Review of the Risk Analysis of Permitted Hunting Activities in State Forests Executive Summary Recreational hunting in NSW State forests was suspended on 4 July 2013 pending the transfer of hunting management from the Game Council of NSW to the NSW Department of Primary Industries and the outcome of a review of the existing risk assessment conducted in 2009 and the management review of the 2009 risk assessment conducted in 2010. The NSW Government passed legislation to disband the Game Council and transfer licensing, hunter education and compliance to the Department of Primary Industries on 18 October 2013. As part of the process to recommence recreational hunting, a review of the risk analysis reports was undertaken at the MLC Centre, 19 Martin Place Sydney on Tuesday 29 October 2013. The review team comprised of management and work force representatives from the Forestry Corporation of NSW (FCNSW), NSW Department of Primary Industries (NSW DPI), Crown Solicitor’s Office, Australian Worker’s Union (AWU), Crown Lands, National Parks and Wildlife Service (NPWS), Australian Forest Contractors Association and WorkCover NSW. Residual risk ratings were not altered during this process. Several recommendations for improvement were put forward by the review team as part of the risk analysis review: 1. Include target identification, navigation skills & requirements of the written permission system in the hunter education program 2. Develop a process for GPS enabled hunting exclusion zone mapping 3. Develop & implement a hunting activity notification process 4. Review FCNSW Safety Standard - Working in Forests Declared for Hunting 5. Develop & implement a Community Awareness Program for hunting activities in State Forests 6. Develop & implement a safety standard for region or work area specific signage requirements The most significant outcome of this review process was the recommendation to develop a process for GPS enabled hunting exclusion zone mapping. The risk reduction measure should provide greater reliability in comparison to the other nominated administrative risk reduction measures. The draft risk assessment report was distributed for review by all workshop participants. Several minor amendments were identified and made to the initial draft. The amended draft was then circulated and communicated to the FCNSW workforce for consideration in sessions facilitated by FCNSW, AWU and the Public Service Association of NSW (PSA). Several meetings were held between the various stakeholders in order to discuss the development and progress of the recommendations from the initial risk assessment workshop and negotiate agreed outcomes as a result of workforce feedback.

Risk Assessment Report Subsequently, a report-back workshop was held on Monday 16 December 2013 at the MLC Centre, 19 Martin Place Sydney. The team comprised of management and workforce representatives from FCNSW, NSW DPI, AWU, PSA and Crown Lands. The outcomes of this workshop were: 1. Discuss the feedback from the facilitated workforce workshops. Several matters were raised and discussed but no further improvements were considered necessary 2. Final review of the content of the hazard and action registers. Further minor amendments were identified and made to the report 3. Conduct of a review of the risk assessment in approximately 12 months’ time. Inputs to the review would include but not be limited to data from hunting incident investigations, compliance audits and risk control effectiveness evaluations 4. Assuming implementation of all nominated control measures, the team agreed that the risk associated with permitted hunting in NSW Forests is reduced to as low as reasonably practicable. Risk Assessment Report Introduction The purpose of this document is to provide a detailed report of the risk analysis review process undertaken at the MLC Centre, 19 Martin Place Sydney on Tuesday 29 October 2013. The Bow Tie diagram identifies the Hazard (Risk Issue), Event (point in time when the Hazard is ‘released’), Threats (Event Causes), Consequences, Escalation Factors, Barriers (risk controls) and Corrective Actions (recommended actions to further reduce risk) that were nominated by the participants. The diagram has been broken down into segments to enhance readability but can be provided on a larger paper size if requested. The risk analysis review was facilitated by Tony Cartwright of KNJ Consultants, an independent person with demonstrated competency in the risk analysis process and facilitation. The role of the facilitator was to assist the team follow the risk analysis process in accordance with the Australian / New Zealand Standard AS/NZS ISO31000:2009 Risk Management - Principles and Guidelines, International Standard IEC/ISO 31010 Risk Management - Risk Assessment Techniques and to maintain focus on the scope and objectives. This report was prepared by Tony Cartwright of KNJ Consultants. Objectives and Deliverables The primary objectives of this risk analysis were to: -

Review the applicability of the previously nominated risk issue and event, including event causes and consequences associated with the conduct of permitted hunting activities in declared NSW State Forests, Review the efficacy of previously nominated risk treatment measures, Recommend risk treatment measures that will further reduce any residual risk to “As Low As Reasonably Practicable” (ALARP).

The team identified the following deliverables from this risk analysis: -

A consolidated list of recommended actions that will reduce any residual risk to ALARP. A document suitable for review by the risk analysis team and aligned to Australian / New Zealand Standard AS/NZS ISO31000:2009 Risk Management - Principles and Guidelines, International Standard IEC/ISO 31010 Risk Management - Risk Assessment Techniques.

