ARTICLE II. BUILDING AND RELATED CODES*

DIVISION 1. GENERALLY Sec. 10-31. Violations and penalties. Any person or corporation who shall violate any of the provisions of this article or who shall fail to comply therewith or with any of the requirements thereof or who shall build or alter any building in violation hereof shall, upon conviction, be guilty of a misdemeanor. The owner or owners of any building or premises or part thereof where anything in violation of this article shall be placed or shall exist and any architect, engineer, building contractor, agent, person or corporation employed in connection therewith and who has assisted in the commission of such violation shall, upon conviction, be guilty of a separate offense and shall be fined as hereinbefore provided. Nothing in this article or in the code hereby adopted shall be construed to affect any suit or proceeding now pending in any court or any rights acquired or liability incurred, or any cause or causes of action accrued or existing, under any act or ordinance repealed hereby; nor shall any right or remedy of any character be lost, impaired or affected by this article. In the event that any terms or provisions of this article conflict with the terms or provisions of any other chapter of the Code of Ocean City, Maryland, or conflict with the provisions of any other ordinance now or hereafter in effect, then and in that event, the terms and provisions of the most stringent chapter or ordinance shall be controlling, except for those terms or provisions expressly set forth in chapter 34, Fire Prevention and Protection, which shall prevail over this article II, Building and Related Codes. Sec. 10-34. Severability. The invalidity of any section or provision of this article or of the code hereby adopted shall not invalidate any other sections or provisions thereof. (Code 1972, § 34-8) Sec. 10-35. Repealer. All ordinances or parts of ordinances in force at the time that this article shall take effect and inconsistent herewith are hereby repealed. (Code 1972, § 34-9) Secs. 10-36—10-50. Reserved. DIVISION 2. INTERNATIONAL BUILDING CODE* Sec. 10-51. Adopted. Those certain documents, copies of which are on file in the office of the city clerk, being marked and designated as the International Building Code, 2012 Edition, except for section 105.2, Appendix H section H 101.2 Appendix K, and chapters 27, 28 and 29 thereof, be and it is hereby adopted as the building code of Ocean City, County of Worcester, State of Maryland, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, including permits and penalties, save and except such portions as may herein be deleted, modified or amended, and the same are hereby adopted and incorporated as fully as if set out at length herein, and the provisions thereof shall be controlling in the construction of all buildings and structures within the corporate limits of Ocean City. Sec. 10-52. Amendments. All fire protection and separation requirements shall be in accordance with chapter 34, Fire Prevention and Protection, of the Code of the Town of Ocean City, Maryland, except as follows: (1)

Protection and separation of all structural members in a structure shall be in accordance with chapter 7 of the International Building Code.

(2)

Protection, separation and opening requirements for exterior walls in a structure shall be in accordance with chapter 7 of the International Building Code.

Whenever a detached single-family or double-family (duplex) residential structure is built on a raised platform with parking of vehicles below and under such platforms allowed, the area of such parking shall have a one-hour approved fire-rated ceiling (underside of platform), and all structural supports for said platform shall be protected by a one-hour approved rating.

Information to be displayed on exterior of building. a.

No single-family, duplex or multifamily dwelling, hotel, motel or other business or commercial building may be constructed unless its street address number is conspicuously displayed on the exterior of the building facing the street upon which it is fronted.

b.

No single-family, duplex or multifamily dwelling, hotel, motel or other business or commercial building that has a name, in addition to its street address, may be constructed unless its project name or business name is conspicuously displayed on the exterior of the building facing the street upon which it is fronted.

c.

Any existing single-family, duplex or multifamily dwelling, hotel, motel or other business or commercial building shall conspicuously display its street address number and its project name or business name, if it has one, on the exterior of the building facing the street upon which it is fronted.

Window requirements for all structures shall be in accordance with the International Building Code, except all windows and doors shall have design pressure rating both positive and negative of at least 35 in buildings with a mean roof height equal to or less than 29 feet in height. Any building with a mean roof height of more than 29 feet in height shall be required to have a minimum design pressure rating of at least 45. In addition, all emergency egress or rescue windows from sleeping rooms must have a minimum net clear opening of five and seven-tenths square feet. The minimum net clear opening height dimension shall be 24 inches. The minimum net clear opening width dimension shall be 20 inches, except in accordance with the International Residential Code.

Stair requirements. a.

Stair requirements for all new single-family homes, duplex, and townhouses not more than three stories in height shall be in accordance with the International Residential Code 2012 Edition.

b.

Exterior stair requirements for commercial and multi-family buildings requirements shall be in accordance with the Town of Ocean City Code Chapter 34.

c.

Stairs located within dwelling units of multi-family buildings shall be in accordance with the International Building Code, 2012 Edition.

d.

Means of egress requirements shall be in accordance with Chapter 34 and NFPA 101 Life Safety Code.

(7) Expiration of permits. 105.5 Every permit issued, under this chapter, shall become invalid unless the work on the site authorized by such permit is commenced with 120 days after its issuance, or if the work authorized on the site by such permit is suspended or abandoned for a period of 120 days after the time the work is commenced. Work shall be considered suspended or abandoned if no required building, fire, plumbing or mechanical inspections have been performed for a period of 120 days or if the final building inspection is not completed within three years after permit issuance. The building official is authorized to grant, in writing, a maximum of two extensions of time, for periods not more than 120 days each. The extension shall be requested in writing and justifiable cause demonstrated. Additional time extensions may be granted by the mayor and city council. No extension will be granted unless the site is in a safe and secure condition as determined by the building official and all construction equipment shall be removed from the site until work resumes. Permit fees; determination of valuation. (a) On all buildings, structures or alterations requiring a building permit, as set forth in the International Building Code, current edition, and any amendments or revisions thereto, a fee shall be paid, at the time of obtaining the building permit, in an amount as may be determined by resolution of the Mayor and City Council. (b) The valuation for all buildings, structures or alterations shall be determined by the building official for Ocean City. In order to determine the proper valuation, the building official shall use the current building valuation data, as published, from time to time, by the International Code Council with location factors as published from time to time by RS Means. Any applicant for a building permit who is aggrieved by the valuation determination of the building official may appeal, within 30 days, said determination to the Board of Adjustments and Appeals, which shall conduct a hearing thereon and determine the valuation of said proposed work. In the event that the applicant desires to commence work pending the hearing, the applicant shall pay the amount determined by the building official. Said payment shall be considered "under protest," and the applicant, if successful on appeal, shall be entitled to a refund of the difference in the event that the Board of Adjustments and Appeals determines that the valuation is less than that determined by the building official. Sec. 10-55. Certifications and affidavits. (a) In all cases where the proposed building or structure requires approval from the Planning Commission or the Board of Zoning Appeals prior to the issuance of a building permit, or when the International Building Code, as referenced in section 10-51 of the Code of the Town of Ocean City, requires that a building or structure be designed and sealed by an architect or engineer legally registered under the laws of this state regulating the practice of architecture or engineering, or when the building or structure is located east of Baltimore Avenue, south of 33rd Street or east of Coastal Highway, north of 33rd Street, the building official shall require from the applicant for a building permit the following signed and notarized certification: PRELIMINARY ARCHITECT'S, ENGINEER'S AND OWNER'S CERTIFICATION We, (owner) and (architect or engineer), for the purpose of obtaining a foundation and/or building permit for the project known as (name of project) located at (description of property) hereby certify that, to the best of our knowledge and belief, the drawings dated and itemized herewith presented for Permit No. conform to the standards of the provisions of all applicable codes, laws and ordinances of Ocean City, including, but not limited to, the following: a) chapter 10, article II of the Ocean City Code, including the International Building Code as to egress, type of construction, general arrangement, strength, stress, strains, loads, stability and design; b) chapter 38, article II, regarding flood damage controls; c) chapter 10, article IV, division 2, regarding foundation regulations in critical areas; d) chapter 10, article IV, division 1, regarding foundation requirements in general areas; and e) chapter 110 regarding zoning, including any plans approved by the Planning Commission and Board of Zoning Appeals. 103.2.2. Notice of violation. Whenever the housing official determines that there are reasonable grounds to believe that there has been a violation of any provision of this code or of any rule or regulation adopted pursuant thereto, he shall give notice of such alleged violation to the person or persons responsible therefor, and such alleged violations shall constitute a nuisance. 106.1. Appointment. (a)

