MAYOR’S MINUTE By Bernie Frieden On Monday, May 16, 2016, the community of Fairfax once again expanded. The new annexation area includes approximately 700 acres to the north of Highway 151, west of 80th Street to Morgan Creek Road. If you drive north of the City on 80th Street you will see that “Phase 1” of the project has begun. This is a project the City of Fairfax has been working on for about two years. It took a lot of work by city staff, the city engineers, the city attorney, former Mayor Jason Rabe, former and present City Council members, and myself to move this major project forward. The project will continue the theme Fairfax is currently offering. Family friendly, high quality housing. A number of family friendly features are planned in the new addition as well. A 20 acre pond, parks and recreation, a walking/biking trail that will eventually connect this addition with the existing trail system Fairfax has already developed, including a nature trail along “No Name Creek.” There will also be commercial lots available along 80th Street for businesses who would like to be located in our community. I believe this and future expansion in this area will become a great asset to the City of Fairfax. As your current Mayor, I would like to personally thank everyone who worked on this annexation to bring it to completion. NOTICE OF PROPOSED PUBLIC HEARING ON LEASE IN A PRINCIPAL AMOUNT NOT TO EXCEED $350,000 (GENERAL OBLIGATION CITY HALL LEASE) The City Council of the City of Fairfax, Iowa, will meet on the 14th day of June, 2016, at 525 Vanderbilt Street, in the City, at 6:00 o’clock p.m., for the purpose of holding a public hearing and taking action to enter into a lease with Guaranty Bank & Trust Company of certain property located at 300 – 80th Street Court, Fairfax (the “Lease”) in a principal amount not to exceed $350,000, pursuant to the provisions of Section 364.4 of the Code of Iowa, for use as City Hall. The Lease will constitute a general obligation of the City and is proposed to be entered into pursuant to authority contained in Section 364.4 of the Code of Iowa. All payments under the Lease will be subject to annual appropriation. At that time and place, oral or written objections may be filed or made to the proposal to enter into the Lease. After receiving objections, the City may determine to enter into the Lease, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter. 2016 USA DAYS FIREWORKS Fairfax - June 25 – 9:30pm Once again the fire department is gearing up for the annual USA Days Fireworks display. A lot of work is done year round in getting ready for this show, this includes planning the show, ordering the fireworks, working on the equipment, and having firefighters take the required training classes to help put on the show. All of this comes together in an amazing fireworks display that is paid for 100% by donations to the fire department marked specifically for fireworks. If you enjoyed the show in the past and would like to help donate to future shows, it is easy to make a donation: stop by city hall any time during the year and drop off a check marked fireworks donation. You can swing by our fire department during the fireman’s picnic and drop a donation in the bucket. We will have firefighters carrying fireworks donation boots during the parade. They will be also walking around neighborhoods and parking areas prior to fireworks with the donation boot. We wouldn’t be able to put on such a successful event without the help and support of our great community. Thanks for your support. The fireworks display will be from the middle of the field, south of Linn Street at 9:30pm.

SWIMMING POOL SAFETY Do you have a swimming pool in your yard? Are you planning on installing a pool? If so, please be sure to review the following information. We want to make sure safety is the first concern when discussing swimming pools. That way, everyone can enjoy a cool dip. Here is an overview of some of the regulations and pool issues:  A pool permit is required to install a swimming pool in Fairfax. A swimming pool is defined in the building code as a pool 24 inches or deeper.  The city clerk’s office has a packet of information to review about pool requirements.  Pools deeper than 24 inches need some sort of barrier installed. The top of the barrier is required to be 48 inches from the ground.  These regulations apply to all types of pools deeper than 24 inches, including in-ground, on the ground, inflatables, hot tubs, spas, ponds, and other standing bodies of water.  You should always check with your homeowner’s insurance about their requirements.

