Diversity and Inclusion Workshop About the LPM Diversity and Inclusion Workshop The inaugural Diversity and Inclusion Workshop, presented by the American Bar Association’s Law Practice Management Section, will take place at The Drake Hotel in Chicago, Illinois on July 12-13, 2012. This two-day Workshop, designed for law firms of all sizes and geographic scope, will provide practical guidelines for helping to determine the effectiveness of a law firm’s diversity efforts. While employers recognize the theoretical value of diversity and inclusion programs, the efforts often lack practical effectiveness. There is a need to constantly educate ourselves and members of our firms on the importance of diversity and inclusion. People of color, women, people with disabilities, LGBT orientations, and others with traditional differences were (and continue to be) discriminated against. Managing diversity efforts can help close the gap in hiring and lawyer retention. And the legal landscape in this area is ever-changing. Please join your fellow legal professionals for this two-day Workshop dedicated to improving and addressing issues of diversity and inclusion in law firms. The Next IQ: The Next Generation of Intelligence on Diversity & Inclusion in the Legal Profession Speaker: Arin N. Reeves, J.D., Ph.D., President, Nextions, Chicago, IL “Never mistake activity for achievement.” - John Wooden. As the world changes rapidly in this new millennium, we need to update and upgrade our vocabulary and efforts in order to create sustained change in the diversity and inclusion within legal organizations, leaders in our profession and individual attorneys. We have to get away from the models of the past where diversity and inclusion efforts are often measured in terms of activity, but as many of you already know, activity does not always accomplish the results we want to see or the impact we want to make. So, what is the difference between activity and achievement of results? The right incentive (the why) and innovative solutions (the how). Do you know your why? Does your organization know its why? This interactive presentation will explore why “the why” matters and how the “business case” and “right thing to do” are outmoded models that may result in activity but they don’t lead to achievement. In addition to “the why”, this presentation will also explore “the how” questions such as: how can you articulate and communicate the difference between diversity and inclusion? How can organizations and individuals ensure that they are working on inclusion alongside their diversity efforts because each is ineffectual without the other? 10:45am – 12:30pm

Implicit Bias – What Law Firms Need to Know* Speakers: Hon. Bernice Donald, U.S. Court of Appeals for Sixth Circuit, Memphis, TN; Sarah Redfield, Professor of Law, University of New Hampshire School of Law, Durham, NH In 2012, no one would say “We’d like to promote her, but we know she wants to have a family…we’ve tried, and it just doesn’t work out.” No one would say out loud “We better make damn sure there are only whites on the jury or we’ll never get a verdict for our side.” Indeed, most, if not all of us, do not subscribe to these views, and we do not want to believe anything like these sentiments exist in our practices. But a growing body of research suggests – without intent, and often without knowledge – we are influenced by unconscious implicit bias. Being implicitly biased does not necessarily mean we act in explicitly biased ways. The program will explain what implicit bias is and how it may influence all of our decisions. Attendees will learn to recognize some behaviors that may suggest bias or differential treatment. Learn some techniques that will help you and your firm debias perceptions and improve interactions. Attendees will also take the implicit bias association test which will offer them insight into their own biases – everyone has them! The program will also summarize the neuroscience relevant to understanding implicit bias.

Fair Measure: Toward Effective Attorney Evaluations* Speakers: Eileen Letts, Co-Managing Partner, Greene and Letts, Chicago, IL; Patricia Costello Slovak, Partner, Schiff Hardin LLP, Chicago, IL Is your attorney evaluation process really unbiased? Do you need help making it more objective? This program will provide a guide to implement and conduct an evaluation program with unbiased evaluations and will discuss raising evaluators’ consciousness of the various ways that gender bias can impact performance reviews. Sample checklists and evaluation forms will also be discussed. Although the discussion will be generally geared to gender bias in evaluating attorneys, it can be universally applied to other under-represented groups and other professionals. 3:00pm – 4:00pm

Navigating Uncharted Territory: A Law Firm Primer on Management of Lawyers with Mental Health Issues* Speakers: Kathy Flaherty, Senior Staff Attorney, Statewide Legal Services of Connecticut, Inc., Middletown, CT; Howard Fulfrost, Partner, Fagen Friedman & Fulfrost, LLP, Los Angeles, CA; Lisa Razzano, Ph.D., CPRP, Associate Professor of Psychiatry & Deputy Director, Center on Mental Health Services Research & Policy Department of Psychiatry, University of Illinois, Chicago, IL Baby boomers have careers lasting years beyond those of their parents’ generation; and scientific breakthroughs are eliminating mental illness as a barrier to finding success within the legal profession. As a result, law firms are now confronted with issues related to employing and managing attorneys who face new and emerging challenges to their practice of law. This presentation will provide law firms with real-world guidance for balancing: their ethical obligations to clients and the legal profession; the unique needs of this growing segment of the population; the stigma associated with these disabilities within the profession and greater community; and the reluctance of both employers and employees to confront the impact of such disabilities on legal practice. The role that lawyer assistance programs (LAPs) may play in addressing these issues will also be discussed. Attendees will leave this presentation with the information necessary to begin to confront these issues as they arise. Morse, Partner, Jenner & Block, Chair, LGBT Forum, Chicago, IL The panel will present ways in which law firms, corporate legal departments, law schools, and bar associations can promote inclusion of LGBT persons. The panel will provide resources to guide law firms on ways to implement initiatives that demonstrate their promotion and support of attorney and staff involvement in LGBT organizations, including examples of activities and actions.
