 3821 Foss, her property backs onto Mirror Lake. She asked what the construction timeline is and whether there will be bulldozers in her backyard. Mayor Faust stated construction will begin on September 15 beginning with the drawdown. Mr. Hubmer stated

excavation will begin when the soil is frozen to be completed by March. The final grade will be done in the spring of 2017. Notices will be sent to residents with the updated schedule. Ms. Deb Larson, 4002 Foss Road, asked how much larger the lake will be. She asked if the park benches and private trees will remain. Mr. Hubmer stated the size will be slightly larger than it is today. The Newstar pipeline work has been completed. Mayor Faust stated by lowering the lake two feet that will allow for more water storage than in the past. Mr. Bill Sauder, 542 Rose Road, New Brighton thanked the City of St. Anthony for dealing with this issue and looking toward the future. Mayor Faust stated he appreciates Mr. Sauder’s comments. The Public Hearing was closed at 7:24 p.m. Mayor Faust asked what standards were used for the 100-year flood. Mr. Hubmer stated the Atlas 14 Standard is being used. That is 7.8 inches of rain in 24 hours. The RCWD adopted this standard as their policy in 2014. V.

GENERAL BUSINESS OF COUNCIL A.

Resolution 16-048 a Resolution Approving Solar Garden Subscription Agreements with United States Solar Corporation and SolarStone Community LLC

City Manager Mark Casey reviewed community solar gardens represent a way for the city of St. Anthony Village to participate in the development of solar energy technology in Minnesota without the direct responsibility of owning and maintaining an on-site solar array. Under this arrangement, the city would “subscribe” to a portion of the energy produced by a solar array that is owned and maintained by a third party. The city would receive credit on its electricity bill from Xcel Energy for the production of solar energy and in turn make subscription payments to the community solar garden developer. The city would not make an upfront payment to fund the construction of a community solar garden. Mr. Amir Nadav, Solar Consultant provided a brief overview of the community solar garden subscription. The city received proposals from three developers that participated in the “Community Solar Subscriber Collaborative” coordinated by the Metropolitan Council. Following direction from the City Council at its May 2 workshop and discussions with the community solar garden developers, staff recommends proceeding with subscriptions for a total of 647,940 kilowatt-hours representing 352 kilowatts of solar garden capacity. These subscriptions amount to approximately one-quarter of the annual electricity use from city government facilities. Mr. Nadav reviewed due to state law and the location of the proposed community solar gardens, only facilities in Hennepin County could be considered for these subscription agreements. Facilities were matched with developers in order to maximize potential cost savings to the city. The size of the subscriptions is based on the annual average electricity use of the selected facilities.

The solar garden should be in place by the end of 2016 or early 2017. The City pays the developer subscription fees and receives from Xcel Energy credits on their bill. The amount of the credit should be more than the subscription fee paid. The bill credit change over the 25-year period of the subscription is unknown. Councilmember Stille asked about the bill credit and would the primary factor in change be the cost of energy and Mr. Nadav stated it is equivalent to the annual rate. Councilmember Stille stated this is prudent financial management. Mayor Faust stated this is the right thing to do in terms of sustainability. Motion by Councilmember Jenson, seconded by Councilmember Brever, to approve Resolution 16-048 a Resolution Approving Solar Garden Subscription Agreements with United States Solar Corporation and SolarStone Community LLC. Motion carried 5-0 B.

Resolution 16-049 a Resolution Authorizing Amended Election Services Agreement with Ramsey County

City Manager Mark Casey reviewed the proposed amended elections agreement. The City originally entered into an agreement with Ramsey County for election services on June 9, 2015. The term of that agreement is due to expire on December 31, 2016. The amended agreement extends the term of the agreement for four additional years with the term expiring December 31, 2020. The terms and conditions remain the same except for the addition of the City’s responsibility for costs of a presidential primary in 2020. Motion by Councilmember Brever, seconded by Councilmember Stille, to approve Resolution 16-049 a Resolution Authorizing Amended Election Services Agreement with Ramsey County. Motion carried 5-0 C.

Ordinance 2016-02 an Ordinance Amending Chapter 32 to add Tree Care Ordinance

City Manager Mark Casey reviewed the ordinance that would establish the Parks Commission as the Tree Board. The Tree Board would be responsible for recommendations to the City Council regarding the comprehensive tree plan for areas within the public right-of-way and City parks. In addition, if requested by the City Council, the Parks Commission (Tree Board) can consider, investigate, and recommend tree care matters as needed. Once adopted the City would be eligible for Tree City USA designation. Motion by Councilmember Stille, seconded by Councilmember Gray, to adopt Ordinance No. 2016 – 02 an Ordinance Adding Section §32.39 TREE CARE. Motion carried 5-0 D.