If you have a pool that does not meet these requirements, contact the city clerk’s office to immediately bring it up to code requirements. Non-compliance not only is a municipal infraction with possible fines, but is a safety hazard for your family and the entire neighborhood.

OFFICAL NOTICE The City of Fairfax has noticed that grass or other lawn debris is being blown out into the street at many addresses in Fairfax. This is against city code section 135.03 as shown below: 135.03 PLACING DEBRIS ON. It is unlawful for any person to throw or deposit on any street or alley any glass, glass bottle, nails, tacks, wire, cans, trash, garbage, rubbish, litter, offal, leaves, grass or any other debris likely to be washed into the storm sewer and clog the storm sewer, or any substance likely to injure any person, animal or vehicle. (Code of Iowa, Sec. 321.369)

Placing debris of any kind in the street poses a hazard to other citizens and it can clog our city’s storm sewer system creating the need for expensive repairs that are ultimately paid for by all residents, including you and your neighbors. City of Fairfax enforcement actions will include a municipal infraction, which carries a fine of $500.00 for the first offense and $750.00 for each subsequent offense. *Each day is considered a separate offense.* If you have any questions regarding the clear meaning of this notice or city code section 135.03 please contact the city’s clerk office at 846-2204, 7:30am – 4:00pm, Monday – Friday

Movie in the Park Planning Dolphin Tale was selected for the June 24 movie and Inside Out for August. Potential Dog Park Discussion Jo Ann visited with D&N Fencing. They have experience with dog park fencing, and will come onsite to provide an estimate. Jo Ann will get this set up. Memorial Park Bench Discussion Jane shared her research findings. She will document and distribute to the Committee at the May meeting. She will also present the proposal to the City Council when finalized. Linn County Trails Committee Update Derek reported on a new trail bridge by Xavier High School. The Complex and Trail Signage Update No update. Parks Equipment Check Out Status No update. Donation Report A $100 donation was received. It was suggested that donation requests be added to the City web site and Facebook page. Opportunities for Citizens Not on the Agenda a. There was a question regarding the status of the curb cut for the trail extension by the fishing pond. Also, lane striping should be added to that area. b. The detention basin at the corner of Linn Street and Fairfax Rd. could still be improved, possibly with cattails. c. The Committee would like to encourage everyone to bike to USA Day activities. d. The City will be adding vinyl fencing around the porta potties at Prairie Creek Park and Driftwood Lane Park.

