SUBJECT: UNCLAIMED MONIES SEIZED INCIDENTAL TO ARREST TRUST FUND Dear Honorable Members: On January 1, 2012, the Los Angeles Police Department (LAPD) requested an escheatment of$415, 194.07 from their "Unclaimed Monies Seized Incidental to Arrest Trust Fund" No. 7772 (UMSIATF) to the City General Fund. This money has remained unclaimed for three years and therefore is eligible for transfer in accordance with Ordinance No. 159509, the notification requirements of the Ci'ty of Los Angeles Administrative Code, and current state law. LAPD has since reported that a claim in the amount of$78.00 has been processed, which reduces the monies available to escheat to $415,116.07.
BACKGROUND The State of California Government Code Section 50050-50055 provides that any money remaining unclaimed in the City Treasury for three years or more may become the prope1ty ofthe City after publication of a notice, provided that within the specified period oftime, no verified complaint seeking to recover all or a designated part of the money is filed in a court of competent jurisdiction. Fmther, Sections 11.33-11.35 of the Los Angeles Adminislrative Code allow the legislative body to transfer these monies to the City's General Fund. Attached herewith is LAPD's request to escheat monies from Fund No. 7772 dated January 11,2011, the Office ofthe City Clerk's proofofpublication advertisements dated February 2, 2012 and the subsequent notice and publications executed on February 9, 2012. These notices stated that on March 27,2012, funds seized from September 17, 1983 to January 2, 2009 would become property of the City. As of the respective aforementioned dates, one claim in the amount of $78.00 was processed, thereby reducing the amount available to escheat to $415,116.07. Per the City Council's instructions (CF No. 04-2206-S 1), the Office of Finance has reviewed the claim's escheatmcnt eligibility and publication notices.

RECOMMENDED ACTION In accordance with the authority of the State Goverrunent Code and City of Los Angeles Administrative Code, it is recommended that City Council, subject to the approval of the Mayor, should: 1. INSTRUCT the Los Angeles Police Department and the City Treasurer to process the sum of $415,116.07 from the Unclaimed Monies Seized Incidental to Arrest Trust Fund No. 7772 (UMSIATF); and 2. INSTRUCT the Controller to TRANSFER all identified eligible monies to the General Fund, Fund No. 100, Department 70, Revenue Source Code 4334.