There is hereby created by the applicable governing body a board to be known as the "Housing Board of Adjustments and Appeals," which shall consist of not less than three members and one alternate member appointed by the governing body. The members shall be residents of the governed area. Members of the board shall be appointed for three-year terms, except that on the initial appointment, one shall be appointed for one year, one for two years and one for three years. Any one or more members of said board shall be subject to removal or replacement by the appointing authority at any time for cause of stated charges after a public hearing before the appointing authority, and a vacancy on said board shall be filled by the appointing authority for the unexpired term of such vacancy. The members of said board shall serve without compensation.

107. Appeals. Any person receiving written notice from the housing official of deficiencies in his property under this code may, within the last day given to correct the violation or 30 days, whichever shall first occur, following the date of such notice, enter an appeal in writing to the housing Board of Adjustments and Appeals. Such appeal shall state the location of the property, the date of the notice of violations and the number of such notice. The appellant must state the variance or modification requested, the reasons thereof and the hardship or conditions upon which the appeal is made. 108. Violations and penalties. Any person, firm, corporation or agent who shall violate a provision of this code or fail to comply therewith or with any of the requirements thereof, or who shall erect, construct, alter, demolish or move any structure, or has erected, constructed, altered, repaired, moved or demolished a building or structure, in violation of this code shall be guilty of a misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed or continued, and, upon conviction of any such violation, such person shall be punished within the limits and as provided by section 10-31 of the Code of Ocean City. 201.1. Definitions. Dwelling. Any building which is wholly or partly used or intended to be used for living or sleeping by human occupants, whether or not such building is occupied or vacant, provided that temporary housing as hereinafter defined shall not be regarded as a "dwelling." 302.5. Heating facilities. (a)

Every dwelling unit intended for yearround use shall have heating facilities which are properly installed, are maintained in safe and good working condition and are capable of safely and adequately heating all habitable rooms and bathrooms in every dwelling unit located therein to a temperature of at least 70 degrees Fahrenheit at a distance three feet above floor level, under ordinary minimum winter conditions.

302.10 Carbon monoxide detector systems in one and two family dwellings. (a)

Every dwelling unit shall be provided with a listed carbon monoxide detector(s), installed in accordance with the manufacturers recommendations where any of the following conditions exist: 1.

Dwellings where fuel-burning equipment is installed or operated.

2.

Enclosed parking areas located within a dwelling.

3.

Dwellings deemed necessary by the chief building official.

When activated, the detector shall provide an audible alarm that is different from smoke detectors located within the dwelling unit. 303.4. Electric lights and outlets required. Every dwelling shall be wired for electric lights and convenience receptacles. Every habitable room of such dwelling shall contain at least two separate floor or wall-type electric convenience outlets; and every kitchen, bathroom, laundry room, furnace room, corridors or hallways and porches shall contain at least one supplied ceiling or wall-type electric light fixture. Every such outlet and fixture shall be properly installed, shall be maintained in good and safe working condition and shall be connected to the source of electric power in a safe manner. 304. Electrical requirements. Every electrical outlet and fixture required by this code shall be installed, maintained and connected to a source of electric power in accordance with the provision of the electrical code of the authority having jurisdiction and in effect at the time of such installation, maintenance or connection. 305.14. Protective treatment. All exterior surfaces not inherently resistant to decay shall be kept covered with a protective coating (such as paint) applied in a workmanlike fashion sufficient to prevent structural deterioration or decay and to prevent the building from contributing to neighborhood blight. 306.4. Minimum floor area for sleeping purposes. Every room occupied for sleeping purposes by one person shall contain at least 70 square feet of floorspace, and every room occupied for sleeping purposes by more than one person shall contain at least 40 square feet of floorspace for each occupant thereof. 1121. DIVISION 7. PROPERTY MAINTENANCE CODE Sec. 10-141. Adopted; amendments. A certain document one copy of which is on file in the office of the Chief Building Official of the Mayor and City Council of Ocean City, being marked and designated as "The International Property Maintenance Code, 2012 Edition," as published by the International Code Council is hereby adopted as the Property Maintenance Code of the Mayor and City Council of Ocean City, in the State of Maryland; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with the additions, insertions, deletions and changes, as hereinafter set forth: 101.1 Title. These regulations shall be known as the Property Maintenance Code of the Mayor and City Council of Ocean City, hereinafter referred to as "this code." 103.1 General. The Chief Building Official shall be known as the code official. 103.5 Fees. The fees for activities and services performed by the department in carrying out its responsibilities under this code are as, from time to time, adopted by resolution of the Mayor and City Council of Ocean City. 107.5 Deleted. 111.4 Open hearing. All hearings before the board shall be open to the public. The appellant, the appellant's representative, the code official and any person whose interests are affected shall be given an opportunity to be heard. A quorum shall consist of not less than a majority of the board membership. 111.5 Postponed hearing. When a quorum of the board is not present to hear an appeal, either the appellant or the appellant's representative shall have the right to request a postponement of the hearing. 111.6 Board decision. The board shall modify or reverse the decision of the code official only by a concurring vote of a majority of the quorum of appointed board members. 111.61.1 Records and copies. The decision of the board shall be recorded. Copies of the decision shall be furnished to the appellant, interested parties, and to the code official. A copy of the transcript of the hearing will be available to the appellant and interested parties upon request and upon paying the reasonable cost of transcribing and copying same. 111.7 Court review. Any person aggrieved by the decision of the board may appeal said decision to the Circuit Court for Worcester County; provided said appeal is filed no later than 30 days from the date of the board's decision. 304.14 Insect screens. During the period from January 1 to December 31, every door, window and other outside opening required for ventilation of habitable rooms, food preparation areas, food service areas, or any areas where products to be included or utilized in good for

human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch (16 mesh per 25 mm) and every swinging door shall have a self-closing device in good working condition. 404.6 Efficiency unit. Nothing in this section shall prohibit an efficiency living unit from meeting the following requirements: 1.