CITY OF FAIRFAX REGULAR CITY COUNCIL MEETING May 10, 2016 The regular meeting of the Fairfax City Council was held May 10, 2016, at Fairfax city hall. Mayor Frieden called the meeting to order at 6:00 PM. Council members present: JoAnn Beer, Mike Daly, Joe Kell, Nick Volk and Marianne Wainwright. Other city staff present: Cynthia Stimson, Lynn Miller, Dave Yanecek, Kevin Stensland, Mike Sankot, and Cathy Bayne. Motioned by Kell, seconded by Daly to approve the consent agenda. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Fire Chief Mike Sankot informed the City Council the fire department has the new monitor in service, the calls have been steady, some members have passed their classes, and they have been getting ready for USA Days. Lynn Miller reported that flushing is done and culvert work will begin soon. He then discussed the notice about blowing grass into the street. The City will do a mass mailing and staff will continue to place a door notice as a violation is observed. The Fairfax City-wide Garage Sale Day is Saturday, May 21. No parking signs will be placed as last year. Kevin Stensland stated 75% of the smoke testing is complete. Two locations were found to be possible infiltration problems. JoAnn Beer reported that the Parks Department is working on details about a dog park and memorial benches. Shane Wicks reported the IDOT wants to eliminate all sidewalk along the east side of their bridge projects. The City Council thought it would be fine as long as there will be sidewalk on the west side. Mayor Frieden opened the public hearing concerning the Plans and Specifications, Form of Contract, and Engineer’s Cost Estimate for the 2016 80th Street Water Main Extension Project at 6:22 PM. No oral or written comments have been received at the city clerk’s office. Shane discussed the project and gave a cost estimate of $335,000. The City will be receiving bids on Thursday, May 12. No one else had any comments. Mayor Frieden closed the public hearing at 6:24 PM. Motioned by Kell, seconded by Volk to approve RESOLUTION NO. 2016-34, A RESOLUTION ADOPTING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATED COST FOR THE 2016 80th STREET WATER MAIN EXTENSION PROJECT. Motioned by Wainwright, seconded by Daly to approve the commercial site plan from Dan Bushman for 600 Fairfax Road, with the condition that prior to the City issuing an occupancy permit on this site for the purpose of housing and renting semi-trailers from this site, that the owner supply the City with certification from an engineer licensed in the State of Iowa that the pond/outlet structure has been constructed per the approved site plans. Ayes: Beer, Daly, Kell, Volk, and Wainwright. Nays: None. Motion carried. Discussion was held about possible special conditions for the residential property being annexed into the City of Fairfax. Based on the answers to the questionnaire, it appears that burning is the only special condition needed. This special condition will be part of the rezoning ordinance and last for 10 years. Garbage service for houses in the annexation area was discussed. Motioned by Wainwright, seconded by Kell to waive the deposit requirement for current owners of homes in the annexation area who will be garbage only customers. Ayes: Beer, Kell, and Wainwright. Nays: Daly. Abstain: Volk. Nick Volk is abstaining because he will be moving to this area within a month. Motion carried. Extensive discussion was held concerning participation in future improvement costs for 80th Street. It was suggested to leave the participation at the $2,100 per acre but come up with a method to delay payment closer to the time the road will need to be improved. Linn County Deputy Sheriff Daubs presented the list of calls. A spreadsheet of City of Fairfax participation costs in the Heartland Heights Subdivision was reviewed. The City Council directed staff to add approximately $300,000 to the bond amount for the costs during the first year. Bruce Sevig asked about the timing of the final plat approval and issuance of building permits. If the City Council allows lots to be sold before acceptance of the final plat, the developer may be required to secure a letter of credit or some sort of surety for the work yet to complete. Joel Gross, Hall and Hall Engineers, gave an update about the Phase 4 Water Main and Vanderbilt Street Reconstruction Project. The water main is done except for Railroad Street and Alliant Energy and Mediacom have caused a delay in the project. Library Board Minutes May 3, 2016 Board Members present: Mary Rita Meyers, Bernie Kleppe, David Lees, Jim Stallman, Linda Pribyl and Billy Toner. Absent, Excused: Dot Pospischil. Staff Present: Cathy Bayne and Beth Wilz Kleppe called the meeting to order at 7:00 pm. Agenda was approved by Toner, seconded by Meyers, and motion carried 6-0. April minutes were reviewed as received. Pribyl made a motion to approve the minutes, seconded by Meyers, and motion carried 6-0. Expenses were reviewed and discussed for April. Stallman made a motion to approve the expenses for April including Cedar Rapids Photo Copy. Toner seconded, motion carried 6-0. Financial Report was then discussed. We are doing well with salaries being only 2% over. Operating expenses are well under spending but it should be closer after new items are received and billed. With Utility costs down and a few other items, there is still some money remaining in the budget. Bayne was instructed to continue purchasing the necessary items that we had put into our budget for this year. A motion was made by Pribyl to have the lights in the library replaced to LED while the Alliant Rebate is still available. Seconded by Meyers, motion carried 6-0. Circulation and Other Reports were reviewed. Good numbers for the month with Bridges and Audio books way up. Policy Reviews were then discussed. Meyers made a motion to approve the Unattended Child Policy’s second reading. Seconded by Toner. Motion carried 6-0. We then discussed the incident that required the help of the sheriff on April 13, 2016. All the problems with the school aged children have been documented and the sheriff told the Fairfax parent that the children involved had to stay off the library property for 2 weeks. The other parent was then notified and the children followed this rule for the 2 weeks. The sewer problems were then discussed and what had happened this month with the maintenance men finding that South Slope had cut the sewer line when they had the fiber optic cable installed. The sewer line is now fixed and the bills will be sent to South Slope for their consideration. Library board felt that South Slope should also be presented the 2 KenWay bills for snaking the drain that the library acquired due to this problem. The discussion then turned to the 3 Year Plan. Toner made a motion to approve the plan as written and now to be put into a format to get it ready for a packet and put onto the website. Seconded by Stallman and Motion carried 6-0. Inventory was very successful this year finding 99.71% of our items which is 22,664 items and we are only missing 65 items but a few of those will show up, like in the past. The Library By-laws were then discussed - Toner made a motion to change 1B from need to MUST, 2A 2nd line is repeated, Delete monthly in 3A, Delete 3C, 4D Delete to debate and change to PROBLEMS. Bayne will talk to City Hall to find out the correct wording for a gender balanced board to be added to the By-laws. Stallman Seconded and motion carried 6-0. Summer Reading was then discussed and the theme is Ready Set Read which is a sports theme. Bayne wants to pass out tickets when patron earn them doing certain things each time and then we will draw for prizes at the end of summer. These would be additional from the other prizes they will earn for reading. The Free Little Library at Hawks Ridge is going well with the rotation of books seems to be ongoing. Next Meeting is June 7. We have 2 open board positions and we need at least one male for state mandate equality. Summer Reading is right HERE. We are really excited about the things we have planned this summer! Start tracking your reading June 1st thru July 30th to receive prizes. You can get a reading log at the library. We have Grout Museum from Waterloo coming on the 29th of June at 4:00 with their show MAD MIXTURE which is a show featuring the best of several of their shows: Super Cold, Combustion, Snakes Alive! and Kitchen Science. Sure to please people of all ages. Everyone who attends activities at the library will get tickets to put in for drawings for a variety of prizes. The more things you participate in, the better the chance you have to win, We have Kernels tickets, a basketball hoop, a sports book, throw down bases and tee to name a few of the drawing items. Each week we will also have additional ways to earn tickets-perhaps wear a Jersey, ride your bike to the library or check out a sports DVD. You can see each week’s additional ticket earning activity by checking us out on Facebook or stopping at the library.