Risk Assessment Report Scope The scope of this process was to review the efficacy of previously nominated risk treatment measures associated with the conduct of any permitted hunting activity that may occur in a declared NSW State Forest. Permitted hunting activities include the use of: -

Registered firearms by licensed users, Bow and arrow, Dog.

The scope did not include any other activity that may occur in a State Forest, including but not limited to: -

Illegal hunting or other activity including cultivation of drugs or unauthorised vehicular or pedestrian access, Recreational activities such as horse riding, motor or mountain bike riding, 4WD, Forestry Corporation of NSW activities such as hazard reduction burning, harvesting, plantation, inspections, road construction, quarrying, etc., Other approved activities such as grazing, etc.

Strategic Context Recreational hunting in NSW State forests was suspended on 4 July 2013 pending the transfer of hunting management from the Game Council of NSW to the NSW Department of Primary Industries and the outcome of a review of the existing risk assessment conducted in 2009 and the management review of the 2009 risk assessment conducted in 2010 Prior to 4 July 2013, conservation hunting was permitted in Declared Forests in the State of NSW by licensed, accredited hunters to assist in the reduction in numbers and impact of feral animals including pigs, goats, foxes, rabbits, deer, hare, wild dogs (not dingoes), and cats. These activities occurred concurrently with a wide range of forestry and recreational activities and permitted activities associated with primary production e.g. grazing. Organisational Context The aim of this risk analysis is to provide the basis of a comprehensive management system to allow permitted hunting and other forest use, in particular Forestry Corporation of NSW activities, to safely co-exist. Risk Analysis Context, Process & Methodology The risk analysis process used was consistent with the framework detailed in Australian / New Zealand Standard AS/NZS ISO31000:2009 Risk Management - Principles and Guidelines, International Standard IEC/ISO 31010 Risk Management - Risk Assessment Techniques. The risk analysis review process involved a cross-disciplined team that included key Forestry Corporation of NSW and Game Council NSW representatives. Assumptions Nil

Ongoing Work, Monitor & Review Nominated Coordinator KNJ Consultants recommend that Forestry Corporation of NSW nominate a person to: -

Determine the target dates for completion of the corrective actions and monitor these to ensure there is close out of each action. Organise formal stakeholder review meetings following receipt of this report, Document the stakeholder review decisions, Communicate the risk analysis findings to all staff and contractors.

Implementation Review Plan It is critical that the risk treatment measures and actions are appropriately managed. The recommendation of the risk analysis review team was that: -

Outcomes of the risk analysis are verified and validated throughout implementation; Corrective actions would be appropriately resourced and implemented.

It is critical that all risk treatment measured (existing and proposed) are reviewed to ensure they are implemented and to detect any changes that may require the controls to be modified. This implementation review will be conducted by the Forestry Corporation of NSW or NSW Department of Primary Industries. Communication and Consultation Communication and consultation form an integral part of the risk management process. It is assumed that this report will be shared with all participants involved in the process and other stakeholders as appropriate during the implementation process of the corrective actions. An online e learning module for outdoor navigation and knowledge of Written permission conditions will be developed and hosted on the current online booking system. Hunters will not be able to book a hunt until they have successfully completed both modules. The Outdoor Navigation module is split into 3 sections. Each section has a bank of 10 questions associated with it. Candidates will be randomly allocated 4 questions from each section and they must answer 3 of the 4 correctly for each section to pass. A question on reporting a grid reference from a map will be compulsory for all candidates. The Written Permission module has one section and the assessment will comprise a bank of 10 questions. Candidates will be allocated 4 questions randomly from the bank and will need to answer 3 correctly to pass.

To ensure compliance with the new mandatory provision for the carriage of a GPS enabled device, a section detailing the new provision has been added to the general conditions of the Written Permission issued to each hunter before they can access a State forest. A range of GPS compatible hunting map data (including details of hunting exclusion zones) will be made available to hunters via the DPI online booking system. When booking a hunt online it will now be mandatory to obtain the GPS map data for the forests intended for hunting, just as it is mandatory for the hunter to print and sign the Written Permission. Detailed information on how to obtain and install GPS hunting map data will be provided on the DPI Biosecurity webpage. An education module with details on how to use a GPS, along with other navigational tools has also been developed as part of the recommendations from the 2013 Risk Assessment for hunting on State forests.

Requirement covered in the Operational Manual for Recreational Hunting on State Forests Nominated FCNSW officers will have administration access to the DPI NSW web portal to confirm bookings by registered hunters on State forests of their choice. The onus will be on FCNSW officers to monitor the commitment of hunters to State forest at any given time. The viewing of hunting commitment for individual State forests may be a daily routine check for FCNSW staff. Importantly, there is a 1 full day buffer period on booking hunts, meaning that hunters must allow at least 1 full day to pass between booking a forest and commencing hunting in that forest.