A unit occupied by not more than two occupants shall have a clear floor area of not less than 250 square feet. A unit occupied by three occupants shall have a clear floor area of not less than 350 square feet. For each additional occupant an additional 100 square feet of clear floor area is required.

2.

The maximum number of occupants shall be determined by the square footage of the unit.

602.3 Heat supply. Every owner and operator of any building who rents, leases or lets one or more dwelling units, rooming units, dormitory or guestroom on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from October 1 to April 30 to maintain a temperature of not less than 65 F. (18 C.) in all habitable rooms, bathrooms, and toilet rooms. Exception: When the outdoor temperature is below the winter outdoor design temperature for the locality, maintenance of the minimum room temperature shall not be required provided that the heating system is operating at its full design capacity. The winter outdoor design temperature for the locality shall be as indicated in Appendix D of the plumbing code. 602.4 Occupiable work spaces. Indoor occupiable work spaces shall be supplied with heat during the period from October 1 to April 30 to maintain a temperature of not less than 65 F. (18 C.) during the period the spaces are occupied. Exceptions: 1.

Processing, storage and operation areas that require cooling or special temperature conditions.

2.

Areas in which persons are primarily engaged in vigorous physical activities.

ARTICLE III. BUILDING COMPONENTS CODES* DIVISION 1. ELECTRICAL CODE Sec. 10-161. Scope. No electrical wiring for light, heat, power or any other purpose shall be installed in any building or structure or for any outdoor electrical displays or signs or in any yard or open air lot, nor shall any major alteration or extension of any existing electrical wiring system be made, except in conformity with the provisions of this article; nor shall any existing electrical wiring system be maintained in defective and unsafe condition within the meaning of the code provided for in this article; and no electric utility company shall connect to any consumer's property within the corporate limits of Ocean City until either the electrical wiring has been inspected and approved pursuant to this article or the consumer has requested immediate connection and has warranted that he will furnish evidence of inspection and approval of such electrical wiring within 30 days; provided, however, that this article shall not apply to emergencies or to federal, state or local government buildings or to electrical wiring and installations in automotive equipment or the installation of equipment employed by an electric or communication utility or a communication transportation system and located outdoors or in buildings used exclusively for that purpose. (a) The Middle Department Inspection Agency, Maryland Electrical Inspections, and any other inspectors from time to time designated by the Mayor and City Council shall, during installation of an electrical wiring system, make or cause inspections to be made to assure compliance with the National Electrical Code. (b) The Middle Department Inspection Agency, Maryland Electrical Inspections, or other inspectors shall, within a reasonable time after notice of the completion of electrical wiring, make or cause to be made an inspection of such work and such tests as may be necessary to determine that it conforms to the provisions of the National Electrical Code, and shall make or cause to be made a reinspection of an electrical wiring installation whenever it deems it necessary in the interest of public safety. (c) For the purpose of making any inspection, test or report necessary for the proper administration and enforcement of this article, the building official or, at his written direction, the Middle Department Inspection Agency, Maryland Electrical Inspections, or other inspectors shall have the authority during reasonable hours to enter in and upon any building or premises, and no person, firm or corporation shall prevent, obstruct or interfere with the performance of any inspection or test made pursuant hereto. (d) The building official shall have the power to stop electrical work when he is notified by the Middle Department Inspection Agency, Maryland Electrical Inspections, or other inspectors that such work being installed does not conform to the National Electrical Code. (e) If any existing electrical wiring system upon inspection is found to be defective and unsafe, upon notification by the building official, the licensee or holder of the permit shall disconnect such system from service until it has been corrected, made to conform to the requirements of the National Electrical Inspections, or other inspectors, provided that, for safety reasons in making any such disconnection, any wiring on the line side of the service-disconnect mains is to be handled by utility company personnel only. (Ord. No. 2009-27, 1-4-2010) Sec. 10-165. Licensing requirements. (a) An electrician's license, issued by Worcester County, Maryland is required to perform electrical work.

Aid, counsel, advise, procure or assist any voter, person or judge to do any act by law forbidden, or in this article constituted an offense; or

(9)

Willfully omit to do any act by this article directed to be done.

(c) Perjury. Any person convicted of willfully and falsely swearing or affirming in taking any oath or affirmation prescribed by or upon any examination provided for in this article shall be guilty of perjury, and shall be punished according to the laws of the state for such offense. (d) Subornation of perjury. Any person who shall willfully and corruptly instigate, advise, induce or procure any person to swear or affirm falsely, as aforesaid, or to offer so to do, shall, upon conviction thereof, be adjudged guilty of subornation of perjury, and shall suffer the punishment directed by law in cases of perjury. (e) Disobedience to election officials. It shall be unlawful for any person to willfully disobey any lawful command of any judge or of any board of registry, given in the execution of his or their duty as such, at any registration or any election. (f) Breach of the peace. It shall be unlawful for any person during any registration of voters or revision thereof, or on the day of any election or during any subsequent canvass, by the judges, to cause any breach of the peace, or be guilty of any disorder, violence or threats of violence whereby any such registration, revision, election or canvass shall be impeded or hindered, or whereby the lawful proceedings of any officer or board of registration, or of any judge or other officer of such election, or challenger or person designated to be present during the reception or canvass of any ballots, are interfered with. (g) Hindering election officials. It shall be unlawful for: (1)

Any person to knowingly or willfully obstruct, hinder or assault, or by bribery, solicitation or otherwise interfere with, any officer of registration, or any judge or challenger or person designated, as provided in this article, to be present at the reception or canvass of any ballots, in the performance of any duty required by him or which he may by law be authorized or permitted to perform;

(2)

Any person by any of the means before mentioned or otherwise unlawfully to, on any day of registration or revision of registration or on the day of any election, hinder or prevent any officer of registration, judge, challenger or person designated as provided in this article to be present at the reception or canvass of ballots in his free attendance and presence at the place of registration or revision of registration, or of election, and designated to serve, or in his full and free access and egress to and from any such place of registration or revision of registration or of election, or to and from any room where such registration, revision of registration or election or canvass of votes or making of any return and certificates thereof may be had; or

(3)

Any person to molest, interfere with, remove or eject from any such place of registration or election, or of canvassing ballots cast thereat or of making returns or

certificates thereof, any such officer of registration, judge, challenger or person designated as provided in this article to watch the reception or canvassing of any ballots except as otherwise provided in this article. (Ord. No. 1996-21, § 43.5, 10-7-1996)

ARTICLE II. ABSENTEE BALLOTING* Sec. 22-31. Authorized. Absentee balloting shall be permitted in all regular and special municipal elections, provided that said absentee balloting is accomplished strictly in accordance with the procedures described in this article. (Code 1972, § 2-1) Sec. 22-32. Application; emergency ballots. The following procedure shall be strictly complied with when absentee ballots are utilized: (1)

Application process. Persons desiring to utilize an absentee ballot shall cause a written request therefor to be received by the Board of Supervisors of Elections of Ocean City, Maryland, c/o the office of the City Clerk, no later than 5:00 p.m. on the Monday before an election. No telephone, verbal or nonwritten applications will be considered. The Board of Supervisors of Elections shall cause an absentee ballot, in the form herein specified, to be handed to or mailed to each qualified applicant for same. All absentee ballots shall be returned to the Board of Supervisors of Elections, c/o the office of the City Clerk, no later than 5:00 p.m. on the Monday before an election.