Ordinance 2016-03 an Ordinance Amending Chapter 112 to Change Hours of Sale on Sundays for Establishments Holding an On-Sale Intoxicating Liquor License

City Manager Casey reviewed the ordinance that would amend Chapter 112 to change hours of sale on Sundays for establishments holding an on-sale intoxicating liquor license. Currently the City of St. Anthony allows for intoxicating liquor or wine to be sold in conjunction with food on Sundays beginning at 10:00 a.m. The ordinance amendment would change the beginning time on Sundays from 10:00 a.m. to 8:00 a.m. Minnesota State Statute 340A.504(3) allows for holders of on-sale intoxicating liquor licenses to sell liquor in conjunction with food beginning at 8:00 a.m. on Sundays. Motion by Councilmember Gray, seconded by Councilmember Brever, to adopt Ordinance No. 2016–03 an Ordinance Amending Chapter 112 to change hours of sale on Sundays for establishments holding an on-sale intoxicating liquor license. Motion carried 5-0 VII.

REPORTS FROM CITY MANAGER AND COUNCIL MEMBERS. City Manager Casey stated recently the City was recognized for GreenStep Four and also from the LMC the Sustainable City Award. Staff was not added for the sustainability efforts. Councilmember Brever stated on May 17 she attended the City Tour and on May 23 she attended the Steering Committee meeting for the Comprehensive Plan. Councilmember Jenson stated on May 11 and May 18 he attended the Kiwanis meetings. He attended the History Committee meeting on May 18. On May 23 he attended the Fire Association Meeting. Councilmember Stille stated he attended the tour on May 17 and on May 23 attended the Planning Commission meeting. Councilmember Gray attended the City tour on May 17. Mayor Faust attended the Stinson Road Re-Construction Project Meeting on May 19th.

VIII. COMMUNITY FORUM. Ms. Mirca, 2501 Lowry Grove, translating for a Lowry Grove resident. She received a letter saying they have 45 days to find $6M to keep Lowry Grove community. She would like the support of the City to help them. The community has found $3M and need to find $3M more and they want support from the Council. Ms. Maria Rosando, she asked the Council for their support. She does not think it is fair to be kicked out of her mobile home. Other family members have also purchased mobile homes within the year and they were not told the park would be sold when they purchased their homes. Others who had been there for many years were aware the park was being sold. They should not have sold homes to people knowing the park was being sold. They have children, veterans and elderly people that do not have places to go. She wants to know yes or no if the Council will support them. Mayor Faust stated they need to follow the state law. They need $6M to purchase the park and have $3M at this time. If they do get the $6M would the Council support them. She asked what the Council would do in their place. Mayor Faust stated the Council does not get involved in private sales. The Council would not be able to take a position on this. Ms. Rosando asked if the Council is aware of the sale of the mobile home park. Mayor Faust stated they have not received notice of the sale or a potential purchaser. Mayor Faust stated the City never enters into any type of business transactions. The government should not be involved in these business transactions. He empathizes with the residents. The owner always has a right to sell. Mayor Faust stated there are renter’s assistance organizations within the State. Owners have the right to sell their property. IX.