Please register for our first of the summer’s Family Reading and Game Night June 8th at 6 pm. We will start with everyone reading as families for 10 -15 minutes and then play some life size games (like Jenga, library mini golf or connect four) followed by snacks. Please register your family so we know how many will be attending. This will be a chance to earn tickets for the drawing prizes!

We also are very excited to let you know that very soon we will have sporting equipment for check out at the library. So here is your chance to try out the Fairfax Parks Disc Golf Course without having to invest in discs. If you are having guests from out of town and want to play horse shoes, sand volleyball, or tennis you can borrow the equipment from the library! At this time we have two sets of golf discs, a volleyball, two tennis rackets and balls, three sizes of soccer balls, a football, a basketball, throw down bases and tee, and horse shoes. If you have any good used sporting equipment that you want to get rid, of please consider giving it to the library.

The library has received 25 Playaway Launchpads. These are the first-ever secure, pre-loaded tablet designed for circulation with educational activities for three year olds to adults. Each tablet is designed with a certain purpose in mind and there are many games and activities to teach the purpose of that particular Launchpad. An example is A Day at the Zoo! Ages 3-5, Pre-K to K. This zoo adventure is the perfect way for children to explore animals, animal noises, and habitats all while learning new words, stories, languages, and more. It has 16 animated and interactive zoo puzzles! Many have characters that child can identify with like Max & Ruby, The Berenstain Bears, or Dr. Seuss. These will also be available for check out in the future.

Stop by on USA Day on June25th for a Root Beer Float being made by Gloria Dei Lutheran Church for a $2 donation that will benefit the library.