(2)

Applications generally. The application for an absentee ballot shall be, as before stated, in writing, delivered to or mailed by the United States Mail to the Board of Supervisors of Elections, c/o the City Clerk's office of Ocean City, Maryland, received no later than the above-specified date and time, and it shall contain an appropriate affidavit which shall set forth the following information, upon penalty of perjury: a.

Name of the applicant and residence address of the applicant.

b.

Age of the applicant and date of the applicant's voter registration is known.

c.

A statement by the applicant that he intends to vote by absentee ballot and that he authorizes the voter registration books to be so marked and that he acknowledges that he must utilize the absentee procedure once his application is received.

Emergency absentee ballots. Notwithstanding anything in this section to the contrary, a registered voter may obtain an emergency absentee ballot as follows: a.

After the Tuesday preceding an election and on the day of the election prior to the time the polls close, any person registered and otherwise qualified to vote may apply, through a duly authorized agent, as authorized in subsection (3)d of this section, who appears in person, at the office of the City Clerk, or, on election day, at the polls for an emergency absentee ballot if the voter: 1.

Has a physical disability or is confined in or restricted to an institution which precludes the voter from being present and personally voting at the polls on any election day;

2.

Is unable to be present at the polls on election day because of a death or serious illness in the voter's immediate family; or

3.

Is unable to be present at the polls on election day as result of illness, accident or other emergency.

b.

The application shall be made under penalty of perjury but without formal oath, setting forth the reason why the voter is unable to be present at the polls on the day of election.

c.

Upon receipt of the application, the board, shall issue to the duly authorized agent an absentee ballot, which shall be marked by the voter, placed in a sealed envelope and returned to the board.

d.

The applicant shall designate a voter registered in Ocean City as agent for the purpose of delivering the absentee ballot to the voter, and the agent shall execute an affidavit, under penalty of perjury, that the ballot was delivered to the voter who submitted the application, was marked by the voter in the agent's presence, was placed in a sealed envelope in the agent's presence and was returned, under seal, to the board by the agent.

e.

Any emergency absentee ballot received by the board shall be considered timely if received at or prior to the close of the polls. (Code 1972, § 2-2; Ord. No. 2012-24, 8-20-2012)

Sec. 22-33. Issuance of ballots. The Board of Supervisors of Elections shall maintain a list of absentee voter applications and shall check said applications against the registration books. In the event that an applicant is not registered to vote at the time his application for an absentee ballot is received, his application shall be rejected and discarded. No application shall be considered unless it contains the required information and the proper affidavit. (1)

Applications made by registered voters will immediately be assigned the next consecutively numbered absentee ballot envelope.

(2)

Immediately after the last date for candidates to file, the absentee ballots shall be marked with the appropriate candidates' names and referendum questions, if any.

(3)

The voter registration books will then be marked to show all persons who intend to vote by absentee ballot. Once the voter registration books are so marked, such person must vote by absentee ballot, as herein provided.

(4)

The absentee ballots shall be handed to or mailed by regular United States mail to the address furnished by the applicant on or before the last hour of the normal business day which precedes the municipal election by seven days. Included in the ballot package furnished to the applicant will be, in addition to the ballot, an envelope preaddressed to: Absentee Ballot Board of Supervisors of Elections of Ocean City, Maryland, c/o City Clerk's Office, Town Hall, Ocean City, Maryland. The preaddressed envelope shall have indicated thereon the consecutive number duly assigned to said ballot. (Code 1972, § 2-3) Sec. 22-34. Ballot form. All absentee ballot envelopes shall be consecutively numbered. Absentee ballots shall be in the form prescribed by the Board of Supervisors of Elections and shall be furnished by said board. No other absentee ballot forms or envelopes may be used. (1)

Title. All absentee ballots shall be prominently marked with the name of the respective election and the name of Ocean City.

(2)

Numbering. All absentee ballot envelopes shall be numbered consecutively. The first application received in respect to any election shall be No. 1, the second received shall be given No. 2, etc. A ledger shall be maintained by the board for each election, wherein, after each application is received and the applicant's registration status approved, the said board shall assign the next consecutive ballot envelope number so that at any given time the total number of qualified absentee voters may be determined.

The provisions of this section shall not apply to the following: 1.

Household tools and portable appliances in normal usage.

2.

Lawn care equipment in normal daytime usage if used and maintained in accordance with the manufacturer's specifications.

3.

Motor vehicles on public roads, but this subsection shall not be construed to interfere with any other regulations of said motor vehicles under other Ocean City, state or federal law or regulations.

4.

Aircraft.

5.

Boats.

6.

Operations by, or sanctioned by, the proper authorities (Ocean City, state or federal) for the protection of persons or property where imminent physical trauma or property damage demands immediate action.

7.

Emergency utility operation.

8.

Operations by Ocean City departments.

9.

Nonamplified sound emanating from duly licensed and/or authorized athletic contests, parades and municipally sponsored public celebrations.

10.

Amusement parks and amusement arcades existing on the date of the enactment of this division are exempted, except from 11:59 p.m. of one day until 10:00 a.m. the following day. This division shall apply to amusement parks and amusement arcades between 11:59 p.m. of one day and 10:00 a.m. of the next day.

11.

Mechanical and construction noise as the same is regulated under division 4 of this article.

12.

Any activity causing noise if a variance for such activity and the noise resulting therefrom has been obtained from the environmental health administration of the Maryland department of health and mental hygiene or is being processed pursuant to the rules and regulations of that department. This exemption shall apply only to the extent of any such variance so granted or being processed. (Code 1972, § 67-19) Secs. 30-368—30-380. Reserved. DIVISION 7. RESIDENCES PROVIDING SHELTER TO TRANSIENT OR TEMPORARY POPULATION Subdivision I. In General Sec. 30-381. Legislative findings. (a) Acting pursuant to the powers granted in article XI-E of the Constitution of Maryland, Ann. Code of Md. art. 23A, § 2, and sections C-414 and C-1403 of the Charter (1972 edition, as amended), the Mayor and City Council of Ocean City (Ocean City) has determined to regulate

and control excessive noise within the corporate limits of Ocean City by establishing a permit procedure to ensure that owners of real property situated within the corporate limits of Ocean City and used to provide temporary shelter to Ocean City's transient and temporary population exercise due diligence in controlling noise on or emanating from their property and, in support thereof, adopts by reference the legislative findings and declarations of the general assembly of Maryland as set forth in Ann. Code of Md., Environment article, § 3-102, and makes additional legislative findings as follows: (1)

The health, comfort and well-being of the citizens of Ocean City have been severely and adversely affected for a substantial period of time by excessive noise within the corporate limits of Ocean City.