27 CITY OF SAINT ANTHONY VILLAGE STATE OF MINNESOTA RESOLUTION 16-050 A RESOLUTION AUTHORIZING HENNEPIN COUNTY ASSESSMENT SERVICES AGREEMENT WHEREAS, the City of St. Anthony has contracted the City’s assessment services through Hennepin County for the Hennepin County portion of St. Anthony; and WHEREAS, the current contract expires on July 31, 2016; and WHEREAS, Hennepin County has provided a four year Assessment Agreement, beginning August 1, 2016 and ending July 31, 2020; and NOW, THEREFORE, BE IT RESOLVED, the City Council authorizes the City of St. Anthony to approve the Hennepin County Assessment Services Agreement. June 3, 2016        Honorable Mayor, City Council and Staff  c/o Mark Casey, City Manager  City of St. Anthony Village  3301 Silver Lake Road NE  St. Anthony, MN  55418    Re:  Resolution Ordering Preparation of the Feasibility Report  2017 Street and Utility Improvement Project    St. Anthony Village, MN    WSB Project No. 02170‐34      Dear Honorable Mayor, City Council, and Staff:    Attached for your consideration is a resolution ordering the preparation of a feasibility report for  the 2017 Street and Utility Improvement Project.    This project proposes the following locations for street and utility reconstruction:     Penrod Lane from 36th Avenue NE to Skycroft Drive   Skycroft Drive from Penrod Lane to Maplewood Drive   Maple Wood Drive from Skycroft Drive to Highcrest Road   Chelmsford Lane from 36th Avenue NE to Maplewood Drive    In addition to the locations described above, the feasibility report will also include options for the  following miscellaneous improvements:     Mill and overlay of Silver Lake Court from Silver Lane to the cul‐de‐sac    These additional improvements are being included with the 2017 feasibility due to the amount of  time and resources that Public Works Staff has been spending on repairing badly deteriorating  pavements at this location. The feasibility will identify a cost and schedule for pavement  improvements at this locations in which the Council may elect to include with the final design of the  2017 plans and specifications.     A map showing the street and utility improvements proposed for 2017 is attached along with a  proposed schedule for your consideration.

WHEREAS,

WHEREAS,

a portion of the cost of the improvements are to be assessed to the benefited properties, pursuant to Minnesota Statutes Chapter 429.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of St. Anthony Village that: The proposed improvement be referred to WSB & Associates, Inc. for study and that they are instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is necessary, cost-effective, and feasible and as to whether it should best be made as proposed or in connection with some other improvement, and the estimated cost of the improvement as recommended.

REQUEST FOR COUNCIL CONSIDERATION Meeting Date: June 14, 2016

Resolution- Requesting an Advance from the Municipal State Aid Street Fund for the Calendar Year 2017.

OVERVIEW: In front of you this evening is a resolution requesting an advance from the Municipal State Aid (MSA) Street Fund for the calendar year 2017. The process for requesting an MSA advance requires a council resolution. The City Engineer will send a cover letter requesting the advance along with the attached resolution to State Aid. Advance requests are reviewed on a first-come-first -serve basis. Distribution of the funds will not be made until 2017. The State Aid finance department will let the City know if the advance is approved. Cities are allowed to request advancement for Municipal State Aid projects costs (or for costs previously incurred). The current request equals four times the City’s annual State Aid construction allotment. The City was recently allocated $263,251 in 2016 for Municipal State Aid projects. Based on the City’s current allotment, the requested advance totals $1,053,004. If the advance is approved from State Aid, annual State Aid reimbursements would not be made during 2018 -2021 as that period of time would have been paid up-front. This advance will maintain the maximum advance of construction reimbursements allowed. Please note that the State account does not bear interest and the State prefers that Cities drawn down their account in connection with MSA expenditures. The advantage for the City is it can invest the proceeds and replenish the funds used for MSA construction expenditures incurred. City Staff is recommending that the Council pass the resolution.

CITY OF ST. ANTHONY VILLAGE RESOLUTION 16-052 A RESOLUTION REQUESTING AN ADVANCE FROM THE MUNICIPAL STATE AID STREET FUND FOR CALENDAR YEAR 2017 FOR THE CITY OF ST. ANTHONY VILLAGE, MINNESOTA WHEREAS,

the City of St. Anthony Village has completed the construction of Municipal State Aid street projects which required State Aid funds in excess of funds available in the City’s State Aid Construction Account, and;

WHEREAS,

the City of St. Anthony Village has completed the construction of said projects and desires to pay future payments for public improvement bonds issued for the construction of said projects through the use of an advance from the Municipal State Aid Street Fund, and;

WHEREAS,

repayment of the funds so advanced will be made in accordance with the provisions of Minnesota Statutes 162.14, Subd. 6 and Minnesota Rules, Chapter 8820.1500, Subp. 10b, and;

WHEREAS,

the City of St. Anthony Village acknowledges advance funds are released on a first-comefirst-served basis and this Resolution does not guarantee the availability of funds.

NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of St. Anthony that the Commissioner of Transportation is hereby being requested to approve this advance for financing of past approved Municipal State Aid street projects which have been constructed in the City of St. Anthony Village and have been paid short in the amount up to $1,053,004 or four times the City’s annual construction allotment. The City of St. Anthony Village authorizes repayments from subsequent accruals to the Municipal State Aid Street Construction Account from future year's allocations until fully repaid.