(2)

The primary cause of this excessive noise is the transient population and temporary residents of Ocean City.

(3)

Each owner of real property situated within the corporate limits of Ocean City and used to provide shelter on a temporary basis to this transient and temporary population has the obligation to control noise on or emanating from that property so that the community will not be injured by the use of that property.

(4)

Any owner who is unwilling or unable to meet this obligation to control noise on or emanating from his property will hereafter not be permitted to use that property to provide shelter on a temporary basis to the transient and temporary population.

(b) It is hereby declared that the provisions of this division constitute a reasonable, necessary and lawful means of eliminating the public nuisance described in subsection (a) of this section. (Code 1972, § 67-26) Sec. 30-382. Violations punishable as misdemeanor. Any violation of section 30-386 of this division shall be punishable as a misdemeanor. (Code 1972, § 67-35) Sec. 30-383. Violations punishable as municipal infraction. (1) It shall be a municipal infraction for the owner of any property for which there must be a permit pursuant to section 30-401 of this division to fail to exercise due diligence, within the meaning of section 30-403, in controlling noise on or emanating from his property, which infraction shall be punishable by a fine not exceeding $1,000.00, with each violation being a separate offense. If the board adjudges that the owner of any such property has failed to exercise due diligence, the board may, in addition to any actions it may take under section 30-403, serve, in any manner permitted by the Maryland rules for service of original process, a citation to the owner, citing the facts supporting the board's conclusion. The board shall retain a copy of the citation, which shall contain: the name and address of the person charged; the nature of the infraction; the location and time(s) of the event(s) that constituted the infraction; the amount of the infraction fine assessed; the manner, location and time in which

the fine may be paid to Ocean City; the person's right to elect to stand trial for the infraction; and the effect of failing to pay the assessed fine or demand a trial within the prescribed time. The fine adjudged by the board is payable by the recipient of the citation of Ocean City within 20 calendar days of receipt of the citation. A person receiving the citation may elect to stand trial for the offense by notifying Ocean City of his intention of standing trial. The notice shall be given at least five days prior to the date of payment of as set forth in the citation. Upon receipt of the notice of the intention to stand trial, Ocean City shall forward to the district court having venue a copy of the citation and the notice from the person who received the citation indicating his intention to stand trial. Upon receipt of the citation, the district court shall schedule the case for trial and notify the defendant of the trial date. All fines, penalties or forfeitures collected by the district court for violations of municipal infractions shall be remitted to the Ocean City government. (2) If a second or greater incident occurs where the property owner fails to exercise due diligence, within the meaning of section 30-403, in controlling noise on or emanating from his property, the property owner is required to appear before the Noise Board. If the property owner is unable to attend the scheduled Noise Board meeting, the property owner must contact the Noise Board meeting and reschedule. If the property owner fails to appear or reschedule, then this will be considered a municipal infraction, which infraction shall be punishable by a fine of $1,000. If the property owner reschedules within 10 days of receipt of formal notice of the fine and appears before the Noise Board, then the fine will be waived. If the property owner reschedules and then fails to appear, the fine will be due. (Code 1972, § 67-30.1; Ord. No. 2012-32, 12-17-2012) State law reference—Penalties for ordinance violations, Ann. Code of Md. art. 23A, § 3. Sec. 30-384. Applicability. The provisions of this division shall apply to any person who owns either a fee simple interest or a leasehold interest redeemable pursuant to the provisions of Ann. Code of Md., Real Property article, § 8-110, in real property situated within the corporate limits of Ocean City, provided that such real property is used for the purpose of providing shelter on a temporary basis. Without in any manner limiting the generality of the foregoing, the provisions of this division shall apply to any person who owns such a fee simple or leasehold interest (herein referred to as the "owner") in any hotel, motel, motor hotel, apartment house, roominghouse, boardinghouse or like facility to the extent that such facility is used to provide shelter on a temporary basis. For purposes of this division, "person" shall include any individual, corporation, business trust, estate, trust, partnership, association, two or more persons having a joint or common interest or any other legal or commercial entity, and "real property" shall be deemed to be used for the purpose of providing shelter on a temporary basis if there exists with respect to such property any lease, contract, agreement or understanding, written or oral, that gives an individual or group of individuals the right or privilege to occupy the property, for any period between May 1 and September 30 of any given year, for the purpose of using the property as a temporary residence, dwelling, refuge or shelter, but not the entire period from May 1 to September 30 of the following year. (Code 1972, § 67-27)

Sec. 30-385. Maximum noise levels; responsibilities of property owner; procedure upon determination of excessive noise level. (a) The maximum allowable noise levels established by regulation of the department of health and mental hygiene of the State of Maryland (the department) as set forth in COMAR 10.20.01 or other noise ordinances set forth in this chapter are hereby adopted as the noise limitations applicable for purposes of this division. Each person to whom this division applies shall exercise due diligence to ensure that these noise levels are not exceeded with respect to any property in which the person owns a fee simple interest or a leasehold interest as described in section 30-384 of this division. (b) Whenever it is determined by a police officer or an official of Ocean City certified by the board to make such determinations that noise on or emanating from any real property situated within the corporate limits of Ocean City exceeds the limitations established in subsection (a) of this section and that such property is subject to the permit requirement established by section 30-401 of this division, the owner or his resident agent (by personal service or by filing in the office of the City Clerk and certified mailing, as the case may be) shall be notified as soon as may be practical, and a report shall be filed with the board indicating the noise level measured or heard, the date and time of measurement or hearing and the names and addresses, if ascertainable of those present on the property at the time the noise level was measured or heard and determined to be excessive; certifying that the owner or his resident agent was notified, together with the date and time of notification; and describing the action, if any, taken by the owner or resident agent to control the noise. Such report shall be signed by the official who made the determination that the applicable noise limitations had been exceeded, maintained as part of the permanent records of the board and made available during regular business hours for public inspection. A copy of such report shall be delivered or sent by certified mail to the owner or his resident agent, and the owner shall have the right to file, within 30 days, a written response to the board, which response shall be maintained as the permanent records of the board. Any determination under this subsection that the noise limitations established by subsection (a) of this section have been exceeded shall be based exclusively on measurements made by an official employee or agent of Ocean City in accordance with the procedures established by the department in COMAR 10.20.01, or by hearing same by an Ocean City police officer. (Code 1972, § 67-33; Ord. No. 2008-5, 3-3-2008) Sec. 30-386. Notification to owners and tenants of noise level standards. Notice of the provisions of this division shall be given in the following manner: (1)

Commencing May 4, 1982, all real estate sales contracts applying to property situated within the corporate limits of Ocean City shall contain the following provision: "All persons who own property in Ocean City, if such property is used to provide houses, apartments or rooms to tenants or guests for periods of one year or less, must obtain a permit from the Noise Control Board. Failure to take prompt action to control excessive noise caused by tenants or guests may result in permit denial."

(2)

Commencing April 1, 2008, all written leases, contracts, and agreements that give individuals or groups of individuals the right or privilege to occupy real property for a period of one year or less for the purpose of using such property as a temporary residence, dwelling, refuge or shelter shall contain the following provisions: "Ocean City has adopted a noise control ordinance that makes it unlawful to cause or permit noise levels which exceed those established by the department of health and mental hygiene of the State of Maryland (COMAR 10.20.01) or other noise ordinances set forth in this chapter. It shall be a violation of this agreement and grounds for eviction under Maryland law if these noise levels are exceeded as a result of activity on this property. Ocean City has other noise ordinances, which are criminal offenses if violated."

(3)

Commencing April 1, 2008, all hotels, motels, motor hotels and other facilities that let room by the day shall advise their guests in writing prior to registration that: a.

Ocean City has adopted a noise control ordinance that makes it unlawful to cause or permit noise levels which exceed those established by the department of health and mental hygiene of the State of Maryland (COMAR 10.20.01), or other noise ordinances set forth in this chapter.

b.

Any guest causing or permitting these noise levels to be exceeded shall be subject to immediate removal or eviction, pursuant to Maryland law.

(4)

Commencing April 1, 2008, all real estate agents shall advise prospective lessees of short term rental property in writing that Ocean City has adopted a noise control ordinance that makes it unlawful to cause or permit noise levels which exceed those established by the department of health and mental hygiene of the State of Maryland (COMAR 10.20.01) or other noise ordinances set forth in this chapter, and that it shall be a violation of this agreement and grounds for eviction under Maryland law if these noise levels are exceeded as a result of activity on this property; and further, that Ocean City has other noise ordinances, which are criminal offenses if violated. Subdivision II. Permit Sec. 30-401. Required. (1) No real property situated within the corporate limits of Ocean City shall be used to provide shelter on a temporary basis unless a permit for such use shall have been issued by the Noise Control Board (the board) and the permit control number shall be conspicuously displayed either on the front door or on a window adjacent to the front door which is clearly visable to a person standing at the front door of said real property, in a manner prescribed and provided by the board.

(2) In a multiple-family dwelling with an entrance to a common lobby area serving each dwelling unit, which has on site personnel 24 hours each day, the permit posting requirement of subsection 30-401(1) hereof can be satisfied by maintaining a book of all rental dwellings, which contains the permit control number for each dwelling unit and which is available for inspection by enforcement personnel, in a manner prescribed and provided by the board.

(3) The City Solicitor is hereby authorized and directed to institute civil proceedings in the circuit court for Worcester County or to request the commencement of any other criminal or civil remedies provided hereunder against any person to whom this division applies for the purpose of enforcing the provisions of this section. In addition thereto, any person required to obtain the aforesaid permit who does not obtain and display same shall not be entitled to obtain a business or occupation license under chapter 14, article II of this Code. Sec. 30-402. Required information; issuance. (a) On or before May 1 for residential rentals or on or before June 1 for business rentals, of each year, there shall be filed with the board with respect to any real property situated within the corporate limits of Ocean City and used for the purpose of providing shelter on a temporary basis the following information, together with a fee established by the Mayor and City Council to cover administrative costs: (1)

Name, permanent address and telephone number of the owner or owners.

(2)

Location and general description of the property.

(3)

If required as part of an approved plan for compliance pursuant to subsection 30-403(b), hereof, the name, address and telephone number of a resident agent, who must reside in the State of Maryland within 30 miles of Ocean City (if there is no owner who maintains a permanent residence in Ocean City). If a resident agent is required but is not provided, any notices provided for hereunder shall be filed in the office of the City Clerk of Ocean City, with a copy thereof mailed (certified mail, return receipt) to the last known address of the property owner.

(b) On or before May 1 for residential rentals or on or before June 1 for business rentals, the board shall issue a permit authorizing any property with respect to which the information required by subsection (a) of this section shall have been timely submitted to be used for the purpose of providing shelter on a temporary basis. § 30-403

Sec. 30-403. Term; renewal; grounds for denial or nonrenewal. (a) A permit issued pursuant to section 30-402 of this division shall be valid until April 30 for residential rentals or May 31 for business rentals of the succeeding year and, upon receipt of the fee established by the Mayor and City Council to cover administrative costs, shall be renewed for successive one-year periods if the following conditions are met to the satisfaction of the board: (1)

The information specified in section 30-402 shall have been revised as necessary and kept current.

(2)

The board shall have determined that the owner of the property with respect to which the permit is issued has exercised due diligence during the preceding year in controlling the noise on or emanating from the property.

(b) If, during the preceding year, the owner of any property for which there must be a permit pursuant to section 30-401 of this division has received two or more notices of violations of the noise limitations set forth in section 30-385 of this division and has failed to take prompt action to control the noise on or emanating from the property following receipt of actual notices of any such violation (including, without limitation, evicting or removing violators), or has allowed the property to be occupied by an individual or group of individuals known to the owner from past experience to have violated the noise limitations set forth in section 30-385 of this division, or has willfully or negligently violated any term or condition of a plan for compliance approved by the board pursuant to section 30-404 of this division, the board may conclude that due diligence has not been exercised. If the board has reason to believe that the owner has failed to exercise due diligence in controlling noise on or emanating from the property, the board shall notify the owner in writing and shall provide him with the opportunity to appear before the board to show cause why the board should not refuse to renew the permit. Notifications of hearings shall be mailed to the resident agent or the property owner, at his last known address, on or before February 1, and any hearings conducted thereon shall be held on or before April 1. Sec. 39-505. Insurance. For the protection of the public and the Mayor and City Council, the operator must obtain, at the operator's own expense, comprehensive automobile liability insurance coverage in at least the amount of $1,000,000.00 per person and $2,000,000.00 per occurrence for bodily injury and $200,000.00 for property damage and comprehensive general liability insurance, with a combined single limit of $2,000,000.00 for both bodily injury and property damage, which shall include product liability insurance in the amount of at least $1,000,000.00. Such insurance coverage shall name the Mayor and City Council as additional insured, and a certificate of insurance evidencing such coverage shall be furnished the Mayor and City Council by the operator and be approved by the City Clerk of Ocean City before the operator engages in the selling of food items from any public ways. (b) The franchise shall immediately be revoked upon the nonpayment of any fee when that fee is due. (c) If the operator fails to keep every condition, term or provision of this article, the franchise may be revoked by the Mayor and City Council. (Code 1972, § 100-4) Sec. 39-507. Prohibited acts. Each of the acts described in this section is prohibited: (1)

For anyone other than the franchise operator to vend prepared food items from public property or public ways within the corporate limits of Ocean City. This subsection shall not be construed to include the convention center property or Northside Park.

For the franchise operator or any of his employees to vend during the hours of 10:00 p.m. to 10:00 a.m. of the following day or to vend from Coastal Highway, Baltimore Avenue, Philadelphia Avenue, Atlantic Avenue (beach and boardwalk) or east of Baltimore Avenue from 27th Street south to the Inlet.

For the franchise operator to utilize more than six vehicles to vend the prepared food products.

official, provided that a request for hearing to the building official be made within 14 days of receipt of such notification. Anyone aggrieved by the decision of the building official may appeal same, within 30 days, in writing, to the Mayor and City Council of Ocean City. (c) Repairs to parking areas shall be performed pursuant to standards for surfacing set forth in section 74-72(a) above. (Code 1972, § 90-23) Sec. 74-74. Waiver of standards. Notwithstanding the provisions of sections 74-72 and 74-73 above, the Mayor and City Council of Ocean City may waive, in writing, said minimum standards in the event of unique topographical characteristics, undue hardship or temporary use of the property after consideration by and recommendation from the Department of Planning and Community Development. $1.50 per hour on Friday, Saturday and Sunday from the Friday after Labor Day through the third Sunday of October, except that said charge shall also be in effect on Thursday before each weekend of Bike Week, Sunfest and Car Cruising, with all other days in said time period without charge.

During the dates parking charges are in effect, the times the charges are effective are as follows: (1)

DIVISION 1. GENERALLY Sec. 74-101. Definitions. As used in this article, the following terms shall have the meanings indicated: City Manager as used in this article shall include his designated representative. Distributor. The person responsible for placing and maintaining a newsrack in a public right-of-way. Newsrack. Any self-service or coin-operated box, container, storage unit or other dispenser installed, used or maintained for the display and sale of newspapers or other news periodicals. Nudity. The showing with less than a fully opaque covering of the genitals, pubic hair, buttocks, natal cleft, perineum, anus or anal region of any person other than a child under the age of puberty or any portion of the breast at or below the areola thereof of any female person other than a child under the age of puberty. Offensive. The work in which the representations appear, taken as a whole, appeals to the prurient interest and patently depicts or portrays the prohibited sexually explicit material in a manner which, taken as a whole, lacks serious literary, artistic, political or scientific value. Parkway. That area between the sidewalks and the curb of any street and, where there is no sidewalk, that area between the edge of the roadway and property line adjacent thereto. "Parkway" shall also include any area within a roadway which is not open to vehicular travel. Pictorial material. Any material suggesting or conveying a visual image and includes, but is not limited to, a photograph, painting or drawing. Roadway. That portion of a street improved, designed or ordinarily used for vehicular travel. Sexually explicit material. Any pictorial material depicting human sexual intercourse, human or animal masturbation, bestiality, oral intercourse, anal intercourse, human-animal intercourse, excretory functions, homosexual acts, direct physical stimulation or touching of unclothed genitals or pubic areas of the human male or female, flagellation or torture by or upon a person in the context of a sexual relationship or sexual stimulation. The material shall be judged without regard to any covering which may be affixed or printed over the material in order to obscure genital areas in a depiction otherwise falling within this definition. Works of art or of anthropological significance are not included with this definition. Sidewalk. Any surface provided for the exclusive use of pedestrians, including Atlantic Avenue (the boardwalk). *Cross reference—Businesses, ch. 14.

§ 74-102

Street. All that area dedicated to public use for public street purposes and shall include, but not be limited to, roadways, parkways, alleys and sidewalks. (Code 1972, §§ 66A-2, 66A-11) Sec. 74-102. Findings; purpose. The Mayor and City Council of Ocean City finds and declares that: (1)

Ocean City is inundated with large masses of people who frequent this seaside resort from May 1 through September 30 each year, that the population can reach 250,000 to 300,000 people and that the pedestrian traffic is overwhelming in particular areas of Ocean City.

(2)

Atlantic Avenue (the boardwalk), Baltimore Avenue from the inlet to 33rd Street and the side streets from the inlet to 33rd Street between the boardwalk and Baltimore Avenue are so inundated by pedestrian traffic from May 1 through September 30 that obstacles placed in those public ways hinder and endanger pedestrian traffic, and to allow obstacles there in addition to fire hydrants, utility poles, etc., which are required for the public safety and welfare, would exacerbate the already overburdened public ways.

(3)

The uncontrolled placement of newsracks in public rights-of-way presents an inconvenience and danger to the safety and welfare of persons using such rights-of-way, including pedestrians, persons entering and leaving vehicles and buildings and persons performing essential utility, traffic control and emergency services.

(4)

Newsracks so located as to cause an inconvenience or danger to persons using public rights-of-way, and unsightly newsracks located therein, constitute public nuisances.

TRAFFIC AND VEHICLES

§ 90-193

Sec. 90-192. Use of bike lane or shoulder by persons operating bicycles or EPAMDs; riding bicycle or EPAMD on roadway. (a) Roadways with bike lane or shoulder paved to smooth surface. Where there is a bike lane paved to a smooth surface or a shoulder paved to a smooth surface, a person operating a bicycle shall use the bike lane or shoulder and may not ride on the roadway, except in the following situations: (1)

When overtaking and passing another bicycle, pedestrian, or other vehicle within the bike lane or shoulder if the overtaking or passing cannot be done safely within the bike lane or shoulder;

(2)

When preparing for a left turn at an intersection or onto an alley, private road, or driveway; or

(3)

When reasonably necessary to leave the bike lane or shoulder to avoid debris or other hazardous condition.

(b) Leaving bike lane. A person operating a bicycle may not leave a bike lane or shoulder until the movement can be made with reasonable safety and then only after giving an appropriate signal. (c) Riding to right side of roadway. Each person operating a bicycle on a roadway shall ride as near to the right side of the roadway as practicable and safe, except when making or attempting to make a left turn, when operating on a one-way street, or when passing a stopped or slower-moving vehicle. (d) It is unlawful for a person to ride an EPAMD on a bike lane, shoulder of road or a roadway, except to cross a roadway at an intersection. (Code 1972, § 30-1.B(1)—(3); Ord. No. 2005-12, 5-16-2005) Sec. 90-193. Operation of bicycles, pushcarts and EPAMDs on boardwalk. (a) Operation of bicycles, pushcarts and EPAMDs on the boardwalk is only permitted, as follows: (1)

From Saturday of Memorial Day weekend through Labor Day, between 2:00 a.m. and 11:00 a.m. of the same day.

(2)

From Tuesday after Labor Day through Friday before Memorial Day at any time subject to the following exceptions: a.

Springfest and Sunfest (Thursday, Friday, Saturday and Sunday) between 2:00 a.m. and 12:00 p.m. of the same day.

(b) Notwithstanding anything to the contrary stated in this section, it shall be unlawful for more than six persons to ride on any bicycle or tricycle or on any self-propelled vehicle with more than two wheels or for any bicycle or tricycle or any self-propelled vehicle capable of containing more than six persons to be operated on the boardwalk at any time.

(c) It shall be unlawful for any nongovernmental motor vehicle, motor-assisted vehicle, bicycle, pushcart, or EPAMDs to be operated on the boardwalk at any time without permission of the Mayor and City Council or its designated agent except during the time set forth in subsection 90-193(a) hereof. (a) If a bicycle is used on a highway at any time when, due to insufficient light or unfavorable atmospheric conditions, persons and vehicles on the highway are not clearly discernible at a distance of 1,000 feet, the bicycle shall be equipped: (1)

On the front, with a lamp that emits a white light visible from a distance of at least 500 feet to the front; and

(2)

On the rear, with a red reflector of a type approved by the administration and visible from all distances from 600 feet to 100 feet to the rear when directly in front of lawful upper beams of headlamps on a motor vehicle.

(b) A bicycle or bicyclist may be equipped with a lamp that emits a red light or a flashing amber light visible from a distance of 500 feet to the rear in addition to the red reflector required by subsection (a) of this section. (Code 1972, § 30-2) State law reference—Similar provisions, Ann. Code of Md., Transportation article, § 21-1207. Sec. 90-195. Operation of skateboards. (a) It shall be unlawful for any person to ride, propel, push or otherwise operate a skateboard on Atlantic Avenue (the Boardwalk) during the following times: (1)

From Saturday of Memorial Day weekend through Labor Day, between the hours of 11:00 a.m. and 2:00 a.m. of the following day.

(2)

Springfest and Sunfest (Thursday, Friday, Saturday and Sunday), between the hours of 12:00 p.m. and 2:00 a.m. of the following day.

(b) It shall be unlawful for any person to ride, propel, push or otherwise operate a skateboard on the sea wall, railings or benches on or adjacent to Atlantic Avenue (the Boardwalk) at any time. (c) Subject to subsection 90-195(a) hereof, it shall be unlawful for any person to ride, propel, push or otherwise operate a skateboard on any other public street, public way, ramp, public alley, public sidewalk, public lots or any other public property (except for public skateboard facilities, and public sponsored or authorized skateboard events) within the corporate limits of Ocean City between April 1 and October 1 of each year. fronting said street. Vending machines shall be placed binding upon and touching a building and may not block any doorway, window, architectural detail, or corner visibility. Grouping of three or more vending machines may be permitted provided they are located within an enclosure meeting the downtown design standards. There shall be no restriction on the number of vending machines that are not visible from a public way. b.

Vending machines shall not be placed closer than three feet from any public right of way except where the existing building will not permit this setback. One existing vending machine per premise located in this setback area before June 1, 2003, shall be permitted. Vending machines shall be placed binding upon and touching a building and may not encroach into the public right-of-way.

c.

These restrictions shall not apply to that portion of any property which fronts upon the east and west sides of Atlantic Avenue (the Boardwalk), except machines shall be placed binding upon and touching a building. Vending machines on east-west side streets of properties that also front the Boardwalk shall be regulated by subsection 110-665(10)a.

(11) Outdoor display of merchandise which is clearly incidental to on-premise use for properties located in the Downtown Overlay and Upper Downtown Overlay Zone Districts in accordance with section 110-885. Bulk regulations are as follows except as otherwise provided in article V, division 2: (1)

DIVISION 16. M MANUFACTURING DISTRICT* Sec. 110-691. Purpose. The purpose of this district is to recognize an existing concrete plant on property immediately north of North Division Street on the bay. (Ord. No. 2002-28, 11-18-2002) Sec. 110-692. Permitted uses. A building or land in the M manufacturing district shall be used only for the following purposes: (1)

Concrete products or central mixing and proportioning plant including the indoor/ outdoor storage of sand, gravel, stone, structural or reinforcing steel, pipe and the like.

Boat docks, piers and anchorages.

(3)

Boat sales, rentals and for hire.

(b) Where parking spaces are required on a rated capacity in persons basis, the department shall determine the rated capacity as the maximum number of persons which may reasonably be accommodated by such use at any one time. (c) "Floor area" and "gross floor area," as used in the requirements of this division, shall be as defined in section 110-2. (d) Except as otherwise provided, the number of employees shall be computed on the basis of the maximum number of persons employed on the premises at one time on an average day or average night, whichever is greater. Seasonal variations in employment may be recognized in determining an average day. (e) Where a fractional space results after tabulating the total number of required spaces, the parking spaces required shall be construed to be the next highest whole number. (f) The use regulations for each district are not affected by their arrangement in this division. (g) The parking requirements in this division are in addition to space for storage of trucks or other vehicles used in connection with any use, or storage space required for waiting at drive-in windows and the like. (h) The parking requirements in this division do not limit other parking requirements contained in the district regulations. (i) The parking requirements in this division do not limit special requirements which may be imposed with regard to large-scale developments, conditional uses or special exceptions. (j) The parking space requirements for a use not specifically listed in this division shall be the same as for a listed use of similar characteristics of parking-demand generation. (k) In the case of mixed uses, or uses with different parking requirements occupying the same building or premises, or in the case of joint use of a building or premises by more than one that one use having the same parking requirements, the parking spaces required shall equal the sum of the requirements of the various uses computer separately, except that in such mixed uses the computation shall not be subject to the base minimum requirement specified in section 110-932(b) above for individual uses; and that the parking requirements for permitted accessory retail and services uses in a hotel, motor or motor lodge containing 50 or more dwelling units may be reduced by the following percentages: (1)

Retail sales, offices and service establishments, 30 percent;

(2)

Restaurants and dining rooms, 50 percent;

(3) Ballrooms, banquet halls, meeting rooms and auditoriums, 70 percent. (Ord. No. 1993-1, § 105-27.3, 1-19-1993; Ord. No. 2013-5, 3-18-2013) Sec. 110-934. Joint use and off-site facilities. (a) All parking spaces required herein shall be located on the same lot or located and maintained not more than 600 feet from the building or use served.

(b) In any case where the required parking spaces are not located on the same lot with the building or use served, or where such spaces are collectively or jointly provided and used, such parking spaces shall be established by a covenant or agreement to be recorded in land records of Worcester County, Maryland, as parking space to be used in conjunction with the principal use and shall be reserved as such through an encumbrance to be valid for the total period the use or uses for which the parking is needed are in existence. A certificate of recording shall be furnished to the department. (Ord. No. 1993-1, § 105-27.4, 1-19-1993) Sec. 110-935. Design standards. (a) Minimum area. For the purpose of these regulations, an off-street parking space is an all-weather surfaced area not within a street or alley and having an area of not less than 180 square feet, exclusive of driveways, and minimum dimensions of nine feet in width and 20 feet in depth, notwithstanding additional requirements for handicapped spaces, and permanently reserved for the temporary storage of one licensed vehicle and connected with a street or alley by a paved driveway which affords ingress and egress for an automobile without requiring another vehicle to be moved. (b) Drainage and maintenance. Off-street parking facilities shall be drained to eliminate standing water and prevent damage to abutting property and/or public streets and alleys and surfaced with erosion-resistant material in accordance with chapter 74 of the Ocean City Code. Off-street parking areas shall be maintained in a clean, orderly and dustfree condition at the expense of the owner or lessee and shall not be used for the sale, repair, or dismantling or servicing of any vehicles. (c) Separation from walkways and streets. Off-street parking spaces shall be separated from walkways, sidewalks, streets or alleys by a wall, fence or curbing or other approved protective device or by distance so that vehicles cannot protrude over publicly owned areas or adjacent lots under separate ownership. (d) Entrances and exits. Location and design of entrances and exits shall be in accordance with applicable Ocean City specifications. (e) Interior drives. Interior drives, except those serving detached single-family dwellings and mobile homes, shall be established and maintained at the following minimum standards to provide adequate circulation and to prevent vehicles from backing into adjoining streets: (1)
